City Council Resolution 1981-32• • ~3~ RESOLUTION ADOPTING ASSESSMENT ROLL FOR 1981-1 IMPROVEMENT PROJECT WHEREAS, pursuant to proper notice duly given aS required by law, the council has met and heard and passed upon all objections to the pro- posed assessment except as noted below for the 1981-1 Improvement Project, consisting of sanitary sewer, watermain, storm sewer and bituminous streets. Areas proposed to be assessed are as follows: 1. All property abutting West River Street between the Burlington Northern railroad tracks westerly approximately 1200' to the North/South ~a line of Section 4, T121 N. R 25W. 2. Portions of the "Meadows" Subdivision plat served by storm sewer, sanitary sewer, water main and bituminous streets. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment= against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it except for the assessment against parcel #155500-041402 owned by Edgar Klucas. In accordance with Minnesota Statutes 429.061, Subdivision 1, the assessment against this parcel shall be consider- ed at an adjourned hearing. Publication and mailing to property owner of said adjourned hearing shall be at least two weeks prior to hearing. 2. Except as noted in paragraph 3 below, the assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable in 1982 and shall bear interest at the rate of 13 per cent annum from the date of the adoption of this assess- ment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1982. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. Assessments for those parcels designated by an asterik (*) shall be deferred for one year and payable over nine (9) years, the first of the installments shall be payable in 1983 and shall bear interest at the rate of 13 percent. To the principal amount listed shall be added interest from date of this resolution until December 31, 1982 and subsequent in- stallments and all other particulars relating to these parcels asterisked shall be in accordance with this resolution. - 1 - • 4. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 5. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the proper tax lists of the county, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
