ACCEPTING A PETITION AND CALLING FOR A PUBLIC HEARING FOR
VACATION OF OTTER CREEK ROAD RIGHT -OF -WAY AND VACATION OF
DRAINAGE AND UTILITY EASEMENTS ACROSS OUTLOT A AND LOTS 1 AND 29
BLOCK 1, PINE VIEW ADDITION

WHEREAS, a petition was received on February 11, 2014, requesting vacation of a portion of
the Otter Creed Road right -of -way, adjacent to Outlot A of Pine View Addition, and vacation of
drainage and utility easements across Outlot A and Lots 1 and 2, Block 1 of Pine View Addition,
and included as Attachment "A "; and
WHEREAS, the Monticello City Council, pursuant to Minnesota Statute 412.851 and 462.358,
desires to consider the vacation of Otter Creek Road right -of -way of the following property
legally described as follows:
That part of Government Lot 1 of Section 3, Township 121, Range 25, Wright
County, Minnesota described as follows: Commencing at the most northerly
corner of PINE VIEW, according to the recorded plat thereof, Wright County,
Minnesota; thence on an assumed bearing of South 0 degrees 18 minutes 18
seconds East along the west tine of said PINE VIEW, a distance of 3 5.3 2 feet to
the point of beginning of the land to be described; thence South 27 degrees 29
minutes 21 seconds West, a distance of 120.27 feet to the east line of
CREEKSIDE TERRACE, according to the recorded plat thereof, Wright County,
Minnesota; thence South 0 degrees 03 minutes 00 seconds West along said east
line, a distance of 18.16 feet to the northwesterly extension of the southwesterly
line of said PINEVIEW; thence South 64 degrees East along said extension line, a
distance of 62.69 feet to southwesterly corner of said PINE VIEW; thence North 0
degrees 18 minutes 18 seconds west along said west line of PINE VIEW, a
distance of 152.33 feet to the point of beginning.
WHEREAS, the Monticello City Council, pursuant to Minnesota Statute 412.851 and 462.358,
also desires to consider the vacation of drainage and utility easements over and across the
following property legally described as follows:
The drainage and utility easements across Outlot A and Lots 1 and 2, Block 1,
PINE VIEW, according to the recorded plat thereof, Wright County, Minnesota.
NOW THEREFORE, BE IT HEREB Y RESOL VED BY THE CITY COUNCIL OF
MONTICELLO, MINNESOTA:
1. The Council will consider the vacation of right -of -way and easements and a public
hearing shall be held on such proposed vacation on the 24th day of March, 2014, before
the City Council in the Council Chambers located at the Monticello Community Center at
7 p.m.

2. The City Clerk is hereby directed to give published, posted and mailed notice of such
hearing as required by law.

Petition by Owner of request for vacation of easements
PLAT: PINE VIEW SECOND ADDITION
NARRATIVE:
It is the applicants proposed intention to Plat the remaining property known as Pine View Second
Addition, so as to be better suited for residential development. Platting Two (2) addition lots known as;
Lot 1 and Lot 2, Block 1, Pine View.
It is the applicants' intention to sell these lots to a Residential Developer or Private Persons for the
purpose of building one (1) Single Family Home on each Lot. These homes are to be constructed in
accordance with The City of Monticello's Codes and Statutes.
Public Improvements follow City of Monticello requirements and will be made by the Developer, upon
which time necessary in the development process.
No Environmental Impact is noted at this time and is unforeseen, as these lots are clearly buffered and
consistent with the current residential surrounding area.,
No Homeowners Association is applicable to this development.
As stated, these properties will be marketed for the purposes of (1) one Single Family Home, consistent
with City of Monticello requirements, codes, and statutes at such time.

This Petition is submitted for the purpose of the Property listed being Platted to improve facilitating
Residential Development. At this time we have already removed and developed (1) of the lots shown on
the Preliminary Plat as; Lot 3, Block 1, Pine View. We hereby, petition the City of Monticello to grant
Vacation of Easements, and a subsequent approval of the Plat showing (2) two additional lots which may
better utilizing the property and facilitate Residential Development. It is KK Construction, Inc. full
intenti n to sell these each lot to a local Developer or Persons with the intention of building (1) one
