City Council Resolution 1981-33~ ~ ~~~ RESOLUTION ADOPTING ASSESSMENT ROLL FOR 1981-2 IMPROVEMENT PROJECT WHEREAS, pursuant to proper notice duly given as required by law, council has met and heard and passed upon all objections to the pro- ed assessment except as noted below for the 1981-2 Improvement Pro- t, consisting of storm sewer improvements. Areas proposed to be essed are as follows: 1. Lots 1 thru 6, Block 1, Lauring Hillside Terrace, and Lots 1 thru 8, Block 2, Lauring Hillside Terrace. 2. Lots 4 thru 7, Block 3, Lots 12 thru 14, Block J, and Lots 4 thru 7, Block 15, Townsite of Monticello. 3. Part of NW's of SE's beginning at intersection of E. Line of Cedar St, With S. Line of Ry R-W E. along right of way 352' Sly. at Rt. W. to beginning, consisting of approximately 2.81 acres. 4. A tract of land in SE's of SW's description as follows: Beginning at NE corner of SEA of SW~a, W on N line of SE's of SW's to N right of way line of Hwy 94. SE along N right of way line of Hwy 94 to E. line of 5E'~ of SW~a, N on E line of SEA of SW's to POB. 5. All of vacated Cedar Street located south of 7th St. lying be- tween Blocks 3 and J. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. The assessments shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable in 1982 and shall bear interest at the rate of 13 per cent annum from the date of the adoption of this assessment resolution. To the first install- ment shall be added interest on the entire assessment from the date of this resolution unitl December 31, 1982. To each subsequent installment when due shall be added interest for one year on all unpaid installments. - 1 - 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the project tax lists of the county, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
