Planning Commission Minutes 09-03-2019MINUTES REGULAR MEETING - MONTICELLO PLANNING COMMISSION Tuesday, September 3rd, 2019 - 6:15 p.m. Mississippi Room, Monticello Community Center Commissioners Present: Sam Murdoff, Paul Konsor, and Alison Zimpfer Commissioners Absent: Marc Simpson and John Alstad Council Liaison Present: Charlotte Gabler Staff Present: Angela Schumann, Steve Grittman (NAC), and Ron Hackenmueller 1. General Business A. Call to Order Sam Murdoff called the Regular Meeting of Monticello Planning Commission to order at 6:00 p.m. B. Consideration of approving minutes a. Regular Meeting Minutes — August 611, 2019 SAM MURDOFF MOVED TO APPROVE THE REGULAR MEETING MINUTES — AUGUST 6TH, 2019. PAUL KONSOR SECONDED THE MOTION. MOTION CARRIED, 3-0. C. Citizen Comments None. D. Consideration of adding items to the agenda None. E. Consideration to approve agenda SAM MURDOFF MOVED TO APPROVE THE AGENDA. PAUL KONSOR SECONDED THE MOTION. MOTION CARRIED, 3-0. 2. Public Hearings A. Continued Public Hearing — Consideration of an amendment to Monticello Zoning Ordinance Chapter 3, Section 7 Overlay Zoning Districts, Subsection (E) Wild and Scenic Recreational River District for height allowances. Applicant: City of Monticello Angela Schumann explained that the item was a continued public hearing from the previous meeting. She noted that the current City regulation for height in the Wild and Scenic District is 35 feet and in the Shoreland District is 25 feet. Staff recommended to remain consistent with DNR standards to change the City's ordinance to 25 feet in each district. Schumann explained that the DNR has reviewed the proposed changes and sent conditional approval of the ordinance amendment. Planning Commission Minutes — September 3rd, 2019 Page 114 Sam Murdoff continued the public hearing. Hearing no further comments, the public hearing was closed. Paul Konsor asked for clarification on why the ordinance amendment was being sought. Schumann noted that it was the goal to remain consistent with state regulations and to also assist with development projects. Schumann also provided the history of the ordinance with the City of Monticello. Schumann explained that after City Council review, the DNR would have to certify the ordinance. ALISON ZIMPFER MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE AMENDMENT FOR HEIGHT REQUIREMENTS IN THE MISSISSIPPI WILD AND SCENIC RECREATIONAL RIVER OVERLAY DISTRICT AS PROPOSED, BASED ON FINDINGS IN RESOLUTION PC - 2019 -026. PAUL KONSOR SECONDED THE MOTION. MOTION CARRIED, 3-0. B. Public Hearing — Consideration of a request for Conditional Use Permit for an approximately 875 square foot residential detached Accessory Use Structure — Maior in an R-1 (Single -Family Residence) District. Applicant: Mick Herold Steve Grittman provided the report. He indicated that the applicant was seeking a 875 square foot accessory structure. The maximum size of the structure that could be built with a CUP is 876 square feet. It was noted that the lot was heavily wooded and the view of the proposed structure would not be noticeable. He explained that all of the criteria for a Conditional Use Permit was met and recommended approval with Exhibit Z comments. Sam Murdoff opened the public hearing and invited the applicant to speak first. Mick Herold, the applicant, introduced himself. Murdoff asked if the applicant had reviewed the Exhibit Z conditions. Herold confirmed with no issues. Murdoff asked about the removal of trees for the project. Herold indicated a small elm would need to be removed and that was it. Hearing no further comments, the public hearing was closed. ALISON ZIMPFER MOVED TO ADOPT RESOLUTION NO. PC 2019-027 RECOMMENDING APPROVAL OF THE CONDITIONAL USE PERMIT FOR A PROPOSED APPROXIMATELY 875 SQUARE FOOT STRUCTURE, SUBJECT TO THE CONDITIONS IN EXHIBIT Z, AND BASED ON FINDINGS IN SAID RESOLUTION. PAUL KONSOR SECONDED THE MOTION. MOTION CARRIED, 3-0. EXHIBIT Z Mick Herold Conditional Use Permit for Accessory Building — Major 9721 Gillard Avenue Northeast Planning Commission Minutes — September 3rd, 2019 Page 2 14 1. Accessory building space is to be utilized solely for the storage of residential personal property of the occupant of the principal dwelling, and no accessory building space is to be utilized for commercial purposes. 2. The accessory building shall be constructed to be similar to the principal building in architectural style and building materials including color. 3. Access to the structure will remain on the property, with no rear yard driveway. 4. An updated certificate of survey illustrating the proposed structure and staking of property lines and setbacks will be required at building permit to verify setback requirements. 5. No overstory trees should be removed without City administrative approval. 6. Compliance with the comments of other staff and Planning Commission. 3. Regular Agenda A. Consideration appoint Chairman Sam Murdoff to the Monticello 2040 Community Vision & Comprehensive Plan Technical Advisory Committee PAUL KONSOR MOVED TO NOMINATE COMMISSIONER SAM MURDOFF AS THE PLANNING COMMISSION REPRESENTATIVE TO MONTICELLO 2040 COMMUNITY VISION + COMPREHENSIVE PLAN TECHNICAL ADVISORY COMMITTEE. ALISON ZIMPFER SECONDED THE MOTION. MOTION CARRIED, 3-0. B. Consideration of the Community Development Directors Report Angela Schumann provided the Community Development Director's Report. She noted that a special meeting would occur before the October Planning Commission meeting for a Land Use Basic refresher. 4. Added Items None. 5.
