City Council Resolution 2023-55CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA RESOLUTION NO. 2023-55 APPROVAL OF VACATION OF DRAINAGE AND UTILITY EASEMENTS IN THE COUNTRY CLUB MANOR 2nd ADDITION WHEREAS, the applicant originally platted the subject property as Country Club Manor Second Addition, and platted each of 60 individual unit lots, surrounding common lot areas, and dedicated drainage and utility easements over the common areas; and WHEREAS, the applicant has submitted a request for a Final Plat for Country Club Manor Third Addition, revising the parcels for mixed residential uses under Planned Unit Development zoning; and WHEREAS, the site is zoned PUD, Country Club Manor Second Addition Planned Unit Development District; and WHEREAS, the proposed use and development of the future residential areas as mixed residential uses would be consistent with Comprehensive Plan designation as Mixed Residential for the subject area the replat will not impact the approved PUD development plan; and WHEREAS, the applicant is seeking a replatting of the property to accommodate the specific building and site development standards within lots created by the proposed plat; and WHEREAS, the applicant has requested a vacation of the surrounding drainage and utility easements to accommodate the altered lot lines in the plat; and WHEREAS, the uses will not create any unanticipated changes to the demand for public services on or around the site; and WHEREAS, the City Council has held a public hearing for consideration of vacation of drainage and utility easements necessary to accommodate the revised final plat and the applicant and members of the public were provided the opportunity to present information to the City Council; and WHEREAS, the City Council has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the City Council of the City of Monticello makes the following Findings of Fact in relation to the vacation approval: 1. The proposed uses are consistent with the existing and future land uses in the area in which they are located. CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA RESOLUTION NO. 2023-55 2. The proposed vacation and Replat incorporates standards of the PUD applicable to the zoning districts which properly address the impacts of the applicable residential development. 3. The impacts of the improvements on public services are those anticipated by residential land uses and are addressed through standard review and ordinances as adopted. 4. The impacts of the land uses as proposed are consistent with those expected by the Comprehensive Plan on adjoining property in the area. 5. No other changes or impacts resulting from the proposed platting or development are anticipated. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota, that the Monticello City Council approves the vacation of drainage and utility easements within the Country Club Manor Second Addition subject to the conditions listed in Exhibit Z of the staff report as follows: 1. Establishment of drainage and utility easements per the direction of the City Engineer on Country Club Manor Third Addition (replat of the townhome area of the 2nd Addition). 2. Recording of the plat of Country Club Manor Third Addition (replat of the townhome area of the Second Addition). 3. Coordination with utility providers for any required relocations resulting from the vacation and replatting of public easements at developer's expense.
