MINUTES
REGULAR MEETING - MONTICELLO PLANNING COMMISSION
Tuesday, September 14, 1982 - 8:00 P.M.
Monticello Public Library
(This meeting was started at 8:00 P.M.
because of this date being Election Day)
Members present: Ridgeway, Dowling, Bondhus, Schaffer.
Members Absent: None.
1. Ap~roval of the Minutes of the Special Meeting of the Planning Com-
mission on August 31, 1982.
A motion was made by Dowling, seconded by Bondhus and all voted in
favor of accepting the minutes as stated.
2.
Public Hearing - Conditional Use Request - Construction 5.
Mr. Tom Brocker of Construction 5 was present and requested the Plan-
ning Commission recommend to the City Council an extension of a
conditional use granted them approximately two years ago to develop
apartment buildings on Blocks 42 and 43 of Lower Monticello. Because
that conditional use had not been utilized within the twelve month
period allowed for a conditional use, it was thereby void and re-
newal was necessary before any further construction could begin on
any building of 13 or more units. The developer was asking the
Planning Commission to recommend renewal and approval to the Council
so they could proceed with construction during the next year on short
notice if financing should become available to them at an acceptable
rate of interest, etc.
It is Construction 5's intent at this time to go ahead with the con-
struction of the 12 unit apartment building and as soon as construc-
tion financing is available, as previously stated, to continue with
two more 24 unit buildings.
Some concern was made by the planning commission as to allowing or
approving the overall development all at one time and felt maybe it
would be in the best interest of the City of Monticello to approve
only the first phase, that is; the twelve unit apartment building,
at this time and watch the progress of that construction before rec-
ommending the consideration of any construction.
A motion was made by Bondhus, seconded by Schaffer to deny the con-
ditional use extension requests for the second phase of the project
which would include the 2 - 24 unit apartment buildings until after
the first phase or the 12 unit apartment building is constructed to
determine what type of a track record this developer would display.

The motion was passed three to one with Dowling voting no.
3. Public Hearing - Variance Request - Independe~t Lumber.
Independent Lumber is proposing to build an additional storage build-
ing within the present compound at the Independent Lumber Yard location.
In the process of building this additional building, Monticello Or-
dinances require that hard surfacing be installed in and around the
areas of storage which are auxiliary to this building.
Previously, when the existing lumber yard was developed, it was an
oversight on the part of the City of Monticello and hardsurfacing
was not required for the storage areas. However, at this time, it
is necessary to address the hardsurfacing requirement when a further
building permit is being requested. Mr. Richard Zahler, owner of
Independent Lumber Company, was present and requested that the
Planning Commission consider granting this variance since there have
been no complaints of excessive dust being created by the lack of
hardsurfacing nor has there been any problems with drainage or
",'ater run off.
A motion was made by Dowling and seconded by Bondhus and all voted
in favor to approve this variance request.
NOTE: Mr. Zahler was advised that the public has an opportunity
to appeal this variance until 5:00 P.M. on September 20th, 1982.
If no appeals are made on this decision of the Planning Commission,
Mr. Zahler will then be eligible to pick up a building permit for
the development of the proposed building.
4. Public Hearing - Consideration of Rezoning.
During the public hearing process for the proposed development of
Chateau plaza, housing for the elderly, approximately two months
ago, a determination was made as to the approximate location of
the collector road which would connect Country Club Road in the
Country Club Manor subdivision to 7th street at the approximate
intersections of Walnut Street and 7th Street.
At that time, the property upon which the proposed Chateau Plaza
was to be built was zoned B-3 and would be the only parcel of
property lying immediately north of the proposed Collector Road
which would be zoned B-3 with all the property surrounding it
being zoned R-3.

A consideration at that time was given to rezoning that parcel of land
to B-3. That consideration was recommended to the Council and ulti-
mately passed, thereby the property was rezoned to R-3. At this time,
Jim and Pam Lindberg are proposing to develop a day care center on the
property owned by Marvin Kramer. That property also lying immediately
north of the proposed Collector Road is the only property in the
immediate adjacent area to be zoned B-3. It was a staff recommendation
that the Planning Commission consider recommending rezoning of that
portion of property now zoned B-3 to R-3 and allow the Collector Road
from the intersection of Elm and Country Club Road to the intersection
of 7th and Walnut streets to be the border line which separated R-3
on the north side and B-3 on the south side of the same road.
This action for rezoning was prompted by a request for a conditional
use within an R-3 zone made by Jim and Pam Lindberg regarding the
Kramer property. A motion was made by Bondhus and seconded by Dowling
to recommend the property immediately north of the proposed Collector
Road be rezoned from B-3 to R-3 if that property was lying between
the interesections of Country Club Road and Elm Street and the inter-
section of Walnut Street and 7th Street and that the property on the
south side of that same proposed road be zoned B-3. All voted in
favor.

5. Public Hearing - Conditional Use Request - Jim and Pam Lindberg.
As was previously discussed in the previous item, Jim and Pam Lindberg
proposed to develop a day care center group nursery on the Marvin
Kramer property. The proposal would be for a permanent type day care
center.
In an R-3 zone, such as was recommended for this property in the pre-
vious item, a day care group nursery required a conditional use.
The Lindbergs have indicated that if the rezoning for this property
is approved for the day care group nursery facility and that if the
conditional use for the same is granted, that they would be willing
to deed to the City the southerly 80 foot portion of their property
for the placement of that Collector Road which would connect the
intersections of Elm and Country Club Road and the intersections of
7th and Walnut Streets.

Two letters of written testimony were presented to the Planning
Commission members and copies were made available to any public
members who wished them which supported the conditional use for the
day care group nursery facility. The members of the Planning Com-
mission also felt in their discussion that a group nursery day care
center would be a valuable asset to the community and therefore, a
motion was made by Bondhus and seconded by Dowling to approve the
conditional use permit contingent upon the Lindberg's dedicating

the southerly 80 feet of that property if the purchase is for the
future development of a group nursery day care center. All voted
in favor of recommending this to pass.
6. Public Hearing - Variance for a Setback - Automatic Garage Door
Company.
Mr. Greg Tobias, manager of the Automatic Garage Door Company in
Monticello, came to the Planning Commission to request a 10 foot
setback for a pylon sign on the Automatic Garage Door property
which is located on Lot 5, Block 1 of the Commercial Plaza 25 on
the southern edge of Monticello along Hwy 25. Monticello
ordinances require that pylon signs be no closer than 30 feet to
the front yard property line without a variance being granted.
Although no members of the public were present to give oral
testimony at the Planning Commission meeting, one letter stating
no objection was presented to the Planning Commission and members
of the public as well as a comment that two members of the public
had called the Zoning Administrator stating they had no objection
to this sign variance request.
Because the Planning Commission could not see where granting this
variance would hinder any future development along that property
or along the highway, a motion was made by Schaffer and seconded
by Dowling to grant this variance with all voting in favor.
NOTE: Mr. Tobias was notified that the public has until 5:00
on September 20th, 1982, to appeal this variance and that if no
one makes an appeal before that stated time that he will be able
to pick up a permit to erect the sign on the following day if
he chooses.
7. New Business -
Some discussion was made among the Planning Commission members to
consider requesting a public hearing to possibly amend Monticello
ordinances to require consideration of a green belt planting strip
adjacent to major thorough fares within the areas of Monticello to
cut down on noise pollution from the freeway or other major Collector
Roads to abutting residential properties. The major concern for the
placement of this green strip was directed to R zones rather than to
business, commercial or industrial zones.

The Zoning Administrator was directed to contact the City Planner for
his comments in such a matter and report back at a subsequent Planning
Commission meeting where further consideration of this matter will be
taken.
