City Council Resolution 1981-06r RESOLUTION REGARDING AMENDMENT TO STEP II EPA GRANT NO. C-270855-02 FOR ADDITIONAL ENGINEERING SERVICES AT THE WASTEWATER TREATMENT PLANT WHEREAS, Orr-Schelen-Mayeron and Associates, Inc. (OSM) has incurred additional engineering costs in the amount of $82,869.49 for preparation of Step II Plans and Specifications under EPA Wastewater Treatment P]_ant Grant No. C-270855-02; and WHEREAS, that additional expense was necessary and proper; and WHEREAS, the additional costs incurred were the result of unforseen and substantial additional engineering design as a result of circumstances discovered following the completion of the Step I facilities plan; and WHEREAS, the additional costs incurred in making the substantial additional engineering design furthered EPA objectives under the Wastewater Treatment Grant Program; and WHEREAS, the EPA and MPCA have approved the plans and specifications prepared by OSM for the Monticello Wastewater Treatment Plant Improvements; and WHEREAS, due to the particular circumstances of this case, including the extremely tight schedule for completion of Step II engineering services required by the MPCA staff and the earlier endorsement by the MPCA of a sub- sequent grant amendment to the Step I grant; NOW THEREFORE, BE IT RESOLVED, that the City of Monticello moves that the EPA Regional Administrator and requests endorsement by the MPCA for a deviation from the substatutory requirements of Federal Regulations 40CFR30.900-1(a) and 40CFR35.935-11. Said deviation is requested pursuant to 40CFR30.1000 Et.SEQ, and is further requested for the purposes of allowing the engineering firm of OSM to recover otherwise allowable costs in the amount of $82,869.49 for the necessary work done in producing plans and specifications under Monticello's EPA Grant C-270855-02.
