RESOLUTION 2026-43
A RESOLUTION APPROVING THE SECOND AMENDMENT TO DEVELOPMENT CONTRACT AND
PLANNED UNIT DEVELOPMENT AGREEMENT FOR STONY BROOK VILLAGE
WHEREAS, on September 13, 2021, the City entered into a Development Contract and
Planned Unit Development with Mark Elliot Homes, LLC, a Minnesota limited liability company
("MEH"), related to the plat known as STONY BROOK VILLAGE (the "Development Contract"); and
WHEREAS, the Development Contract affects and concerns the real property legally
described on the attached Exhibit A (the "Property"). The Development Contract was recorded
on April 27, 2022 as Document No. A1505364 in the Office of the Wright County Recorder; and
WHEREAS, construction of the Improvements as required by the Development Contract
has commenced but has not been completed in full; and
WHEREAS, the Developer is the fee owner of the Property and the successor in interest
to MEH; and
WHEREAS, as successor in interest, the Developer is responsible to the completion of
Improvements as required by the Development Contract; and
WHEREAS, the Second Amendment to Development Agreement and Planned Unit
Development Agreement for Stony Brook Village provides for the status and completion of
Improvements as required, specifying the submission of cash escrow for the review, inspection
and administration of the plat by the successor in interest.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Monticello, Minnesota
hereby approves the Second Amendment to Development Contract and Planned Unit
Development Agreement for Stony Brook Village and authorizes the Mayor and Clerk to
execute documents necessary to effectuate the Amendment upon submission by the Successor
Developer of all escrows and financial securities required under the Contract and Agreement.
ADOPTED this 26th day of May, 2026, by the City Council of the City of Monticello, Minnesota.
