Curphew OrdinanceThe City Council of Monticello hereby ordains
the following:
6-1-9 CURFEW: No minor under the age of eighteen
(18) years of age, when not accompanied by parents or
guardian, shall be allowed on the streets, sidewalks, or
any public place in the City of Monticello after the hour
of 11:00 P.M. and before 5:00 A.M. the succeeding morning
without reasonable cause. Any parent, guardian or other
adult person having the care and custody of a minor under
the age of eighteen (1 8) years, who shall permit such
minor to violate the aforementioned curfew shall be guilty
of a misdemeanor and upon conviction thereof shall be sub-
ject to a fine of not more than twenty-five dollars ($25)
plus costs of prosecution.

6-1-1: ASSUALT: WAOEVER DOES ANY OF THE FOLLOWING, COMMITS AN
ASSUALT, IS GUILTY OF A MISDEMEANOR, AND MAY BE SENTENCED
AS PROVIDED IN SECTION 1-4-1 OF THIS CODE:
(A) DOES ANY ACT WITH INTENT TO CAUSE FEAR IN ANOTHER OF IMMEDIATE
BODILY HARM OR DEATH; OR
(B) INTENTIONALLY INFLICTS OR ATTEMPTS TO INFLICT BODILY HARM UPON
ANOTHER.
6-1-2: UNLAWFUL ASSEMBLY: WHEN THREE (3) OR MORE PERSONS ASSEMBLE,
THEN EACH PARTICIPANT IS GUILTY OF A MISDEMEANORS AND MAY BE
SENTENCED AS PROVIDED IN SECTION 1-4-1 OF THIS CODE, IF THE ASSEMBLY IS:
(A) WITH INTENT TO COMMIT AN UNLAWFUL ACT BY FORCE; OR
(B) WITH INTENT TO CARRY OUT ANY PURPOSE IN SUCH A MANNER AS WILL DISTURB
OR THREATEN THE PUBLIC PEACE; OR
(C) WITHOUT UNLAWFUL PURPOSE, BUT THE PARTICIPANTS SO CONDUCT THEMSELVES
IN A DISJORDERLY MANNER AS TO DF3TURB OR THREATEN THE PUBLIC PEACE,
PRESENCE AT UNLAWFUL ASSEMBLY: WHOEVER WITHOUT LAWFUL
PURPOSE IS PRESENT AT THE PLACE OF AN UNLAWFUL ASSEMBLY

GROUNDS TO KNOW THAT IT WILL OR WILL TEND TO ALARM, ANGER OR DISTURB
OTHERS OR PROVOKE AN ASSUALT OR BREACH OF PEACE, IS GUILTY OF A MIS-
DEMEANOR AND MAY BE SENTENCED AS PROVIDED IN SECTION 1-4-1 OF THIS CODE:
(A) ENGAGES IN BRAWLING OR FIGHTING; OR
(B) DISTURBS AN ASSEMBLY OR MEETING NOT UNLAWFUL IN ITS CHARACTER; OR
(C) ENGAGES IN OFFENSIVE, OBSCENE OR ABUSIVE LANGUAGE OR IN BOISTEROUS
AND NOISY CONDUCT TENDING UNREASONABLY TO AROUSE ALARM, ANGER, OR
RESENTMENT IN OTHERS.

(D) LOOKS, PEERS OR PEEPS INTO THE WINDOW OF ANY STRUCTURE, NOT ON HIS
OWN PROPERTY, WHICH STRUCTURE IF OCCUPIED OR IS INTENDED TO BE
OCCUPIED AS A RESIDENCE, OR LOITERS AROUND OR WITHIN VIEW OF ANY
SAID WINDOW WITH THE INTENT OF WATCHING OR LOOKING THROUGH SAID
WINDOW*
6-1-5: OBSTRUCTING LEGAL PROCESS OR ARREST: WHOEVER INTENTIONALLY
OBSTRUCTS, HINDERS OR PREVENTS THE LAWFUL EXECUTION OF ANY
LEGAL PROCESS, CIVIL OR CRIMINAL, OR APPREHENSION OF ANOTHER ON A CHARGE
OR CONVICTION OF A CRIMINAL OFFENSE, IS GUILTY OF A MISDEMEANOR AND MAY
BE PUNISHED AS PROVIDED IN SECTION I-4-1 OF THIS CODE.
DRUNKENNESS: EVERY PERSON WHO BECOMES INTOXICATED BY
VOLUNTARILY DRINKING INTOXICATING LIQUCR--, IS GUILTY OF A
MISDEMEANOR AND MAY BE PUNISHED AS PROVIDED IN SECTION
OF THIS CODE.
6-1-7: MINORS: POSSESSION: IT SHALL BE UNLAWFUL FOR A MINOR TO HAVE
IN HIS POSSESSION ANY INTOXICATING LIQUOR, OR ANY NON -INTOX-
ICATING MALT LIQUOR, WITH INTENT TO CONSUME THE SAME AT A PLACE OTHER THAN
THE HOUSEHOLD OF HIS PARENT OR GUARDIAN. POSSESSION OF SUCH INTOXICATING
LIQUOR OR NON -INTOXICATING MALT LIQUOR AT A PLACE OTHER THAN THE HOUSEHOLD
OF HIS PARENT OR GUARDIAN SHALL BE PRIMA FACIE EVIDENCE OF INTENT TO CON-
SUME THE SAME AT A PLACE OTHER THAN THE HOUSEHOLD OF HIS PARENT OR GUARDIAN,
A PERSON VIOLATING A PROVISION OF THIS SECTION rt 15 GUILTY OF A MISDEMEANOR
AND MAY BE SENTENCED AS PROVIDED IN SECTION 1_�-I OF THIS CODE.
6-t_8: THEFT: WHOEVER INTENTIONALLY AND WITHOUT CLAIM OF RIGHT
TAKES, USES, TRANSFERS, CONCEALS OR RETAINS POSSESSION OF
THE PROPERTY OF ANOTHER WHERE THE VALUE OF SAID PROPERTY IS ONE HUNDRED
DOLLARS ($100.00) OR LESS, WITHuUT HIS CONSENT AND WITH INTENT TO DEPRIVE
THE OWNER PERMANENTLY OF POSSESSION OF SAID PROPERTY, IS GUILTY OF A MIS-
DEMEANOR AND MAY BE SENTENCED AS PROVIDED IN SECTION 1-4-1 OF THIS CODE.

AFTER THE HOUR OF 11:00 P.M. AND BEFORE 5:00 A.M. THE SUCCEEDING MORNING
