Village Council
May 25, 1970 7:00 P.M.
Special meeting of Village Council called to order at 7:00 P.M., Monday
May 25th by Ronald Schleif, Mayor. All councilmen were present: James
Maus, Franz Swanberg, Richard Martie, William Sandberg. Attorney Greg
Smith was present.
Attorney Walter Johnson and Stan Peters, owner -manager of Wayside Inn
were present.
Ron Schleif introduced discussion on the resolution that had been de-
ferred from the previous meeting. After lengthy discussion by all parties
concerned, James Maus made the motion that resolution be accepted. Franz
Swanberg seconded motion, Voting in favor: Maus, Swanberg, Martie, Schleif.
Voting against: Sandberg.
This action would permit Walter Johnson and his clients Stan Peters and
Archie Lindenfelser, Monte Club, to withdraw motion objecting to annex-
ation.
Monticello Township had advised Clerk that it intends to blacktop portion
of South Elm Street. James Maus made motion that village pay its share
as determined by engineer, Thore Meyer. Richard M.a.rtie seconded, motion
carried.
James Maus made motion that village go ahead with street repair program
with Thore Meyer prbvi.ding specifications and supervision. Work to be
done on a per -ton laid basis. Franz Swanberg seconded, carried.
William Sandberg made motion, seconded by Richard Martie that off -sale
liquor store be opened at 8:00 A.M. beginning May 27th if possible.
Motion carried without dissent.
Recommendation made that liquor store be open on Saturday, Memorial Day
if adequate help is available..
Request by Joel Sletten that street right-of-way between East River Street
and river, and adjacent to his property be vacated. Request denied.
Motion to adjourn at 8:15 P. M., carried.

RESOLUTION NO. 70 -
RESOLUTION SUPPORTING THE LEGAL EFFECT OF M. S. A. 340. 11 Subd. 7a
WHICH WOULD ALLOW THE LIQUOR LICENSES IN MONTICELLO TOWNSHIP TO
REMAIN IN EFFECT AND BE RENEWED EVEN THOUGH THE VILLAGE LIQUOR
STORE REMAINED IN OPERATION WITH "ON -SALE" AND "OFF -SALE" BUSINESS
AFTER ANNEXATION OF THE TERRITORY TO THE VILLAGE.
BE IT resolved by the Village Council of the Village of Monticello as follows:
1. That the attached Attorney General opinion is recognized as valid law, and
that the Village Council will abide by the attached opinion which allows the Village
to maintain its "on -sale" and "off -sale" liquor store and annex territory containing
private licenses without invalidating the licenses, and may renew the private
licenses.
2. That the Village Council will, in fact, pursuant to the above, renew the private
licenses.
3. That the license fees for the private licenses in the annexed territory will be
somewhere between what the licenses now cost and what the licenses cost in the
villages in the area where there is no municipal liquor store.

The motion for the adoption of the foregoing resolution was duly seconded by
Councilman _ , and upon vote being taken thereon, the following
