MINUTES
REGULAR MEETING - MONTICELLO PLANNING COMMISSION
August 13, 1985 - 7:30 P.M.
Members Present: Joyce Dowling, Richard Carlson, Richard
Martie, Ed Schaffer.
Members Absent: Jim Ridgeway.
Staff Present: Rick Wolfsteller, Gary Anderson.
The meeting was called to order by Chairman Elect Richard
Carlson at 7:38 P.M.
Motion by Ed Schaffer, seconded by Richard Marti~ to approve
the minutes of the July 9, 1985 Planning Commission Meeting.
Motion carried unanimously with Jim Ridgeway absent.
3.
Public Hearing - Variance Request to Allow a Garage Addition
to be Built in Side Setback Requirement - Applicant, Brazil Fyle.
Mr. Brazil Fyle was present to propose a Variance Request to allow
him to build an addition onto his existing garage. The new
proposed addition to the garage would be a temporary type
lean-to structure to accommodate boat and other storage inside
this garage addition. The distance between the closest structure
which would be Mr. Eugene Bland residence and the proposed
garage addition would be 25 feet. A motion by Joyce DOWling,
seconded by Ed Schaffer, to approve the Variance Request to
build a garage addition within six inches of the side property
line. Motion carried unanimously, with Jim Ridgeway absent.
4. Public Hearing - Variance Request to Allow an Addition to
be Built Within the Front Setback Requirement - Applicant,
Monticello Dairy Queen.
Mr. Mel Wolters was present to propose a Variance Request
~o allow him to build an atrium type addition onto the front
of his existing Dairy Queen building. As was noted in the
agenda supplement, Mr. Wolters would have with the atrium addition,
a three foot encroachment into the front setback requirement.
In double checking his measurements on Tuesday afternoon,
Zoning Administrator Gary Anderson discovered that the atrium
addition to the front of the existing Dairy Queen building
would encroach 13 feet into the front setback instead of 3
feet. Zoning Administrator Anderson indicated that with
the 13 foot encroachment into the front setback requirement,
there would still be plenty of open vision out of the egress
to the existing Dairy Queen. Motion by Richard Martie, seconded
by Ed Schaffer, to approve Variance Request to allow an addition
to be built onto the front of the existing Dairy Queen building with
an encroachment of 13 feet into the front setback requirement.
Motion carried unanimously with Jim Ridgeway absent.

5. Public Hearing - Conditional Use Request to allow Minor Auto
Repair and Outdoor Sales in a B-4 Zone - Applicant, Monticello
Auto Sales.
Mr. Clarence McCarty, owner of Monticello Auto Sales, was present
to propose Conditional Use Request to allow Minor Auto Repair
and Outdoor Sales in the former K & H Auto building site.
Mr. McCarty indicated he would like to be able to sell automobiles
out of this location and also be able to tune-up, Clean-up
the vehicles which he has for sale in the other part of the
building with the existing office part to be used as his auto
sales office. Chairman Elect, Richard Carlson opened the
meeting up for input from the public. There was no input
from the public, he then turned to the staff for their input
on this. Staff indicatedJlike it was proposed previously
in the agenda supplement>that the problem we
have with this request is that the size of the existing
K & H auto building is 1500 square feet: maximum allowed
for Outdoor Sales is 30% of the gross floor area of the principal
use. 30% of the gross floor area would be 450 square feet
which Mr. McCarty could use for auto sales display. This
would accommodate just over 2 1/2 cars to be parked within
that 450 square feet. HOWever, the Planning Commission does
have the latitude to increase the percentage allowed for Outdoor
Sales area at their discretion.
Zoning Adiminstrator Anderson also indicated that the
former K & H Auto Sales property is currently located in a
redevelopment area. With this in mind, at some point in time,
the area of this property site along with an adjoining property
site or sites could be incorporated for new development.
The City would like to have the Conditional Use, if approved,
supersede any lease agreement which Mr. McCarty could secure
for this property. Taking the above information into consideration
a motion by Richard Martie, seconded by Ed Schaffer, to
deny the Conditional Use Request to allow Minor Auto Repair
and Outdoor Sales in a B-4 regional business zone. Also as
part of the motion was Mr. Martie's reason for denial, and
that was that the area is not conducive to B-4 type buinesses~
that the sole intent of the B-4 regional business zone is
to accommodate retail and office space within, not the type
of business or businesses as the one proposed by Mr. McCarty.
The motion carried unanimously with Jim Ridgeway absent.
6.
Public Hearing - Request for a Revised Development Plan of
a Planned Unit Development - Mike Reher.
Mr. Mike Reher was present to propose a change in the original
public hearing notice request, to allow him to be allowed
preliminary stage approval for a subdivision to be known as
Victoria Square Addition. Mr. Reher indicated the intent
behind the change was on a suggestion worked out with City
Staff Members on Thursday, August 8, that he shoul~to accomplish
the goals that he is after) change his original request
from a Planned Unit Development to a straight subdivision.

Mr. Reher indicated to Planning Commission Members} in his
presentation)all the aspects which meet the minimum requirements
as spelled out in the zoning ordinance under the preliminary
approval stage of a subdivision. Chairman Elect Richard Carlson
opened up for any comment from the public. Mr. Mel Wolters.
indicated he wanted to go on record as should Dundus Road
be extended to State Highway 25. that he not be assessed until
his property is sold. should he not be able to reach an agreement
with the developer. Mr. Mike Reher. Planning Commission member
Ed Schaffer questioned Zoning Administrator Anderson if everything
was done as per minimum requirements of the preliminary stage
of a subdivision request Zoning Administrator Anderson
countered that everything is in order. Mr. Reher did meet
the minimum requirements of the preliminary stage of a subdivision
request except that the actual writing of the information
onto the subdivision request of the preliminary stage of the
subdivision request was put in by Mr. Reher himself and not
a professional registered engineer. However. Zoning Administrator
Anderson indicated that this would be done before the next
Council Meeting to be held on August 26. 1985. Motion by
Ed SChaffer. seconded by Joyce Dowling. to approve the preliminary
plan stage of subdivision to be known as Victoria Square Addition.
The motion carried unanimously with Jim Ridgeway absent.
7.
Public Hearing - Request for a Final Stage Plan Approval of
a Planned Unit Development - Applicant. Ultra Homes. Inc.
Zoning Administrator Gary Anderson indicated to the Planning
Commission members that due to a conflict of interest the
owners from Ultra Homes. Inc. could not be present to propose
their request. He did. however. indicate to Planning Commission
members the background information which was supplied
to them in their agenda supplement. The Meadow
Oak Third Addition. also known as Outlot G. to be platted is
ready for development stage approval subject to some written
agreements as to the final grating. as per grating plan for
this Outlot G and an agreement as to when the curb and gutter
and asphalt surface would be put in. The properties have
currently been assessed for storm sewer. water and sewer improvements
(which are already in). However. the rough grating. the curb
and gutter. and the hard surfacing of the street. these improvements
are to be at the developer's expense.
At the development stage. the Outlot H. which is the Meadow
Oak fourth addition; Outlot C. which is the Meadow Oak Estates
second addition; Outlot D. which is the Meadow Oak Estates
third addition are before you. the proposed platting of these
lots. The staff however. feels that the Outlots. C. D. & H
be approved at the development stage approval only and not
be passed on for proposed final approval. The reasoning behind
this is that should the developer decide to sell off these
platted lots with no improvements into them whatsoever. the
individual property owner or owners could at some point in
time. in the near future. come into the City to request improvements
be put in to service their vacant lot properties.

At that time, should the City approve putting in the public
utilities, we would have to bond for them. With the last
two additions that have come into the City, all the public
improvements for these subdivisions, and the cost for these
have been borne by the developer himself in its entirety.
Chairman Elect Richard Carlson opened the meeting up for any
input from the public. There being no input from the public,
he read aloud a letter submitted from consulting planner John
Uban of Dahlgren, Shardlow, Uban and Associates. Having heard
the above information, a motion was made by Joyce Dowling,
seconded by Richard Martie to:
1. Approve the development stage of a Planned Unit Development
for Outlot G to be known as the Meadow Oak Third Addition.
2. Contingent upon the written agreements being approved by the City
of Monticello, they would also recommend approval of the
final stage of a Planned Unit Development for Outlot G
to be known as the Meadow Oak Third Addition.
3. That they also approve the development stage of Outlot C,
Meadow Oak Estates Second Addition; Outlot D to be known
as the Meadow Oak Estates Third Addition; and Outlot H
to be known as the Meadow Oak Fourth Addition.
The motions carried unanimously with Jim Ridgeway absent.

Additional Information Items
1. Motion by Ed Schaffer, it is the general consensus of
the Planning COmmission members present, except Jim Ridgeway,
that the next tentative meeting of the Monticello Planning
Commission be held on September 10, 1985, at 7:30 P.M.
2. A request for a special meeting was proposed by Mr. Gary
Weiber, who was representing his brother Wayne Weiber. Mr.
Weiber's request is for a Conditional Use Request to allow
a 24 unit apartment building to be built in an R-3 Zone.
There is also a request submitted from Mr. Richard Martie,
on behalf of Rick and Jan lana, for a Variance Request
to allow a house with an attached garage to be built within
the side setback requirement. Taking the above two requests
into consideration, it was the general consensus of the
Planning Commission members in attendance, except Jim
Ridgeway who was absent, to set a special Monticello Planning
Commission Meeting for August 26, 1985, at 6:30 P.M.
3. Motion by Joyce Dowling, seconded by Richard Martie, to
adjourn the meeting. The meeting adjourned at 9:02 P.M.
