CITY OF MONTICELLO, WRIGHT COUNTY, MINNESOTA
RESOLUTION FOR ORDERLY
ANNEXATION OF LAND TO THE CITY OF MONTICELLO
WHEREAS, Monticello Township ("Township") and the City of Monticello ("City") have
entered into an orderly annexation agreement dated June 21, 2004, as amended June of 2005,
and filed and identified by Minnesota Department of Administration File No. OA-1061
("Agreement"); and
WHEREAS, that Agreement provides that if the terms and conditions have been met as
contained in the Agreement, the Township shall not object to an annexation initiated by the City
filing an Annexation Resolution with the Department of Administration; and
WHEREAS, the Agreement states, in part, that no consideration by the Department of
Administration, or its successor agency, is necessary, and that all terms and conditions for
annexation are provided in the Agreement;
WHEREAS, the Agreement designates, in part, pursuant to Paragraph 13, No Hearing
Required, that the City shall provide to Township a written notice of annexation and this
Annexation Resolution, and the Department of Administration may review and comment within
thirty days of receipt of this Annexation Resolution and the Agreement and order the annexation
of the area designated in this Annexation Resolution in accordance with the Agreement.
WHEREAS, the Agreement designates, in part, the area described in the attached Exhibit
A as in need of orderly annexation ("Land"); and
WHEREAS, upon annexation of the Land, the City shall reimburse the Township for the
loss of taxes from the property so annexed, as outlined in Paragraph 6, Tax Reimbursement, of
the Agreement;
WHEREAS, other than the payment of taxes, the necessary criteria for annexation of the
Land pursuant to the Agreement have been met.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Monticello that the
Land is hereby annexed into the City. Annexation is conditioned on the Land connecting to City
municipal services.
ADOPTED this 25t" day of November, 2024, by the City Council of the City of
Monticello.

Exhibit A
Legal Description of the Land
The North Half of the Southwest Quarter (N1/2 of SW1/4) and the Southeast Quarter of the
Northwest Quarter (SE1/4 of NW1/4) of Section Eighteen (18), Township One Hundred Twenty -
One (121), Range Twenty-four (24), lying Northeasterly of the Northeast right of way line of
Wright County Highway No. 75, and lying Southwesterly of the Southwesterly right of way line
of Interstate No. 941 according to the U.S. Government survey thereof, Wright County,
Minnesota.
LESS AND EXCEPT
That part of the Northeast Quarter of the Southwest Quarter and the Southeast Quarter of the
Northwest Quarter of Section 18, Township 121 North, Range 24 West, Wright County,
Minnesota, lying northeasterly of the northeasterly right of way line of Wright County Highway
No. 75, and southwesterly of the southwesterly right of way line of Trunk Highway No. 94, as
both highways are now located and established, which lies northerly of Line 1 described below:
Line 1: Commencing at the west quarter corner of said Section 18; thence easterly on an
azimuth of 90 degrees 59 minutes 00 seconds along the east and west quarter line thereof for
1834.62 feet; thence on an azimuth of 283 degrees 42 minutes 55 seconds for 269.43 feet;
thence on an azimuth of 284 degrees 47 minutes 29 seconds for 155.30 feet to said
northeasterly right of way line and the point of beginning of Line 1 to be described; thence on
an azimuth of 104 degrees 47 minutes 29 seconds for 155.30 feet, thence on an azimuth of 103
degrees 42 minutes 55 seconds for 269.43 feet to said east and west quarter line of Section 18;
thence continue on an azimuth of 103 degrees 42 minutes 55 seconds for 21.64 feet; thence on
an azimuth of 110 degrees 03 minutes 15 seconds for 295.91 feet to said southwesterly right of
way line and there terminating.

All that part of the West Half of the Southeast Quarter of Section 18, Township 121, Range 24,
lying Northeasterly of the Burlington Northern Railway Right of Way and Southwesterly of
Interstate 94, Wright County, Minnesota.
LESS AND EXCEPT
That part of the Northwest Quarter of the Southeast Quarter of Section 18, Township 121
North, Range 24 West, lying northeasterly of the railway right of way (now BNSF Railway),
which lies southwesterly of a line run parallel with and distant 200 feet northeasterly
(measured at right angles) of the Great Northern Railway Company's (now BNSF Railway) main
track centerline, as located and established prior to January 1, 1954, and northwesterly of Line

Line 1: Commencing at a point on the east line of Section 19, Township 121 North, Range 24
West, distant 310.2 feet south of the northeast corner thereof; thence northwesterly at an
angle of 52 degrees 35 minutes from said east line (measured from north to west) for 128.4
feet; thence deflect to the right at an angle of 02 degrees 40 minutes for 1849.3 feet; thence
deflect to the right at an angle of 14 degrees 25 minutes for 1089 feet to the point of beginning
of Line 1 to be described; thence deflect to the left at a right angle for 600 feet and there
terminating.
ALSO LESS AND EXCEPT
That part of the westerly 600 feet of the southerly 500 feet of the Northwest Quarter of the
Southeast Quarter (NW1/4 SE1/4) of Section 18, Township 121 North, Range 24 West, lying
northeasterly of the right of way of the Burlington Northern Inc., except that part taken for
highway purposes; which lies southeasterly of the following described line: From a point on the
east line of Section 19, Township 121 North, Range 24 West, distant 310.2 feet south of the
northeast corner thereof, run northwesterly at an angle of 52 degrees 35 minutes with said east
section line for 128.4 feet; thence deflect to the right at an angle of 2 degrees 40 minutes for
1849.3 feet; thence deflect to the right at an angle of 14 degrees 25 minutes for 1089 feet to
the point of beginning of the line to be described; thence deflect to the left at an angle of 90
degrees for 400 feet and there terminating.
