Meeting called to order at 4:3 5 p.m. by Harvey Kendall -Chair 2. MOTION by Bob Murray to approve the February 27, 2003 regular meeting minutes as presented, SECOND by Richard Quick, MOTION PASSED 3. No items added to the agenda 4. Update Items: a. Youth Policies - Kitty Baltos relayed information about the first use of City of Monticello Ordinance enforcement on an individual skateboarding on the main sidewalk. Kitty received two phone calls from parents and an email from a youth regarding the ordinances. Deputy Leander from the High School informed Kitty that the news of the ordinances and their enforcement spread quickly around the Middle and High School. Thanks to Richard Quick for his help with this project. b. Financial review through February 2003 - Revenue was up for both January and February, memberships sold were about the same for January but up about 50 fro February, facility usage was up almost 2,000 for each month over last year. March is on track to match if not exceed March 2002 even though membership sales for March 2003 are slightly down. C. Kitty Baltos relayed two items of interest (1) that the Senior Center will honoring the Monticello Community Center staff for their assistance and willingness to volunteer and help the seniors, (2) the Minnesota Public Radio will be hosting a debate with Senators Dayton and Coleman sometime in mid April, Kitty will confirm the date with the Board. 5. Discussion on possible budget cuts to the community center budget for 2003 - Kitty Baltos provided information on some of the line items for the current budget and areas that she believe could be cut. a. Misc. Professional Services could be cut $7,000 that was put in for mural painting which ultimately paid for by the Land of Lakes Choirboys b. Conferences and Schools could be cut by $3,000 for Diamond Brite School that Brian Weldon, Maintenance Supervisor, was expected to attend, however, due to proprietary rights he will be unable to attend. C. Improvements included $9,000 to replace the iron filtration system that it now appears Wigen may be able to fix. The potential savings may be as high as $8,000 d. The planned tropical tree, lily pad walk and the float able toy for the pool have not yet been purchased, those budget items total $29,500. e. Kitty Baltos would like to upgrade the CSI Software that the community center uses. This is not a budgeted item and would cost up to $10,000. f. The board requested that Kitty bring back prioritized list to the next meeting for review. 6. Consideration of safety equipment change to not require knee pads in the skate and bike parks. Kitty Baltos informed that board of the continual battle to enforce the knee pad requirement in the parks. She spoke with the League of MN Cities and their Risk Assessment Lawyer said that she could not see that it would increase the cities liability to not enforce their use, however, they strongly recommend all safety equipment. MOTION by Tom Neumann to remove the mandatory knee pad policy along with ensuring that included in the Wheel Park waivers it states that the City of Monticello strongly recommends that use of all safety equipment, SECOND by Bob Murray, MOTION PASSED. 7. MOTION by Tom Neumann to adjourn the meeting at 5:50 p.m., SECOND by Bob Murray, MOTION PASSED meeting adjourned. (B) ROLLER SKATES/BLADES means a shoe with wheels attached or a device with wheels which is designated to be attached to a shoe. (C) SKATEBOARDS means a wheeled device designed to transport a rider in a standing position, which device is not otherwise secured to the rider's feet or shoes. (D) SCOOTER: A foot -operated vehicle consisting of a narrow board mounted between two wheels, tandem, with an upright steering handle attached to the front wheel. (E) OPERATE means to ride on or control the operation of a skateboard, roller skates/blades, or scooter. (F) OPERATOR means every person who operates or is in actual physical control of a skateboard, roller skates/blades, or scooter. 8-10-2: PROHIBITED AREAS: No person shall ride or use a skateboard, roller skates/blades, or scooter: (A) On any public sidewalk, street, or any public parking lot situated in the Central Business District in any careless, reckless, or negligent manner so as to endanger or be likely to endanger the safety of any person or property of any other person, or MUNTIGELLO CITY ORDINANCE TITLE VIII/Chpt 10/Page 1 (B) On any other public or private property of another without the express permission to do so by the owner or occupant of said property. or (C) On any state highNyav in the city of Monticello. 8-10-3: OBSERVATION OF RULES OF THE ROAD: (A) The operator of a skateboard. roller skates/blades. or scooter emerging, fi-om any alley. drive,,yay. or building upon approaching a sidewyalk or the sidewalk area extending across any allevxvay, shall yield the right-of-wav to all pedestrians approaching the sidewalk or sidewalk area and upon entering the roadway shall yield the m,ht-of-way to all vehicles approaching on the roadway-. (B) No person operating a skateboard. roller- skates/blades. or scooter shall attach the same or the person of the operator to any vehicle upon a roadNyay. (C) Every person operating a skateboard. roller skates/blades. or scooter upon a roadway shall ride as close as possible to the right-hand curb or edge of the roadway. (D) NO person shall use a skateboard, roller skates/blades. or scooter upon a public street, sidewalk. or other roadway after sunset and before sunrise. 8-10-4: VIOLATIONS: Any person who violates anv provision of this ordinance shall be guilty of a petty misdemeanor and upon conviction shall be punished not more than the maximum penalty as prescribed by state law. In addition. any peace officer who observes any person violate any provisions of this ordinance is authorized to seize the offender's roller skates/blades. skateboard. or scooter and to hold same at the �A`riuht COunty Sheriffs Department or Cite Police Department. In the event of such seizure. the offender. if an adult. may secure the return of the article seized after twenty-four (24) hours have elapsed since the seizure. In the case of a minor. the article seized shall be returned only to the parent or guardian of such minor offender after t%yenty-four (24) hours have elapsed since the seizure. All such detached structures shall be constructed of uniform building grade material. ?. All sides. roof. and floor shall be securely fastened to the interior frame of said detached structure. 3. All surfaces of such detached structures shall be stained. sealed. or painted. 4. Exterior metal surfaces shall be treated with materials designed to resist corrosion. 5. Structures that do not have slab floors shall have a rodent barrier- that extends 8 inches under the surface of the `round along the perimeter of the outside wall of the structure. 6. All such detached structures shall be permanently anchored to the ground. 7. StoraQe sheds erected after the adoption of the zoning ordinance shall meet district setback requirements. 8. Detached structures shall be erected in the side or rear yard of any residence. Obstructing pedestrian or vehicular traffic or otherwise causing an obstruction or interference with premises or rendering any premise dangerous for passage except in cases of emergency. 5. Failing or refusing to vacate or leave any premises after being requested or ordered, either orally, in writing, or by posted sign, to do so by the owner, agent, manager, or person in charge thereof, or by any law enforcement agent or official, and also the return at any time thereafter to any such premises after having been so requested or ordered to vacate or leave such premises. B. Petty Misdemeanors. Whoever commits any of the following acts is guilty of a petty misdemeanor and upon conviction shall be punished not more than the maximum penalty as prescribed by state law: (358. 1 /8/01) 1. Races the motor of any motor vehicle so as to cause unnecessary and unreasonable noise; 2. Causes, produces, or creates any unnecessary and unreasonable noise by shouting, mechanical means, the blowing of motor vehicle horns, or any other similar noise. 3. Using profane, abusive, indecent, or threatening language in public. 4. Occupies a standing motor vehicle in an area generally reserved for parking or occupies a standing motor vehicle while the vehicle is double parked. MONTICELLO COMMUNITY CENTER POLICY MANUAL 3. GENERAL GUIDELINES AND CONDUCT CODE A. Smoking The MCC is a smoke free and tobacco free building. Designated areas outside the building for smoking will be located outside of the Banquet Room and the Walnut Street entrance. There will be no tobacco allowed on the sun deck or around the wheel park area. B. Food and Beverage Area 1. No alcohol is allowed outside the Banquet Room or designated facility areas as reserved. 2 Red beverages are prohibited. This includes red wine, punches, or juices. 3. Food and beverage are only allowed in designated areas. No food or beverages will be allowed in the gymnasium, climbing wall, pit of skate park, or indoor child play area. C. Advertising and Solicitation Policies 1. General soliciting - No soliciting allowed on the MCC premises unless approved by the Community Center Management. 2. Banners and posters- All users must receive approval from the MCC management to hang banners, affix posters or other promotional materials in the facility. Only non-profit, community events may advertise on bulletin board. 3. Gallery - An organization or group may reserve the gallery area for art or display. This will be reserved in advance for a set time as determined by the MCC director. 4. Community Bulletin Board - Advertising community events may be displayed in a professional manner as approved by the Community Center Management. All approved flyers or material shall be submitted to the MCC Office for approval. Flyers will be posted by the MCC staff. The MCC Director will have the authority to remove any material not appropriate to the facility. D. Music Sound levels in and around the facility are required to be controlled and maintained at a level appropriate for the room size and respect to other areas. This includes bands, DJ's, portable stereos and other audio equipment. E. Dress Code 1. All users must wear a shirt and shoes in all areas except the pool, locker rooms and the Gymnasium. 2. Any user can be asked to leave if wearing offensive or inappropriate attire as determined by the MCC director or staff on duty. 3. Wet bathing suits will not be allowed out of the designated pool and concession area. F. Inappropriate Material or Language 1. Inappropriate material, clothing, behavior or language will not be allowed in the Community Center. a. This would be defined as any material, clothing, behavior or language that is racial, sexually explicit, displays of nudity or uses profane language. Page 17 MONTICELLO COMMUNITY CENTER POLICY MANUAL 3. GENERAL GUIDELINES AND CONDUCT CODE G. Conduct Code 1 MCC will enforce a zero tolerance policy against any type of weapons, drugs, violence, underage use or possession of alcohol or tobacco products. Violators will be removed from the premises and not allowed future access. Law violators will be reported to the Wright County Sheriff's Department. 2. All persons present at any activity on MCC property shall abide by the policies of the MCC. At their discretion, MCC staff or the acting security person may: a. Order removal of offender b. Revoke the permit and order all persons from the premise (without refund or any monetary compensation) C. Order immediate removal of all intoxicating liquor from the premises 3. Children under the age of 8 must be kept under the direct supervision of adults at all times and kept to the reserved areas. The City will not assume liability for unsupervised children. The parents or adult supervisors will be assessed any damage or additional cleaning for any costs incurred as a result of unsupervised youth. 4 Disorderly conduct will be grounds for immediate termination of the activity/event without a refund. This will be determined by staff or law enforcement agency. 5. MCC Loitering policy: Individuals or groups lingering at the Community Center for an unreasonable period of time who have not paid to use the facilities, are not using the "free"* areas, or in general appear to be lingering without purpose, will be asked to leave by the manager, supervisor or the custodian on duty. If the individual or group does not comply with the manager, supervisor or custodian, the Wright County Sheriff shall be called for assistance. Assistance from the Wright County Sheriff will also be requested for persons or groups who: 1. Conduct themselves in a disorderly manner as to disturb or threaten the public peace, engage in brawling or fighting or engage in offensive, obscene, or abusive language or in boisterous and noisy conduct tending unreasonably to arouse alarm, anger or resentment in others. 2. Lingering about the doorway, sitting or lingering upon the steps, window sills, railings, fence or parking area adjacent to the Community Center in such a manner as to obstruct or partially obstruct ingress to or egress from the building, appear to be threatening to users of employees of the Community Center, or in such a manner to annoy the occupants of the Community Center. *"Free" areas are the Warehouse teen center and the walk/jog track. 6. No profanity, violence, assaultive or abusive behavior or language will be tolerated. 7. No Bikes, in -line skates, or skateboarding except in wheel parks. H. Facility Phone Use 1. Emergency phones will be located around the facility with instructions on use. Page 18 MONTICELLO COMMUNITY CENTER POLICY MANUAL 2 MCC will page users over intercom, within reason, as long as it does not interfere with facility operations. 3. A courtesy phone will be available for free use at the main desk for paying customers of the Community Center. All others will be charged a .50 fee to use the phone. I. Misc. 1. Monticello Community Center is not responsible for personal valuables. 2. Users must comply with all city ordinance, Minnesota state statues, federal laws, building and fire codes. J. Complaint or comment procedure 1. There will be comment forms and drop -box available at the front desk. Each form will offer the option to receive a call back to the comment, complaint or suggestion. 2. All comments will be forwarded directly to MCC management for handling. 3. If the complaint is urgent and the director is available MCC staff will notify the Director immediately. 4. When appropriate, MCC will attempt to respond to complaints in oral or written form. Helmets must be worn on the head and buckled at all times that the individual is in the parks Profanity, abusive or derogatory language will not be tolerated in or around the wheel parks. Disregard for this policy will result in expulsion from the parks with no monetary reimbursement. Shirts must be worn while using the parks. The Community Center strongly recommends long pants also be worn. Paying customers ONLY will be allowed in the parks fenced area No roller blading, biking or skate boarding will be allowed on the Community Center's sidewalks or parking lots for the safety of all patrons of the Center. City of Monticello Ordinances will be enforced on this misdemeanor offense. Wheel park users will obey the rules of the Community Center, the Wheel Parks and the Wheel Park Attendants or they will be expelled from the Parks.
