RESOLUTION 2026-80
RESOLUTION APPROVING REVOCATION OF CONDITIONAL USE PERMIT FOR
CROSS ACCESS IN A B-4, REGIONAL BUSINESS DISTRICT BETWEEN
THAT PORTION TO BE PLATTED AS LOT 1, BLOCK 1, JEFFERSON COMMONS FIFTH ADDITION)
AND PARCELS 155192001011, 155164000070
WHEREAS, the applicant has previously received approval for a Conditional Use Permit
for cross access over and with adjoining parcels; and
WHEREAS, the applicant has requested the revocation of the cross access conditional
use permit at the request of the additional party to the cross access; and
WHEREAS, the elimination of the proposed access does not limit the reasonable
subdivision of commercial property; and
WHEREAS, the site plan has been revised to illustrate improvements which remain
compliant with existing agreements and approvals; and
WHEREAS, the Planning Commission held a public hearing on August 4, 2026 on the
application and the applicant and members of the public were provided the opportunity to
present information to the Planning Commission; and
WHEREAS, the City Council has considered all of the comments of the Planning
Commission, the public, and the staff report, which are incorporated by reference into the
resolution; and
WHEREAS, the City Council makes the following Findings of Fact in relation to the
revocation of the CUP for shared access:
1. The applicant has provided plans demonstrating that the use will improve long-term
use of, and access to, the site for uses in the subject zoning district and
Comprehensive Plan land use category.
2. The parcel is intended for commercial uses, which is the existing and proposed use
of the property.
3. The operation of the business will not be limited by the removal of the cross -access
condition and retains configurations for appropriate vehicle access and fire safety.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: that
the Monticello City Council approves the revocation of the Conditional Use Permit for cross
access.
ADOPTED this 24th day of August, 2026 by the City Council of the City of Monticello,
Minnesota.
