City Council Resolution 1999-61RESOLUTION NO. 99-61 RESOLUTION VACATING UTILITY EASEMENT (OCELLO LLC) WHEREAS, a public hearing on the vacation of a drainage and utility easement across portions of the Southeast Quarter of Section 15, Township 121, Range 25 as described below was held on October 25, 1999 at 7 p.m. at the Monticello City Hall, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: that the following described drainage and utility easement be vacated by the City of Monticello: That part of the Southeast Quarter of Section 15, Township 121, Range 25, Wright County, Minnesota described as follows: Commencing at the Southwest corner of said Southeast Quarter; thence North along the West line of said Southeast Quarter a distance of 1170.18 feet to the point of beginning of the land to be described; thence East parallel with the South line of said Southeast Quarter, a distance of 723.00 feet; thence North, parallel with the West line of said Southeast Quarter, to the North line of said Southeast Quarter; thence West along said North line to the Northwest corner of said Southeast Quarter; thence South along the West line of said Southeast Quarter to the point of beginning which lies within the following permanent easements for drainage and utility purposes: A strip of land 50.00 feet in width over that part of the Southeast Quarter of Section 15, Township 121, Range 25, Wright County, Minnesota, the centerline of which is described as follows: Commencing at the Southwest corner of said Southeast4Quarter; thence North along the West line of said Southeast Quarter a distance of 1170.18 feet; thence East, parallel with the South line of said Southeast Quarter, a distance of 723.00 feet; thence North, parallel with the West line of said Southeast Quarter a distance of 1071.32 feet to the point of beginning of said centerline to be hereinafter described, said centerline to be hereinafter referred to as "Line B", thence Southwesterly deflecting to the left 121 degrees 52 minutes 13 seconds a distance of 272.71 feet; thence Southwesterly, deflecting to the right 02 degrees 57 minutes 40 seconds a distance of 116.29 feet to a point to be hereinafter referred to as "Point A" and said centerline and "Line B" there terminating. 0 Said strip of land is to extend by its full width from a line drawn parallel with said West line of the Southeast Quarter and passes through the point of beginning to a line drawn perpendicular to said "Line B" and passes through said "Point A". And also a strip of land 30.00 feet in width over that part of said Southeast Quarter, the centerline of which is described as follows: Beginning at said above referenced "Point A"; thence Southwesterly, along the Southwesterly extension of said above referenced "Line B" a distance of 445.06 feet to the West line of said Southeast Quarter and said centerline there terminating. Said strip of land is to extend by its full width from said line drawn perpendicular to "Line B" and passes through "Point A" to said West line of the Southeast Quarter. Also which lies within the following temporary easements for construction purposes: A strip of land 50.00 feet in width over that part of said Southeast Quarter the Southeasterly line of which is contiguous with the Northwesterly line of the first above described perpetual easement. Said strip of land is to extend by its full width from the Northerly extension of the Easterly line of the first above described permanent easement to said line drawn perpendicular to "Line B" and passes through "Point A". And also a strip of land 50.00 feet in width over that part of said Southeast Quarter the Northwesterly line of which is contiguous with the Southeasterly line of the first above described permanent easement. Said strip of land is to extend by its full width from the Southerly extension of the Easterly line of the first above described permanent easement to said line drawnperpendicularto "Line B" and passes through "'Point A". And also a strip of land 60.00 feet in width over that part of said Southeast Quarter, the Southeasterly line of which is contiguous with the Northwesterly line of the last above described permanent easement. Said strip of land is to extend by its full width from said line drawn perpendicular to "Line B" and passes through "Point A" to said West line of the Southeast Quarter. And also a strip of land 60.00 feet in width over that part of said Southeast Quarter the Northwesterly line of which is contiguous with the Southeasterly line of the last above described permanent easement. Said strip of land is to extend by its full width from said line drawn perpendicular to "Line B" and passes through "Point A" to said West line of the Southeast Quarter.
