(9)BuildingHeight ThefollowingminimumrequirementsshallbeobservedintheWSRRoverlaydistrict: (a)Themaximumheightofprincipalstructuresshallnotexceed25feet. (b)Themaximumheightofaccessorystructuresshallnotexceed25feet. (10)Additionalstructureandusestandards (a)Placementofstructures Structuresshallnotbelocatedonslopesgreaterthan12percentexceptbyconditionaluse permitasprovidedforinsubsection3.7(E)(7). (b)Maximumdensity ThemaximumdensityintheWSRRoverlaydistrictshallnotexceedonedwellingunit perlotwiththeexceptionofapprovedaccessorydwellingunits. (d)Stormwatermanagement Subjecttoothermorerestrictivelimitationswhichmaybeimposedbythisordinance,the followinggeneralandspecificstandardsshallapply: (i)Generalstandards 1.Whenpossible,existingnaturaldrainageways,wetlands,andvegetatedsoil surfacesshallbeusedtoconvey,store,filter,andretainstormwaterrunoffbefore dischargetopublicwaters. 2.Developmentshallbeplannedandconductedinamannerthatwillminimizethe extentofdisturbedareas,runoffvelocities,erosionpotential,andreduceand delayrunoffvolumes.Disturbedareasmustbestabilizedandprotectedassoon aspossibleandfacilitiesormethodsusedtoretainsedimentonthesite. 3.Whendevelopmentdensity,topographicfeatures,andsoilandvegetation conditionsarenotsufficienttoadequatelyhandlestormwaterrunoffusingnatural featuresandvegetation,varioustypesofconstructedfacilitiessuchasdiversions, settlingbasins,skimmingdevices,dikes,waterways,andpondsmaybeused. Preferenceshallbegiventodesignsusingsurfacedrainage,vegetation,and infiltrationratherthanburiedpipesandmanmadematerialsandfacilities. (ii)SpecificStandards 1.Whenconstructedfacilitiesareusedforstormwatermanagement,documentation shallbeprovidedbyaqualifiedindividualthattheyaredesignedandinstalled consistentwiththefieldofficetechnicalguideofthelocalsoilandwater conservationdistricts. 2.Newconstructedstormwateroutfallstopublicwatersshallprovideforfiltering orsettlingofsuspendedsolidsandskimmingofsurfacedebrisbeforedischarge. (e)SpecialProvisionsforCommercial,Industrial,Public/Semipublic,Agricultural,and Forestry (i)Standardsforcommercial,industrial,public,andsemipublicuses 1.Surfacewater-orientedcommercialusesandindustrial,public,orsemipublic useswithsimilarneedsforaccesstoanduseofpublicwatersmaybelocatedon parcelsorlotswithfrontageonpublicwaters.Subjecttoothermorerestrictive limitationswhichmaybeimposedbythischapter,thoseuseswithwater-oriented needsshallmeetthefollowingstandards: a.Inadditiontomeetingimperviouscoveragelimits,setbacks,andother zoningstandardsinthischapter,theusesshallbedesignedtoincorporate topographicandvegetativescreeningofparkingareasandstructures; ORDINANCENO.545 Page 8 of 42 b.Usesthatrequireshort-termwatercraftmooringforpatronsmustcentralize thesefacilitiesanddesignthemtoavoidobstructionsofnavigationandtobe theminimumsizenecessarytomeettheneed;and c.Usesthatdependonpatronsarrivingbywatercraftmayusesignsand lightingtoconveyneededinformationtothepublic,subjecttothefollowing generalstandards: i.Noadvertisingsignsorsupportingfacilitiesforsignsmaybeplacedinor uponpublicwaters.Signsconveyinginformationorsafetymessagesmay beplacedinoronpublicwatersbyapublicauthorityorunderapermit issuedbythecountysheriff. ii.Signsmaybeplaced,whennecessary,withintheshoreimpactzoneif theyaredesignedandsizedtobetheminimumnecessarytoconvey neededinformation.Theyshallonlyconveythelocationandnameof theestablishmentandthegeneraltypesofgoodsorservicesavailable. Thesignsshallnotcontainotherdetailedinformationsuchasproduct brandsandprices,shallnotbelocatedhigherthantenfeetabovethe ground,andshallnotexceed32squarefeetinsize.Ifilluminatedby artificiallights,thelightsshallbeshieldedordirectedtoprevent illuminationoutacrosspublicwaters;and iii.Otheroutsidelightingmaybelocatedwithintheshoreimpactzoneor overpublicwatersifitisusedprimarilytoilluminatepotentialsafety hazardsandisshieldedorotherwisedirectedtopreventdirect illuminationoutacrosspublicwaters.Thisdoesnotprecludeuseof navigationallights. 2.Useswithoutwater-orientedneedsmustbelocatedonlotsorparcelswithout publicwatersfrontage,or,iflocatedonlotsorparcelswithpublicwaters frontage,musteitherbesetbackdoublethenormalordinaryhighwaterlevel setbackorbesubstantiallyscreenedfromviewfromthewaterbyvegetationor topography,assumingsummer,leaf-onconditions. (ii)Agricultureusestandards 1.Generalcultivationfarming,grazing,nurseries,horticulture,truckfarming,sod farming,andwildcropharvestingarepermittedusesifsteepslopesandshore andbluffimpactzonesaremaintainedinpermanentvegetationoroperatedunder anapprovedconservationplan(resourcemanagementsystems)consistentwith thefieldofficetechnicalguidesofthelocalsoilandwaterconservationdistricts orthenaturalresourcesconservationservice,asprovidedbyaqualified individualoragency. a.Theshoreimpactzoneforparcelswithpermittedagriculturallandusesis equaltoalineparalleltoand50feetfromtheordinaryhighwaterlevel. b.Thebluffimpactzoneisequaltothebluffandlandlocatedwithin20feet fromabluffline. ORDINANCENO.545 Page 9 of 42 2.Animalfeedlotsshallmeettherequirementsofthischapter,aswellasthe followingstandards: a.NewfeedlotsshallnotbelocatedintheWSRRoverlaydistrict;and b.Modificationsorexpansionstoexistingfeedlotsthatarelocatedwithin300 feetoftheordinaryhighwaterlevelorwithinthebluffimpactzoneare allowediftheydonotfurtherencroachintotheexistingordinaryhighwater levelsetbackorencroachonbluffimpactzones. 3.Useoffertilizer,pesticides,oranimalwasteswithintheWSRRoverlaydistrict shallbedoneinsuchawayastominimizeimpactontheshoreimpactzoneor publicwaterbyproperapplicationoruseofearthorvegetation. (iii)Forestmanagementstandard 1.Theharvestingoftimberandassociatedreforestationmustbeconducted consistentwiththeprovisionsoftheMinnesotaNonpointSourcePollution Assessment--ForestryandtheprovisionsofWaterQualityinForest Management--BestManagementPracticesinMinnesota. 2.Useoffertilizer,pesticides,oranimalwasteswithintheWSRRoverlaydistrict shallbedoneinsuchawayastominimizeimpactontheshoreimpactzoneor publicwaterbyproperapplicationoruseofearthorvegetation. (iv)Extractiveusestandards 1.Sitedevelopmentandrestorationplan.Anextractiveusesitedevelopmentand restorationplanshallbedeveloped,approved,andfollowedoverthecourseof operationofthesite.Theplanshalladdressdust,noise,possiblepollutant discharges,hoursanddurationofoperation,andanticipatedvegetationand topographicalterations.Itmustalsoidentifyactionstobetakenduringoperation tomitigateadverseenvironmentalimpacts,particularlyerosion,andshallclearly explainhowthesitewillberehabilitatedafterextractiveactivitiesend. 2.Setbacksforprocessingmachinery.Processingmachineryshallbelocated consistentwithsetbackstandardsforstructuresfromtheordinaryhighwater levelandfromblufflines. (11)VegetativeCutting Selectivecuttingoftreesinexcessoffourinchesindiameteratfourfeetheightwithinthe WSRRoverlaydistrictandwithin100feetoftheordinaryhighwaterleveland20feet landwardoftheblufflineshallbesubjecttothefollowing: (a)Clearcutting,exceptforanyauthorizedpublicservicessuchasroadsandessential services,shallnotbepermitted.Clearcuttingforessentialservices,suchastelephone lines,substations,andrelatedstructures,shallrequireaspecialpermitissuedbytheCity Councilinaccordancewith2.4(N)ofthisordinance. ORDINANCENO.545 Page 10 of 42 (b)Cuttingisspacedinseveralcuttingoperationsandacontinuoustreecoverismaintained, uninterruptedbylargeopenings.Incaseswheretheexistingtreecoverhasbeen interruptedbylargeopeningsinthepast,selectivecuttingmaybeperformedsoasto maintainacontinuoustreecoverintheremainingwoodedareas. (c)Theabovecuttingprovisionsshallnotbedeemedtoprevent: (i)Theremovalofdiseasedorinsect-infestedtrees,orofrottenordamagedtreesthat presentsafetyhazards. (ii)Pruningunderstoryvegetation,shrubs,plants,bushes,orgrasses,orharvestingcrops, orcuttingsuppressedtreesortreeslessthanfourinchesindiameteratfour-foot height. (d)Exceptincaseswherevegetativecuttinghasbeenapprovedaspartofasubdivisionor otherdevelopment,anypersonproposingvegetativecuttingshallapplytothecityfora vegetativecuttingpermit.Applicationformsforthepermitshallbeprovidedbythe CommunityDevelopmentDepartmentandrequirethefollowinginformation: (i)Nameandaddressofapplicant. (vi)Thehighway,street,orstreets,orotherpublicwaysinthecityuponandalongwhich anymaterialistobehauledorcarried. (vii)Anestimateofthetimerequiredtocompletethevegetativecutting. (x)Astatementthattheapplicantwillcomplywithallconditionsprescribedbythecity. (12)ClearcuttingRestrictions ClearcuttingwithintheWSRRoverlaydistrictshallbesubjecttothefollowingstandardsand criteria: (a)Clearcuttingshallnotbeusedasacuttingmethodwheresoil,slope,orotherwatershed conditionsarefragileandsubjecttoinjury. (b)Clearcuttingshallbeconductedonlywhereclearcutblocks,patches,orstripsare,inall cases,shapedandblendedwiththenaturalterrain. (c)Thesizeofclearcutblocks,patches,orstripsshallbekeptattheminimumnecessary. (16)LandSuitability NolandshallbesubdividedwhichisdeterminedbythecityortheCommissionerofthe DepartmentofNaturalResourcestobeunsuitablebyreasonofflooding,inadequatedrainage, soilandrockformationwithseverelimitationsfordevelopment,severeerosionpotential, unfavorabletopography,inadequatewatersupplyorsewagetreatmentcapabilitiesorany otherfeaturelikelytobeharmfultothehealth,safety,orwelfareofthefutureresidentsofthe proposedsubdivisionorthecity. (17)NonconformingUses AllusesinexistencepriortoJuly1,2000,whicharelawfullypermitteduseswithinthewild andscenicrecreationalriverdistrict,butdonotmeettheminimumlotarea,setbacksorother dimensionalrequirementsofthischaptershallbeallowedtocontinuesubjecttothefollowing conditionsandexceptions: (a)Anystructuralalterationoradditiontoanonconformingusewhichwillincreasethe substandarddimensionsshallnotbeallowed. (b)NonconformingSewageTreatmentSystems Anonconformingsewagetreatmentsystemnotmeetingtherequirementsofapplicable rulesofthestateDepartmentofHealth,thestatepollutioncontrolagency,specifically MinnRulesch.7080,forindividualsewagetreatmentsystems,andanyotherapplicable localgovernmentstandardsshallbebroughtintoconformityordiscontinuedwithinfive yearsofthedateofenactmentoftheWildandScenicRecreationalRiverDistrict Ordinancefromwhichthisdivisionisderived. (20)Plats CopiesofallplatswithintheWildandScenicRecreationalRiverDistrictshallbeforwarded totheCommissioneroftheDepartmentofNaturalResourceswithintendaysofapprovalby theCity.Approvalofaplatwhichisinconsistentwiththisdivisionispermissibleonlyifthe detrimentalimpactoftheinconsistencyismorethanovercomebyotherprotective characteristics. (21)PlannedUnitDevelopment Aplannedunitdevelopmentmaybeallowedpertherequirementsofsection2.4(P)only whentheproposeddevelopmentprovidesabettermeansofpreservingagriculturalland,open space,woods,scenicviews,wetlands,andotherfeaturesofthenaturalenvironmentthan traditionalsubdivisiondevelopment.PlannedUnitDevelopmentsshallbereviewedunder theprovisionsoutlinedinSection2.4(P)ofthisordinance,withthefollowingadditional criteria: (a)PreliminaryplansareapprovedbytheCommissioneroftheDepartmentofNatural ResourcespriortotheirenactmentbytheCityCouncil. (b)Apublicly-ownedsewersystemsisused. (23)NoticetotheDNRofProposedActionswithintheWildandScenicRecreationalRiver District (a)NotificationofProposals (i)ForpropertieswithintheWildandScenicRecreationalRiverDistrict,the CommunityDevelopmentDepartmentshallnotifytheCommissionerofthe DepartmentofNaturalResourcesofanyapplicationforavariance,ordinance amendment(includingproposedchangestodistrictlines),conditionalusepermits, PUDs,andplats. (ii)NotificationsforordinancechangesandPUDsshallconsistofacopyoftheproposed ordinanceamendment(s),acopyoftheproposedPUD,andallotherapplication materialsasmaybeneededbytheCommissioneroftheDepartmentofNatural Resourcestofullyunderstandtheproposal. (b)POLICY:TheuncontrolleduseofshorelandsoftheCityofMonticello,Minnesota affectsthepublichealth,safety,andgeneralwelfarenotonlybycontributingtopollution ofpublicwaters,butalsobyimpairingthelocaltaxbase.Therefore,itisinthebest interestsofthepublichealth,safety,andwelfaretoprovideforthewisesubdivision,use anddevelopmentofshorelandsofpublicwaters.ThelegislatureofMinnesotahas delegatedresponsibilitytolocalgovernmentsofthestatetoregulatethesubdivision,use anddevelopmentoftheshorelandsofpublicwatersandthuspreserveandenhancethe qualityofsurfacewaters,conservetheeconomicandnaturalenvironmentalvaluesof shorelands,andprovideforthewiseuseofwatersandrelatedlandresources.This responsibilityisherebyrecognizedbytheCityofMonticello. (2)GeneralProvisions (a)Jurisdiction (i)Theprovisionsofthisordinanceshallapplytotheshorelandsofthepublicwater bodiesasclassifiedinSection3.7(F)(4)ofthisordinance. (ii)Shorelandshallincludealllandwithin1,000feetoftheOrdinaryHighWaterLevel (OHWL)ofalakeand300feetofariveranditsdesignatedfloodplainasdepictedon theCityofMonticello’sOfficialZoningMap. (iii)PursuanttoMinnesotaRegulations,Parts6120.2500-6120.3900,nolake,pond,or flowagelessthan10acresinsizeinmunicipalitiesor25acresinsizein unincorporatedareasneedberegulatedinalocalgovernment’sshoreland regulations.Abodyofwatercreatedbyaprivateuserwheretherewasnoprevious shorelandmay,atthediscretionofthegoverningbody,beexemptfromthis ordinance. (b)Compliance: Theuseofanyshorelandofpublicwaters;thesizeandshapeoflots;theuse,size,type andlocationofstructuresonlots;theinstallationandmaintenanceofwatersupplyand wastetreatmentsystems,thegradingandfillingofanyshorelandarea;thecuttingof ORDINANCENO.545 Page 17 of 42 shorelandvegetation;andthesubdivisionoflandshallbeinfullcompliancewiththe termsofthisordinanceandotherapplicableregulations. (c)Enforcement TheCommunityDevelopmentDepartmentisresponsiblefortheadministrationand enforcementofthisordinance.Anyviolationoftheprovisionsofthisordinanceor failuretocomplywithanyofitsrequirements(includingviolationsofconditionsand safeguardsestablishedinconnectionwithgrantsofpermits,variancesorconditional uses)shallbesubjecttotheremediesandpenaltiesoutlinedinSection7.6ofthis ordinance. (d)Interpretation Intheirinterpretationandapplication,theprovisionsofthisoverlaydistrictshallbeheld tobeminimumrequirementsandshallbeliberallyconstructedinfavoroftheCityand shallnotbedeemedalimitationorrepealofanyotherpowersgrantedbyStateStatutes. (e)AbrogationandGreaterRestrictions Itisnotintendedbythisordinancetorepeal,abrogate,orimpairanyexistingeasements, covenants,ordeedrestrictions.However,wherethisordinanceimposesgreater restrictions,theprovisionsofthisordinanceshallprevail. (3)Administration (a)PermitsRequired (i)Apermitisrequiredfortheconstructionofbuildingsorbuildingadditions(including butnotlimitedtorelatedactivitiessuchasconstructionofdecksorsigns),the installationand/oralterationofsewagetreatmentsystems,andallgradingandfilling activitiesasrequiredbythisordinance.Applicationforapermitshallbemadetothe CommunityDevelopmentDepartmentpursuanttotheapplicableregulationsin Chapter2ofthisordinance.Theapplicationshallincludethenecessaryinformation sothattheCommunityDevelopmentDepartmentcandeterminethesite’ssuitability fortheintendeduseandthatacompliantsewagetreatmentsystemwillbeprovided. (ii)Apermitauthorizinganadditiontoanexistingstructureshallstipulatethatan identifiednonconformingsewagetreatmentsystemshallbereconstructedorreplaced inaccordancewiththeprovisionsofthisordinance. (b)DeterminationofZoningCompliance TheCommunityDevelopmentDepartment,inreviewingarequiredpermit,shallmakea determinationastowhethertheproposaliscompliantwithallprovisionsofSection 3.7(F)ShorelandDistrict.Anyuse,arrangement,orconstructionnotauthorizedby permitshallbedeemedaviolationofthisordinanceandshallbepunishableasprovided inSection7.6ofthisordinance. (c)Variances (i)VariancesshallbereviewedundertheprovisionsoutlinedinSection2.4(C)withthe followingadditionalrequirements: ORDINANCENO.545 Page 18 of 42 1.Novarianceshallcircumventthegeneralpurposesandintentoftheshoreland overlaydistrict. 2.Novariancemaybegrantedthatwouldallowanyusethatisprohibitedinthe zoningdistrictinwhichthesubjectpropertyislocated. 3.Thevarianceapplicationmustclearlydemonstratewhetheraconformingsewage treatmentsystemispresentfortheintendeduseoftheproperty.Thevariance,if issued,mustrequirereconstructionofanonconformingsewagetreatmentsystem. (ii)Acopyofthenoticeforthepublichearing(s)toconsideravariancemustbesentto theCommissioneroftheDepartmentofNaturalResourcesorthecommissioner's designatedrepresentativeandpostmarkedatleasttendaysbeforethehearings. (iii)Acopyofalldecisionsgrantingvariancestoshorelandregulationsshallbe forwardedbymailtotheCommissionerofNaturalResourceswithinten(10)daysof suchaction. (iv)Appealsfromvariancedecisionsonshorelandissuesmaybemadeinaccordance withtheprovisionsofSection2.4(H)andalsoMinnesotaStatutes. (d)ConditionalUses Conditionalusesallowablewithinshorelandareasshallbereviewedundertheprovisions outlinedinSection2.4(D),andinterimusepermitsforusesorstructureswithinshoreland areasshallbereviewedundertheprovisionsoutlinedinSection2.4(E),withthe followingadditionalrequirements: (i)EvaluationCriteria Athoroughevaluationofthewaterbodyandthetopographic,vegetation,andsoils conditionsonthesitemustbemadetoensure: 1.Thepreventionofsoilerosionorotherpossiblepollutionofpublicwaters,both duringandafterconstruction; 2.Thevisibilityofstructuresandotherfacilitiesasviewedfrompublicwatersis limited; 3.Thesiteisadequateforwatersupplyandon-sitesewagetreatment;and 4.Thetypes,uses,andnumbersofwatercraftthattheprojectwillgenerateare compatibleinrelationtothesuitabilityofpublicwaterstosafelyaccommodate thesewatercraft. (ii)Conditionsattachedtoconditionalusepermits TheCommunityDevelopmentDepartment,uponconsiderationofthecriterialisted aboveandthepurposesofthisordinance,shallattachsuchconditionstotheissuance oftheconditionalusepermitsasitdeemsnecessarytofulfillthepurposesofthis ordinance.Suchconditionsmayinclude,butarenotlimitedto,thefollowing: 1.Increasedsetbacksfromtheordinaryhighwaterlevel; 2.Limitationsonthenaturalvegetationtoberemovedortherequirementthat additionalvegetationbeplanted;and ORDINANCENO.545 Page 19 of 42 3.Specialprovisionsforthelocation,design,anduseofstructures,sewage treatmentsystems,watercraftlaunchinganddockingareas,andvehicleparking areas. (iii)NotificationProcedures 1.Acopyofthenoticeforthepublichearing(s)toconsideraconditionalusepermit mustbesenttotheCommissioneroftheDepartmentofNaturalResourcesorthe commissioner'sdesignatedrepresentativeandpostmarkedatleasttendaysbefore thehearings. 2.Acopyofalldecisionsgrantingaconditionalusepermitsubjecttoshoreland regulationsshallbeforwardedbymailtotheCommissionerofNaturalResources withinten(10)daysofsuchaction. ORDINANCENO.545 Page 26 of 42 (6)ZoningandWaterSupply/SanitaryProvisions (a)DesignCriteriaforStructuresintheShorelandDistrict (i)HighWaterElevations Structuresmustbeplacedinaccordancewithanyfloodplainregulationsapplicableto thesite.Wherethesecontrolsdonotexist,theelevationtowhichthelowestfloor, includingbasement,isplacedorflood-proofedmustbedeterminedasfollows: 1.Forlakes,byplacingthelowestflooratalevelatleastthreefeetabovethe highestknownwaterlevel,orthreefeetabovetheordinaryhighwaterlevel, whicheverishigher; 2.Forriversandstreams,byplacingthelowestflooratleastthreefeetabovethe floodofrecord,ifdataareavailable.Ifdataarenotavailable,byplacingthe lowestflooratleastthreefeetabovetheordinaryhighwaterlevel,orby conductingatechnicalevaluationtodetermineeffectsofproposedconstruction uponfloodstagesandfloodflowsandtoestablishafloodprotectionelevation. Underallthreeapproaches,technicalevaluationsmustbedonebyaqualified engineerorhydrologistconsistentwithparts6120.5000to6120.6200governing themanagementoffloodplainareas.Ifmorethanoneapproachisused,the highestfloodprotectionelevationdeterminedmustbeusedforplacingstructures andotherfacilities;and 3.Water-orientedaccessorystructuresmayhavethelowestfloorplacedlowerthan theelevationdeterminedinthisitemifthestructureisconstructedofflood- resistantmaterialstotheelevation,electricalandmechanicalequipmentisplaced abovetheelevationand,iflongdurationfloodingisanticipated,thestructureis builttowithstandiceactionandwind-drivenwavesanddebris. (ii)Water-orientedAccessoryStructures Eachlotmayhaveonewater-orientedaccessorystructurenotmeetingthenormal structuresetbackofthisordinanceifthiswater-orientedaccessorystructurecomplies withthefollowingprovisions: 1.Thestructureorfacilitymustnotexceedtenfeetinheight,exclusiveofsafety rails,andcannotoccupyanareagreaterthan250squarefeet.Detacheddecks mustnotexceedeightfeetabovegradeatanypoint; 2.Thesetbackofthestructureorfacilityfromtheordinaryhighwaterlevelmustbe atleasttenfeet; 3.Thestructureorfacilitymustbetreatedtoreducevisibilityasviewedfrom publicwatersandadjacentshorelandsbyvegetation,topography,increased setbacksorcolor,assumingsummer,leaf-onconditions; 4.Theroofmaybeusedasadeckwithsafetyrails,butmustnotbeenclosedor usedasastoragearea; 5.Thestructureorfacilitymustnotbedesignedorusedforhumanhabitationand mustnotcontainwatersupplyorsewagetreatmentfacilities;and ORDINANCENO.545 Page 27 of 42 6.Asanalternativeforgeneraldevelopmentandrecreationaldevelopment waterbodies,water-orientedaccessorystructuresusedsolelyforwatercraft storage,andincludingstorageofrelatedboatingandwater-orientedsporting equipment,mayoccupyanareaupto400squarefeetprovidedthemaximum widthofthestructureis20feetasmeasuredparalleltotheconfigurationofthe shoreline. (iii)Stairways,Lifts,andLandings Stairwaysandliftsarethepreferredalternativetomajortopographicalterationsfor achievingaccessupanddownbluffsandsteepslopestoshoreareas.Stairwaysand liftsmustmeetthefollowingdesignrequirements: 1.Stairwaysandliftsmustnotexceedfourfeetinwidthonresidentiallots.Wider stairwaysmaybeusedforcommercialproperties,publicopen-spacerecreational properties,andplannedunitdevelopments; 2.Landingsforstairwaysandliftsonresidentiallotsmustnotexceed32squarefeet inarea.Landingslargerthan32squarefeetmaybeusedforcommercial properties,publicopen-spacerecreationalproperties,andplannedunit developments; 3.Canopiesorroofsarenotallowedonstairways,lifts,orlandings; 4.Stairways,lifts,andlandingsmaybeeitherconstructedabovethegroundon postsorpilings,orplacedintotheground,providedtheyaredesignedandbuilt inamannerthatensurescontrolofsoilerosion; 5.Stairways,lifts,andlandingsmustbelocatedinthemostvisuallyinconspicuous portionsoflots,asviewedfromthesurfaceofthepublicwaterassuming summer,leaf-onconditions,wheneverpractical;and 6.Facilitiessuchasramps,lifts,ormobilitypathsforphysicallyhandicapped personsarealsoallowedforachievingaccesstoshoreareas,providedthatthe dimensionalandperformancestandardsofsub-items(1)to(5)arecompliedwith inadditiontotherequirementsofMinnesotaRegulations,Chapter1341. (iv)SignificantHistoricSites Nostructuremaybeplacedonasignificanthistoricsiteinamannerthataffectsthe valuesofthesiteunlessadequateinformationaboutthesitehasbeenremovedand documentedinapublicrepository. (v)SteepSlopes TheCommunityDevelopmentDepartmentmustevaluatepossiblesoilerosion impactsanddevelopmentvisibilityfrompublicwatersbeforeissuingapermitfor constructionofsewagetreatmentsystems,roads,driveways,structures,orother improvementsonsteepslopes.Whendeterminednecessary,conditionsmustbe attachedtoissuedpermitstopreventerosionandtopreserveexistingvegetation screeningofstructures,vehicles,andotherfacilitiesasviewedfromthesurfaceof publicwaters,assumingsummer,leaf-onvegetation. ORDINANCENO.545 Page 28 of 42 (b)ShorelandAlterations Alterationsofvegetationandtopographywillberegulatedtopreventerosionintopublic waters,fixnutrients,preserveshorelandaesthetics,preservehistoricvalues,preventbank slumping,andprotectfishandwildlifehabitat. (i)VegetationAlterations 1.Vegetationalterationnecessaryfortheconstructionofstructuresandsewage treatmentsystemsandtheconstructionofroadsandparkingareasareexempt fromthevegetationalterationstandardsthatfollow. 2.Removaloralterationofvegetation,exceptforagriculturalandforest managementusesasregulatedinSection3.7(F)(6)(e)(ii)and3.7(F)(6)(e)(iii), respectfully,isallowedsubjecttothefollowingstandards: a.Intensivevegetationclearingwithintheshoreandbluffimpactzonesandon steepslopesisnotallowed.Intensivevegetationclearingforforestland conversiontoanotheruseoutsideoftheseareasisallowableasaconditional useifanerosioncontrolandsedimentationplanisdevelopedandapproved bythesoilandwaterconservationdistrictinwhichthepropertyislocated. b.Inshoreandbluffimpactzonesandonsteepslopes,limitedclearingoftrees andshrubsandcutting,pruning,andtrimmingoftreesisallowedtoprovide aviewtothewaterfromtheprincipaldwellingsiteandtoaccommodatethe placementofstairwaysandlandings,picnicareas,accesspaths,livestock wateringareas,beachandwatercraftaccessareas,andpermittedwater- orientedaccessorystructuresorfacilities,providedthat: i.Thescreeningofstructures,vehicles,orotherfacilitiesasviewedfrom thewater,assumingsummer,leaf-onconditions,isnotsubstantially reduced; ii.Alongrivers,existingshadingofwatersurfacesispreserved;and iii.Theaboveprovisionsarenotapplicabletotheremovaloftrees,limbs,or branchesthataredead,diseased,orposesafetyhazards. (ii)TopographicAlterations/GradingandFilling 1.Gradingandfillingandexcavationsnecessaryfortheconstructionofstructures, sewagetreatmentsystems,anddrivewaysundervalidlyissuedconstruction permitsforthesefacilitiesdonotrequiretheissuanceofaseparategradingand fillingpermit.However,thegradingandfillingstandardsinthisSectionmustbe incorporatedintotheissuanceofpermitsforconstructionofstructures,sewage treatmentsystems,anddriveways. 2.PublicroadsandparkingareasareregulatedbySection3.7(F)(6)(c)ofthis ordinance. 3.Notwithstandingsub-items1.and2.above,agradingandfillingpermitwillbe requiredfor: ORDINANCENO.545 Page 29 of 42 a.Themovementofmorethanten(10)cubicyardsofmaterialonsteepslopes orwithinshoreorbluffimpactzones;and b.Themovementofmorethan50cubicyardsofmaterialoutsideofsteep slopesandshoreandbluffimpactzones. 4.Thefollowingconsiderationsandconditionsmustbeadheredtoduringthe issuanceofconstructionpermits,gradingandfillingpermits,conditionaluse permits,variancesandsubdivisionapprovals: a.Gradingorfillinginanytype2,3,4,5,6,7,or8wetlandmustbeevaluated todeterminehowextensivelytheproposedactivitywouldaffectthe followingfunctionalqualitiesofthewetland: i.Sedimentandpollutanttrappingandretention; ii.Storageofsurfacerunofftopreventorreduceflooddamage; iii.Fishandwildlifehabitat; iv.Recreationaluse; v.Shorelineorbankstabilization;and vi.Noteworthiness,includingspecialqualitiessuchashistoricsignificance, criticalhabitatforendangeredplantsandanimals,orothers. Thisevaluationmustalsoincludeadeterminationofwhetherthewetland alterationbeingproposedrequirespermits,reviews,orapprovalsbyother local,state,orfederalagenciessuchasawatersheddistrict,theMinnesota DepartmentofNaturalResources,ortheUnitedStatesArmyCorpsof Engineers.Theapplicantwillbesoadvised. b.Alterationsmustbedesignedandconductedinamannerthatensuresonly thesmallestamountofbaregroundisexposedfortheshortesttimepossible; c.Mulchesorsimilarmaterialsmustbeused,wherenecessary,fortemporary baresoilcoverage,andapermanentvegetationcovermustbeestablishedas soonaspossible; d.Methodstominimizesoilerosionandtotrapsedimentsbeforetheyreach anysurfacewaterfeaturemustbeused; e.Alteredareasmustbestabilizedtoacceptableerosioncontrolstandards consistentwiththefieldofficetechnicalguidesofthelocalsoilandwater conservationdistrictsandtheUnitedStatesSoilConservationService; f.Fillorexcavatedmaterialmustnotbeplacedinamannerthatcreatesan unstableslope; g.Planstoplacefillorexcavatedmaterialonsteepslopesmustbereviewedby qualifiedprofessionalsforcontinuedslopestabilityandmustnotcreate finishedslopesof30percentorgreater; h.Fillorexcavatedmaterialmustnotbeplacedinbluffimpactzones; ORDINANCENO.545 Page 30 of 42 i.Anyalterationsbelowtheordinaryhighwaterlevelofpublicwatersmust firstbeauthorizedbytheCommissioneroftheDepartmentofNatural ResourcesunderMinnesotaStatutes,section103G; j.Alterationsoftopographymustonlybeallowediftheyareaccessoryto permittedorconditionalusesanddonotadverselyaffectadjacentornearby properties;and k.Placementofnaturalrockriprap,includingassociatedgradingofthe shorelineandplacementofafilterblanket,ispermittedifthefinishedslope doesnotexceedthreefeethorizontaltoonefootvertical,thelandwardextent oftheriprapiswithintenfeetoftheordinaryhighwaterlevel,andtheheight oftheriprapabovetheordinaryhighwaterleveldoesnotexceedthreefeet. (c)PlacementandDesignofRoads,Driveways,andParkingAreas (i)Publicandprivateroadsandparkingareasmustbedesignedtotakeadvantageof naturalvegetationandtopographytoachievemaximumscreeningfromviewfrom publicwaters.Documentationmustbeprovidedbyaqualifiedindividualthatall roadsandparkingareasaredesignedandconstructedtominimizeandcontrol erosiontopublicwatersconsistentwiththefieldofficetechnicalguidesofthelocal soilandwaterconservationdistrict,orotherapplicabletechnicalmaterials. (ii)Roads,driveways,andparkingareasmustmeetstructuresetbacksandmustnotbe placedwithinbluffandshoreimpactzones,whenotherreasonableandfeasible placementalternativesexist.Ifnoalternativesexist,theymaybeplacedwithinthese areas,andmustbedesignedtominimizeadverseimpacts. (iii)Publicandprivatewatercraftaccessramps,approachroads,andaccess-related parkingareasmaybeplacedwithinshoreimpactzonesprovidedthevegetative screeninganderosioncontrolconditionsofthissubpartaremet.Forprivatefacilities, thegradingandfillingprovisionsofSection3.7(F)(6)(b)(ii)ofthisordinancemustbe met. (d)StormwaterManagement Thefollowinggeneralandspecificstandardsshallapply: (i)GeneralStandards 1.Whenpossible,existingnaturaldrainageways,wetlands,andvegetatedsoil surfacesmustbeusedtoconvey,store,filter,andretainstormwaterrunoffbefore dischargetopublicwaters. 2.Developmentmustbeplannedandconductedinamannerthatwillminimizethe extentofdisturbedareas,runoffvelocities,erosionpotential,andreduceand delayrunoffvolumes.Disturbedareasmustbestabilizedandprotectedassoon aspossibleandfacilitiesormethodsusedtoretainsedimentonthesite. ORDINANCENO.545 Page 31 of 42 3.Whendevelopmentdensity,topographicfeatures,andsoilandvegetation conditionsarenotsufficienttoadequatelyhandlestormwaterrunoffusingnatural featuresandvegetation,varioustypesofconstructedfacilitiessuchasdiversions, settlingbasins,skimmingdevices,dikes,waterways,andpondsmaybeused. Preferencemustbegiventodesignsusingsurfacedrainage,vegetation,and infiltrationratherthanburiedpipesandman-madematerialsandfacilities. (ii)SpecificStandards 1.Impervioussurfacecoverageoflotsmustnotexceed25percentofthelotarea. 2.Whenconstructedfacilitiesareusedforstormwatermanagement,documentation mustbeprovidedbyaqualifiedindividualthattheyaredesignedandinstalled consistentwiththefieldofficetechnicalguideofthelocalsoilandwater conservationdistricts. 3.Newconstructedstormwateroutfallstopublicwatersmustprovideforfiltering orsettlingofsuspendedsolidsandskimmingofsurfacedebrisbeforedischarge. (e)SpecialProvisionsforCommercial,Industrial,Public/Semipublic,Agricultural, ForestryandExtractiveUsesandMiningofMetallicMineralsandPeat (i)StandardsforCommercial,Industrial,Public,andSemipublicUses 1.Surfacewater-orientedcommercialusesandindustrial,public,orsemipublic useswithsimilarneedstohaveaccesstoanduseofpublicwatersmaybelocated onparcelsorlotswithfrontageonpublicwaters.Thoseuseswithwater-oriented needsmustmeetthefollowingstandards: a.Inadditiontomeetingimperviouscoveragelimits,setbacks,andother zoningstandardsinthisordinance,theusesmustbedesignedtoincorporate topographicandvegetativescreeningofparkingareasandstructures; b.Usesthatrequireshort-termwatercraftmooringforpatronsmustcentralize thesefacilitiesanddesignthemtoavoidobstructionsofnavigationandtobe theminimumsizenecessarytomeettheneed;and c.Usesthatdependonpatronsarrivingbywatercraftmayusesignsand lightingtoconveyneededinformationtothepublic,subjecttothefollowing generalstandards: i.Noadvertisingsignsorsupportingfacilitiesforsignsmaybeplacedinor uponpublicwaters.Signsconveyinginformationorsafetymessagesmay beplacedinoronpublicwatersbyapublicauthorityorunderapermit issuedbythecountysheriff; ii.Signsmaybeplaced,whennecessary,withintheshoreimpactzoneif theyaredesignedandsizedtobetheminimumnecessarytoconvey neededinformation.Theymustonlyconveythelocationandnameofthe establishmentandthegeneraltypesofgoodsorservicesavailable.The signsmustnotcontainotherdetailedinformationsuchasproductbrands andprices,mustnotbelocatedhigherthantenfeetabovetheground, ORDINANCENO.545 Page 32 of 42 andmustnotexceedthirty-two(32)squarefeetinsize.Ifilluminatedby artificiallights,thelightsmustbeshieldedordirectedtoprevent illuminationoutacrosspublicwaters;and iii.Otheroutsidelightingmaybelocatedwithintheshoreimpactzoneor overpublicwatersifitisusedprimarilytoilluminatepotentialsafety hazardsandisshieldedorotherwisedirectedtopreventdirect illuminationoutacrosspublicwaters.Thisdoesnotprecludeuseof navigationallights. 2.Useswithoutwater-orientedneedsmustbelocatedonlotsorparcelswithout publicwatersfrontage,or,iflocatedonlotsorparcelswithpublicwaters frontage,musteitherbesetbackdoublethenormalordinaryhighwaterlevel setbackorbesubstantiallyscreenedfromviewfromthewaterbyvegetationor topography,assumingsummer,leaf-onconditions. (ii)AgricultureUseStandards 1.Generalcultivationfarming,grazing,nurseries,horticulture,truckfarming,sod farming,andwildcropharvestingarepermittedusesifsteepslopesandshore andbluffimpactzonesaremaintainedinpermanentvegetationoroperatedunder anapprovedconservationplan(ResourceManagementSystems)consistentwith thefieldofficetechnicalguidesofthelocalsoilandwaterconservationdistricts ortheUnitedStatesSoilConservationService,asprovidedbyaqualified individualoragency.Theshoreimpactzoneforparcelswithpermitted agriculturallandusesisequaltoalineparalleltoand50feetfromtheordinary highwaterlevel. 2.Animalfeedlotsareprohibited. (iii)ForestManagementStandards Theharvestingoftimberandassociatedreforestationorconversionofforesteduseto anon-forestedusemustbeconductedconsistentwiththefollowingstandards: 1.Timberharvestingandassociatedreforestationmustbeconductedconsistent withtheprovisionsoftheMinnesotaNon-pointSourcePollutionAssessment- ForestryandtheprovisionsofWaterQualityinForestManagement"Best ManagementPracticesinMinnesota." 2.Forestlandconversiontoanotheruseshallrequireissuanceofaconditionaluse permitsubjecttoSection2.4(D)andadherencetothefollowingstandards: a.Shoreandbluffimpactzonesmustnotbeintensivelyclearedofvegetation; and b.Anerosionandsedimentcontrolplanisdevelopedandapprovedbythelocal soilandwaterconservationdistrictbeforeissuanceofaconditionaluse permitfortheconversion. ORDINANCENO.545 Page 33 of 42 c.Useoffertilizer,pesticides,oranimalwasteswithinshorelandsmustbedone insuchawayastominimizeimpactontheshoreimpactzoneorpublic waterbyproperapplicationoruseofearthorvegetation. (iv)ExtractiveUseStandards 1.SiteDevelopmentandRestorationPlan.Anextractiveusesitedevelopmentand restorationplanmustbedeveloped,approved,andfollowedoverthecourseof operationofthesite.Theplanmustaddressdust,noise,possiblepollutant discharges,hoursanddurationofoperation,andanticipatedvegetationand topographicalterations.Itmustalsoidentifyactionstobetakenduringoperation tomitigateadverseenvironmentalimpacts,particularlyerosion,andmustclearly explainhowthesitewillberehabilitatedafterextractiveactivitiesend. 2.SetbacksforProcessingMachinery.Processingmachinerymustbelocated consistentwithsetbackstandardsforstructuresfromordinaryhighwaterlevels ofpublicwatersandfrombluffs. (v)MiningofMetallicMineralsandPeat Miningofmetallicmineralsandpeat,asdefinedinMinnesotaStatutes,sections 93.44to93.51,shallbeapermitteduseprovidedtheprovisionsofMinnesota Statutes,sections93.44to93.51,aresatisfied. (f)WaterSupplyandSewageTreatment (i)WaterSupply WatershallbesuppliedthroughtheCityofMonticellomunicipalwatersystem. (ii)SewageTreatment Anypremisesusedforhumanoccupancymustbeprovidedwithanadequatemethod ofsewagetreatment,asfollows: 1.Publicly-ownedsewersystemsshallbeusedforanynewdevelopment. 2.Nonconformingsewagetreatmentsystemsshallberegulatedandupgradedin accordancewiththeprovisionsSection3.7(F)(7)below. (7)Nonconformities Alllegallyestablishednonconformitiesasofthedateofthisordinancemaycontinue,but theywillbemanagedaccordingtoapplicablestatestatutesandtheprovisionsofChapter6of thisordinanceforthesubjectsofalterationsandadditions,repairafterdamage, discontinuanceofuse,andintensificationofuse;exceptthatthefollowingstandardswillalso applyinshorelandareas: (a)Constructiononnonconforminglotsofrecord (i)Lotsofrecordintheofficeofthecountyrecorderonthedateofenactmentoflocal shorelandcontrolsthatdonotmeettherequirementsofSection3.7(F)(5)(b)maybe allowedasbuildingsiteswithoutvariancesfromlotsizerequirementsprovidedthe useispermittedinthezoningdistrict,thelothasbeeninseparateownershipfrom ORDINANCENO.545 Page 34 of 42 abuttinglandsatalltimessinceitbecamesubstandard,wascreatedcompliantwith officialcontrolsineffectatthetime,andsewagetreatmentandsetbackrequirements ofthisordinancearemet. (ii)Avariancefromsetbackrequirementsmustbeobtainedbeforeanyuse,sewage treatmentsystem,orbuildingpermitisissuedforalot.Inevaluatingthevariance,the boardofadjustmentshallconsidersewagetreatmentandwatersupplycapabilitiesor constraintsofthelotandshalldenythevarianceifadequatefacilitiescannotbe provided. (iii)If,inagroupoftwoormorecontiguouslotsunderthesameownership,any individuallotdoesnotmeettherequirementsofSection3.7(F)(5)(b),thelotmustnot beconsideredasaseparateparceloflandforthepurposesofsaleordevelopment. Thelotmustbecombinedwiththeoneormorecontiguouslotssotheyequaloneor moreparcelsofland,eachmeetingtherequirementsofSection3.7(F)(5)(b)asmuch aspossible. (b)Additions/expansionstononconformingstructures (i)Alladditionsorexpansionstotheoutsidedimensionsofanexistingnonconforming structuremustmeetthesetback,height,andotherrequirementsofSection3.7(F). Anydeviationfromtheserequirementsmustbeauthorizedbyavariancepursuantto Section3.7(F)(3)(c). (ii)Deckadditionsmaybeallowedwithoutavariancetoastructurenotmeetingthe requiredsetbackfromtheordinaryhighwaterlevelifallofthefollowingcriteriaand standardsaremet: 1.Thestructureexistedonthedatethestructuresetbackswereestablished; 2.Athoroughevaluationofthepropertyandstructurerevealsnoreasonable locationforadeckmeetingorexceedingtheexistingordinaryhighwaterlevel setbackofthestructure; 3.Thedeckencroachmenttowardtheordinaryhighwaterleveldoesnotexceed15 percentoftheexistingsetbackofthestructurefromtheordinaryhighwaterlevel ordoesnotencroachcloserthan30feet,whicheverismorerestrictive;and 4.Thedeckisconstructedprimarilyofwood,andisnotroofedorscreened. (8)SpecialProvisionsforSubdivisionandPlattinginShorelandDistricts (a)Landsuitability Eachlotcreatedthroughsubdivision,includingplannedunitdevelopmentsauthorized underSection2.4(P)ofthisordinance,mustbesuitableinitsnaturalstateforthe proposedusewithminimalalteration.Suitabilityanalysisbythelocalunitofgovernment shallconsidersusceptibilitytoflooding,existenceofwetlands,soilandrockformations withseverelimitationsfordevelopment,severeerosionpotential,steeptopography, inadequatewatersupplyorsewagetreatmentcapabilities,near-shoreaquaticconditions unsuitableforwater-basedrecreation,importantfishandwildlifehabitat,presenceof ORDINANCENO.545 Page 35 of 42 significanthistoricsites,oranyotherfeatureofthenaturallandlikelytobeharmfulto thehealth,safety,orwelfareoffutureresidentsoftheproposedsubdivisionorofthe community. (b)Consistencywithothercontrols Subdivisionsmustconformtoallofficialcontrolsofthiscommunity.Asubdivisionwill notbeapprovedwherealatervariancefromoneormorestandardsinofficialcontrols wouldbeneededtousethelotsfortheirintendedpurpose.Eachlotshallmeetthe minimumlotsizeanddimensionalrequirementsofSection3.7(F)(5),includingatleasta minimumcontiguouslawnarea,thatisfreeoflimitingfactorssufficientforthe constructionoftwostandardsoiltreatmentsystems.Lotsthatwouldrequireuseof holdingtanksmustnotbeapproved. (c)Informationrequirements. Sufficientinformationmustbesubmittedbytheapplicantforthecommunitytomakea determinationoflandsuitability.Theinformationshallincludeatleastthefollowing: (i)Topographiccontoursatten-footintervalsorlessfromUnitedStatesGeological Surveymapsormoreaccuratesources,showinglimitingsitecharacteristics; (ii)ThesurfacewaterfeaturesrequiredinMinnesotaStatutes,section505.02, subdivision1,tobeshownonplats,obtainedfromUnitedStatesGeologicalSurvey quadrangletopographicmapsormoreaccuratesources; (iii)Adequatesoilsinformationtodeterminesuitabilityforbuildingandon-sitesewage treatmentcapabilitiesforeverylotfromthemostcurrentexistingsourcesorfrom fieldinvestigationssuchassoilborings,percolationtests,orothermethods; (iv)Informationregardingadequacyofdomesticwatersupply;extentofanticipated vegetationandtopographicalterations;near-shoreaquaticconditions,including depths,typesofbottomsediments,andaquaticvegetation;andproposedmethodsfor controllingstormwaterrunoffanderosion,bothduringandafterconstruction activities; (v)Locationof100-yearfloodplainareasandfloodwaydistrictsfromexistingadopted mapsordata;and (vi)Alineorcontourrepresentingtheordinaryhighwaterlevel,the“toe”andthe“top” ofbluffs,andtheminimumbuildingsetbackdistancesfromthetopofthebluffand thelakeorstream. (d)Dedications Whenalandoreasementdedicationisaconditionofsubdivisionapproval,theapproval mustprovideeasementsovernaturaldrainageorpondingareasformanagementof stormwaterandsignificantwetlands. D.SUPPORTINGDATA: None CityCouncilAgenda:09/10/12 1 5I.ConsiderationofauthorizingsubmittalofNCTCMembershipApplication (JO) A.REFERENCEANDBACKGROUND: Asyouknow,initialeffortstogainmembershipintheNCTC(NationalCableTelevision Cooperative,Inc.)failedatthetimethatFiberNetwasgearinguptoprovidetripleplay services.ItisourunderstandingthattheNCTCrejectedtheapplicationduetoFiberNet’s standingasamunicipaloperation.AsanalternativetoNCTCmembership,FiberNetthen turnedtotheNTTC(NationalTelcoTelevisionConsortium)forobtainingtelevision content.FiberNetwasabletogainmembershiptotheNTTC;however,thecostfor televisioncontentwashigherthanthroughtheNCTC.Wehavenowlearnednowthat theNCTChaschangeditswaysandisnowacceptingapplicationsformembershipfrom Telecommunicationsystemsoperatedbymunicipalities.Therefore,Councilisaskedto authorizesubmittalofanapplication,pendingsuccessfulrenegotiationofexisting contractwiththeNCTC.Inconjunctionwiththisauthorization,MarkPultuskerwillbe contactingtheNTTCtodeterminethecostsassociatedwithterminatingtheexisting contract.TheresultsofthisnegotiationwiththeNTTCwilldeterminewhetherornotis makessensetoactuallysubmittheapplicationandfee($1,500)totheNCTC.Channel line-upsprovidedbybothprovidersisgood.However,theNTTCoptionmayprovide someadvantages.Channelselectionwouldnotbeasignificantreasonforswitching providers. Staffhasbeentryingtodevelopa2013budgetthatwouldminimizethepropertytax effectonallpropertyowners.Forinitialbudgetingpurposes,staffusedataxlevytarget of$7,900,000.Thelevytargetrepresentsa$50,000(.6%)increaseoverthe2012final levy.The.6percentincreaseiswellbelowthe12monthchangeinCPIof1.4%. Additionally,theimpactonresidentialpropertyrangesfromlessthan$1permonthon homesvaluedat$135,000tolessthan$2permonthonhomesvaluedat$300,000. TheCity’slevysupportsfourdifferentfunctionsoftheCity,includinggeneralfund operations,thecommunitycenter,streetreconstructionactivities,andrepaymentofdebt. Staffassembleddepartmentrequestsandmadeadjustmentstovariouslineitemsto balancethebudget.RequeststrimmedfromtheGeneralFundtotaled$420,000.The latestdraftofthe2013GeneralFundbudgetprovidesfora$75,000(1.1%)increasein expendituresoverthe2012adoptedbudget.DraftbudgetsfortheGeneraland CommunityCenterFundsareattached. Addingbackitemsremovedfromtherequestedbudgetwillrequireadjustmentsto revenuesand/orotherexpendituresinordertoachieveabalancebudget.
