AN ORDINANCE AMENDING TITLE 10 OF THE MONTICELLO CITY
CODE (THE ZONING ORDINANCE) ADDRESSING ACCESSORY
BUILDINGS, USES, AND EQUIPMENT.
THE CITY COUNCIL OF THE CITY OF MONTICELLO DOES HEREBY
ORDAIN:
Title 10, Section 2-2, of the Monticello City Code (Definitions) is hereby amended to
delete the following:
(AA) Accessory Building or Use: A subordinate building or use which is
located on the same lot on which the main building or use is situated
and which is reasonably necessary and incidental to the conduct of the
primary use of such building or main use.
Title 10, Section 2-2, of the Monticello City Code (Definitions) is hereby amended to
add the following:
(AA) Accessory Building: A portion of the principal building or a detached
principal building or a detached structure on the same lot which is
used for an accessory use.
(AA1) Accessory Use: A use of a land or of a building or portion thereof
customarily incidental and subordinate to the principal building and
located on the same lot with such principal use.
Title 10, Section 3-2(D), of the Monticello City Code (Accessory Building
Requirements) is hereby amended to read as follows:
(D) ACCESSORY BUILDINGS, USES, AND EQUIPMENT:
1. An accessory building shall be considered an integral part of the
principal building if it is connected to the principal building
either directly or by an enclosed passageway.
2. No detached accessory building shall be erected or located
within any required yard other than the rear yard.
3. Detached accessory buildings shall not exceed fifteen (15) feet in
height and shall be ten (10) feet or more from all side lot lines of
adjoining lots, five (5) feet or more from the rear lot line, shall
be ten (10) feet or more from any other building or structure on
the same lot, and shall not be located within a utility easement.

4. No detached accessory building shall exceed ten percent (10%) of
the rear yard or 1,000 square feet in floor area, whichever is
less.
5. Each applicant for a building permit to construct any dwelling
shall be required to provide off-street parking space for at least
one (1) automobile per family to be housed, in addition to any
garage space to be used. Subject to the following exceptions, no
permit shall be issued for the construction of more than one (1)
private, detached accessory structure for each dwelling, except:
a. By conditional use permit, or
b. For conforming single family dwellings, one (1) detached
accessory structure of not more than 120 square feet shall
be permitted as a second accessory structure without a
conditional use permit, subject to all other applicable
codes and standards.
6. No accessory uses or equipment such as air conditioning cooling
structures or condensers which generate noise may be located in
a side yard except for side yards abutting streets where
equipment is fully screened from view.
This ordinance shall become effective immediately upon its passage and
publication.
