MINUTES
REGULAR MEETING - MONTICELLO PLANNING COMMISSION
Tuesday, January 8, 1991 - 7:00 p.m.
Members Present:

1. The meeting was called to order by Chairperson Dan McConnon at
7:03 p.m.
2. Appointment of planning Commission Chairperson.
Motion was made by Cindy Lemm, seconded by Richard Martie, to
approve the appointment of Dan McConnon as Planning Commission
Chairperson. Motion carried unanimously with Dan McConnon
abstaining.
3. Appointment of planninq Commission Vice Chairperson.
Motion was made by Richard Martie, seconded by
Carlson, to approve the appointment of Cindy Lemm
Planning Commission Vice Chairperson. Motion
unanimously with Cindy Lemm abstaining.

4. Motion was made by Cindy Lemm, seconded by Richard Carlson, to
approve the minutes of the regular meeting held December 4,
1990.
5. Continued Public Hearinq--Consideration of an ordinance
amendment to Section 3-9 [C14 to include: (i) A permit for a
public siqn in the form of a decorative banner to be displayed
on public property for a period of one (1) year. A permit
shall be issued for each year that the decorative banners are
displayed. Applicant, City of Monticello.
Assistant Administrator, Jeff O'Neill, explained to Planning
Commission members and the public the results of a joint
meeting wi th Councilmember Dan Blonigen; Councilmember Shirley
Anderson; and Barb Schwientek, Monticello-Big Lake Hospital
Administrator.
Chairperson Dan McConnon then opened the public hearing.
There being no comments from the public, the public hearing
was closed and input was received from Planning Commission
members.

Planning Commission input centered around item #6 of the
proposed ordinance amendment which read: "Public banners may
not be hung only on alternate streets cape fixtures unless
otherwise approved by Council." Item #6 shall be amended to
read: "Public banners shall be hung only on alternate
streetscape fixtures unless otherwise approved by Council."
There being no further input from Planning Commission members,
a motion was made by Richard Martie, seconded by Jon Bogart,
to approve the zoning ordinance amendment to Section 3-9 [C]4
to include: (j) A permit for a public sign in the form of a
decorative banner to be displayed on public property for a
period of one (1) year. A permit shall be issued for each
year that the decorative banners are displayed. Motion
carried unanimously.
6. Public Hearing--A variance request to allow an additional
premise identification sign and to allow additional premise
sign square footage. Applicant, Holiday Companies.
Chairperson Dan McConnon opened the public hearing.

Gary Anderson, Zoning Administrator, explained to Planning
Commission members Holiday Companies' request to allow an
additional premise identification sign and additional premise
sign square footage.
The Holiday Companies explained their rationale for the
development of their signage within their building complex
similar to what the other existing buildings are being
required to do.
There being no further input from the public, Chairperson Dan
McConnon then closed the public hearing and opened the meeting
for input from the Planning Commission members.
The discussion amongst the Planning Commission members
centered around granting additional premise identification
signage.
There being no further input from the Planning Commission
members, motion was made by Richard Carlson, seconded by
Richard Martie, to deny the variance request to allow an
additional premise identification sign and to allow additional
premise sign square footage. Motion carried unanimously.
Reason for denial: There was no hardship displayed.

Public Hearing--Consideration of an ordinance amendment to
Section 2-2 [HBl of the Monticello Zoning Ordinance by adding
"beautician" to the list of home occupations allowed by
ordinance. Amendment to also include additional conditions
associated with the operation of a home occupation and
establishment of a home occupation permitting process.
Applicant, City of Monticello.
Jeff O'Neill, Assistant Administrator, explained to Planning
Commission members and the public a proposed ordinance
amendment to allow "beautician" as a home occupation.
Mr. O'Neill presented and read a petition which was submitted
to City staff, which represented neighbors in the Par West
addition of the proposed home occupation beautician.
Chairperson Dan McConnon then opened the public hearing.
Art Dorn, Century 21 realtor, questioned the necessity of such
condi tions for the beautician as a home occupation. He
questioned the necessity of an ordinance at all regulating
this, as they pretty much regulate themselves wi thin the
residential zone according to his experience as a realtor.
Karla Dickey, proposed applicant of such ordinance amendment,
explained the operation of her beauty shop business.
Residents near the proposed beauty shop home occupation
explained their concerns over signage, traffic, and the
residential appearance of this proposed use of residential
property. Concerns also addressed were that if a beautician
is allowed as a home occupation, it is streamlined to maintain
the residential integrity in which it is being placed.
Chairperson Dan McConnon then closed the public hearing and
opened the meeting for discussion amongst Planning Commission
members. Discussion amongst Planning Commission members
centered around being sympathetic to the applicant but also
realizing the best place for this type of occupation is in a
business zone.
With no further discussion amongst Planning Commission
members, a motion was made by Jon Bogart, seconded by Richard
Carlson, to amend the ordinance to include "beautician"
amongst the list of home occupations allowed by ordinance.
The motion carried unanimously. Motion based on the finding
that a permit process is necessary to protect the integrity of
residential property.

Motion by Richard Martie, seconded by Jon Bogart, to adopt the
permit process for the purpose of monitoring and enforcing the
home occupation operation standards. Motion carried
unanimously with the following conditions: (1) one parking
stall must be provided for off-street parking, no customer
parking on the street, and total vehicles parked outside at
anyone time limited to two vehicles. The home should not
have a parked-up appearance; (2) No signs allowed indicating
the presence of a commercial use of the property. Motion
carried unanimously.
8. Public Hearinq--Consideration of amendment to the Monticello
zoninq Ordinance, Section 6-3, permittinq accessory uses in an
R-l, R-2, R-3, and PZM zone by addinq "sale of items includinq
automobiles, recreational vehicles, boats, and other
equipment. Items sold limited to three items per property
annually and limited to items owned by property owner. "

Chairperson Dan McConnon then opened the public hearing.

Jeff O'Neill, Assistant Administrator, explained to Planning
Commission members and the public the proposed ordinance
amendment to restrict sale of recreational equipment, etc.,
within the R-l, R-2, R-3, and PZM zones within the city of
Monticello. The intent of the proposed ordinance amendment is
to limit the total number of vehicles and recreational
equipment to be sold within a calendar year on a property and
that they be limited to the owner, leasee, or renter of the
property.
There being no comments from the public, Chairperson Dan
McConnon then closed the public hearing and opened the meeting
for input from the Planning Commission members. One concern
brought up by the Planning Commission members was were any of
the proposed violators or residential property owners notified
of the proposed ordinance amendment? City staff replied that
no letters had been sent to the individual property owners.
Planning Commission members felt uncomfortable without
notifying potential violators personally by letter, and the
City staff was then instructed to send letters to each
affected property owner that staff can recall on Broadway or
River Street to notify them of the proposed ordinance
amendment.

Motion was made by Richard Carlson, seconded by Jon Bogart, to
table the ordinance amendment to the Monticello Zoning
Ordinance, Section 6-3, permitting accessory uses in an R-1,
R-2, R~3, and PZM zone by adding "sale of items including
automobiles, recreational vehicles, boats, and other
equipment. Items sold limited to three items per property
annually and limited to items owned by property owner."
Motion carried unanimously.
9 . Consideration of an interim ordinance imposinq a moratorium on
adult oriented land uses on certain property located in the
city of Monticello. Applicant, City of Monticello.
Jeff O'Neill, Assistant Administrator, explained to Planning
Commission members and the public the proposed ordinance
amendment imposing a moratorium on adult oriented land uses on
certain property located in the city of Monticello. A problem
that was noted in talking to the City's consulting planner,
Mr. John Uban of Dahlgren, Shardlow & Uban & Associates, is
that the City must define a certain area in which they would
be permitted. In looking at the existing zoning map, it was
tough to specifically define an area for them, but such areas
were suggested amongst Planning Commission members.
There being no further input from the Planning Commission
members, a motion was made by Jon Bogart, seconded by Richard
Carlson, to create an interim ordinance imposing a moratorium
on adult oriented land uses on certain property located within
the city of Monticello. Motion based on findings noted in the
language contained wi thin the ordinance. Motion carried
unanimously.
10.
A Continued Public Hearinq--A conditional use request to allow
used automobiles/liqht truck sales in a B-3 (hiqhway business)
zone. Applicant, Hoqlund Transportation/94 Services.
Staff indicated they would like to see the continued public
hearing continued until the next regularly scheduled meeting.
11. A Continued Public Hearinq--A variance request to allow less
than the minimum 4,500 square feet of sales and display area.
Applicant, Hoqlund Transportation/94 Services.
City staff suggested that the Planning Commission members also
continue this public hearing until the next regularly
scheduled Planning Commission meeting.

ADDITIONAL INFORMATION ITEMS
1. A variance request to allow construction of a detached garage
within the rear yard setback requirement. Applicant, Antone
and Cecelia Banyai. Council action: No action required, as
the request did not come before them.
2. An ordinance amendment to Section 3-9 [C]4 to include (j) a
permit for a public sign in the form of a decorative banner to
be displayed on public property for a period of one (1) year.
A permit shall be issued for each year that the decorative
banners are displayed. Applicant, city of Monticello.
Council action: No action required, as the request did not
come before them.

adjourn the meeting. The meeting adjourned at 9:17 p.m.
