RESOLUTION DENYING AN AMENDMENT TO A CONDITIONAL USE PERMIT FOR A
RESTAURANT WITHIN 300 FEET OF A RESIDENTIAL ZONING DISTRICT IN THE B-4, REGIONAL
BUSINESS DISTRICT

WHEREAS, the applicant has submitted a request for an amendment to a Conditional
Use Permit for a restaurant within 300 feet of a Residential Zoning District; and
WHEREAS, the proposed facility is intended to construct the restaurant as a part of a
new mixed -use commercial building on an existing undeveloped parcel; and
WHEREAS, the site is zoned as B-4, Regional Commercial and is subject to a Conditional
Use Permit requirement; and
WHEREAS, the proposed amendment relies on a reconfiguration of the site plan
involving a second driveway access to the site, which access requires approval of a separate
variance; and
WHEREAS, the Planning Commission has denied said variance application, such that the
reconfiguration of the site plan is not feasible as proposed; and
WHEREAS, the Planning Commission held a public hearing on August 41", 2026, on the
application and the applicant and members of the public were provided the opportunity to
present information to the Planning Commission; and
WHEREAS, the Planning Commission has recommended denial of the proposed
amendment to conditional use permit; and
WHEREAS, the City Council has considered all of the comments of the Planning
Commission, the public, and the staff report, which are incorporated by reference into the
resolution; and
WHEREAS, the City Council makes the following Findings of Fact in relation to denial of
the conditional use permit:
1. The proposed use is dependent on reconfiguration of the site through a separate
variance request for lot access.
2. The Planning Commission has denied that separate variance, making the
reconfiguration of the site plan unviable.
3. The original Conditional Use Permit granted in May of 2026 remains in place.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: that
the City Council hereby denies the Amendment to the Conditional Use Permit for a restaurant
and attached retail space, based on the failure of the separate variance request and the
findings herein.
ADOPTED this 24th day of August, 2026 by the City Council of the City of Monticello,
Minnesota.
