MINUTES
JOINT MEETING - PLANNING COMMISSION & CITY COUNCIL
March 9, 1981 - 6:30 P.M. - Monticello City Hall
CITY COUNCIL MEMBERS PRESENT:
Arve Grimsmo, Phil White, Fran Fair, Dan Blonigen, Ken Maus.
PLANNING COMMISSION MEMBERS PRESENT:
Dick Martie, John Bondhus, Bill Burke, Loren Klein.
PLANNING COMMISSION MEMBERS ABSENT:
Ed Schaffer, Jim Ridgeway.
The purpose of the Joint Meeting between the City Council and the Planning Commis-
sion was to review the process previously recommended by the Planning Commission
to simplify the variance procedure. This procedure would involve having the
Planning Commission appointed as the Board of Adjustment and Appeals.
As a result of this proposed change by the Planning Commission, the Commission
itself would hold the public hearing and its decision on variances would be
final unless an appeal was filed in writing within five days after the Plan-
ning Commission meeting. This appeal would then be heard by the City Council
for final action. The primary purpose of the revision in the process was to
expedite variances that are non-controversial. By allowing the appeal process,
this would still allow the applicant or any citizen to appeal the decision
of the Planning Commission if it was felt the decision was unreasonable.
The pros and cons of the proposed ordinance amendment were discussed at length
with the final consensus of both bodies to have the fOllowing procedure set up
and reviewed by our City Attorney before final enactment by the City Council:
1. Planning Commission to become the Board of Adjustment and Appeals.
2. 4/5's Vote of the Planning Commission would be required for approval of a
variance.
3. An appeal could be filed within five (5) days, by any citizen including the
applicant, after the Planning Commission meeting.
4. If an appeal was filed, the City Council would hold another hearing at the
Council level.
5. Notice sent to property owners on the hearing at the Planning Commission level
would indicate the process for appeal and indicate if an appeal was filed when
it would be heard by the City Council. It was also felt it would be a good
idea to indicate to people receiving the notice that if an appeal were coming
up for hearing, it would be published in the paper.

City Administrator, Gary Wieber, was directed to review the proposed changes with
Gary Pringle, City Attorney, before final ordinance amendment enactment by the
City Council.
