City Council Resolution 2024-115and CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA CITY COUNCIL RESOLUTION NO. 2024-115 A RESOLUTION APPROVING A FINAL PLAT OF BROADWAY PLAZA WHEREAS, the applicant is seeking a final plat of a parcel of currently undeveloped land; WHEREAS, the proposed plat would incorporate development opportunity for mixed commercial/hospitality uses as an allowed use in the proposed Broadway Plaza Planned Unit Development zoning district; and WHEREAS, the plat creates two development parcels, dedication of public easements, and utilizes existing right of way related to public streets along with drainage and utilities; and WHEREAS, the platted parcels will be consistent with requirements of the City's Subdivision and Zoning Ordinance requirements under the appropriate PUD standards; and WHEREAS, the subject property will be developed under the requirements of the Monticello Comprehensive Plan, which designate the land use for the property as Employment Campus uses; and WHEREAS, the proposed final plat shows two development parcels, upon which the existing and proposed buildings will be located, as well as other improvements; and WHEREAS, the Planning Commission reviewed the application for the preliminary plat pursuant to the regulations of the applicable ordinances and land use plans and policies; and WHEREAS, the Planning Commission held a public hearing on July 2, 2024 on the preliminary plat application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission recommended approval of the preliminary plat of Broadway Plaza and the City Council has approved the Preliminary Plat for Broadway Plaza; and WHEREAS, the City Council considered all of the comments of the Planning Commission, the public, and the staff report as it relates to the review of the final plat, which are incorporated by reference into the resolution, and WHEREAS, the City Council of the City of Monticello makes the following Findings of Fact in relation to the approval for the Final Plat of Broadway Plaza: CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA CITY COUNCIL RESOLUTION NO. 2024-115 1. The final plat as proposed is consistent with the approved preliminary plat for Broadway Plaza. 2. The proposed uses are consistent with the intent and purpose of the PUD, Planned Unit Development District. 3. The proposed uses will be consistent with the existing and future land uses in the area in which they are located, including the Monticello Comprehensive Plan. 4. The impacts of the improvements are those anticipated by the existing and future land uses and are addressed through standard review and ordinances as adopted. 5. The proposed plat accommodates additional public and private improvements, including pedestrian facilities, utilities, and stormwater controls that ensure the project will continue to be consistent with the City's long-term public service infrastructure. 6. The proposed plat accommodates reasonable extensions of development and infrastructure to serve other undeveloped property in the area. 7. The proposed access and development details, as supplemented in further submissions, meet the intent and requirements of the applicable zoning regulations. 8. As a property with high visibility and exposure but separate major roadway access, the proposed plat is not anticipated to negatively impact surrounding residential properties. 9. Approval of the plat will not result in the need for additional road or utility infrastructure other than that being provided by and for the proposed use and should not otherwise negatively impact the health or safety of the community. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota that the Monticello City Council approves the Final Plat for Broadway Plaza, subject to the conditions of Exhibit Z of the staff report, as follows: 1. No project zoning, subdivision, or environmental approvals granted under this process are final until the property is annexed into the City of Monticello. 2. Annexation of the area to be platted as Broadway Plaza is contingent on the approval of the final plat, final stage PUD and rezoning to PUD for Broadway Plaza. 3. No permits shall be issued, nor shall any approvals or documents recorded, until the property is annexed to the City of Monticello. CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA CITY COUNCIL RESOLUTION NO. 2024-115 4. No development granted under this PUD shall be permitted until final approvals and requirements of the wetland mitigation are completed and found to be compliant. 5. As a single-phase project, the development agreement shall be signed, all securities shall be provided, and all building permits shall be granted concurrently, or in succession beginning with the Hotel -Restaurant -Event Center on Lot 2, Block 1. 6. All buildings within the PUD shall be connected to public utilities. 7. No expansion of the existing building on the site may commence until commencement of construction consistent with the PUD approvals on Lot 2, Block 1. Improvements shall be per the plans submitted for the November 25, 2024, consideration. 8. No permits for development within the plat shall be issued until the development agreement and all securities are in place. 9. Uses allowed in the PUD are those proposed by the applicant's narrative and expressed on the approved site plan, and include Hotel, Event Center, Full - service Restaurant, Museum, and Private Storage, each use assigned to the appropriate building on the approved plans. Changes in any use shall require an amendment to the PUD, according to the terms of the Zoning Ordinance for such amendments. 10. No outdoor storage or display of any type is permitted in the PUD. 11. Site landscaping plans shall be included for the November 25, 2024, Final Stage PUD consideration, including the Development Stage landscaping plan as enhanced and modified by the Final Stage PUD Plans. 12. Signage plans shall be as submitted with the Final Stage PUD plans and narrative for November 25, 2024, consideration and shall not include pylon signage within the PUD. 13. Execution and recording of the development contract and a stormwater maintenance agreement. 14. Compliance with the terms of the City's Engineering Staff letter dated November 20, 2024, and including a requirement to obtain necessary BNSF permits. Compliance with the terms of the Chief Building Official's letter dated June 20, 2024, and including a requirement to obtain necessary BNSF permits or licenses. 16. Comments and recommendations of other Staff and City Council. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA, that the document titled "Development Contract for Broadway Plaza" with assignment of the specific terms and conditions for public improvements and the specific terms and conditions for plat development, is hereby approved.
