City Council Ordinance 837ORDINANCE NO. 837 CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA AN ORDINANCE ENACTING MONTICELLO CITY CODE TITLE XI — BUSINESS REGULATIONS, CHAPTER 118 — CANNABIS BUSINESS REGULATIONS THE CITY COUNCIL OF THE CITY OF MONTICELLO, MINNESOTA, HEREBY ORDAINS: SECTION 1. Chapter 118, Cannabis Business Regulations is hereby enacted to read as follows: § 118.01 Purpose. The City of Monticello (hereinafter "City") makes the following legislative findings: The purpose of this ordinance is to implement the provisions of Minnesota Statutes, chapter 342, which authorizes the City to protect the public health, safety, welfare of City residents by regulating cannabis businesses within the legal boundaries of City. § 118.02 Definitions. Unless otherwise noted, terms used herein are defined as in Minn. Stat. § 342.01 and the rules promulgated pursuant to Minnesota Statutes Chapter 342, as amended. For the purposes of this Chapter, the following terms have the meanings given them: (a) Registered Retailer: any cannabis retailer, cannabis microbusinesses with retail endorsement, cannabis mezzobusiness with retail endorsement, medical cannabis retailer, medical cannabis combination business, or lower -potency hemp edible retailer. § 118.03 Registration Required. (A) No individual or entity may operate a Registered Retailer within the City without first being issued a retail registration by Wright County. (B) No registration shall be issued to a Registered Business unless there is an available registration for the business under Section 118.06 and the Registered Business complies with all requirements of City code zoning code, including the requirements of § 153.091(A)(4)(c), as well as the adopted building and fire codes. (C) Any Registered Business that sells to a customer or patient without valid retail registration shall incur a civil penalty of $2,000 for each violation. § 118.04 Consent to Inspection. All Registered Businesses shall consent to inspection for compliance with state law and the City code at any point during business hours, with or without advance notice. Pursuant to Minn. Stat. § 342.22, the County shall conduct at least one unannounced compliance check per year per Registered Business. 2332720 ORDINANCE NO.837 § 118.05 Registration Procedure. All Registered Businesses shall follow the registration procedure, including paying any applicable fees, as set by Wright County. § 118.06 Limiting of Registrations. (A) There shall be no more than 2 registered cannabis retailers, cannabis microbusinesses with a retail endorsement, or cannabis mezzobusinesses with a retail endorsement operating within the City at any time. (B) Notwithstanding (A), no additional cannabis retailers, cannabis microbusinesses with a retail endorsement, or cannabis mezzobusinesses with a retail endorsement may register to operate within the City if there is currently at least one (1) registered cannabis retailer, cannabis microbusiness with a retail endorsement, or cannabis mezzobusiness with a retail endorsement per 12,500 residents across Wright County. § 118.07 Registration Non -Transferable. Registrations shall be specific to the applicant and location registered, and shall not be transferred or relocated. Any registered business wishing to relocate shall be required to submit a new application for a registration for the new location from Wright County. SECTION 3. This ordinance shall be effective immediately upon its passage and publication. ADOPTED by the Monticello City Council this 251h day of November, 2024.
