Brian Stumpf called the Special/Joint Meeting of the Planning Commission and City
Council to order at 4:45 p.m.
2. Concept Sta�e Planned Unit Development proposal for a 4 storv, 80-unit residential
multi-familv apartment complex
Applicant: Kent Kiellber�
Steve Grittman introduced the staff report for the item. He noted that the original PUD
was in place for the parcel to contain all multi-tenant commercial space. The request was
to amend the remaining vacant space of the PUD for a multi-family development.
Grittman noted staff concerns with having no direct access from a public street. It
contained surface parking and at grade covered parking.
He noted the proj ect would use the R-4 zoning. Grittman noted the site sits within a
transitional zoning area to the mix of residential and commercial uses. It was noted the
parcel is currently zoned B-4.
Overall, the Planning Commission and City Council were concerned about access onto
School Boulevard. It was noted that a traffic study to determine the amount of traffic
would be important for a commercial or residential project. The design of the building
was favorable.
The boards also discussed the powerline easement. It was noted that the easement does
not affect the parcel. Road and trail connections were discussed using this easement.
Tom Wasmoen, the applicant's engineer, explained that the drawing was preliminary and
could change. He said that he would work on addressing the access and traffic concerns.
Grittman summarized the conversations from the boards. The applicant could apply for
development stage PUD as a next step.

2. Public Hearings
A. Continued Public Hearin� — Consideration of an amendment to Monticello
Zonin� Ordinance Chapter 3, Section 7 Overlav Zonin� Districts, Subsection
(E) Wild and Scenic Recreational River District for hei�ht allowances.
Applicant: Citv of Monticello
Angela Schumann explained that the item was a continued public hearing from
the previous meeting. She noted that the current City regulation for height in the
Wild and Scenic District is 35 feet and in the Shoreland District it is 25 feet. Staff
recommended to remain consistent with DNR standards to change the City's
ordinance to 25 feet in each district. Schumann explained that the DNR has
reviewed the proposed changes and sent conditional approval of the ordinance
amendment.

Sam Murdoff continued the public hearing. Hearing no further comments, the
public hearing was closed.
Paul Konsor asked for clarification on why the ordinance amendment was being
sought. Schumann noted the goal was to remain consistent with state regulations
and to also assist with development projects. Schumann also provided the history
of the ordinance with the City of Monticello.
Schumann explained that after City Council review, the DNR would have to
certify the ordinance.
ALISON ZINIPFER MOVED TO RECOMMEND APPROVAL OF THE
ORDINANCE AMENDMENT FOR HEIGHT REQUIREMENTS 1N THE
MISSISSIPPI WILD AND SCENIC RECREATIONAL R1VER OVERLAY
DISTRICT AS PROPOSED, BASED ON FINDINGS 1N RESOLUTION PC-
2019-026. PAUL KONSOR SECONDED THE MOTION. MOTION CARRIED,

B. Public Hearin� — Consideration of a request for Conditional Use Permit for
an approximatelv 875 square foot residential detached Accessorv Use
Structure — Maior in an R-1 (Sin�le-Familv Residence) District. Applicant:
Mick Herold
Steve Grittman provided the report. He indicated that the applicant was seeking a
875 square foot accessory structure. The maximum size of the structure that could
be built with a CUP is 876 square feet. It was noted that the lot was heavily
wooded and the view of the proposed structure would not be noticeable. He
explained that all of the criteria for a Conditional Use Permit was met and
recommended approval with Exhibit Z comments.
Sam Murdoff opened the public hearing and invited the applicant to speak first.
Mick Herold, the applicant, introduced himsel£ Murdoff asked if the applicant
had reviewed the Exhibit Z conditions. Herold confirmed with no issues. Murdoff
asked about the removal of trees for the proj ect. Herold indicated a small elm
would need to be removed and that was it.
Hearing no further comments, the public hearing was closed.

Project Description:
The applicant proposes to amend the zoning ordinance
to incorporate tattoo establishments into the zoning
ordinance as an allowed use in the downtown area. The
zoning ordinance includes a definition for Tattoo, but

limits it as a use to the B-4, Regional Business zoning
district. The proposal is to expand Tattoo (or `Body
Art" as it is generally referenced by the Minnesota
Department of Health) is included as one of the
specified uses under the category of "Personal
Services".
ANALYSIS
For many years, Tattoo was an unregulated service that occasionally raised concerns
over health and welfare conditions in the facility or the area in which the facility was
located. As such, most cities severely limited the location of tattoo establishments to
avoid potential issues.
As of 2013, the Minnesota Department of Health (MDH) established a licensing
program and standards, pursuant to legislation passed by the Minnesota legislature in
2010. While Monticello's zoning ordinance defines tattoo and tattooing, it restricts
tattooing under the Personal Services land use category to the B-4, Regional Business
zoning district.
With more comprehensive State regulation in place, it is reasonable to consider
expanding the allowance for tattoo facilities (including `Body Art" which is the
category used by MDH), to the general Personal Services use.
PERSONAL SERVICES: Establishments that primarily engage in
providing services generally involving the care of the person or
person's possessions. Personal services may include but are not limited
to: laundry and dry-cleaning services, barber shops, beauty salons,
health and fitness studios, music schools, informational and
instructional services, tanning salons, bodv art includin� tattooin�),
and portrait studios.
TATTOO, TATTOOING: Any method of placing designs, letters,
scrolls, figures, symbols or any other mark upon, under or in the skin
with ink or any other substance resulting in the coloration of the skin
by the aid of needles or any other instruments which puncture any
portion of the skin to any degree.
BODY ART: Establishments that enga�e in "Bodv art" or "bodv art
procedures" includin� phvsical bodv adornment usin�, but not
limited to, tattooin� and bodv piercin .� Bodv art does not include
practices and procedures that are performed bv a licensed medical
or dental professional if the procedure is within the professional's
scope of practice.

With the addition of the State's licensing program, there would not seem to be any
significant concerns related to health or general welfare issues — the common
elements on which the City's zoning authority is based. The amendment would
clarify the allowances for the use in the City's commercial areas.
B. ALTERNATIVE ACTIONS
Decision 1. Add Tattoo establishments as a use included in the Personal Services use
category and include references to the State licensing requirements:

C. STAFF RECOMMENDATION
Staff recommends approval of the proposed amendment clarifying the status of
Tattoo establishments in the Personal Services use category. The use has a rigorous
requirement for State licensing and should pose no extraordinary issues for local land
use regulation as a result of the licensing program.
The applicant's property is located in the Pine Street subarea of the CCD where
Personal Services are a Permitted Use and as such, tattoo services in this sub-district
would be permitted upon adoption of the proposed amendment.

RECOMMENDING APPROVAL OF AN AMENDMENT TO THE ZONING
ORDINANCE TO INCLUDE TATTOO SERVICES AND ESTABLSHMENTS AS AN
INCLUDED PERSONAL SERVICE ALLOWED IN THE SAME COMMERCIAL
DISTRICTS AND ESTABLISHING STANDARDS FOR THE USE
WHEREAS, an applicant has submitted a request to amend the Zoning Ordinance to
include Tattoo services as a common Personal Service; and
WHEREAS, the effect of the amendment would be to include Tattoo services in any
of those areas where Personal Services are otherwise allowed; and
WHEREAS, the State of Minnesota has established generally applicable licensing
requirements for tattoo establishments and providers; and
WHEREAS, the proposed amendment would incorporate those State requirements
into the City's zoning ordinance; and
WHEREAS, the use, under State licensing regulation, would raise no issues for the
City with regard to public health or welfare beyond those common to other Personal Service
uses; and
WHEREAS, the Planning Commission held a public hearing on October lst, 2019 on
the application and the applicant and members of the public were provided the opportunity to
present information to the Planning Commission; and
WHEREAS, the Planning Commission has considered all of the comments and the
staff report, which are incorporated by reference into the resolution; and
WHEREAS, the Planning Commission of the City of Monticello makes the following
Findings of Fact in relation to the recommendation of approval:
1. The Zoning Ordinance amendment provides an appropriate means of
furthering both the intent and the specific goals and policies for land use in the
Comprehensive Plan.
2. The proposed use raises no extraordinary issues for the City's regulation of
Personal Services.
3. The ordinance incorporates applicable provisions of State law and regulation
regarding Tattoo establishments, thus providing a protection for the public.
4. The proposed use is expected to have no negative impacts on municipal public
services.

as part of the Official Monticello City Code, Title 10, Zoning Ordinance, and to
renumber the tables and chapters accordingly as necessary to provide the intended
effect of this Ordinance. The City Clerk is further directed to make necessary
corrections to any internal citations that result from said renumbering process,
provided that such changes retain the purpose and intent of the Zoning Ordinance
as has been adopted.
Section 5. This Ordinance shall take effect and be in full force from and after its passage
and publication. The ordinance in its entirety shall be posted on the City website
after publication. Copies of the complete Ordinance are available online and at
Monticello City Hall for examination upon request.

Hello city of Monticello,
before I launched into Dark Horse Vapery and The
Nordic Brewing Co., I used to own Empire Tattoo and have
been Tattoo Artist for 12 years. I would like to open a private
by appointment only licensed studio space within all of the
extra-unused space I have at the Hillside Mall.
This would be a private area licensed through the department
of health and I would not be doing any advertising or having
any signage.
My hopes are to work with 1 or possibly 2 clients a week. As
you all know I am very busy with my other company projects.
To establish this use, the zoning ordinance would require
amendment, as tattoo parlors are currently restricted to B-4
(Regional Business) Districts. The amendment would need
to permit tattoo studios/parlors within the CCD (Walnut &
Cedar sub-district), in which the space is located. As the city
considers an amendment, it may also review the potential to
allow the tattoo studio use in other commercial districts.

(19) Offices (Commercial)
In the CCD, the following conditions shall apply:
(a) Building architecture shall be designed to reflect retail street-level architecture
as defined in the City's Comprehensive Plan, and detailed in the
Comprehensive Plan Amendment entitled "Downtown Monticello Small Area
Plan."
(b) Street-level floor planning designed to accommodate use by or conversion to
future use as retail land uses.
(c) Parking areas shall be situated so as to minimize their exposure to public
areas, or shall be landscaped and screened to minimize large expanses of open
pavement.
(20) Offices (Professional) Including Financial Institutions
In the CCD, the following conditions shall apply:
(a) Building architecture shall be designed to reflect retail street-level architecture
as defined in the City's Comprehensive Plan, and detailed in the
Comprehensive Plan Amendment entitled "Downtown Monticello Small Area
Plan."
(b) Street-level floor planning designed to accommodate use by or conversion to
future use as retail land uses.
(c) Parking areas shall be situated so as to minimize their exposure to public
areas, or shall be landscaped and screened to minimize large expanses of open
pavement.
(d) Parking supply shall be calculated at the same rate as retail sales.
(21) Personal Services
(a) In the B-1 district, the following shall apply:
(i) Outdoor lighting shall be restricted to be consistent with the hours of
operation, within one half hour of open and close times.
(ii) Hours of operation shall be limited to 6:00 a.m. to 9:00 p.m.

Section 5.2 Use-Speci fic Standards
Subsection (F) Regulations for Commercial Us,:��
(b) Establishments engaged in dry cleaning shall be held to the following
requirements:
(i) Dry cleaning processing shall be restricted to the B-4 district.
(ii) Dry cleaning operations shall be self-contained in terms of noise and
fumes with no venting to outside of building.
(iii) Dry cleaning facilities shall have direct access to major thoroughfare via
driveway or frontage road.
(c) Tattoo parlors shall be restricted to the B-4 district.
(22) Places of Public Assembly
In the CCD, the following conditions shall apply:
(a) Building architecture shall be designed to reflect retail street-level architecture
as defined in the City's Comprehensive Plan, and detailed in the
Comprehensive Plan Amendment entitled "Downtown Monticello Small Area
Plan."
(b) Site planning shall minimize parking lot development adjacent to public areas
in the district, including streets, pathways, and open spaces.
(23) Production Breweries and Micro-Distilleries with Accessory Taproom or
Cocktail Room
Production Breweries and Micro-Distilleries with Accessory Taproom or Cocktail
Room shall be allowed by conditional use permit in the CCD, B-3 and B-4
Districts, provided that:
(a) The owner of the brewery qualifies for and receives a brewer license and a
malt liquor wholesale license from the State of Minnesota, according to Minn.
Statutes Section 340A.301.
(b) The Brewery or Micro-Distillery includes an accessory brewer's taproom or
cocktail room for the on-sale of products produced on-site, and such room
shall require the applicable license from the City of Monticello, according to
City Code Section 3-1-13.
(c) On-site sale of beer in the form of growlers shall require a Brewery License
for Off-Sale of Ma1t Liquor, according to City Code Section 3-1-13. Off-sale
hours of sale must conform to hours of sale for retail off-sale licensees in the
City of Monticello.

A. REFERENCE AND BACKGROUND:
The Planning Commission is asked to consider posting for candidates interested
in serving on the Commission. The posting is in advance of the anticipated
vacancy on the Commission, which is pending the resignation of Commissioner
Simpson later this year.
To prepare for that vacancy, staff would like to post the opening, with interviews
to be held in late November, 2019.

Monticello 2040 Community Vision & Comprehensive Plan Update
Please see attached update on previous, current and upcoming Monticello 2040 activities.
Planning Commission members will also be asked to complete Sounding Board cards as
part of the October meeting.
MN APA Planning Conference
The Community Development Director will be attending the state planning conference
from September 25-27th. An update on seminars and information of note will be
provided as part of the November agenda.
Chelsea to School Boulevard Planning
Planning Commissioners are asked to watch their email for a potential Commission-
Council j oint workshop date related to land use planning concepts for the commercial
area between Chelsea Road and School Boulevard, between Cedar Street and Edmonson
Avenue. Commissioners may recall that a developer has proposed a residential multi-
family use in the area. Since that time, staff and NAC have been working on further
developing a land use concept for the area. The goal is to have a workshop to gain
additional direction from the Planning Commission and City Council on this mixed-use
concept in October, prior to a regular City Council meeting. The concept presented as
part of the packet for the developer's concept stage submittal is attached for reference.

Monticello 2040 Vision + Plan
The kick-off events for Monti2040 were a success!
Thanks to all who attended the introductory Technical
and Community Advisory Committee meetings
September 6t" and 7t"! We had great attendance on
the community bus tour (see pic at right) and although
it was a cold and drizzly day, great feedback was
received at the Music on the Mississippi event on
Saturday.
There are now Monticello 2040 Sounding Boards
located around town. The Sounding Boards teature tour
key questions to help us better understand Monticello's strengths, challenges, vision, and values.
There are Sounding Boards located in each of the 5 school faculty rooms, the MontiArts
building, the Monticello library, City Hall, and Bluestone Grill! Staff will also be working with two
Monticello classrooms on a Sounding Board exercise this month.
In addition, the Sounding Board is available in digital
form at https://www.surveymonkey.com/r/montisurvey1.
Quick polls will also pop up from time to time on the
City's Monti2040 webpage.
The swans have even gotten in on the 2040 act!
We are also looking forward to two upcoming planning
events for Monticello 2040:
TAC/CAC Pep Rally Event: To be scheduled the week of October 16tn
Community Workshop Events: the next visit by the Lakota Group, is set for October 315t_
November 2nd. This visit will include:
o Stakeholder meetings
o Joint TAC/CAC worksession
o Community open house at the MCC (the craft show will be held at MCC the same
day for a big crowd!).
o We are also hoping to hold an Urban Land Institute forum — Navigating Your
Competitive Future, which features a developer and development professional
roundtable to offer additional insight into Monti2040 planning.
