RESOLUTION NO. 2012-073
APPROVING VACATION OF DRAINAGE AND UTILITY EASEMENTS BETWEEN
LOTS 24, 25, AND 26; APPROVING SIMPLE SUBDIVISION OF LOT 25; AND
APPROVING ADMINISTRATIVE LOT COMBINATION OF LOT 24 PLUS PART OF
LOT 25 AND OF LOT 26 PLUS PART OF LOT 25;
LOTS 24,25 AND 26, BLOCK 1, CARLISLE VILLAGE 5TH ADDITION
WHEREAS, the City of Monticello did receive petitions dated August 13, 2012, from the
owners of Lots 24, 25 and 26, Block 1, Carlisle Village 5th Addition requesting vacation of a
portion of the 12 foot drainage and utility easements on the boundary lying between said lots;
and
WHEREAS, the owner of Lot 25, Block 1, Carlisle Village 5tt' Addition requested a Simple
Subdivision of said Lot 25, subject to vacation of the easements; and
WHEREAS, the owners of Lots 24 and 26, Block 1, Carlisle Village 5t' Addition requested an
Administrative Lot Combination of Lot 24 and part of Lot 25 and Lot 26 and part of Lot 25,
subject to vacation of the easements and approval of the Simple Subdivision of Lot 25; and
WHEREAS, on August 16 and 23, 2012, the City published notice of a Public Hearing to be held
on August 27, 2012, to consider vacating a portion of the drainage and utility easements on the
boundary lying between Lots 24, 25 and 26, Block 1, Carlisle Village 5t'' Addition; and
WHEREAS, on August 17, 2012, affected property owners were mailed a notice of the Public
Hearing to be held August 27, 2012;
NOW THEREFORE, BE IT RESOLVED BY THE CITY CO UNCIL OF MONTICELLO,
MINNESOTA: that the drainage and utility easements be vacated and re- established as
described in Attachment "A "; and
THEREFORE, BE IT FURTHER RESOLVED: that the Monticello City Council approves the
Simple Subdivision of Lot 25, Block 1, Carlisle Village 5th Addition as described in Attachment
"B "• and
THEREFORE, BE IT FURTHER RESOLVED: that the Monticello City Council approves the
Administrative Lot Combination of Lot 24 and part of Lot 25 and Lot 26 and part of Lot 25,
Block 1, Carlisle Village 5th Addition as described in Attachment "C'; and
THEREFORE, BE IT FURTHER RESOLVED BY THE MONTICELLO CITY COUNCIL:
that granting of said vacation is subject to the following conditions:
• The applicants shall provide a revised Certificate of Survey for each of the two
resulting lots within 60 days of approval of the simple subdivision and lot
combination.
• The applicants shall sign a drainage and utility easement in favor of the City of
Monticello, reestablishing interior lot drainage and utility easements.
• The drainage and utility easement in place over the ponding area shall remain
unaffected by the subdivision and combination.
• Property owners are responsible for working with private utilities if relocation of
utilities in easements to be vacated is needed.
• The resulting Lot 24 and Lot 26 shall each retain a single curb cut access after
combination with resulting portion of Lot 25.
• Per City Ordinance Title 7, the water and sewer services are the responsibility of the
property owner from the main to the premises. The installation of a cap at the end of
the curb stop and the lowering of the standpipe on Lot 25 is a requirement of the
approval of the simple subdivision and lot combination.
• Properties maybe subject to 1 '/2 times assessment for future road improvements,
based on origina ,platting of lots.

feet northerly of and parallel with the southerly lines of said Lot 25 and Lot 26, and lying
