Planning Commission Minutes 02-12-1985 . . . MINUTES REGULAR MEETING - MONTICELLO PLANNING COMMISSION February 12, 1985 - 8:00 P.M. Members Present: Jim Ridgeway, Joyce Dowling, Richard Carlson, Dick Martie, Ed Schaffer. Members Absent: None. Staff Present: Thomas Eidem, Rick Wolfsteller, Gary Anderson. The meeting was called to order by Chairman Jim Ridgeway at 8:10 P.M. Motion by Ed Schaffer, seconded by Joyce Dowling, to approve the minutes of the regular Monticello Planning Commission meeting held on January 8, 1985. Motion carried unanimously. 3. Election of Officers. Chairman Jim Ridgeway opened the meeting up for nominees for Chairman and Vice-Chairman positions for 1985. Motion by Ed Schaffer, seconded by Richard Carlson, to nominate Mr. Jim Ridgeway as Chairman and Mrs. Joyce Dowling as Vice-Chairman of Monticello Planning Commission for 1985. Also, motion by Ed Schaffer to have all nominations cease on the previous motion. The motion carried unanimously with all in favor. 4. Public Hearing - Review of Conditional Use Permit Issued to Allow Major Auto Repair in a B-4 Zone - Applicant, Monti Motors. Mr. Pat Townsend, owner of Monti Motors, was present to answer any questions from Commission members or any concerned citizens in regards to his operation of a major auto repair business in a B-4 Zone. Mr. Townsend indicated he would like to be able to continue his operation at the present site. Chairman Jim Ridgeway opened the public hearing for public testimony. Mr. Stan Douglas, owner of Golden Valley Furniture, was present to inquire as to whether Monti Motors is intending to extend the auto repair business into the entire building. Zoning Administrator Anderson countered that the intention of the public hearing notice when it was sent out was to show the darkened in area of the affected property and that Monti Motors has no intention of expanding into the existing main portion of the old Monticello Ford building. Zoning Administrator presented Chairman Ridgeway with a letter received from Mr. Randy Havel, Havel Giarusso & Associates, Inc. Mr. Havel indicated that he saw no problem with the business currently operated out of there and with the intentions of Mr. Townsend and Mr. Floyd Shake to renovate the entire old Monticello Ford building. Motion by Dick Martie, seconded by Joyce Dowling, to approve the conditional use permit to allow major auto repair in a B-4 Zone for a period of one year from tentative Council approval at the February 25, 1985, City Council meeting. Public Hearing - Variance Request to Allow an Entry Addition to be Built onto the House Within the 30-foot Front Setback Requirement _ Applicant, William Malone. William Malone was present to propose his request to be allowed to put an 8' x 12' enclosed porch onto the front of his existing house. In doing so, the front porch addition would be into the front 30-foot setback requirement. City Administrator, Thomas Eidem, indicated to Planning Commission members the intent of the proposed new subdivision which the City is initiating with the developer, Construction 5. The new subdivision would show a new alignment of Lauring Lane and also a new alignment of Fallon Drive, or the old Copeland Road. The City would, however, still obtain easement over the existing Fallon Drive once the new road is in place, therefore still necessitating the need for a variance. Mr. Eidem, representing the City Council, sees no problem with Mr. Malone receiving approval of his variance request. Motion by Ed Schaffer, seconded by Joyce Dowling, to grant the variance request to allow an 8' x 12' addition to be built within the front setback requirement. Motion carried unanimously. 6. Public Hearing - Request for a preliminary Stage Approval of a Proposed New Subdivision Plat - Applicant, Construction 5, Inc. Tom Eidem, representing the City of Monticello, indicated that the City is the one that has initiated this subdivision request on behalf of the developer along with the developer, Construction 5, Inc. The City saw the need at this time to make the extension of Lauring Lane to accommodate future growth along the freeway. Mr. Gary LaFromboise, partner in Construction 5, along with their engineer, Dennis Taylor, Taylor Land Surveyors, was present to explain to Planning Commission members their proposed new subdivision. Planning Commission members questioned if all the requirements of the preliminary stage approval of the proposed new plat had been reviewed and a recommendation from staff on the review. Zoning Administrator Anderson countered that the plan had been reviewed by City staff; Consulting Engineering Firm, OSM; consulting Planning Firm, Dahlgren & Associates, and their copies are enclosed. The basic concept of the plan has been approved and with some very minor Changes that would be incorporated before the final plat would come before their approval or denial. Mr. William Malone questioned as to any impact on his property or onto his mother's property with the new proposed subdivision. City Administrator, Thomas Eidem, answered that with the proposed new alignment of Lauring Lane and also the termination of the Fallon Drive or the old Copeland Road past his property and his mother's property, it would be more or less a buffer area created between Lauring Lane and Fallon Drive with the new park that is to be dedicated within the subdivision plat. Motion by Richard Carlson, seconded by Ed Schaffer, to approve the preliminary stage of a proposed new subdivision plat. Motion carried unanimously. -2- . . . Planning Commission Minutes - 2/12/85 7. Public Hearing - Conditional Use Request to Allow an Apartment Building to be Constructed in Excess of 12 Units - Applicant, Construction 5, Inc. Thomas Eidem, City Administrator representing the City, indicated to Planning Commission members that although the conditional use request is legitimate, it is not within the realms of the ordinance, as there is no approved plat for which the proposed conditional use is coming from. He, therefore, suggested to Planning Commission members that they table the applicant's conditional use request indicating to them that it is not that the City was denying their conditional use request but that the City, under the ordinance, cannot act on it unless there is an approved plat. Therefore, motion by Ed Schaffer, seconded by Joyce DOWling, to continue the public hearing on the conditional use request to allow an apartment building to be constructed in excess of 12 units .at an upcoming meeting. Motion carried unanimously. 8. Public Hearing - Conditional Use Request to Allow an Apartment Building to be Constructed in Excess of 12 Units - Applicant, Metcalf & Larson. Mr. Jim Metcalf, partner in the Metcalf & Larson, Attorneys at Law Firm, was present to discuss with Plap.ning Commission members a proposal to construct a 33-unit subsidized low to moderate income apartment building. The building is to consist of 2~ stories, with the lower most portion of the building to be utilized as a walkout area to the rear of the apartment. The apartment bUilding would consist of 19 one-bedroom units, 12 two-bedroom units, and 2 two-bedroom handicapped units. The two handicapped units exceed the minimum requirements as required by the Uniform Building Code. The lot area of the proposed apartment building site has enough square footage to allow a 33-unit apartment building to be built and does allow enough room for 66 parking spaces. Motion by Joyce DOWling, seconded by Richard Martie, to approve the conditional use request to allow an apartment building to be built in excess of 12 units. Motion carried unanimously. 9. Public Hearing - Variance Request to Allow no Garage to be Constructed on a 33-Unit Apartment Building Site - Applicant, Metcalf & Larson. Mr. Jim Metcalf, partner in the law firm Metcalf & Larson, was present to request a variance to allow no garages to be built on a 33-unit apartment building site. Mr. Metcalf explained the background to the type of funding which they are requesting; and according to the federal funding which they are requesting, the federal government does not recognize garages as an allowable -3- . . . Planning Commission Minutes - 2/12/85 expenditure for funds to construct a low to moderate income apartment building. Therefore, if garages were to be built, they would have to be built at the developer's expense and/or donated or given to the property to be marketed through market rent. Each additional garage unit costs approximately $1,600.00 for each unit, which in turn would be an expenditure of approximately a little over $27,000.00 for a 17-unit garage building. Under the present ordinance, the requirement for enclosed parking spaces or garage units is one per two units. In this case we would need 17 enclosed garage spaces. Much discussion then centered around whether garage units should be required as per ordinance or if the ordinance should be amended to allow fewer garage units or no garage units at all for this type of subsidized multiple family housing. Motion by Joyce DOWling, seconded by Richard Martie, to deny the variance request to allow no garages to be constructed on a 33-unit apartment building site. Motion carried unanimously. 10. Public Hearing - Conditional Use Request to Allow a Government Sponsored Program to be Conducted out of a Residential House - Applicant, Marvin Kramer. Marvin and Deborah Kramer were present to explain their proposal for a group home for girls, ages 11-17 years. Mr. Jim Reese, Director of Wright Direction Group Home for Boys, was present to explain the currently run program which he has for boys and the similarity of his group home for boys with the proposed group home proposal for girls as submitted by the Kramers. The intent of the conditional use is to allow a group home for girls to be conducted out of the residential house. In looking at our ordinance, it is only allowed as a conditional use through some type of a government sponsored program or out of a government building. Planning Commission members questioned if they did have the approval of the Wright County Board of Commissioners, and they said they had a verbal approval, Commission members requested that they get a letter of recommendation from the Wright County Board of commissioners and then come back to them at another meeting. Motion by Richard Martie, seconded by Joyce Dowling, to table the conditional use request to allow a government sponsored program to be conducted out of a residential house. Motion carried unanimously. 11. Public Hearing - Conditional Use Request to Allow an Additional Number of Vehicles to be Placed on an Outdoor Sales Lot - Applicant, Monticello Auto Sales. Dr. McCarty wasn't present to answer any questions from the Monticello Planning Commission on his conditional use request. -4- . . . Planning Commission Minutes - 2/12/85 Dr. McCarty would like to have increased the condition which was applied to his original conditional use request on the number of vehicles allowed to be parked on his outdoor sales lot from 10 to 20 as the maximum number of vehicles to be allowed to be placed on an outdoor sales lot. Commission members questioned if Dr. McCarty had complied to the other conditions that were submitted by Planning Commission members and also City Council members. zoning Administrator Anderson countered that the conditions had been met by the applicant, Dr. McCarty. Motion by Dick Martie, seconded by Joyce Dowling, to increase the number of vehicles from 10 to 20 vehicles at the maximum to be displayed on an outdoor sales lot for all 7 days of the week. Motion carried unanimously. 12. Public Hearing - Conditional Use Request to Allow as a Home Occupation an Auto Sales Office - Applicant, Monticello Auto Sales. The owner of Monticello Auto Sales, Dr. McCarty, requested that his conditional use request be withdrawn. Upon further information received from the Licensing Division of the Minnesota Used Auto Dealer Association, one requirement is that the sales office be in a commercial building on a commercially zoned lot. Dr. McCarty's house does not qualify for that. Therefore, the Planning Commission members took no action on this request. 13. Public Hearing - Conditional Use Request to Allow Outdoor Sales Service and Outdoor Storage in a B-3 Zone - Applicant, Samuel Properties. Mr. Sam Peraro was not present to explain his proposal for the proposed conditional use request. Zoning Administrator Anderson indicated to Planning Commission members that Mr. Peraro's request is to allow as a conditional use outdoor storage, outdoor sales, and outdoor service out of a wood frame, pOle-type commercial building. The proposed use of the building is to be a retail equipment rental business. To the rear of the building which would abut Sandberg Road would be a screened fenced-in area for outdoor storage of the rental equipment. Planning Commission member Richard Carlson questioned as to the type of construction of the building as to why there couldn't be another type of construction other than a pOle-type building. Zoning Administrator Anderson countered that we have other pOle-type buildings which are compatible with this proposed new building. Motion by Richard Martie, seconded by Joyce Dowling, to approve the conditional use request to allow outdoor sales, service, and outdoor storage in a B-3 Zone. Motion carried unanimously. -5- . . . Consensus of the Planning Commission members was to set the next tentative date of the Monticello Planning Commission meeting for March 12, 1985, 7:30 P.M.
