Planning Commission Resolution 2024-38 (Zoning Amendment Enforcement)CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA PLANNING COMMISSION RESOLUTION NO. PC 2024-38 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MONTICELLO RECOMMENDING APPROVAL OF AN AMENDMENT TO THE ZONING ORDINANCE MODIFYING THE PROCESS FOR REZONING OF MULTI -PHASED PLANNED UNIT DEVELOPMENT PROJECTS WHEREAS, the City regulates land use through its development regulations, including zoning ordinances which include enforcement provisions to ensure compliance and obtain corrections to ensure the health, safety and welfare of the community; and WHEREAS, the City Code related to processing of violations of the zoning ordinance requires amendment to pursue more timely voluntary correction and an effective process for legal action for repeat violations of the zoning ordinance; and WHEREAS, the City finds that the best interests of the City's land use goals and objectives would be best served by amending the current Code; and WHEREAS, the Planning Commission has reviewed the amendments modifying the applicable ordinances and their effect on the City's land use plans and policies; and WHEREAS, the Planning Commission held a public hearing on September 3, 2024 on the application and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution the following Findings of Fact in relation to the recommendation of approval: 1. The current ordinance creates unnecessary delay in the prompt voluntary resolution of ordinance violations and limits the City's ability to effectively enforce the ordinance for repeated violations. 2. The proposed amendments create a reasonable process for the City in seeking compliance with the zoning ordinances. 3. The proposed amendment details meet the intent and requirements of the applicable zoning regulations, and are consistent with the applicable land use policies and ordinances. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Monticello, Minnesota that the Planning Commission recommends to the City Council that the proposed zoning amendments in Ordinance No. 2024- approved, based on the findings noted herein. ADOPTED this 3rd day of September, 2024 by the Planning Commission of the City of Monticello, Minnesota.
