Consideration of an Amendment to the Monticello City Code, Title XV: Land Usage, Chapter 153: Zoning Ordinance, Sections 153.012 — Definitions and 153.042 — Common District Requirements to allow certain encroachments into the required front vard for single- and two-family residences, and including definitions or other regulations necessary to define and limit the intent or application of the proposed amendment. Applicant: Jonanthan & Nancv Parker City Planner Steve Grittman provided an overview of the agenda item to the Planning Commission and the public. The request was to allow for limited encroachment into the front yard setback for single- and two-family homes, specifically related to open -sided and covered entry porches and similar structures of a specific size and encroachment. This request stemmed from the applicant's original intent to enhance the front fagade of their home by adding an enclosed garage, but realized the zoning ordinance would not allow such enhancements as it would encroach within the setback requirements on the lot. After review of the ordinance section, staff believed that an amendment to allow this type of encroachment would benefit the City's support for investment in existing housing stock within the community. Additionally, staff believed that such encroachment would add character to individual houses and their neighborhoods overall. Mr. Konsor asked whether stairs up to a porch that would encroach in this manner would need to meet encroachment limitation. Mr. Grittman clarified that the stairs are allowed to encroach further as necessary to access the porch structure, so long as they do not exceed 30 inches above grade, as defined by the zoning ordinance. Mr. Konsor noted that the proposed ordinance allows for walls on two sides of a given porch at no more than 40% of that area from floor to ceiling being enclosed by said walls, and asked whether screens and windows would be allowed within that open area. Mr. Grittman clarified that the remainder area will be required to be open, and that the proposed language addresses the use of screens, windows. Mr. Grittman added that the only area of any proposed porch addition that is subject to these standards is the area encroaching within the setback requirement for the property. Eric Hagen asked whether it was necessary to address the use of gates within the proposed amendments on encroachment. Mr. Grittman clarified that gates, fences, and walls outside of the buildable area would be required to meet the zoning code section on fences and walls (Section 153.062). Mr. Konsor opened the public hearing portion of the agenda item. Jonathan Parker, 130 Kampa Circle, Monticello, MN 55362, applicant, addressed the Planning Commission. Mr. Parker noted that when he originally brought these plans to the City, he wanted to make sure he was abiding by what the zoning ordinance allows and appreciated City staff for helping to find a solution to the encroachment issue. Mr. Konsor closed the public hearing portion of the agenda item. PAUL KONSOR MOVED TO ADOPT RESOLUTION NO. PC-2023-35 RECOMMENDING APPROVAL OF AN AMENDMENT TO THE ZONING ORDINANCE CREATING AN ALLOWANCE FOR A LIMITED ENCROACHMENT INTO THE FRONT YARD SETBACK FOR SINGLE- AND TWO-FAMILY HOMES, SUBJECT TO THE CONDITIONS IN EXHIBIT Z AND BASED ON THE FINDINGS IN SAID RESOLUTION. TERI LEHNER SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY, 5-0. 3. Ieular Agenda A. Consideration of Adopting Resolution PC-2023-36, Finding the Proposed Acquisition of Certain Land by the City of Monticello Economic Development Authority is Consistent with the Citv of Monticello 2040 Vision + Plan (Comprehensive Plan). Community Development Director Angela Schumann provided an overview of the agenda item to the Planning Commission and the public. The EDA is planning to purchase two parcels along West 71" Street to the west of Runnings, one, a vacant 14-acre parcel and the other a stormwater pond. The acquisition is intended to further the EDA's ability to attract certain businesses that can better meet economic development objectives identified in the Comprehensive Plan, such as added jobs and tax base. Mr. Konsor asked what would change in regard to accomplishing economic development goals outlined within the comprehensive plan with the EDA purchasing this property. Ms. Schumann clarified that it provides the EDA the opportunity to focus on potential best users for the site. Given the property is guided Commercial and Residential Flex, which provides a broad range of potential users, the current zoning of the site is B-3, Highway Business. This zoning district does allow for uses that may not best accomplish the economic development goals identified within the Comp Plan. EDA ownership of the property allows them to evaluate potential buyers through the more focused lens of those Comprehensive Plan goals. Andrew Tapper asked who the seller of the properties was. Ms. Schumann clarified that Riverwood Bank is the current owner of both properties. PAUL KONSOR MOVED TO ADOPT RESOLUTION NO. PC-2023-36, FINDING THAT THE PROPOSED ACQUISITION OF CERTAIN LAND, OUTLOT A, GREAT RIVER ADDITION AND THAT LAND TO BE PLATTED AS OUTLOT A, GREAT RIVER 2ND ADDITION, BY THE CITY OF MONTICELLO ECONOMIC DEVELOPMENT AUTHORITY IS CONSISTENT WITH THE CITY OF MONTICELLO COMPREHENSIVE PLAN (MONTICELLO 2040 VISION + PLAN). TERI LEHNER SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY, 5- 0. B. Consideration of Planning Commission Resignation and Interview Meeting Ms. Schumann provided an overview of the agenda item to the Planning Commission and the public. Commissioner Eric Hagen had previously informed City staff that he would not seek reappointment to another term that would have begun in 2024. The Planning Commission was asked to accept Mr. Hagen's resignation and call for a special meeting in the future to conduct interviews to fill the position.
