AN ORDINANCE AMENDING TITLE 3 OF THE MONTICELLO CITY CODE
BY AMENDING CHAPTER 10

The City Council of the City of Monticello does hereby ordain:
Section 1: The City Code is hereby amended as follows:
3-10-1: DEFINITION: When used in this ordinance, the following term has the following

meaning:
(A) "Transient merchant" includes any person, firm, or corporation, whether as
owner, agent, consignee, or employee, who engages in a temporary
business (for six months or less) of selling and delivering goods, wares,
and merchandise, or buying and receiving goods, wares, and merchandise
within the city and who, in furtherance of such purpose, hires, leases, uses,
or occupies any building, structure, motor vehicle, trailer, tent, railroad
boxcar, boat, public room in hotels, lodging houses, apartments, shops, or
any street, alley, or other place within the city for the exhibition and sale
of such goods, wares, and merchandise either privately or at public
auction, provided that such definition does not include any person, firm, or
corporation who, while occupying such temporary location, does not sell
from stock but exhibits samples for the purpose of securing orders for
future delivery only. Location utilized by transient merchants shall be
consistent with uses identified as permitted in particular zoning district
and adequate off-street parking is available.

GENERAL LICENSE RESTRICTIONS:
1. No transient merchant shall sell or offer for sale any goods, wares,
or merchandise within the city from a stationary location on public
or private property without first obtaining the written consent of
the property owner or occupant.
2. No transient merchant license shall be issued nor shall any vendor
conduct sales from any location which does not have sufficient
parking for customers and for areas where customer parking would
interfere with normal traffic flow. The space used by the vendor,
including_ space used for off-street parking, shall not exceed the
space needed for the existing business at the site. Adequate off-
street parking shall be available to meet the required principal use
of the property and the transient merchant/vendor use of the
property.
3. Only one (1) transient merchant license shall be issued per location
(property owner) at any given time.
4. No merchant shall display or off for sale any merchandise within
or upon any public right-of-way or within the front or side yard
setback areas of the appropriate zoning district.
5. No merchant shall display or offer for sale any merchandise at
locations that are not consistent with the uses identified as
permitted in a particular zoning district.
6. No signage shall violate Cit, code ode provisions relating to size,
location and number of business signs allowed for the property
being used. No signage is allowed to be placed within the public
right -of -waw

3-10-4: EXEMPTIONS FROM LICENSING AND PERMIT FEES
Sale of farm or garden products by the person or persons producingthe_
product provided the vendor complies with the following conditions:
1. No vendor shall conduct sales from anv location which does not
have sufficient parking for customers and for areas where customer
parking would interfere with normal traffic flow. The space used
by the vendor, including_ space used for off-street parking, shall not
exceed the space needed for the existing business at the site.
Adequate off-street parking shall be available to meet the required
principal use of the property and the transient merchant/vendor use
of the property_

Section II. Effective Date: This ordinance shall become effective immediately upon its
passage and publication according to law.
