Meeting called to order by Harvey Kendall at 4:35 p.m.
2. ITEM 7 moved up to first item: Consideration of allowing partnerships with businesses as
sponsors of departments of the Community Center and defining policies or parameter for such
ventures. Scott Ziessman, Fantastic Sams Owner, shared the idea that he approached Kitty Baltos
with; the Community Center would present a coupon for dollars off Fantastic Sam's services and
as they were turned into the business, Scott would pay a dollar for dollar donation to the
Community Center for their programming department. Mr. Ziessman noted that he has just begun
this program with the Elk River Park and Recreation Department, however, it is not a nationwide
Fantastic Sam's promotion. Kitty Baltos expressed concern about favoring one business over
another. Harvey Kendall expressed to Mr. Ziessman that we would not be able to promise
exclusive privileges to Fantastic Sam's if another business requested to do a similar promotion.
Sandra Theros questioned who's responsibility it would be to copy or print the coupons. Mr
Ziessman noted that the City would most likely be able to produce the coupons on a copier for
significantly cheaper than he can have them printed and said that he would gladly reimburse the
cost back to the City. MOTION by Bruce Thielen to run the program for six (6) months to enable
the Community Center to determine if there might be any problems or community concerns about
this practice and that Fantastic Sam's would not be promised exclusivity for this program,
SECOND by Richard Quick, MOTION PASSED.
3. Consideration of adding items to the agenda. Kitty Baltos added the February 2004 meeting
minutes for approval. She inadvertently left them off the agenda.
4. Presentation from Jeff O'Neill on the proposed movement of the Old Methodist Church to the
west end of the Community Center parking lot. Mr. O'Neill provided a brief history of the
Methodist Church;
a. it's been of the chopping block for a number of years
b. it is currently owned by Sunny Fresh Foods who is hoping to have it moved
C. it was built in 1957 and is on the National Registry, it will be torn down and lost if not
moved,
d. The Monticello Arts Board investigated the possibility of moving it and using it but
abandoned the idea due to funding shortages,
e. The Swan River Montessori School stepped forward with a proposal to have the building
moved and use the main portion of the church as an assembly area and build classrooms
around the church.
f. Mr. O'Neill felt that the proposal fit with the City's comprehensive plan, would be
available for rentals for the Community Center evenings and weekends with the revenue
going to MCC.
g. Bruce Thielen said that their were concerns expressed about the City providing land to a
public school. If the school did not succeed, would the City still own the land. Mr.
O'Neill stated that this is one of the issue that is still being worked on.
The mechanics of the move would be Sunny Fresh providing $200,000 for the move and to include
closing up the remaining building, however, the City feels that this should be responsibility of
Sunny Fresh. The City will move the building, Swan River will obtain Charter status from the
state which will in turn make monies available to the school for repayment to the City for
expenses.
There is a concern about asbestos in the building. The State Health Department provides that the
building can be move without asbestos clean up as long as the asbestos is not disturbed. Fred
Patch, City's Chief Building Official, is hiring a structural engineer to our ability to move the
building. Dick Quick gave information on the asbestos in the walls as a past church member and
volunteer.
A concern expressed is that the City is supporting a school that could possibly take students away
from the public schools. Has the School District been talked to? It is believed that the school will
lose no more than 20% of it's students to this new school and that the Charter school will draw
from a larger area and possibly bring families to the Monticello area. The school would be
students through sixth grade and house approximately 120 students.
Other thoughts and concerns expressed by the Board:
Dick Quick - Who would locally approve the Charter School and who would supervise their
Charter? A structural engineer stated 20 years ago that the building would need to be destroyed in
20 years. Their were concerns about paint adhering to the siding due to the insulation.
Harvey Kendall - Did Swan River look at other possible sites? Bruce Thielen informed that their
costs would rise significantly if the building has to be moved farther. Questioned who would be
responsible for the set up and clean up in the school if MCC uses? Would they have janitors and
maintenance. Would MCC need to reimburse for heat and electricity? Harvey expressed concern
about the appearance of the City doing more for another school especially during difficult budget
times for the public school. Did Swan River look into renting Eastview?
Jeff O'Neill said that he hopes that Swan River will have enough space to install an outdoor play
area that could be used by the general public, however, Bruce Thielen expressed concern about an
unsupervised attraction. He felt that there could be concerns about who the users of this park
might be after school hours.
The move is planned for June 1, 2004. No action is required from the Advisory Board at this time.
This was informational only.
5. Update Items:
a. Wheel Park opening and planned competition: The wheel Parks opened two nice weekends
in April and will open after school and weekends in May. Kitty reported that she added a
piece of equipment, a pyramid, to the skate park this year with the money not used for the
ATM machine. This was a suggestion from the park users. MCC is sponsoring a board
team with Nendsa Bike Shop this year. They will do demos for us and for other
communities wearing MCC t-shirts. Kitty gave free season passes to our three board team
members. MCC is planning to do a competition in the Parks on Saturday of RiverFest
weekend. This will be a judged event run by The Third Lair. The RiverFest committee has
been notified and approves of this addition.
b. Seim Lessons and pool closures for the summer: MCC for the past two summers has closed
the pool during summer swim lessons to be able to offer the maximum number of lessons
and will be doing so again this year. They are planning to do a direct mail newsletter
informing members and posting notices prominently to reduce any confusion.
C. Financial and membership update: Kitty Baltos provided revenue and expenses through
February 2004 and membership information through March 2004 as information for the
Board.
d. Mississippi Room Patio Fence: Kitty reported that footings will be dug any day and the
fence should be done by the end of May.
6. Consideration of approving the minutes from the January 22, 2004 even though there was not a
quorum from that meeting at the current meeting. MOTION by Sandra Theros to approve the
minutes as presented, SECOND by Harvey Kendall, ABSTAINING Richard Quick and Bruce
Thielen as they were not present at the meeting and Tom Neumann is no longer on the Advisory
Board. MOTION PASSED with a two person quorum.
7. Consideration of approving the minutes from the February 26,2004 regular meeting. MOTION by
Richard Quick to approve, SECOND by Sandra Theros, MOTION PASSED.
8. Consideration of accepting Bob Grabinski as a Board member to replace the position vacated by
Tom Neumann. This term would expire on December 31, 2004. MOTION by Harvey Kendall to
approve Bob Grabinski as a Board member, SECOND by Richard Quick, MOTION PASSED.
9. Consideration of making the Community Center a smoke or tobacco free facility, exempting the
Mississippi Room patio, based on recommendations made by TATU (Teens Against Tobacco Use)
at the Parks Commission on April 22, 2004. Bruce Thielen was at the Parks Commission meeting
and informed that Coon Rapids just made this change exempting their City owned golf course.
Harvey Kendall expressed concern that smoking might become a government issue and that the
rights of the smokers need to be considered. Richard Quick expressed that MCC is a family
facility and except for the weddings this would be a good fit for the facility. The Board asked that
Kitty Baltos follow up with other communities and with the Parks Commission and report back at
the next meeting.
10. Consideration of allowing the Community Center to use collection agencies for certain accounts
and defining a policy as to when this would be initiated. Kitty Baltos reported that this is not a
significant problem, however, after a number of calls with no response or broken promises from
the customer, her only recourse is to write the item off. The Board agreed without a motion that it
would be okay to use collections agencies if absolutely necessary.
11. MOTION by Richard Quick to adjourn the meeting at 6:00 p.m., SECOND by Sandra Theros,
MOTION PASSED meeting adjourned.

TOBACCO -FREE PARK POLICY
Subject: Prohibition of tobacco product use in the City of Monticello's park and trail
system.
Purpose: In order to protect the health and welfare of the citizens of Monticello and the
people who use the City's parks and trails, the City of Monticello prohibits the use
of tobacco products on City owned park land, recreation facilities, trails and open
space.
Policy: No person shall use tobacco products on City owned park land, recreation
facilities, trails and open spaces except for the following:
1. At the Xcel Ballfields, except during exclusively youth activities.
2. At the Monticello Community Center- designated smoking areas during
private events.
3. At Ellison Park during the Riverfest celebration.
Phasing Plan: A phasing plan for establishing all City owned park land, recreation facilities,
trails and open space as tobacco free is as follows:
2004 - East/West Bridge Park
2005 - Ellison Park/Pioneer Park
2006 - All remaining parks *q-
Implementation:
The emphasis on enforcing the Tobacco -Free park policy is through voluntary
compliance.
1. Signs shall be posted at all City owned parks, recreation facilities, trails
and open space.
2. City staff will make periodic observations of recreation facilities and park
land to monitor for compliance.
3. A community education program will be implemented to assist in
enforcing this policy.
4. Athletic associations that utilize city owned facilities must commit to
enforcing this policy during all scheduled activities.

2olicy Statement
Subject: Prohibition of tobacco product use at City of Eagan outdoor
facilities and venues that are host to youth activities.
Purpose: The Eagan Parks and Recreation Department believe that tobacco
use in the proximity of children is detrimental to their health. As
responsible adult citizens this policy demonstrates our commitment
towards a healthy environment for our youth.
Implementation: Tobacco use is prohibited at outdoor recreation
facilities owned by the City of Eagan where youth activities are being
conducted. This includes: playgrounds, athletic sites, winter warming
shelters, and skating/ tubing facilities. The Parks and Recreation
Department will post appropriate signage.

Smoking
• No smoking will be allowed inside the Community Center.
• Smoking on the (outdoor) patio is permitted by those of legal age.
Outside Food/Beverage Policy
• No coolers, outside food/beverage, or glass shall be allowed in the Community Center
unless organized through Community Center staff. Water bottles will be permitted.
Lost and Found
• All items turned in will be date tagged.
Early Closure
• Staff shall have discretion to close the facility in case of a building emergency or
inclement weather.
Customer Grievance
• Any citizen issue/concern brought to a City Councilmember regarding the
Community Center should first be directed to staff so that staff can work with the
citizen to resolve the concern.
Maintenance Days
• The Community Center will block off dates for necessary repairs or maintenance of
areas/equipment. Each area can be blocked off for up to 14 days per year, usually
during non -peak times. Membership fees reflect these blackout days.
The Blast (Indoor Playground)
• All children under age 10 are required to have adult supervision.
• Unsupervised children, ages 12 and over, are not permitted in The Blast.
• No food or beverages permitted in The Blast.
• A hand stamp is required for admittance into The Blast.
• No running or rough play is permitted.
• Socks must be worn at all times. No shoes or bare feet shall be permitted.
• Group Rates:
l . Two weeks advanced notice reservation required based on availability.
2. Group rates do not apply on school release days, weekends, and/or
holidays.
3. A minimum of one adult supervisor for every ten children is required, to
be present.

Kitty -
Lisa ask that I give you information about the park's policy
The Usage of Public Parks, Recreation Facilities and Equipment Policy has this statement:
"Tobacco use is prohibited at all public buildings, park property and ISD #279 property operated by the Board through a joint
powers agreement."
Because the Community Center has it's own operating policies, it is not included in the park policies - So smoking is allowed in
designated areas. Because it operates under an enterprise fund it often has differing policies then the parks as a whole.
The park policy statement has always been there, so we didn't make any ordinance changes. We did agree with the group to
"market" the policy better i.e. by signs, newsletter articles etc.
think Plymouth Community Center has made some changes with their ordinance, so check with them also I have heard
Bloomington is smoke free at their Art Center

Subject: smoking ban
I believe indoor areas should be smoke free. I believe outdoor areas such as bleachers or confined areas should
be smoke free.
I am a non-smoker and find smoking offensive. I believe that people have the right to choose for themselves. I
believe the teens should focus on making good choices for themselves rather than controlling the choices of
everyone. If this were to happen these problems would very quickly disappear by themselves.

Hi Kitty,
I am not a smoker, and whenever I go out I request a seat in the
non-smoking
section. I appreciate the right to do that. I also appreciate what the
kids are trying to accomplish with their request, however, I disagree
with
making our parks, trails, playgrounds etc. tobacco free. I would rather
see
a parent that smokes come to their childs event, or bring their child to
the

restrictions. If we begin with these restrictions, where do they end?

can educate people on the risks, but we are a free people, so far, in

country and we need to maintain the rights of people who are not

the law. We can't force people to do what may be best for them. As
non-smokers we can choose to frequent or not frequent places where
smoking
is allowed. Let's keep the decision making in the hands of citizens,

I am writing in response to Amy Dean's request for input on the proposed smoking policy.
We, as a family have spent countless hours enjoying the great facilities and parks in the Monticello area over the past ten years. I
don't recall ever having a problem with smokers or second-hand smoke.
I think it is noble and good for the students to become active in political and environmental issues. However, I think that ratifying
this policy is needless and cumbersome. Most people have heard that second-hand smoke has been proven dangerous, but the
counter argument has just as much support from scientific research.
think the city should leave well enough alone. Amy mentioned the group "Teens Against Tobacco Users." I don't know anyone
who would be willing to argue the benefits of smoking. By the same token, I certainly don't know anyone who form an alliance
against fellow citizens because of their smoking preference.
The only tangible benefit that I see in passing a non-smoking policy would be the civics lesson that the "Teens" would gain.
For the record, both my wife and I are non-smokers.

Although I don't smoke, I feel that no government agency has the right
to ban smoking outdoors. A question of smoking outdoors is no longer a
question of health concerns involving second-hand smoke. (Especially
because to be fair you'll have to ban all of the other outdoor pollution
as well.) I would support fines for littering (dropping cigarette
butts), but as long as there is no littering, smoking SHOULD be allowed
outdoors. (punish the few litterbugs, not all of the smokers.)
I feel it is just as important for teens to truly understand the 'US
Constitution', and the 'Bill of Rights' as it is for them to abstain
from tobacco. Where do you draw the line? Hip Hop music makes me just
as ill as the smell of smoke does. I know others that feel the same
way. Should we start a movement to ban Hip Hop?
Bans don't discourage, they do just the opposite. TATU's efforts would
be better spent using positive and proactive tactics.

I've missed seeing you in the hallways of your fine establishment lately. You and your staff, as always, are doing a fabulous job
there at the center. I really appreciate the top-notch facility you are running; especially the recent upgrades to the equipment up in

I believe that the proposal to make the entire facility smoke -free is in keeping with the mission of a facility such as yours- it's all

I support most of the smoking restrictions requested by TATU. Certainly
entrances to the MCC should be smoke free, as should the public
facilities that the Park & Recreations Board supports (rinks,
playgrounds, athletic fields, tennis courts, etc.) where people gather.
I do not support making parking lots smoke free, nor the trails. I
believe that it will be very costly and nearly impossible to enforce a
smoking ban in these areas. The trails are not "gathering" places;
second hand smoke is of minimal concern because bicyclers, skaters,
runners, and walkers generally aren't smoking while using the trails.
In addition, I suspect that people who are smoking while sitting in
their own vehicles while parked in lots adjacent to Park & Rec
facilities, are probably legally protected.

that. I don't think that outdoor areas should be smoke free. If you

I believe the government should not force private businesses to be smoke
free; each customer has a choice if he or she wants to purchase goods or
services from any particular business. I, therefore, choose not to go
into places and purchase goods where people tend to smoke. That's my
choice, and I cast my vote through my dollar.
On the other hand, the MCC is subsidized by tax money, and public
buildings are held to a different standard. Schools, town halls, state
capitol buildings, and the like should be smoke -free to make them
accessible to the entire public.
It would be virtually impossible to enforce such a rule on walking

I believe indoor areas should be smoke free. I believe outdoor areas such as bleachers or confined areas should
be smoke free.
I am a non-smoker and find smoking offensive. I believe that people have the right to choose for themselves. I
believe the teens should focus on making good choices for themselves rather than controlling the choices of
everyone. If this were to happen these problems would very quickly disappear by themselves.

Hi Kitty,
I am not a smoker, and whenever I go out I request a seat in the
non-smoking
section. I appreciate the right to do that. I also appreciate what the
kids are trying to accomplish with their request, however, I disagree
with
making our parks, trails, playgrounds etc. tobacco free. I would rather
see
a parent that smokes come to their childs event, or bring their child to
the
park, and step away to smoke, than to not come at all because of
restrictions. If we begin with these restrictions, where do they end?
We
can educate people on the risks, but we are a free people, so far, in
this
country and we need to maintain the rights of people who are not
breaking
the law. We can't force people to do what may be best for them. As
non-smokers we can choose to frequent or not frequent places where
smoking
is allowed. Let's keep the decision making in the hands of citizens,
-lot
government.

Kitty,
I am writing in response to Amy Dean's request for input on the proposed smoking policy.
We, as a family have spent countless hours enjoying the great facilities and parks in the Monticello area over the past ten years. I
don't recall ever having a problem with smokers or second-hand smoke.
I think it is noble and good for the students to become active in political and environmental issues. However, I think that ratifying
this policy is needless and cumbersome. Most people have heard that second-hand smoke has been proven dangerous, but the
counter argument has just as much support from scientific research.
I think the city should leave well enough alone. Amy mentioned the group "Teens Against Tobacco Users." I don't know anyone
who would be willing to argue the benefits of smoking. By the same token, I certainly don't know anyone who form an alliance
against fellow citizens because of their smoking preference.
The only tangible benefit that I see in passing a non-smoking policy would be the civics lesson that the "Teens" would gain.
For the record, both my wife and I are non-smokers.

I would not object to a smoking ban at the entrances to the community
center, parks or general recreation areas.
I would object to the ban applying to parking lots and trails. These
are open areas where smokers and non-smokers would not be in extended
contact; hence, there should be no risk from second-hand smoke.
