RESOLUTION NO. 2023-95
A RESOLUTION APPROVING FINAL STAGE PLANNED UNIT DEVELOPMENT, ZONING
ORDINANCE AND MAP AMENDMENTS, AND DEVELOPMENT AGREEMENT FOR THE
GREAT RIVER PLANNED UNIT DEVELOPMENT
LOT 1, BLOCK 1, GREAT RIVER SECOND ADDITION
WHEREAS, the applicant has platted the subject property as Great River Second
Addition, creating a development parcel and one outlot; and
WHEREAS, the applicant has submitted a request for a Final Planned Unit
Development for Lot 1, Block 1, Great River Second Addition, Zoning Ordinance Amendment
creating the Great River PUD Zoning District, Rezoning of Lot 1, Block 1, Great River Second
Addition to the Great River PUD District, and Development Agreement governing the
development and use of the subject property; and
WHEREAS, the site is guided for Commercial - Residential Flex land uses in the
Monticello 2040 Vision + Plan Comprehensive Plan; and
WHEREAS, the proposed use and development of the proposed multi -family
residential project would be consistent with Comprehensive Plan designation; and
WHEREAS, the applicant proposes a mix of market -rate and affordable housing,
consistent with the City's housing policies and plans; and
WHEREAS, the proposed project includes a variety of amenities, including
recreational amenities, covered garage space, open spaces that support the use of planned
unit development flexibility for project consideration; and
WHEREAS, the uses will not create any unanticipated changes to the demand for
public services on or around the site; and
WHEREAS, the Planning Commission has held a public hearing for consideration of
the PUD and associated zoning amendments on September 5, 2023 and the applicant and
members of the public were provided the opportunity to present information to the City
Council; and
WHEREAS, the City Council has previously approved the Development Stage PUD
with conditions related to final consideration; and
WHEREAS, the City Council has considered all of the comments of the Planning
Commission, the public, and the staff report, which are incorporated by reference into the
resolution; and

WHEREAS, the City Council of the City of Monticello makes the following Findings of
Fact in relation to the Final Plat approval:
1. The proposed uses are consistent with the existing and future land uses in the
area in which they are located.
2. The proposed PUD incorporates standards of the PUD applicable to the zoning
district which properly addresses the impacts and requirements of the applicable
residential development.
3. The impacts of the improvements on public services are those anticipated by
residential land uses and are addressed through standard review and ordinances
as adopted.
4. The impacts of the land uses as proposed are consistent with those expected by
the Comprehensive Plan on adjoining property in the area.
5. No other changes or impacts resulting from the proposed platting or
development are anticipated.
NOW, THEREFORE, BE /T RESOLVED, by the City Council of the City of Monticello,
Minnesota, that the Monticello City Council approves the Final Stage PUD for the Great
River Planned Unit Development District, adopts the Zoning Ordinance amendments for the
Great River Planned Unit Development on Lot 1, Block 1, Great River Second Addition
subject to the conditions listed in Exhibit Z of the staff report as follows:
1. The Final Stage PUD is conditioned on adoption of the Zoning District
amendment and Rezoning to Great River PUD District.
2. Approval of the residential PUD and associated zoning amendments are
subject to approval and execution of final development agreement.
3. The project is developed in accordance with the finally approved plans,
including the civil plans, landscape plans, architectural plans, phasing plans
and other plans as submitted and approved on November 13, 2023, pursuant
to any conditions requiring amendments or change as applicable.
4. The PUD is subject to Park Dedication requirements as recommended by the
PARC and approved by the City Council per the Great River Second Addition
Development Contract.
5. The landscape plans are revised to show additional plantings along the east
boundary to comply with the buffer requirement, including at least 7
additional shrubs.
6. The landscape plans are modified to provide adequate planting width and
add at least 3 trees to eliminate the gap in tree planting along the south
boundary with 1-94.

7. Additional landscaping is provided to enhance the amenity areas, as well as
to screen the activity areas from the private living spaces of the adjoining
units, particularly the playground area.
8. All landscape areas, including the berm and buffer plantings noted in this
report, are irrigated to help ensure survival.
9. The applicant continues to work with the City on final parking management
and other details and incorporates additional comments into the Final PUD
plans as required.
10. Comments and recommendations of the City Engineer in the letter dated
August 25, 2023, September 28, 2023 and November 9, 2023.
11. Comments of the Department of Building Safety & Code Enforcement as
provided in their comments of September 27, 2023.
12. Execution of an amended PUD agreement governing the proposed and
remaining development in accordance with the standard requirements and
the additional recommendations noted in this report.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA, that the
document titled "First Amendment to Development Contract and Planned Unit
Development for Great River Second Addition" with assignment of the specific terms and
conditions for public improvements and the specific terms and conditions for plat and PUD
development, is hereby approved.
ADOPTED this 13t" day of November, 2023, by the City Council of the City of Monticello,
Minnesota.
