MONTICELLO CITY COUNCIL SPECIAL MEETING
Monday, August 25, 2025 – 4:45 p.m.

1. Call to Order
Mayor Lloyd Hilgart called the special meeting to order at 4:45 p.m.
2. Downtown Parking Discussion
City Engineer/Public Works Director Matt Leonard presented an update regarding the
Block 51 parking lot project, reporting that the plans have reached 60% completion. The
proposed design reflects the number of available parking spaces, with construction
anticipated to commence in 2026.
In addition, Mr. Leonard introduced the design of new parking signage intended to assist
the public to more effectively locate available public parking areas.
3. 2026 Budget Discussion
Finance Director Sarah Rathlisberger presented updated preliminary taxable market
value data, including projected valuations for Xcel Energy. All market value classes
reflected positive growth.
Ms. Rathlisberger initiated discussion regarding potential levy increase scenarios. She
noted that a 1 percent levy increase would generate approximately $140,000 in
additional revenue. She further noted that an increase of 8.64 percent would be
required to maintain the current tax rate.
Following discussion, the Council reached consensus in support of a preliminary tax levy
that will maintain or slightly lower the current tax rate. It was noted that the percentage
increase will be discussed at a future meeting. There was additional discussion on how
to allocate the levy increase across various city funds.

By consensus, the meeting was adjourned at 6:15 p.m.

Motion by Council Member Martie to approve the agenda. Council Member Hinz
seconded the motion. Motion carried unanimously.
C. Approval of Meeting Minutes

Motion by Council Member Hinz to approve the special meeting minutes and the
regular meeting minutes. Council Member Christianson seconded the motion.
Motion carried unanimously.

E. Public Service Announcements
City Administrator Rachel Leonard noted the following public announcements:

F. Council Liaison Updates
• Economic Development Authority (EDA) – Council Member Hinz provided a
recap of the meeting held on August 13, 2025. They approved funding for the
IEDC Manufacturer’s Breakfast Event and for the Initiative Foundation
Community and Economic Development Program. Approved a resolution

recognizing a new City Ordinance that establishes an affordable housing trust
fund. Approved an amendment to a lease agreement for property at 349 W.
Broadway. Approved a 2026 tax levy and budget.
• Planning Commission – Council Member Christianson gave an update of the
regular meeting held on August 5, 2025, and a special meeting held on August
19, 2025. At the regular meeting, the commission approved the preliminary and
final plat for Spaeth Development and approved an ordinance addressing various
zoning amendments. The special meeting on August 19 was a public hearing on
the ordinance framework for Data Center Planned Unit Developments.
G. Department Updates
• Construction Update – Matt Leonard, Public Works Director/City Engineer, gave
an update on current construction projects.
2. Consent Agenda:
Motion by Council Member to approve the Consent Agenda. Council Member
seconded the motion. Motion carried unanimously.
A. Consideration of approving the payment of bills. Action taken: Approved the bill
and purchase card registers for a total of $1,434,637.02.
B. Consideration of approving new hires and departures for City departments.
Action taken: Approved the terminations for Hi-Way Liquors, Monticello
Community Center, and Parks Department.
C. Consideration of approving the sale/disposal of surplus city property for the
Public Works Department. Action taken: No report.
D. Consideration of approving an application for a temporary gambling permit for a
raffle and bingo to be conducted by the Wright County Ducks Unlimited, Chapter
39 on September 29, 2025, at the American Legion Post 260. Action taken:
Approved the temporary gambling permit for the Wright County Ducks
Unlimited.
E. Consideration of adopting Resolution 2025-50 approving Second Amendment to
Lease Agreement between the City of Monticello and Economic Development
Authority (EDA) for 349 West Broadway (Fred’s Auto) for MontiArts activities.
Action taken: Adopted Resolution 2025-50 approving Second Amendment to
Lease Agreement.

F. Consideration of approving North Risk Partners as the City’s Agent of Record for
workers’ compensation insurance for 2025-2030. Action taken: Approved North
Risk Partners as Agent of Record.
G. Consideration of adopting Ordinance 855 amending the Monticello City Code,
Title XV: Land Usage, Chapter 153: Zoning Ordinance, Sections 153.012 –
Definitions, 153.027 – Common Review Procedures and Requirements, 153.028
Specific Review Procedures and Requirements, 153.090 – Use Table, 153.040 –
General Provisions, 153.042 – Common District Requirements, 153.067 _ Off-
Street Parking, 153.070 – Building Materials, 153.060 – Landscaping and
Screening, 153.064 – Signs, and 153.092 – Accessory Use Standards. Applicant:
City of Monticello. Action taken: Adopted Ordinance 855 amending the City
Code to update zoning sections and adopted Summary Ordinance 855A for
publication based on findings in PC-Resolution 2025-32.
H. Consideration of adopting Resolution 2025-51 approving the preliminary and
final plat for Spaeth Industrial Park Fourth Addition. Applicant: Spaeth
Development, LLC and Spaeth Properties, LLC (Ken Spaeth). Action taken:
Approved the preliminary and final plat for Spaeth Industrial Park Fourth
Addition and the third amendment to the Development Contract and Planned
Unit Development for Spaeth Industrial Park, subject to conditions in Exhibit Z
and based on findings in said resolution.
I. Consideration of approving the Third Amendment to Development Contract and
Planned Unit Development for Carcone Addition and First Amendment to
Development Contract and Conditional Use Permit Amendment for Planned Unit
Development. Action taken: Approved the third amendment to Development
Contract and Planned Unit Development for Carcone Addition and first
amendment to Development Contract and Conditional Use Permit (CUP)
amendment for PUD.
J. Consideration of adopting Ordinance 856 amendment the Monticello City Code,
Title III, Chapter 36: Fee Schedule by amending Waste items. Action taken:
Adopted Ordinance 856 amending the fee schedule.
K. Consideration of approving a revised scope, accepting quote and awarding
contract to Minnesota Native Landscapes for prairie conversion and hardwood
seeding for $20,621.25. Action taken: Approved the revised scope, accepted
quote and awarded contract to Minnesota Native Landscapes.
L. Consideration of approving a special event permit for outdoor entertainment,
street closure, and the use of City resources and approving a temporary liquor

license at American Legion Post 260 on Saturday, September 13, 2025. Applicant:
American Legion Post 260. Action taken: Approved the event permit contingent
on notification to surrounding property owners.
3. Public Hearing:
A. PUBLIC HEARING (Continued): Consideration of a vacation of a permanent
easement for 85th Street NE as legally described for a portion of the plat Haven
Ridge.
Community Development Director Angela Schumann gave a brief update and
noted that the applicant was continuing to work through matters related to the
final plat. She recommended that the City Council take public testimony, close
the public hearing, and table it to a future date.
Mayor Hilgart noted that the public hearing was still open and invited public
testimony. No one testified. Mayor Hilgart closed the public hearing.
Motion by Council Member Martie to table action of the permanent easement
to a future date. Council Member Christianson seconded the motion. Motion
carried unanimously.

Motion to approve the bill and purchase card registers for a total amount of $949,903.69.
REFERENCE AND BACKGROUND
City staff submits the attached bill registers and purchasing card registers for approval by
Council. The bill registers contain all invoices processed and the purchasing card registers
contain all card purchases made since the last Council meeting. Subject to MN Statutes, most
invoices require Council approval prior to releasing checks for payment. The day following
Council approval, payments will be released unless directed otherwise. A credit purchasing
agreement and policy was approved by Council initially and card purchases must comply with
the policy.
If Council has no questions or comments on the bill and purchase card registers, these can be
approved with the consent agenda. If requested, this item can be removed from consent and
discussed prior to making a motion for approval.

REFERENCE AND BACKGROUND
The Monticello Chamber of Commerce’s Downtown Trick or Treat event is scheduled for
October 23, 2025, from 4:00 – 6:00 p.m. During the event, participating downtown businesses
will offer trick-or-treating in their storefronts along Broadway and Walnut Street, extending to
West Bridge Park. Businesses without a downtown storefront will set up booths in the park.
The Chamber is requesting use of West Bridget Park and temporary closure of River Street from
the side of Walnut Street to Highway 25. The closure will take place from 7 a.m. – 6:30 p.m.,
which will allow time for setup and takedown.
Additionally, the applicant requests assistance from the Streets Department for the street
closure and traffic control, including the provision of barricades and appropriate signage.
The applicant will also notify the Wright County Sheriff’s Office of the event.

fund Monticello Heritage Days.
REFERENCE AND BACKGROUND
The Initiative Foundation awarded the City of Monticello a $5,000 grant to develop and host a
new event called Monticello Heritage Days. This event is proposed for June 2026 in conjunction
with Walk & Roll and would celebrate the city’s historical ties to the logging industry. The vision
for the celebration includes a lumberjack show, live music, food vendors, cultural
performances, and an appearance by Paul Bunyan.
If additional event partners can be secured, funding for the proposed event could be increased.
However, if the City of Monticello is ultimately the sole host, the event budget will be limited to
the grant allocation and associated staff time.
In accordance with Minnesota Statutes § 465.03, the City Council must adopt a resolution to
formally accept the grant and designate its intended use. Adoption of a resolution is required
by state law to formally accept the funds and designate their purpose.
I. Budget Impact: Grant funds will be used to cover entertainment, vendor support, and
promotional costs associated with the new Heritage Days event.
II. Staff Workload Impact: City staff will coordinate event logistics, vendor outreach, and
programming.
III. Comprehensive Plan Impact: The proposed Monticello Heritage Days event supports

WHEREAS, the City of Monticello is committed to celebrating its cultural heritage and
fostering community engagement through inclusive public events; and
WHEREAS, Monticello Heritage Days serves as a signature annual celebration that
reflects the city’s history, identity, and community spirit; and
WHEREAS, the Initiative Foundation has awarded a grant totaling $5,000 to the City of
Monticello to support the development and implementation of a new featured event during
Monticello Heritage Days; and
WHEREAS, this new event will highlight Monticello’s historic ties to the logging industry

The City received an application for a Therapeutic Massage Enterprise license from Heather

release form, and liability insurance. In addition, the education component of the application
was verified.
The applicant still requires an inspection of the space by the City’s Building Department. This
will be completed before a license is issued.

Project Description: The applicant proposes to develop a parcel in the Union Crossings
retail Planned Unit Development as a restaurant with drive-
through facilities. The site is an existing vacant parcel
approximately 1.27 acres in area. The property includes a
potential shared drive along the west boundary; however, the
applicant proposes not to make use of that drive. Instead, access
and egress will be provided via an internal private street on the
north side of the property in question.
ANALYSIS
The City approved an amendment to the Union Crossings Planned Unit Development for the
proposed Wendy’s facility in September of 2024.
The applicant requested an extension of the CUP approval as they continue to work through
their land development process. The applicant’s letter of request indicates an intent to
commence construction in spring 2026. The motion for extension would grant up to one year to
commence construction.
The Monticello Zoning Ordinance addresses the timeline under which a CUP must commence
and authorizes extension per the following provision:
(8) Time limit.
(a) Unless otherwise specified in the conditional use permit, the operation of the
use and/or issuance of building permits for permitted structures shall begin within one
year of the date of the conditional use permit approval. Failure to do so will invalidate
the conditional use permit. Permitted timeframes do not change with successive
owners.
(b) If the operation of the use and/or issuance of building permits has not
commenced within one year of the date of approval, the applicant may petition for an
extension of time in which to commence the work that has been granted by the
conditional use permit. Such extension shall be requested in writing and filed with the
Community Development Department at least 30 days before the expiration of the one-
year period. The request for extension shall state facts supporting good cause for
extension of the conditional use permit. Such petition shall be presented to the Planning
Commission for a recommendation and to the City Council for a decision.
(c) If a use operating pursuant to an approved conditional use permit is
discontinued for a period of at least one year, any further use of the property shall
conform to the requirements of this chapter. A discontinued conditional use shall not
begin operations again without first obtaining approval of a new conditional use permit.

1. The plans are updated to include building elevations and building materials,
including for the attached building area to the south of the principal structure.
The walk-in building area is required to meet the zoning ordinance for
commercial building standards, in materials similar to the main portion of the
building Exterior mechanical and related components (particularly on the south
side of the building) to match the base wall material colors.
2. The plans clarify the proposed exterior materials for the trash enclosure and
show that those materials are consistent with the principal structure.
3. The applicant provides schematic floor plans to verify parking demand.
4. The applicant provides final landscaping plans that identify materials species.
5. The applicant updates the landscaping plan to add planting in the extensive turf

REFERENCE AND BACKGROUND
Monticello’s trail system has grown into a vital part of the community’s transportation and
recreation network. In 2008, the City partnered with the Minnesota Department of
Transportation (MnDOT) and Three Rivers Park District to pilot pavement preservation
techniques. This collaboration helped establish the City’s Pathway Management Program
(PMP).
The PMP guides annual inspections and maintenance planning for over 20+ miles of bituminous
pathways, including 18 miles maintained year-round for snow and ice removal. As part of this
program, the City uses the PASER (Pavement Surface Evaluation and Rating) method to assign a
1–10 rating based on overall surface condition. Monticello supplements PASER ratings with
additional criteria such as pavement age, drainage performance, constructability, plowing
status, and usage frequency to prioritize maintenance needs.
The City received two proposals for micro-surfacing, patching, and crack sealing services: MP
Asphalt submitted a bid of $45,250, and ACI submitted a bid of $87,423.50. After thorough
evaluation, staff recommend awarding the contract to MP Asphalt, a contractor with a strong
record of high-quality trail work in Monticello and active projects with Three Rivers Park
District.
The project includes crack filling, infrared patching, and installation of the Road-Guard micro-
surfacing product. These treatments are designed to address surface deficiencies that have
developed over time, including surface cracking, asphalt failure, and minor to major raveling.
Micro-surfacing is a preventative maintenance treatment that forms a protective membrane

over the asphalt surface, sealing cracks and voids, slowing oxidation, restoring skid resistance,
and significantly extending pavement life.
The proposed work will focus on trails located in the northwestern quadrant of the City. These
trails are between 8 and 10 feet wide and were originally constructed in 1995 and 2012.
Previous maintenance treatments include chip sealing in 2001 and 2006, patching with asphalt
fines mix two seasons ago, and crack sealing in 2019. If the contract is approved, work will be
scheduled to begin next Tuesday and is expected to be completed within two to three weeks.
I.Budget Impact: The 2025 budget for the Parks department in the General Fund includes
$120,000 for pathway maintenance and improvements. The recommended proposal
from MP Asphalt at $45,250 falls well within the allocated budget, allowing flexibility for
future maintenance needs or additional pathway enhancements as identified through
the City’s Pathway Management Program.
II.Staff Workload Impact: A few hours of staff time for observation of contractor
performance during the product applications.
III.Comprehensive Plan Impact: The proposed micro-surfacing, crack filling, and patching
work reinforces the plan’s commitment to long-term asset management, active living,
and equitable access to outdoor amenities, while also aligning with broader mobility
objectives found in Chapter 4 by maintaining year-round usability for non-motorized
transportation.

REFERENCE AND BACKGROUND
Nordic BrewPub submitted a special event permit application for a free outdoor block party to
be held at Nordic Tap House (106 Walnut Street) on October 4. The request includes City
assistance closing a portion of Walnut Street from River Street to the middle of the block. The
closure would be in place from 7 a.m. on Saturday through 7 a.m. Sunday. A layout of the event
is provided in the agenda packet. In addition, the applicant requested 12 picnic tables from the
Parks Department.
The event will feature live entertainment of five bands. It was previously an event where tickets
had to be purchased. This year it is a free event, reimagined as a downtown block party.
The applicant requested that the event be from 2:00 - 9:55 p.m. Staff recommend that the
event end at 9 p.m. This is due to the length of time of the event, change in seasonal darkness,
the noise level, and consideration of neighboring businesses and residents.
I. Budget Impact: None.
II. Staff Workload Impact: Minimal staff time was necessary to review the request and
prepare the report. The Street Department will close the street for the event and the
Parks Department will deliver the picnic tables.
III. Comprehensive Plan Impact: This event supports the Monticello 2040 Value Statement
of supporting a vibrant downtown as a focal point for the community.
STAFF RECOMMENDED ACTION
Staff recommend approval of the Special Event Permit, including the closing of Walnut Street

REFERENCE AND BACKGROUND
The Community Energy Transition Grant program was created by the Minnesota legislature to
support communities that host large electric generating facilities as they address the economic
dislocation created by future plant closures.
The City was successful in receiving a $1 million CET grant administered through MN-DEED for
the extension of sewer and water utilities to the west along CSAH 39 which would promote
development. The Strategic Transition Plan identified the Northwest Growth Area as the best
option for increased tax base to reduce the reliance on the Xcel nuclear power generating
facility.
Following receipt of a 30% cost estimate for the project, it was determined the project scope
needed to be revisited. Phasing options were presented to the City Council during a work
session and these options included shortening the project limits or only installing the
watermain at this time. The City Council provided direction to move forward to install the
watermain with MN-DEED approval to preserve the use of the grant funds received for this
project.
MN-DEED approved the project scope changes and plans and specifications were prepared. The
watermain is proposed to be installed within existing right-of-way along Chelsea Road and
County Road 39. The watermain will be installed utilizing trenchless technology to minimize
impacts of construction. An open trench crossing of County Road 39 at Chelsea will be
completed as part of the project which will require a construction detour utilizing Chelsea Road.
This detour is expected to last approximately one week, and the remaining project is expected
to have shoulder closures during the watermain and hydrant installation.
This project also is planned to include the expansion of a stormwater pond in the Otter Creek
Industrial Park. The pond adjacent to Karlsburger Foods needs to be expanded to meet current
stormwater requirements.
Wright County’s pavement project plan includes this section of CSAH 39 to be completed in
2026, and city staff are coordinating with them. They anticipate construction on the pavement
project after the watermain installation is complete. Construction of the watermain extension is
expected to start in October with completion prior to the grant deadline of June 30, 2026.
A bid opening was held on September 4, 2025, and ten bids were received ranging in price from
$1,246,202.15 to $1,691,046.00. The $1,246,202.15 bid was from Park Construction Company.
The engineer’s estimate for the project was $1,753,000.00.
MN-DEED is currently reviewing the bid documents and approval for bid award is expected
soon.

I. Budget Impact: Due to projections of full project costs, the CSAH 39 West Utility Extension
project, which was originally budgeted for in the Water Trunk Sub-Fund for $530,000 and
the Sewer Trunk Sub-Fund for $3,600,000, was pared back to only include the watermain
extension. Therefore, the $1,000,000 CET grant will be allocated to the Water Trunk Sub-
Fund rather than to the Sewer Trunk Sub-Fund as budgeted. The construction costs based
on the low-bid are as follows:
a. Stormwater Improvements - $501,325.20
b. Watermain Improvements - $744,876.95
The watermain improvement costs will be offset by the 50% funding received from the CET
grant.
The project will continue into next year, so the 2026 Water Trunk Sub-Fund budget and
Stormwater Trunk Sub-Fund will be updated.
II. Staff Workload Impact: City staff will be involved in the construction process at an
estimated amount of 50 hours of staff time.
III. Comprehensive Plan Impact: The 2040 Plan recognizes the Northwest Area as a key area
for future growth. With the completion of the Industrial Feasibility analysis, the Northwest
Area further solidified the area’s growth potential. Development of utility plans and their
extension is in direct support of the following 2040 strategy: Consider a more detailed
planning initiative for the Northwest and East Bertram Study Areas to better define land
use, utility and transportation corridors and needs, which can be incorporated into finance
and capital improvement plans.
STAFF RECOMMENDED ACTION
City staff recommends awarding the project for the CSAH 39 West Utility Extension Project.

REFERENCE AND BACKGROUND
Wright County Parks and Recreation has proposed a special archery deer hunt to be held in
designated Monticello-area parks from October 17 to October 26, 2025. This initiative is part of
a broader regional effort to manage deer populations in high-density areas and address
growing concerns related to public safety, environmental degradation, and property damage.
Monticello has experienced a noticeable increase in deer-related incidents in recent years,
particularly motor vehicle collisions. These incidents have prompted calls from residents and
city staff for more effective wildlife management strategies. The proposed hunt offers a
controlled, ethical, and low-impact method of reducing deer numbers while minimizing
disruption to park users and nearby neighborhoods.
The hunt will be conducted under strict guidelines established by Wright County. Ten hunters
will be selected through a lottery system open to Wright County residents beginning September
1 and closing September 21. Selected participants must hold a valid Minnesota Department of
Natural Resources archery license, pass a proficiency test, and attend a mandatory pre-hunt
meeting. Each hunter will be assigned a specific area within one of three parks: Montissippi
County Park, Harry Larson County Park, or Bertram Chain of Lakes Regional Park.
Hunters may begin scouting and setting up tree stands starting October 2. All stands must be
elevated at least six feet above ground unless the hunter has a handicap exemption, in which
case a ground blind is permitted. Only one portable stand or blind is allowed per hunter, and all
equipment must be tagged with contact information. Minimal vegetation clearing is permitted,

limited to brush and buckthorn. All kills and wounded animals must be reported within 24
hours to the hunt manager.
This program aligns with similar efforts by regional partners, including Xcel Energy, which has
hosted deer management hunts on utility-owned lands to reduce damage and improve safety
near critical infrastructure. The County’s approach ensures that hunting is conducted
responsibly, with an emphasis on safety, transparency, and ecological stewardship.

WHEREAS, Monticello City Code, Section 132.03 gives the City Council the right to
authorize hunting of dangerous animals within city limits where hunting is otherwise not allowed
in the City under Monticello City Code, Section 132.01; and
WHEREAS, over the last few years, the City has experienced a noticeable increase in deer-
related public safety incidents, particularly motor vehicle collisions; and
WHEREAS, the Wright County Parks and Recreation Department intends to hold an
archery deer hunt from October 17, 2025 to October 26, 2025 that includes efforts to manage
the higher deer herd population at three parks, including Montissippi County Park located in th e
City of Monticello.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello that:
1. The City finds deer constitute a dangerous animal for the public safety at their current
population level under Monticello City Code, Section 132.03.
2. Pursuant to Monticello City Code, Section 132.03, the City authorizes hunters selected to
participate in the Wright County Parks and Recreation Archery Hunt to hunt and destroy
deer at Montissippi County Park in compliance with the rules and regulations of the
archery hunt program and any other applicable laws or regulations, from October 17,

Background
To manage the deer heard in higher populated areas throughout the County, the Parks and Recreation
Department will be conducting an annual archery deer hunt. The hunting area will be initially focused in and
around the Monticello area.
Procedure
• Hunting Season
o Wright County’s archery hunting season will take place from October 17, 2025, to October 26,
2025.
• Selection Process
o Eligibility
▪ All participants must be 18 years of age as of October 17, 2025.
▪ Participants must have a Minnesota Department of Natural Resources hunting license
appropriate to the archery deer hunt.
▪ Participants must be able to prove that they are Wrigth County residents.
o Lottery System
▪ 10 hunters will be selected through a lottery system.
• Participants will need to register for the lottery by going to

• Registration for the lottery will open on September 1 and close at midnight on

The City of Monticello was contacted by CentraCare Monticello leadership with a request to
enter into a Memorandum of Understanding (MOU) to help them certify their eligibility for a
federal drug discount program under Section 340B of the Public Health Services Act.
To maintain their certification, CentraCare Monticello must have an MOU with a local
government body highlighting their continued commitment to treating everyone who needs
care regardless of ability to pay. In previous years, the hospital’s agreement was made with the
Hospital District Board; however, the board was dissolved in 2024.
The MOU does not compel the City of Monticello to undertake any additional responsibility.
The document asks for City “Acceptance and Acknowledgement” of the service commitment
being made by the hospital to the region.
The document was reviewed by the city attorney and is attached for reference.

THIS MEMORANDUM OF UNDERSTANDING is made this 2nd day of September 2025 by and
between the undersigned representatives of Monticello, Minnesota (“MNCITY”), located at 505 Walnut
St, Monticello, MN 55362 and CentraCare Health System-NR LLC (“MNHOSP”), located at 1013 Hart
Blvd, Monticello, MN 55362. An operating division of CentraCare, A Minnesota non-profit corporation.
RECITALS:
WHEREAS, MNHOSP is a not-for-profit hospital which provides health care services to
the Medicare and Medicaid population in addition to supporting programs that benefit the
indigent, uninsured or underinsured population in the region in and adjacent to Monticello,
Minnesota;
WHEREAS, MNHOSP desires to participate in the drug discount program established under
Section 340B of the Public Health Services Act (the “340B Program);
WHEREAS, in order to participate in the 340B Program, MNHOSP must enter into an
agreement with a unit of state or local government pursuant to which MNHOSP commits to provide
healthcare services to low-income individuals who are not entitled to Medicare or Medicaid benefits;
WHEREAS, MNHOSP desires to make such a formal commitment to the MNCITY;
and
WHEREAS, MNCITY agrees to accept such commitments on behalf of the citizens of the
Monticello, Minnesota.
NOW, THEREFORE, in consideration of the mutual agreements and covenants contained herein and for
other good a valuable consideration, the receipt and sufficiency of which hereby are acknowledged, it is
mutually agreed and covenanted, under seal, by and between the parties to this Agreement, as follows:
1. Commitment of Hospital to Provide Care to the Indigent, Uninsured, and Underinsured.
During the term of this MOU, MNHOSP agrees to continue its historical
commitment to the provision of healthcare to indigent, uninsured and
underinsured residents of Monticello, Minnesota and the surrounding
communities. MNHOSP provides health care services and programs which are
needed to meet the health care needs of a community, but which do not

generate revenue. For example, MNHOSP provides support or 24-hour emergency
rooms. A variety of education programs, and hosting nursing, medical and other
students. MNHOSP will continue to provide this care, and will ensure that all
patients will receive necessary care, as required by law, regardless of ability to pay.
2. Acceptance and acknowledgements of the City of Monticello.
a. The MNCITY accepts the commitment of MNHOSP set forth above;
b. The MNCITY hereby acknowledges that the healthcare services provided by MNHOSP
hereunder are in the public interest and are being provided to individuals who are not entitled
to benefits under Title VIII or eligible for assistance under any State plan pursuant to Title
XIX of the Social Security Act; and
c. The MNCITY acknowledges that MNHOSP is providing a significant volume of free and
discounted health care services to indigent, uninsured, and underinsured patients.
3. Representations of Hospital.
Hospital represents that as of the date hereof:
a. Hospital is a corporation duly organized and validly existing in good standing under the laws
of the STATE OF MINNESOTA with the corporate power and authority to enter into and
perform its obligations under this Agreement; and
b. Hospital is a tax-exempt corporation under Section 501(c)(3) of the Internal Revenue Code of
the United States, as amended and under applicable laws of STATE OF MINNESOTA
4. Term and termination.
The term of this MOU shall commence on the date first above written and shall continue
until terminated by either party upon not less than sixty (60) days prior written notice
to the other.

REFERENCE AND BACKGROUNG
Electric bicycles (e-bikes) and other micromobility devices have become a popular mode of
transportation in recent years. While many e-bikes are ridden safely and appropriately, a
concerning number are not. Residents and Wright County Sheriff’s Office have observed e-bikes
operating at high speeds and in ways that create safety hazards for riders, pedestrians, or other
vehicles. In addition, there are other motorized models that have damaged City landscaping
and park features. Staff propose to update the existing Recreational Motor Vehicle Ordinance
to allow the continued responsible use of e-bikes and micromobility devices while
implementing stronger guidance and enforcement mechanisms to limit unsafe and destructive
uses.
E-bikes are defined by Minnesota Statutes, Section 169.011, which classifies them into three
categories based on maximum speed and how the electric assist functions. The ordinance
recognizes these classifications and incorporates definitions for micromobility devices, which
include skateboards, scooters, Segways, hoverboards, and similar vehicles operated by a single
rider. These definitions are intended to clarify enforcement and ensure consistent application
across various device types consistent with state law.
Minnesota Statute 169.022 considers e-bikes to be bicycles that can be operated in the same
manor as bicycles, although there are some specific regulations regarding e-bikes. These
include:
• E-bike operator must be at least 15 years old

• E-bikes or pedal bikes are prohibited from carrying more people than for what it was
designed to carry
• E-bikes are allowed on bicycle trails, although some restrictions may be locally imposed.
The proposed ordinance prohibits the operation of micromobility devices on state trunk
highways within city limits unless specifically permitted by state law. It further restricts Class 3
electric bicycles, defined as pedal-assist bikes with motors capable of providing assistance for
speeds up to 28 mph, from operating on bicycle paths, trails, and shared-use facilities with the
motor engaged. Class 1 and Class 2 electric bicycles are permitted where traditional bicycles are
allowed.
Additionally, motorcycles, motorized bicycles, and off-highway motorcycles which may have
electric motors but lack functional pedals or cranks to satisfy the definition of an electric
bicycle, are prohibited from all public trails, sidewalks, and park areas. These provisions are
designed to balance the growing popularity of e-bikes with the risks to public safety and welfare
in shared spaces.
Staff discussed additional regulations for e-bikes on sidewalks and limiting speed on trails with
the city attorney. However, it was concluded that such provisions had drawbacks and could be
difficult to enforce, and therefore they were not included in the proposed ordinance
amendments.
If adopted, staff will provide public communication to highlight the amendments, encourage
responsible and allowed uses, and call out prohibited uses.

THE CITY COUNCIL OF THE CITY OF MONTICELLO HEREBY ORDAINS:
SECTION 1. The City Council of the City of Monticello finds that while electric bicycles and other
micromobility devices have become a popular mode of transportation and can by ridden safely,
residents of the City and the Wright County Sheriff’s Office have observed a significant number
of riders of such vehicles operating them at unsafely high speeds and in a manner that creates a
safety hazard for riders, pedestrians, or other vehicles, and City park landscaping. The City finds
that the operation of electric bicycles in some circumstances is not consistent with the safety or
general welfare of bike paths, trails, or shared-use paths and in other locations where non-
electric bicycles are not permitted.
SECTION 2. Monticello City Code, Title VII, Chapter 71: RECREATIONAL MOTOR VEHICLES is
hereby amended to add the underlined language and delete the strikethrough language as
follows:
§ 71.02 DEFINITIONS.
For the purpose of this chapter, the following definitions shall apply unless the context clearly
indicates or requires a different meaning.
ALL-TERRAIN VEHICLE or VEHICLE. Has the meaning given in M.S. § 84.92, subd. 8, as it
may be amended from time to time.
CLASS 1 ATV. An ATV that has a total dry weight of less than 900 pounds.
CLASS 2 ATV. An ATV that has a total dry weight of 900 to 1,500 pounds.
DRIVER-OPERATOR. Every person who drives or operates and is in actual physical
control of a recreational vehicle.
ELECTRIC BICYCLE. An electric-assisted bicycle, as defined by Minnesota Statutes,
Section 169.011, subdivision 27.
MOTORIZED GOLF CART. A vehicle usually three or four wheeled, which is self-propelled
and is designed to be used to provide transportation on a golf course.

OWNER. A person, other than a lien holder, having the property in or title to a
recreational motor vehicle entitled to the use or possession thereof.
RECREATIONAL MOTOR VEHICLE (RMV). A self-propelled vehicle designed for travel on
snow, ice, or natural terrain steered by wheels, skis, or runners. Snowmobiles, Class 1 ATV,
Class 2 ATV, UTV, golf carts, go-carts, mini-bikes, dune buggies, and trail bikes are all RMVs.
SNOWMOBILE. A self-propelled vehicle designed for travel on snow or ice steered by
skis or runners.
§ 71.07 ELECTRIC BICYCLES.
(A) No person under the age of 15 years old may operate an electric bicycle within the city.
(B) No person shall operate an electric bicycle on natural or artificial turf, playfield,
playground, court, ice rink, natural area, or structure located in a designated public park unless
bicycles are otherwise permitted there.
§ 71.078 COMPLIANCE.
It is unlawful for an owner-operator to permit a recreational motor vehicle contrary to the
provisions of this chapter.
SECTION 3. Monticello City Code, Title IX, Chapter 94: STREETS AND SIDEWALKS is hereby
amended to add the underlined language and delete the strikethrough language as follows:

§ 94.45 DEFINITIONS.
For the purpose of this subchapter, the following definitions shall apply unless the context
clearly indicates or requires a different meaning.
CENTRAL BUSINESS DISTRICT. Any area of the city within a B-3 (highway business)
zoning district or B-4 (regional business) zoning district.
OPERATE. To ride on or control the operation of a skateboard, roller skates/blades, or
scooter.
OPERATOR. Every person who operates or is in actual physical control of a skateboard,
roller skates/blades, or scooter.

ROLLER SKATES/BLADES. A shoe with wheels attached or a device with wheels which is
designated to be attached to a shoe.
SCOOTER. A foot-operated vehicle consisting of a narrow board mounted between two
wheels, tandem, with an upright steering handle attached to the front wheel.
SKATEBOARDS. A wheeled device designed to transport a rider in a standing position,
which device is not otherwise secured to the rider’s feet or shoes.
ELECTRIC BICYCLE. An electric-assisted bicycle, as defined by Minnesota Statutes,
Section 169.011, subdivision 27.
MICROMOBILITY DEVICE. Any small, lightweight vehicle operated by a single rider,
including but not limited to skateboards, roller skates/blades, scooters, Segways/EPAMDs,
electric scooters, and hoverboards. The term also includes any substantially similar device,
whether human-powered or electric-powered.
MOTORCYCLE. A motor vehicle as defined by Minnesota Statutes, Section 169.011,
subd. 44.
MOTORIZED BICYCLE. A bicycle propelled by a motor which does not qualify as an
electric bicycle, as defined by Minnesota Statutes, Section 169.011, subd. 45.
OFF-HIGHWAY MOTORCYCLE. A motorized, off-highway vehicle as defined in Minnesota
Statutes, Section 84.787, subd. 7.
SEGWAY/ELECTRIC PERSONAL ASSISTIVE MOBILITY DEVICE (EPAMD). A device defined
by Minnesota Statutes, Section 169.011, subdivision 26 and regulated under Minnesota
Statutes, Section 169.212.
§ 94.46 PROHIBITED AREAS.
No person shall ride or use a skateboard, roller skates/blades, or scooter:
(A) On any public sidewalk, street, or any public parking lot situated in the Central Business
District in any careless, reckless, or negligent manner so as to endanger or be likely to endanger
the safety of any person or property of any other person;
(B) On any other public or private property of another without the express permission to do
so by the owner or occupant of the property; or
(C) On any state highway in the city.

(A) No person shall operate a micromobility device on any state trunk highway or
playground within the city limits, except where specifically permitted by state law.
(B) No person shall operate a Class 3 electric bicycle or multiple mode electric-assisted
bicycle with the motor engaged on a bicycle path, bicycle trail, or shared-use path in
accordance with Minnesota Statutes, Section 169.222, subd. 6a(c). Class 1 and Class 2 electric
bicycles are permitted where bicycles are otherwise allowed.
(C) No person shall operate a motorized bicycle, motorcycle, or off-highway motorcycle on
any public trail, sidewalk or park, except where specifically permitted by state law.
SECTION 4. This ordinance shall be effective immediately upon its passage and publication.

REFERENCE AND BACKGROUND
Monticello was awarded $800,000 through a Transportation Alternatives (TA) grant to
construct a pathway section along Golf Course Road/CSAH 39 between Elm Street and Chelsea
Road, which was identified as a high priority in the 2019 Safe Routes to School (SRTS) Plan. The
scope was later reduced to the section between Elm Street and 7th Street to due bridge
improvements that would be required if the pathway crossed I-94 to get to Chelsea Road. The
Minnesota Department of Transportation (MnDOT) approved the change in scope and allowed
Monticello to maintain the full funding level, which is split between the State’s fiscal year (FY)
2025 ($558,488) and FY 2026 ($241,512).
The project will install a 10-foot pathway along the north side of Golf Course Road from Elm
Street to 7th Street. The project will also include Wright County’s pavement preservation
project which includes reclaiming the roadway section and installing curb and gutter along with
associated storm sewer along the north side of the roadway. The roadway will be striped to
include a center two-way left turn lane. Construction is planned to start in the fall of 2025 or
spring of 2026 with final completion in the summer of 2026.
A bid opening was held on September 4, 2025, and five bids were received ranging in price from
$1,801,483.05 to $1,974,386.50. The low bid of $1,801,483.05 was submitted by Thomas and
Sons Construction, Inc.
MnDOT is currently reviewing the bid documents and approval for bid award is expected soon.
I. Budget Impact: The 2025 Capital Projects Fund Budget includes $1,600,000 for this project.
The construction cost estimate is $1,825,000 with Wright County’s portion of the project
estimated to be $665,000. The City costs will be offset by the $800,000 grant funds noted
above. The 2026 CIP will be updated to reflect the bid results.
II. Staff Workload Impact: City and County staff have been collaborating on the completion of
the project. Staff time to coordinate construction is estimated at approximately 80 hours.
III. Comprehensive Plan Impact: The extension of the pathway along Golf Course Road
enhances the city’s multimodal goals identified in the Transportation section of the
Comprehensive Plan by closing a key gap in the regional trail system and improving non-
motorized access along a collector roadway. The project also supports the Parks, Trails,
and Pathway section of the Comprehensive Plan by linking nearby residential areas to
existing parks, open spaces, and future trail corridors identified in the Pathway Plan Map.
The trail also supports the Land Use and Healthy Community section by promoting
walkability and safe active transportation options near developing neighborhoods, the
pathway extension aligns with land use goals for well-connected, livable communities.

PREVIOUS COUNCIL ACTION
January 14, 2019: Council authorized the payment of $167,000 to Wright County for the
discharge of stormwater from the Carlisle Village development per the
agreement with Wright County and rescinded the transfer of a portion of
County Ditch 33 to the City.
July 26, 2021: Council authorized the completion of a feasibility study for improvements
on County Ditch 33 for a total amount of $25,970.
August 8, 2022: Council approved the purchase of an easement for $18,000 for
construction of a new stormwater outlet from CSAH 39 to the Mississippi
River.
April 10, 2023: Council approved accepting a water quality grant in the amount of
$970,625 with Wright County for improvements to Ditch 33.
June 12, 2023: Council approved the purchase of a permanent easement for the
improvements to County Ditch 33 for a total amount of $63,000.
November 27, 2023: Council approved a contract with WSB for engineering services for the
Ditch 33 Improvements project in the amount of $196,534.
March 5, 2024: Council approved a contract amendment with WSB for engineering
services for the Ditch 33 Improvements project in the amount of $35,500.
February 2, 2025: Council approved a contract with TreeStory Inc. for tree removal in the
amount of $29,850.
May 12, 2025: Council approved approving the plans and specifications and
authorization to bid for the Ditch 33 Improvements Project.

REFERENCE AND BACKGROUND
Wright County Ditch (CD) 33 is a public drainage system managed by Wright County, which
serves as the Drainage Authority. The administration of CD 33 is subject to Minnesota Statute
Chapter 103E. Eastern portions of the City currently direct runoff to CD 33 as well as areas
located within the orderly annexation area.
The ditch was established in 1917, and many sections of it are in disrepair. The City has been
working with Wright County to determine potential solutions to alleviate flooding caused by
the failing ditch system while ensuring adequate capacity for future development. Rather than
having parallel systems for Ditch 33 and a future stormwater system with an outlet into the
Mississippi River, the City and County are partnering on a single Mississippi River stormwater
outfall. The City acquired the necessary easements, and the proposed a new outlet to the river
would be located just east of the Tyler East subdivision.
The City received $575,000 in federal funding through the Promoting Resilient Operations for
Transformative, Efficient, and Cost-Saving Transportation (PROTECT) program and $970,625 of
local funding from Wright County through their Water Quality grant program. Finally, Wright
County received $400,000 from the Minnesota Pollution Control Agency, resulting in a total of
$1,945,625 of grant funds for this project.
The Ditch 33 Improvements Project includes the construction of a 48” stormwater outfall to the
Mississippi River connecting to the existing Wright County Ditch 33 alignment just south of the
Tyler East subdivision.
A bid opening for the project was held on August 7, 2025, and 14 bids were received ranging
between $1,896,525.25 to $4,423,049. Rachel Contracting, LLC was the lowest bidder at
$1,896,525.25, which is slightly more than the engineer’s estimate of $1,760,864.
However, following the bid opening, concerns with a specific aspect of the scope of work were
identified during discussions with the Technical Evaluation Panel (TEP), which assists with
administering the Wetland Conservation Act. As a condition of the grant agreement for this
project, Wright County requires abandoning the section of ditch that will be bypassed by this
project, but TEP representatives noted concerns with that approach. Given the level of
concerns and the potential costs for abandoning that section of Ditch 33, staff recommends
rejecting all bids and re-bidding the project when the abandonment requirements are better
defined.
I. Budget Impact: The 2025 Stormwater Fund budget is $1,600,000 for this project, and the
2026 draft budget will include this project reflecting the recent bid prices should the ditch
abandonment requirements allow for such timing. The project costs will be offset by
$1,945,625 in grant funding as noted above.

II. Staff Workload Impact: City and County staff have been collaborating on the completion of
the project. Staff time to coordinate with the TEP panel and re-bidding is estimated at
approximately 100 hours.
III. Comprehensive Plan Impact: Improvements to Ditch 33 represent an investment in
supporting the future growth identified in the comprehensive plan. Enhanced stormwater
capacity and conveyance in this area will reduce flood risk and provide the necessary
infrastructure to support the development potential outlined in the Future Land Use Map.
These improvements directly support the Monticello 2040 vision by enabling development
while protecting environmental resources and maintaining long-term community livability.

RESOLUTION REJECTING BIDS AND AUTHORIZING READVERTISEMENT FOR BIDS FOR THE
DITCH 33 IMPROVEMENTS PROJECT
WHEREAS, pursuant to an advertisement for bids for the Ditch 33 Improvements
Project, fourteen bids were received complying with the advertisement. The bid which included
improvements of constructing a 48” stormwater outfall to the Mississippi River connecting the
existing Wright County Ditch 33 alignment just south of the Tyler East subdivision, fourteen
They were as follows:
1. Rachel Contracting, LLC $1,896,525.25
2. LaTour Construction, Inc $2,063,364.15
3. Northern Lines Contracting $2,081,630.00
4. Minger Construction Co. Inc. $2,208,000.00
5. S R Weidema, Incorporated $2,222,070.80
6. Kuechle Underground Inc. $2,232,202.70
7. RL Larson Excavating Inc. $2,387,497.95
8. D&D Contracting LLC $2,399,675.79
9. Geislinger & Sons $2,419,181.00
10. New Look Contracting, Inc. $2,424,857.00
11. Burschville Construction Inc. $2,616,229.50
12. Meyer Contracting Inc. $3,219,562.78
13. T. Scherber Demolition and Excavating LLC. $3,337,413.95
14. Dunnick Inc. $4,423,049.00
WHEREAS, the low bid submitted by Rachel Contracting, LLC, was higher than the
engineer’s estimate of $1,760,864; and
WHEREAS, Project funding received from Wright County requires the abandonment of a
section of Ditch 33; and
WHEREAS, additional permits are required prior to the abandonment of the ditch and
the timing and costs associated with these permits are unknown at this time.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF MONTICELLO,
MINNESOTA:
1. The City Council herby rejects all bids received.
