Planning Commission Minutes 06-21-1977 . PLANNING COMMISSION MEETING June 21, 1977 - 7:30 P. M. Members present: Gillham, Doerr, Ridgeway, Topel, Miller. Member absent: Ba u e r . 1. Motion made by Ridgeway, second by Doerr and unanimously carried to approve the minutes of May 17, 1977 as presented. . 2. Public Hearing - Rezonin~ of Parcel from R-1 to R-2 to Allow for Two (2) Family Dwelling. Mr. Vern Youngberg requested that Lot 1, Block 2, Creekside Terrace be rezoned from R-1 to R-2 to allow for a double bungalow. Neighboring residents, G. Stickfort and Jim Larson voiced opposition to the rezoning. They felt that by allowing a duplex to be built, the city may be setting a precedent for other requests in the future and that they originally purchased property in the area because it was zoned single family residential, assuming the area would remain single family. A motion was made by Doerr, second by Topel to recommend approving the rezoning of Lot 1, Block 2 from R-1 (Single Family) to R-2 (Single and Two Family) to allow Mr. Youngberg to build a duplex contingent upon approval of the building permit for a duplex, which must include a site plan and certificate of survey showing lot size square footage. In favor: Doerr, Gillham, Topel. Opposed: Ridgeway. The Planning Commission also recommended that ~ other lots in Creekside Terrace be rezoned to R-2 for duplex development and that future duplexes should be considered individually on a scattered site basis in R-1 zones. 3. Approval of Building Permit - 12 Unit Apartment. Mr. Joseph LaFromboise dba Construction Five is re- questing a building permit for a twelve unit apartment. This apartment would be constructed utilizing an existing foundation just west of the apartment known as Belmar Apartments. This foundation was abandoned in 1973 shortly after construction had started on an apartment house at that time. .' . Ridgeway made a motion, second by Topel and unanimously carried to recommend approval of a building permit for the 12 unit apartment building to Construction 5 Inc., providing the revised drainage plan, landscaping requirements and building codes are met. . 4. Public Hearing - Ordinance Amendments - Motor Vehicle and Recreation Equipment Sales. A Public Hearing was held on a proposal to amend the current Zoning Ordinances to require a conditional use permit for outside sales in a B-3 or B-4 zoning district rather than allow car sales, etc. as a per- mitted use in these zones. The purpose of the amend- ment was to control outside sales connected with the principal use of the business to (30%) of the gross floor area of the principal building. Mr. Jim Teslow and Curt Hoglund both felt that a 30% limitation on outside sales may be too small. Ridgeway made a motion, second by Topel and unanimously carried to recommend that Section 10-13-1-(B), which allowed motor vehicle and recreation equipment sales and garages accessory thereto as permUted uses in a B-3 district be deleted and that the following amend- ments be added to the zoning ordinances: Amend ordinance Section 10-13-4-(E)-1 as follows: 1. Outside services, sales and equipment rental connected with the principal use is limited to thirty (30) per cent of the gross floor area of the principal use. This percentage may be in- creased as a condition of the conditional use permit. Amend ordinance Section 10-14~4-(B) as follows: (B). Open or outdoor service, sale and rental as a principal and accessory use and including sales in or from motorized vehicles, trailers or wagons provided that: 1. Outside service, sales and equipment rental connected with the principal use is limited to thirty (30) percent of the gross floor area of the principal use. This percentage may be increased as a condition of the conditional use permit. . -2- . 5. Variance Request by Jean Brouillard to Build an Accessory Building in an R-l District. Mr. Jean Brouillard requested a variance to build an accessory building (garage) on his property located on Lots 7,8,9 and 10, BLOCK C, Lower Monticello. The current zoning ordinances allow one accessory buildings up to 1,000 square feet in size for each residence and Mr. Brouillard would like to build a second garage for storage of personal equipment not related to his business. Mr. Brouillard currently operates a bulk oil business from his home. Topel made a motion, seconded by Doerr and unanimously carried to recommend that a variance be granted to Mr. Brouillard to build a second garage provided that this building is not used for business purposes. A public hearing will be held at the City Council meeting on July 11, 1977 at 7:30 P. M. . A joint meeting of the Planning Commission and City Council was tentatively set for July 12, at 7:30 P. M. for the purpose of reviewing the proposed Comprehensive Plan for Monticello and Orderly Annexed Areas. adjourned. RW/lg . -3-
