City Council Resolution 2022-104CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA RESOLUTION NO. 2022-104 APPROVAL OF A FINAL PLAT FOR THE COUNTRY CLUB MANOR SECOND ADDITION AND COUNTRY CLUB MANOR SECOND ADDITION MIXED RESIDENTIAL PLANNED UNIT DEVELOPMENT AND DEVELOPMENT AGREEMENTS WHEREAS, the applicant has submitted a request for a Final Plat, establishing parcels for mixed residential uses under Planned Unit Development zoning; and WHEREAS, the site is to be zoned PUD, Country Club Manor Second Addition Planned Unit Development District; and WHEREAS, the proposed use and development of the future residential areas as mixed residential uses would be consistent with Comprehensive Plan designation as Mixed Residential for the subject area; and WHEREAS, the applicant is seeking a rezoning of the property to PUD, Planned Unit Development to accommodate the specific building and site development standards in the PUD proposal; and WHEREAS, the applicant is developing the site to include private common areas and public improvements to serve the plat; and WHEREAS, the uses will not create any unanticipated changes to the demand for public services on or around the site; and WHEREAS, the Planning Commission held public hearings on the preliminary plat application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has recommended approval of the preliminary plat of Country Club Manor Second Additions (formerly known as First Addition); and WHEREAS, the City Council has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the City Council of the City of Monticello makes the following Findings of Fact in relation to the Final Plat approval: 1. The proposed uses are consistent with the existing and future land uses in the area in which they are located. 2. The proposed Plat incorporates standards of the PUD applicable to the zoning districts which properly address the impacts of the applicable residential development. The impacts of the improvements on public services are those anticipated by residential land uses and are addressed through standard review and ordinances as adopted. 4. The impacts of the land uses as proposed are consistent with those expected by the Comprehensive Plan on adjoining property in the area. 5. No other changes or impacts resulting from the proposed platting or development are anticipated. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota, that the Monticello City Council approves the Final Plat of Country Club Manor Second Addition subject to the conditions listed in Exhibit Z of the staff report as follows: 1. The approval of the final plat is contingent on approval of the final stage PUD and rezoning to PUD. 2. Approval of the final stage PUD and rezoning to PUD are contingent on approval of the final plat. 3. All work in the plat for private and public improvements shall comply with the final submitted plans with the comments identified in the following conditions of Exhibit Z. 4. Additional pedestrian access is confirmed to include a looped trail around the apartment building (combined with a fire access route), and direct sidewalk access to both 7t" Street and Tee Box Trail. 5. Engineered lap siding as noted in this report, rather than vinyl, shall be used as primary finish materials on the proposed twinhome buildings 6. Fiber -cement siding or other composite material as noted in this report shall be used as primary siding finish materials (not including vinyl) in support of the proposed and recommended stone veneer for the multi -family building. 7. Individual trash containers shall be stored within the garages of the twinhomes, and all trash service shall be located within the basement garage of the apartment building. 8. All signage shall be subject to review for compliance with the requirements of the City's sign regulations. 9. Issues related to site access and streets shall be subject to comment and recommendation by the City Engineer. 10. Upland area within Outlot C shall be devoted to recreational open space for PUD residents. 11. Wetland -related issues, including wetland buffer requirements, shall be subject to comment and recommendation by the City Engineer. 2 CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA RESOLUTION NO. 2022-104 12. Issues related to grading, drainage and utilities shall be subject to comment and recommendation by the City Engineer. 13. The pergola design over the entryway sidewalks shall be applied to each of the twinhome units. 14. Street lighting shall be in accordance with the City's Subdivision Ordinance standards. This issue shall be subject to further comment by the City Engineer. 15. The applicant will correct the preliminary and final plat naming, confirming the naming convention with Wright County. 16. The final plat shall be revised to meet the requirements for drainage and utility easements per the City Engineer and Subdivision Ordinance. 17. The Developer shall continue to work with the City on the extension of the pathway along 7t" Street to Elm Street at the direction of the City Engineer. If extended, the Developer would receive additional credit toward their park dedication requirement. 18. Plat street names are required to be revised consistent with Wright County naming conventions. 19. A cross easement agreement reflecting any shared uses or amenities, including the open spaces and stormwater facilities, is to be prepared, executed and recorded by the Developer, and is subject to the comments of the City Attorney and City Engineer. 20. If any individual buildings or units within the twinhome lots are to be sold as owner - occupied units, a homeowner's association document is required to be prepared, executed and recorded by the Developer, and is subject to the comments of the City Attorney. The document should provide the terms for all association and private property responsibilities, both for the units and all common spaces. 21. Compliance with the Department of Building Safety & Code Enforcement regarding Fire Code requirements. 22. Compliance with the comments of the Wright County Highway Engineer's Department and the comments of MnDOT. 23. Compliance with the terms of the City's Engineering Staff letters for the twinhome and multi -family project areas dated September 8th and 20th, 2022. 24. The Developer shall execute the required Development Contracts outlining the terms and conditions of the plat and PUD; these contracts shall be subject to the comments of the City Attorney. 25. Comments and recommendations of other Staff and final approvals of the City Council. 3 CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA RESOLUTION NO. 2022-104 BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA, that the document titled "Development Contract and Planned Unit Development for "Country Club Manor Second Addition" and the "Development Contract and Planned Unit Development for Country Club Manor Second Addition — Lot 1, Block 5" with assignment of the specific terms and conditions for public improvements and the specific terms and conditions for plat development, is hereby approved.
