City Council Resolution 2014-37CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2014-037 APPROVING A FINAL PLAT FOR PINE VIEW SECOND ADDITION WHEREAS, KK Construction/Kent Kjellberg is requesting a Final Plat approval of the Pine View Second Addition subdivision; and WHEREAS, the Planning Commission held a public hearing on March 4th, 2014 on the preliminary plat application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The proposed plat is consistent with the land use plans of the City of Monticello's Comprehensive Plan; 2. The proposed plat is consistent with the standards of the applicable R -1 zoning district; 3. The proposed plat will be able to meet all the standards of the City's development regulations with the incorporation of staff comments and recommendations. WHEREAS, after taking public comment, the Planning Commission recommended approval of the preliminary plat of Pine View Second Addition to the City Council per Resolution 2014 -021; and WHEREAS, upon review of the preliminary plat and final plat for Pine View Second Addition, planning staff recommended approval of the plat revision in its report based on the finding that the subdivision will adhere to the subdivision ordinance requirements; and WHEREAS, the Monticello City Council reviewed the recommendation of the Planning Commission on April 10, 2014; NO W THEREFORE, BE IT RESOL VED B Y THE CITY CO UNCIL OF MONTICELL O, MINNESOTA, that the final plat of the Pine View Second Addition, with drainage and utility easements as required, is hereby approved contingent upon meeting all conditions of the subdivision ordinance; and the following conditions: 1) The final plat shall be revised to include proper documentation of the vacation of Otter Creek right of way and drainage and utility easements. 2) The applicant shall provide drainage, erosion control, and stormwater management plans for review and approval by the City Engineer, and will need to address any recommendations the engineer makes in this regards. Further, development of the proposed lots will need to adhere to erosion control and drainage requirements provided in Sec. 11 -5 -5 and 11 -5 -6 of the Subdivision Ordinance, in addition to meeting related standards provided in Zoning Ordinance Section 4.10. 3) The applicant shall comply with all recommendations of the City's Consulting Engineer as provided in the comment letter dated February 26th, 2014. 4) Future dwellings on subdivided parcels are required to meet the minimum width, depth, and floor area standards provided in Chapter 5, Section 5.2(C) of the Zoning Ordinance, and the minimum garage area standards for accessory garages in the R -1 District. 5) No building permits for lots shall be issued until the City has received satisfaction that the plat has been recorded at the Wright County Recorder's Office. 6) The applicant shall execute a development agreement covering the terms of the City's Plat and PUD approval. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF MONTICELL 0, MINNESOTA, that the document titled "Development Contract — Pine View Second Addition," with assignment of the specific terms and conditions for public improvements and the specific terms and conditions for plat development, is hereby approved.
