AN ORDINANCE AMENDING TITLE 10, CHAPTERS OF THE MONTICELLO CITY
CODE, KNOWN AS THE ZONING ORDINANCE, BY AMENDING CHAPTER
2.4(C)(4)(C) AND CHAPTER 2.4(C)(7) RELATING TO THE APPEALS PROCESS FOR
DECISIONS OF THE BOARD OF APPEALS AND ADJUSTMENTS; AND CHAPTER
2.4(D)(8) RELATING TO THE TIME LIMIT FOR EFFECTING AN APPROVED
CONDITIONAL USE PERMIT
THE CITY COUNCIL OF THE CITY OF MONTICELLO HEREBY ORDAINS:
Section 1. Chapter 2.4 (C) — Variances is hereby amended to read as follows:
2.4(C)(4) Review
(c) Appeal of Variance Decision
Decisions of the Board of Adjustment and Appeals are final unless the
applicant or an affected party, including any member of the City
Council, files a written appeal outlining the basis for the appeal within
five (5) ten (10) business days of the decision. Variance appeals shall be
reviewed by the City Council as outlined in Section 2.4(H)(3)(c) subject to
the review criteria in Section 2.4(H)(4).
Section 2. Chapter 2.4 (C) - Variances is hereby amended to read as follows:
2.4(C)(7) Time Limit
(a) Unless otherwise specified in the Variance, if a Building Permit has not
been secured within six meni one (1) year of the date of the Variance
approval, the Variance shall become invalid. Permitted timeframes do
not change with successive owners.
(b) Upon written request, one extension of civ meat one (1) year may be
granted by the Community Development Department if the applicant can
show good cause.
Section 3. Chapter 2.4 (D) — Conditional Use Permits is hereby amended to read as follows:
2.4 (D)(8) Time Limit
(b) If the operation of the use and/or issuance of building permits has not
commenced within one year of the date of approval, the applicant may
petition for an extension of time in which to eemplete commence the
work that has been granted by the Conditional Use Permit. Such
extension shall be requested in writing and filed with the Community
Development Department at least thirty (30) days before the expiration
of the eenditional use per-mione year period. The request for extension
shall state facts supporting good cause for extension of the conditional
use permit. Such petition shall be presented to the Planning

Commission for a recommendation and to the City Council for a
decision.
Section 4. The City Clerk is hereby directed to make the changes required by this Ordinance
as part of the Official Monticello City Code, Title 10, Zoning Ordinance, and to
renumber the tables and chapters accordingly as necessary to provide the intended
effect of this Ordinance. The City Clerk is further directed to make necessary
corrections to any internal citations and diagrams that result from such
amendments, provided that such changes retain the purpose and intent of the
Zoning Ordinance as has been adopted.
Section 5. This Ordinance shall take effect and be in full force from and after its passage and
publication. Revisions will be made online after adoption by Council. Copies of
the complete Zoning Ordinance are available online and at Monticello City Hall.
