City Council Resolution 2014-38CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2014-038 APPROVING A FINAL PLAT FOR UNION CROSSINGS SIXTH ADDITION AND AMENDMENT TO A PLANNED UNIT DEVELOPMENT WHEREAS, Ryan Companies US Inc. is requesting a Final Plat and PUD amendment to subdivide Lot 2, Block 1 of Union Crossings 5th Addition and approval of the resulting Union Crossings Sixth Addition subdivision; and WHEREAS, upon review of the site survey and final plat for Union Crossings Sixth Addition, planning staff recommended approval of the plat revision in its report based on the finding that the subdivision will adhere to Union Crossings PUD, B -4 District, and subdivision ordinance requirements; and WHEREAS, the Planning Commission held a public hearing on April 1, 2014 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The proposed Union Crossings Sixth Addition subdivision will adhere to established Union Crossings PUD, B -4 District, and subdivision ordinance requirements; and 2. The proposed Union Crossings Sixth Addition subdivision will support commercial uses designated for the subject area in the Monticello Comprehensive Plan. WHEREAS, after taking public comment, the Planning Commission recommended approval of the final plat of Union Crossings Sixth Addition to the City Council per Resolution 2014- 03 5; and WHEREAS, the Monticello City Council reviewed the recommendation of the Planning Commission on April 14th, 2014; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA, that the final plat and amendment to Planned Unit Development of the Union Crossings Sixth Addition, with drainage and utility easements as required, is hereby approved contingent upon meeting all conditions of the subdivision ordinance; and the following conditions: 1. The applicant shall revise the plans to comply with all recommendations of the City Engineer regarding grading, drainage, and utilities, if any. 2. The applicant shall provide documentation of updated easements for public and private sewer, water, and access to the new parcels in the plat. 3. Execute a development agreement covering the terms of the City's Plat and PUD approval. BE IT FURTHER RESOL VED BY THE CITY COUNCIL OF MONTICELL0, MINNESOTA, that the document titled "Amendment to Development Contact and Planned Unit Development Agreement — Union Crossings Sixth Addition," with assignment of the specific terms and conditions for public improvements and the specific terms and conditions for plat development, is hereby approved.
