RESOLUTION NO. 2024-25
A RESOLUTION APPROVING
AN AMENDMENT TO THE COUNTRY CLUB MANOR SECOND ADDITION PLANNED UNIT
DEVELOPMENT DISTRICT
WHEREAS, the applicant is seeking a replatting of a parcel currently subject to a Planned
Unit Development District known as the Country Club Manor 2nd Addition PUD District; and
WHEREAS, the proposed plat modifies the original PUD to replace a multi -family
structure with development opportunities for up to 22 twinhome units in 11 buildings, and a
new public street, all under the requirements of a Planned Unit Development; and
WHEREAS, the site is subject to a concurrent request for replatting which would
establish said lots, public street, and associated easements; and
WHEREAS, the proposed PUD District amendment makes appropriate revisions to the
current Zoning District language; and
WHEREAS, the platted lots will be consistent with requirements of the City's Subdivision
and Zoning Ordinance requirements under the appropriate PUD standards; and
WHEREAS, the subject property will be developed under the requirements of the
Monticello Comprehensive Plan, which designate the land use for the property as Mixed
Density Residential; and
WHEREAS, the Planning Commission has reviewed the application for the zoning district
ordinance pursuant to the regulations of the applicable ordinances and land use plans and
policies; and
WHEREAS, the Planning Commission held a public hearing on March 4t", 2024 on the
application and the applicant and members of the public were provided the opportunity to
present information to the Planning Commission; and
WHEREAS, the Planning Commission has recommended approval of the amendment to
the Country Club Manor Second Addition Planned Unit Development District, and
WHEREAS, the City Council has considered all of the comments of the Planning
Commission, the public, and the staff report, which are incorporated by reference into the
resolution, and

WHEREAS, the City Council of the City of Monticello makes the following Findings of Fact in
relation to the approval for Amendment to PUD:
1. The proposed ordinance amendment to the PUD accommodates uses which are
consistent with the intent and purpose of the original R-3, Medium Density Residential
District, the Country Club Manor Second Addition Planned Unit Development District as
adopted.
2. The proposed ordinance accommodates uses that will be consistent with the existing
and future land uses in the area in which they are located, including the Monticello
Comprehensive Plan.
3. The impacts of the improvements are those anticipated by the existing and future land
uses and are addressed through standard review and ordinances as adopted.
4. The proposed access and development details meet the intent and requirements of the
applicable zoning regulations under this revised zoning district and are consistent with
the applicable land use policies and ordinances.
5. The proposed ordinance is not anticipated to create development that would negatively
impact surrounding residential properties, and instead is expected to encourage long
term affordable residential uses on the subject property.
6. Approval of the ordinance, and its associated plat and PUD plans, will not result in the
need for additional road or utility infrastructure other than that being provided for the
proposed use, and should not otherwise negatively impact the health or safety of the
community.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota
that the Monticello City Council approves the Amendment to PUD for Country Club Manor
Second Addition subject to the conditions of Exhibit Z of the staff report, as follows:
1. Finalize the building arrangements on the final plat to avoid the clustered driveways at
the end of the cul-de-sac and revision of the preliminary plat accordingly.
2. The setbacks for all buildings are required to meet or exceed the originally approved 25-
foot setback from right of way line to building wall.
3. All architectural and landscaping plan elements required of the first phase 60-unit
County Club Manor Second Addition PUD project are incorporated into the Fourth
Addition.
4. Building separations are maintained at a minimum of 12 feet from the closest projection
of any above -grade element of the buildings, including eaves.
5. Maintain the sidewalk along the north side of the new street.

6. The applicant will provide a final landscaping plan, including unit foundation planting,
for the project area, based on the final PUD and plat layout.
7. The applicant will verify that the full structure, including patio and footings will be
included in the final lot boundary as a condition of approval.
8. Coordination with, and approval of, other City agencies (including the EDA) related to
public financing assistance and other aspects of the project.
9. The governing PUD Zoning Ordinance is written to require the formation and funding of
a Homeowners Association, or similar structure and documentation, to manage
common property and provide common maintenance in a form to be approved by the
City.
10. Prior to any individual lot sale, a Homeowners Association shall be established providing
for access to the public street and sidewalk, common ownership of Lot 23, Block 1, and
the management and maintenance of common property and easements in a form to be
approved by the City.
11. The development is constructed in accordance with the terms and conditions identified
in the adopted PUD Zoning Ordinance for Country Club Manor Second, Third, and
Fourth Additions, in addition to those conditions identified in this Exhibit Z.
12. The applicant executes any requested revisions to the governing development
agreement necessary to effectuate the revisions approved as a part of these
applications.
13. Comments and recommendations of the City Engineer in their report dated February 29,
2024, March 20, 2024, including those comments related to environmental review and
remediation, and the comments of Wright County and MnDOT.
14. Comments and recommendations of other Staff and Planning Commission.
