City Council Resolution 2026-15 (Conceyance Business subsidy kids haven)CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION 2026-15 Date I L, Motion By ouvlc,c1 wm,�(y Resolution No. Z 02— tc,) _ L Seconded By (vru"KLey �VV5�a,V�SDVI RESOLUTION APPROVING THE CONVEYANCE OF CERTAIN REAL PROPERTY AND A BUSINESS SUBSIDY WHEREAS, the City of Monticello ("City") owns real property legally described as Outlot C, Jefferson Commons, according to the recorded plat thereof, Wright County, Minnesota consisting of approximately 7.01 acres ("City Property" ); and WHEREAS, Kid's Haven of Monticello Holdings, LLC ("Buyer") desires to acquire a 2.93 acre portion of the City Property to lease to Kid's Haven of Monticello, LLC ("Tenant") for development of a new 26,704 sq. ft. childcare center; and WHEREAS, Buyer desires to plat the City Property as Lot 1, Block 1 and Outlot A, Jefferson Commons Fifth Addition and acquire Lot 1, Block 1 of the Plat ("Subject Property") from the City for the childcare center; and WHEREAS, the City proposes to convey the Subject Property to Buyer, subject to Buyer and Tenant entering into the Contract for Private Development Agreement presented to the City Council ("Contract") which includes a business subsidy in the form of a loan in the amount of $258,926 for a portion of the purchase price of the land, with the understanding that the Subject Property will be developed into a child care center and be maintained as such for a minimum period of five (5) years; and WHEREAS, maintaining ownership of the Subject Property by the City would not serve the public interest; and WHEREAS, the City believes that the terms of the Contract are reasonable and the conveyance of the Subject Property is in the best interest of the City; and WHEREAS, Minn. Stat. §462.356, subd. 2 requires that the Planning Commission review the City's proposed disposal of real property for compliance with the comprehensive plan and to report to the City Council in writing its findings; and 238658vl WHEREAS, the Planning Commission has reviewed the proposed conveyance of the Property and has found that the conveyance is consistent with the City's comprehensive plan; and WHEREAS, as required under Minn. Stat. 116J. 994, subd. 5, a hearing has been held on the proposed business subsidy to be granted for the conveyance of the Subject Property preceded by the required public notice. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Monticello, Minnesota: 1. The Contract for Private Development is hereby approved; and 2. The Mayor and City Administrator are authorized to execute any documents which, in the opinion of the City Attorney, are necessary to complete this transaction.
