Notices were sent out for this meeting to the surrounding area, where the development is proposed. Ms. Schumann noted that the meeting did not involve a public hearing, but if time allows, residents present may address the group. City Planner Steve Grittman provided an overview of the agenda item to the City Council, Planning Commission and the public. A two-phase apartment concept, that would consist of 50 -units built initially, followed by an additional 50 -units. The developer has made note that the uniqueness of the proposed garages on site would attract a niche group of renters, that need more space than a normal apartment development. Mr. Grittman emphasized that the Planning Commission and City Council should not only focus their comments on areas of the concept that could be adjusted to be a more desirable proposal for Monticello, but also what areas of the concept submittal should be retained as the developer continues to work on more solidified plans for formal submittal in the future. The developer who submitted the concept design is intending a PUD zoning. Mr. Grittman summarized the rest of the details of the concept for the group. Ms. Schumann noted the Minnesota Department of Transportation received notice of the meeting and the concept design, and recommended that if the proposal was to move forward, they would recommend landscape or another form of buffering treatment along the 1-94 right-of-way. Councilmember Gabler asked if there have been any recently approved apartment developments that include detached garages for tenant use. Ms. Schumann noted that Monticello Lakes was originally approved with detached garages on site, then recently proposed an amendment that was approved to remove the garages. Though not recently approved, the Monticello Crossings apartment complex also includes detached garages on site. Councilmember Gabler asked if the provided housing study was recently updated. Ms. Schumann clarified that the housing study's executive summary provided was from the original housing study for Monticello, created in 2020. Economic Development Manager Jim Thares noted the EDA was prepared to consider an update to the housing study on June 14, 2023, at their regular meeting. Planning Commission Chair Paul Konsor asked if there was proposed underground parking below the building. Mr. Grittman clarified that the concept shows under - building or at -grade parking on the first level above the ground. Mayor Lloyd Hilgart believed the proposed density for the project was not enough. The total area included in the concept plan is 6 acres with 100 units on site. The concept proposed is 16.7 gross units per acre. Mayor Hilgart also expressed disinterest in the proposed garages. His main concern regarding the garages focused on the tenant's utilization of the garages and potentially the lack of need for tenants to have that much storage space in an apartment setting. If the tenants do not need the space, it allows the possibility of the garage area to be rented out by non -apartment residents who live nearby. Mr. Konsor liked the uniqueness and design of the detached garage layout, but also expressed concerns about those spaces being rented out to non -apartment residents. Andrew Tapper concurred with Mr. Konsor, and also had concerns about how an affordability aspect can be incorporated into the concept with the garages. The detached garages appeared to be a "higher end" feature of the proposal, and could make affordability difficult. Councilmember Gabler said that she liked the idea of the detached garages, if they were on an adjacent parcel where if you lived in the apartment, there would be easy access to the space, and at the same time allowing people in the community to utilize the storage if needed. Applicant Pat Briggs of Briggs Companies addressed the Planning Commission, City Council & the public. The detached garage concept stemmed from a review of the existing housing market in the area. Mr. Briggs noted that the difficulty of becoming a new home buyer remains steady, and also mentioned that the detached garages can give those groups more space for storage of their personal items, while not being forced into buying a home at an inopportune time. Mr. Briggs also mentioned that the majority of the units in the proposed concept are 2 and 3 -bedroom units, noting that 3 -bedroom units remain the most needed size of apartment unit currently. Mayor Hilgart reiterated that his concerns lie with the density of the proposed project, as well as the detached garages. Mayor Hilgart did not express concern on an apartment building being at that location, due to the proposed location of the project already being previously approved for an apartment building. Mr. Briggs said that the proposed detached garages, and the additional personal storage space that brings to the proposed development will draw a group of young residents and families that have not yet been able to purchase their own piece of property that allows them to store those items they would not have space for in another apartment development. Mr. Konsor addressed the proposed underbuilding parking and said he would like to see a 1:1 unit to parking stall ratio for those apartments. Mr. Konsor expressed concern regarding the inclusion of the garages with the units, and how that could make an affordability aspect difficult in this proposed development. Mr. Konsor did note that the concept drawings of the development were aesthetically appealing. Eric Hagen liked the uniqueness of the detached garages, but expressed concerns about the number of multi -family developments that have recently been approved and currently under construction developments. Councilmember Gabler mentioned it could be beneficial to focus the concept's units towards the 2 -bed and 3 -bed units, and moving away from the studio and one -bed units. Councilmember Lee Martie concurred with Mr. Hagen's previous statement. Councilmember Tracy Hinz mentioned that the City would have a better understanding of whether the City does in fact need this type of development following the completion of the housing study update. Continued - Consideration of Conditional Use Permit for an Accessory Structure— Major and Conditional Use Permit for Driveway leading to Accessory Structure in Rear Yard in the R-1, Single Family Residential District Applicant: Ben Roberg City Planner Steve Grittman provided an overview of the agenda item to the Planning Commission and the public. A continued item from the May Planning Commission regular meeting, the applicants requested a Conditional Use Permit for an accessory detached structure that would exceed 1,200 square feet of total accessory structure area on the property. The applicants are also requesting a Conditional Use Permit to install a driveway in the rear yard, leading to the detached structure. Paul Konsor asked if a survey is required as a part of the conditions laid out in exhibit Z. Mr. Grittman noted that Exhibit Z includes a requirement for the applicants to submit a survey, and it is a requirement for acquiring a building permit. Councilmember Gabler asked if this proposed structure would be in the way of any potential noise barriers to be installed along Interstate 94. Community Development Director Angela Schumann said that although she is uncertain where specifically a noise wall would be installed in this area of Monticello, noise walls are typically installed in the Minnesota Department of Transportation's right-of-way. Mr. Konsor opened the public hearing portion of the agenda item. Andrew Tapper asked the applicant if the fence on-site is on the property line, and if the proposed driveway will abut that fence. Applicant Ben Roberg, 9413 Giffort Court, stated that the fence is on the property line, and that the driveway will abut the fence on the North property line, while still meeting the 3 -foot minimum setback. Mr. Konsor closed the public hearing portion of the agenda item. Mr. Konsor asked if the proposed structure is subject to the minimum building standards that would require a brick or stone treatment on the front of the structure. Mr. Grittman clarified that the structure's siding will need to match that of the principal building on site, which the applicant stated they intend to do. However, the brick or stone standard in the Zoning Ordinance is only for accessory structures that can be seen from the street. With the proposed structure being in the rear yard, that standard would not apply in this case. Consideration of a Conditional Use Permit for Home Occupation for Manufacturing which requires equipment other than that which is typically found in a dwelling, and Use of an Accessory Building for said Home Occupation, which includes sales, in the R-1, Single-family Residential District Applicant: Tyler Berg Mr. Grittman provided an overview of the agenda to the Planning Commission and the public. A permitted accessory use in residential districts, the applicant applied for a Conditional Use Permit for home occupation. Home occupations are predominantly established through an administrative permitting process, provided the applicant can meet the standards established in the Zoning Ordinance. When those standards cannot be met per the requested home occupation, a Conditional Use Permit is required to be obtained. The applicant needed flexibility allowed under the Conditional Use Permit to operate a portion of the home occupation in an accessory building, also to be able to use equipment not typically found within a home. Mr. Grittman noted the equipment not typically found in a home that the applicant proposed to use is a 3-D printer, that would make certain parts of firearms, which would then be assembled on site. Mr. Tapper asked if there is a maximum number of employees the applicant would be allowed to have, or if the Planning Commission should consider setting a limit. Mr. Grittman clarified that the applicant noted in his narrative that he would be the sole employee of the business. If he were to add any employees, it would require an amendment to the requested Conditional Use Permit. Mr. Konsor opened the public hearing portion of the agenda item. Applicant Tyler Berg, 1713 Broadway St., addressed the Planning Commission and the public, and noted he was available for any questions. Councilmember Gabler asked Mr. Berg how loud the 3-D printer is. Mr. Berg clarified that the 3-D printer is roughly as loud as a standard dishwasher. Councilmember Gabler asked if there was a need to adjust the electrical feed to the home to be able to power the 3-D printer. Mr. Berg clarified that the 3-D printer runs on a standards home outlet (110 volts). Mr. Konsor asked how long the 3-D printer takes to make something. Mr. Berg said that the firearm components he is proposing to make with the 3-D printer take between 18-20 hours. Jane Theiler, 102 Hillcrest Circle, asked the applicant how many firearms would be stored on site related to the proposed home occupation. Mr. Berg said the maximum number of firearms related to the proposed home occupation that he can keep in possession is 5 due to storage capacity, but does not plan to hold firearms that have not already been ordered by a customer. Daryl Tindle, 1707 W. River St., mentioned he wrote the public comment submitted by email, and noted he is in support of the request made by the applicant, so long as business is conducted as written in the application narrative. Mr. Berg also mentioned that the materials used in the 3-D printer do not release any polymers, as the 3-D printer does not heat up the material enough to do so. Consideration of an Amendment to the Monticello 2040 Vision + Plan (Comprehensive Plan), Chapter 3, "Land Use, Growth and Orderly Annexation", amendine the text of the Plan to add flexibilitv for implementation of the Plan's goals and land use objectives for Industrial designations Applicant: City of Monticello Ms. Schumann provided an overview of the agenda item to the Planning Commission and the public. Over the previous few months, Planning Commissioners and City staff held workshops to review Chapter 3 of the Monticello 2040 Vision + Plan (Comp Plan). This item stemmed from two recent public hearings the Planning Commission held related to land use designations of certain industrial -zoned property in Monticello. These amendments directly related to the goals and objectives of the industrial zoning districts within the City, as well as the land slated for industrial uses in the "Future Land Use Map" in Chapter 3 of the Comp Plan. Mr. Konsor asked what the lot pattern example will be changed to for the employment campus designation page (page 80). Ms. Schumann clarified that the proposed lot pattern example is UMC, Inc.'s two parcels along Chelsea Road. Mr. Konsor asked if these proposed amendments include any map amendments to the existing future land use map in Chapter 3 of the Comp Plan. Ms. Schumann clarified that there are no proposed amendments to the future land use map. Mr. Konsor opened the public hearing portion of the agenda item. Deadline for Decision: August 7th, 2023 (60 -day deadline) October 6th, 2023 (120 -day deadline) Land Use Designation: Community Commercial Zoning Designation: B-4, Regional Business 1 Planning Commission Agenda - 07/05/2023 Overlays/Environmental Regulations Applicable: NA Current Site Uses: Quick -service restaurant with drive-through Surrounding Land Uses: North: Commercial -Restaurant East: Highway 25/Mixed Commercial South: Commercial -Restaurant West: Vacant Commercial Project Description: The applicant operates a quick -service restaurant with indoor ordering and sit-down service, as well as a drive-through lane with an order board for off-site consumption. The original CUP for the drive-through restaurant was issued in 2003. ANALYSIS Zoning. The subject site is zoned B-4, Regional Business. Within B-4 districts, drive-through facilities are allowed by conditional use permit. The original drive-through facility was also reviewed and approved by CUP. Substantive changes to the layout or function of this aspect of the site use requires an amendment to the CUP, which is treated as processed in the same manner as a new Conditional Use Permit. Setbacks. The B-4 District imposes specific building setbacks within the district at 6'. As the 6' requirement is a building or structure setback, the City has commonly allowed parking and drive -aisles to encroach into the required 6' yard area. The drive-through bypass lane would encroach into the 6' yard and existing drainage and utility easement on the south property line, which requires an encroachment agreement with the City. This encroachment is discussed in more detail as a part of the landscaping discussion below. Drive -Through Design. The current condition provides just one permanent drive-through lane and order board, although the applicant has occasionally created a second order lane during peak use. The amendment would reconfigure the curb line to shift one order lane toward the building, create an island which would contain the second menu board and lane, and then add a bypass lane that loops south of the two drive-through lanes and around the building. This improves the temporary configuration in that as now configured, easterly bound drive-through traffic is encouraged to back up into the parking lot and interfere with what would be westbound exiting traffic. The new design shifts the entrance to all drive-through traffic to align with the typical traffic patterns. 2 Planning Commission Agenda - 07/05/2023 It also avoids the temporary nature of the additional drive-through facility, clarifying access and use of the facility as a permanent feature of the site. Two-lane drive-through facilities are becoming more common for these types of restaurants, a change that began as an interim accommodation during the Covid pandemic months. This new configuration would eliminate the current trash enclosure and shift it to the parking lot, discussed separately below. The applicant has also provided a detailed set of specifications on the dimensions for the new lanes and menu boards, as well as the structures used to support the use. The menu boards are not considered signs, since they do not provide communication to the traveling public. Other Elements. Two other aspects of the site use are impacted by the revisions to the drive- through, each discussed separately below. Landscaping. The applicant has incorporated a landscaping plan with extensive plantings in the affected area, including a variety of deciduous and evergreen shrubs, as well as perennial grasses and flowering underplantings. The City's regulations require a common setback of 6' to accommodate both the required drainage and utility easements, and to provide a green space for planting. The proposed improvements narrow the dimension between the new southerly curb line and the property line, where the drive-through lanes (and bypass lane) have squeezed the dimension between curb and property line to a very narrow area. The space does not appear to be dimensioned on the civil plans or other details, but the applicant has indicated that it is approximately 4.5'. The adjoining property (Applebee's) appears to maintain the required space south of the common property line, with a line of trees in this space on the Applebees side of the property line. While drive -aisle encroachments into the 6' setback area are possible, staff would recommend some revision of the plan to slightly increase this width of this area, creating a more plantable and maintainable space. A line of shrubs would supplement the existing landscape and help create a barrier that better addresses the narrowed green space. Trash Enclosure. As noted above, the trash enclosure is proposed to be relocated from its current space adjoining the building (where the revised drive-through would now be constructed) to a space in the parking lot nearest the main entrance from Deegan Avenue NE. The location as proposed raises two concerns. First is the prominence of the enclosure, which would be the most visible location on the property. The City allows detached enclosures, but this location would be effectively in the "front yard" of the site. Further, as designed, the gates face the street. Unfortunately, many of these facilities can be difficult to maintain, particularly during winter weather, which would leave the trash areas visibly exposed to Planning Commission Agenda - 07/05/2023 entering traffic. Moreover, by moving the enclosure farther away from the service door, staff will have to negotiate two lanes of parking and drive aisles to use the trash facilities. Staff recommends relocating the enclosure to another position on the site that is much less prominent, providing better access to maintenance staff, and minimizing the view of the structure. A portion of the parking area nearer the building would be a better location in this regard, even though it would occupy closer parking spaces. Conditional Use Permit Criteria. Approval of a conditional use permit application requires that the City find that conditions can be established to ensure that all the following criteria will always be met: (ii) The conditional use will not substantially diminish or impair property values within the immediate vicinity of the subject property. Staff Comment: Attending to the concerns noted in the report, including landscape screening and trash enclosure location would avoid the likelihood that property values would be affected by the change. (ii) The conditional use will not be detrimental to the health, safety, morals, or welfare of persons residing or working near the use. Staff Comment: The drive-through will not endanger persons or property in the area and is anticipated to improve vehicle circulation within the site. (iii) The conditional use will not impede the normal and orderly development of surrounding property for permitted uses predominant in the area. Staff Comment: No access or development will be impacted by the proposed accessory building. (iv) The conditional use will not pose an undue burden on public utilities or roads, and adequate sanitary facilities are provided. Staff Comment: Construction of the revised drive-through facility is not expected to have an impact on utilities or roads. (v) The conditional use can provide adequate parking and loading spaces, and all storage on the site can be done in conformance with City Code requirements. Staff Comment: The primary concern in this regard is the trash handling issues raised by the expanded drive-through. (vii) The conditional use will not unnecessarily impact natural features such as woodlands, wetlands, and shorelines, and all erosion will be properly controlled. Staff Comment: No impacts to any natural features are expected with this project. ANY WELLS DISCOVERED ON SITE THAT WILL HAVE NO USE MUST BE PLUGGED BY A LICENSED WELL DRILLING CONTRACTOR IN A MANNER APPROVED BY ALL JURISDICTIONAL AGENCIES. CONTRACTOR SHALL BE RESPONSIBLE FOR OBTAINING ANY WELL ABANDONMENT PERMITS REQUIRED. 11. ANY WELL DISCOVERED DURING EARTH MOVING OR EXCAVATION SHALL BE REPORTED TO THE APPROPRIATE JURISDICTIONAL AGENCIES WITHIN 24 HOURS AFTER DISCOVERY IS MADE. 12. EROSION CONTROL MAINTENANCE ALL MEASURES STATED ON THE EROSION AND SEDIMENT CONTROL PLAN, AND IN THE STORM WATER POLLUTION PREVENTION PLAN, SHALL BE MAINTAINED IN FULLY FUNCTIONAL CONDITION AS REQUIRED BY ALL JURISDICTIONS UNTIL NO LONGER REQUIRED FOR A COMPLETED PHASE OF WORK OR FINAL STABILIZATION OF THE SITE. CONTRACTOR SHALL DENOTE ON PLAN THE TEMPORARY PARKING AND STORAGE AREA WHICH SHALL ALSO BE USED AS THE EQUIPMENT MAINTENANCE AND CLEANING AREA, EMPLOYEE PARKING AREA, AND AREA FOR LOCATING PORTABLE FACILITIES, OFFICE TRAILERS, AND TOILET FACILITIES. 8. ALL WASH WATER (CONCRETE TRUCKS, VEHICLE CLEANING, EQUIPMENT CLEANING, ETC.) SHALL BE DETAINED AND PROPERLY TREATED OR DISPOSED. 9. SUFFICIENT OIL AND GREASE ABSORBING MATERIALS AND FLOTATION BOOMS SHALL BE MAINTAINED ON SITE OR READILY AVAILABLE TO CONTAIN AND CLEAN-UP FUEL OR CHEMICAL SPILLS AND LEAKS. 10. THE CONTRACTOR SHALL BE RESPONSIBLE FOR DUST CONTROL ON SITE. THE USE OF MOTOR OILS AND OTHER PETROLEUM BASED OR TOXIC LIQUIDS FOR DUST SUPPRESSION OPERATIONS IS PROHIBITED. 11. RUBBISH, TRASH, GARBAGE, LITTER, OR OTHER SUCH MATERIALS SHALL BE DEPOSITED INTO SEALED CONTAINERS. MATERIALS SHALL BE PREVENTED FROM LEAVING THE PREMISES THROUGH THE ACTION OF WIND OR STORM WATER DISCHARGE INTO DRAINAGE DITCHES OR WATERS OF THE STATE. 12. ALL STORM WATER POLLUTION PREVENTION MEASURES PRESENTED ON THE PLAN SHALL BE INITIATED AS SOON AS IS PRACTICABLE. 13. ALL STAGING AREAS, STOCKPILES, SPOILS, ETC. SHALL BE LOCATED SUCH THAT THEY WILL NOT ADVERSELY AFFECT STORM WATER QUALITY. OTHERWISE, COVERING OR ENCIRCLING THESE AREAS WITH SOME PROTECTIVE MEASURE WILL BE NECESSARY. 14. CONTRACTOR SHALL BE RESPONSIBLE FOR RE-ESTABLISHING ANY EROSION CONTROL DEVICE WHICH THEY DISTURB. EACH CONTRACTOR SHALL NOTIFY THE OWNER'S REPRESENTATIVE OF ANY DEFICIENCIES IN THE ESTABLISHED EROSION CONTROL MEASURES THAT MAY LEAD TO UNAUTHORIZED DISCHARGE OR STORM WATER POLLUTION, SEDIMENTATION, OR OTHER POLLUTANTS. UNAUTHORIZED POLLUTANTS INCLUDE (BUT ARE NOT LIMITED TO) EXCESS CONCRETE DUMPING OR CONCRETE RESIDUE, PAINTS, SOLVENTS, GREASES, FUEL AND LUBRICANT OIL, PESTICIDES, AND ANY SOLID WASTE MATERIALS. 15. EROSION CONTROL DEVICES SHOWN ON THESE PLANS SHALL BE INSTALLED PRIOR TO THE START OF LAND -DISTURBING ACTIVITIES ON THE PROJECT. 16. ANY REVISIONS TO THE EROSION CONTROL PLAN MADE BY THE CONTRACTOR MUST BE APPROVED BY THE ENGINEER. 18. NOTE: THE SEQUENCE OF CONSTRUCTION SHOWN ABOVE IS A GENERAL OVERVIEW AND IS INTENDED TO CONVEY THE GENERAL CONCEPTS OF THE EROSION CONTROL DESIGN AND SHOULD NOT BE RELIED UPON FOR CONSTRUCTION PURPOSES. IN NO CASE SHALL ACCESSIBLE RAMP SLOPES EXCEED 1 VERTICAL TO 12 HORIZONTAL. IN NO CASE SHALL SIDEWALK CROSS SLOPES EXCEED 2%. IN NO CASE SHALL LONGITUDINAL SIDEWALK SLOPES EXCEED 5%. BACKFILL FOR UTILITY LINES SHALL BE PLACED PER DETAILS, STANDARDS, AND SPECIFICATIONS SO THAT THE UTILITY WILL BE STABLE. WHERE UTILITY LINES CROSS THE PARKING LOT, THE TOP 6 INCHES SHALL BE COMPACTED SIMILARLY TO THE REMAINDER OF THE LOT. UTILITY DITCHES SHALL BE VISUALLY INSPECTED DURING THE EXCAVATION PROCESS TO ENSURE THAT UNDESIRABLE FILL IS NOT USED. 6. CONTRACTOR IS RESPONSIBLE FOR THE REMOVAL AND REPLACEMENT OF 4" OF TOPSOIL AT COMPLETION OF WORK. ALL UNPAVED AREAS IN EXISTING RIGHTS-OF-WAY DISTURBED BY CONSTRUCTION SHALL BE REGRADED AND SODDED. 7. AFTER PLACEMENT OF SUBGRADE AND PRIOR TO PLACEMENT OF PAVEMENT, CONTRACTOR SHALL TEST AND OBSERVE PAVEMENT AREAS FOR EVIDENCE OF PONDING. ALL AREAS SHALL ADEQUATELY DRAIN TOWARDS THE INTENDED STRUCTURE TO CONVEY STORM RUNOFF. CONTRACTOR SHALL IMMEDIATELY NOTIFY OWNER AND ENGINEER IF ANY DISCREPANCIES ARE DISCOVERED. 8. WHERE EXISTING PAVEMENT IS INDICATED TO BE REMOVED AND REPLACED, THE CONTRACTOR SHALL SAW CUT FULL DEPTH FOR A SMOOTH AND STRAIGHT JOINT AND REPLACE THE PAVEMENT WITH THE SAME TYPE AND DEPTH OF MATERIAL AS EXISTING OR AS INDICATED. 9. THE CONTRACTOR SHALL INSTALL PROTECTION OVER ALL DRAINAGE STRUCTURES FOR THE DURATION OF CONSTRUCTION AND UNTIL ACCEPTANCE OF THE PROJECT BY THE OWNER. ALL DRAINAGE STRUCTURES SHALL BE CLEANED OF DEBRIS AS REQUIRED DURING AND AT THE END OF CONSTRUCTION TO PROVIDE POSITIVE DRAINAGE FLOWS. 10. IF DEWATERING IS REQUIRED, THE CONTRACTOR SHALL OBTAIN ANY APPLICABLE REQUIRED PERMITS. THE CONTRACTOR IS TO COORDINATE WITH THE OWNER AND THE DESIGN ENGINEER PRIOR TO ANY EXCAVATION. 11. FIELD DENSITY TESTS SHALL BE TAKEN AT INTERVALS IN ACCORDANCE WITH THE LOCAL JURISDICTIONAL AGENCY OR TO MN/DOT STANDARDS. IN THE EVENT THAT THE CONTRACT DOCUMENTS AND THE JURISDICTIONAL AGENCY REQUIREMENTS ARE NOT IN AGREEMENT, THE MOST STRINGENT SHALL GOVERN. 12. ALL SLOPES AND AREAS DISTURBED BY CONSTRUCTION SHALL BE GRADED AS PER PLANS. THE AREAS SHALL THEN BE SODDED OR SEEDED AS SPECIFIED IN THE PLANS, FERTILIZED, MULCHED, WATERED AND MAINTAINED UNTIL HARDY GRASS GROWTH IS ESTABLISHED IN ALL AREAS. ANY AREAS DISTURBED FOR ANY REASON PRIOR TO FINAL ACCEPTANCE OF THE JOB SHALL BE CORRECTED BY THE CONTRACTOR AT NO ADDITIONAL COST TO THE OWNER. ALL EARTHEN AREAS WILL BE SODDED OR SEEDED AND MULCHED AS SHOWN ON THE LANDSCAPING PLAN. 13. THE CONTRACTOR SHALL BE RESPONSIBLE FOR THE CONTROL OF DUST AND DIRT RISING AND SCATTERING IN THE AIR DURING CONSTRUCTION AND SHALL PROVIDE WATER SPRINKLING OR OTHER SUITABLE METHODS OF CONTROL. THE CONTRACTOR SHALL COMPLY WITH ALL GOVERNING REGULATIONS PERTAINING TO ENVIRONMENTAL PROTECTION. 14. SOD, WHERE CALLED FOR, MUST BE INSTALLED AND MAINTAINED ON EXPOSED SLOPES WITHIN 48 HOURS OF COMPLETING FINAL GRADING, AND AT ANY OTHER TIME AS NECESSARY, TO PREVENT EROSION, SEDIMENTATION OR TURBID DISCHARGES. 15. THE CONTRACTOR SHALL ENSURE THAT LANDSCAPE ISLAND PLANTING AREAS AND OTHER PLANTING AREAS ARE NOT COMPACTED AND DO NOT CONTAIN ROAD BASE MATERIALS. THE CONTRACTOR SHALL ALSO EXCAVATE AND REMOVE ALL UNDESIRABLE MATERIAL FROM ALL AREAS ON THE SITE TO BE PLANTED AND PROPERLY DISPOSED OF IN A LEGAL MANNER. 16. THE CONTRACTOR SHALL INSTALL ALL UNDERGROUND STORM WATER PIPING PER MANUFACTURER'S RECOMMENDATIONS AND MN/DOT SPECIFICATION. 17. ALL CONCRETE/ASPHALT SHALL BE INSTALLED PER GEOTECH REPORT, CITY OF MONTICELLO AND MN/DOT SPECIFICATIONS. 18. SPOT ELEVATIONS ARE TO FLOWLINE OF CURB UNLESS OTHERWISE NOTED. 19. LIMITS OF CONSTRUCTION ARE TO THE PROPERTY LINE UNLESS OTHERWISE SPECIFIED ON THE PLAN. 20. IMMEDIATELY REPORT TO THE OWNER ANY DISCREPANCIES FOUND BETWEEN ACTUAL FIELD CONDITIONS AND CONSTRUCTION DOCUMENTS. 21.
