City Council Resolution 2016-74CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2016-074 A RESOLUTION OF THE MONTICELLO CITY COUNCIL APPROVING A PRELIMINARY AND FINAL PLAT AND DEVLEOPMENT AGREEMENT FOR CAMPING WORLD FIRST ADDITION WHEREAS, the applicant has submitted an application for approval of a Preliminary and Final Plat to accommodate the development of retail uses; and WHEREAS, the property in question is guided for commercial uses under the "Places to Shop" category in the Monticello Comprehensive Plan; and WHEREAS, the property in question is proposed to be zoned B -3, Highway Business District to accommodate the proposed uses on the combined parcel in the proposed plat; and WHEREAS, the proposed plat will accommodate a development project consistent with the requirements of the Monticello Comprehensive Plan; and WHEREAS, the proposed project will meet the goals and policies of the Monticello Comprehensive Plan, as well as the Zoning Ordinance encouraging commercial uses on the subject property; and WHEREAS, the Planning Commission held a public hearing on November 1, 2016 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the City Council has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the City Council of the City of Monticello hereby makes the following Findings of Fact in relation to the recommendation of approval: 1. The proposed project complies with the intent of the use of the property within the City Comprehensive Plan. 2. With conditions, the proposed plat meets all applicable requirements of the City's Zoning Ordinance. 3. All applicable requirements and performance standards of the City's Zoning and Subdivision Ordinances will be satisfied. 4. The addition of commercial retail uses on the subject site is consistent with the City's development objectives. 5. The retail project contributes to a reasonable expectation and density of land use on the property. 6. The project can be accommodated with existing and planned public infrastructure. 7. The project will not negatively impact conditions or property values for other properties in the area. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota: The Monticello City Council hereby approves the Camping World First Addition Preliminary and Final Plat applications as recommended by the Planning Commission, and the Development Agreement regulating the development and completion of required plat improvements, subject to compliance with related codes and regulations for such use, and the following conditions: 1. The applicant will prepare an amended final plat incorporating all acquired property into the same development parcel. 2. The applicant meets all performance standards as identified in the staff report and zoning ordinance. 3. The applicant will submit the necessary paperwork to vacate the drainage and utility easements related to the lot combination, subject to encroachment agreements governing improvements prior to vacation of the easements, such vacations only to the extent that the required easement widths will remain in force. 4. The applicant is found to meet all applicable zoning regulations governing building size ratios, or the applicant receives approval of a variance based on the existing lot and building sizes. 5. Signage plans will be submitted for permits in accordance with sign ordinance allowances and processing. 6. The applicant comply with the City Engineer's report dated October 25, 2016. 7. The applicant shall enter into a development agreement which is subject to final review and satisfaction of the City Attorney. 8. Requirements and comments of other city staff are incorporated into the final approval. ADOPTED this 14t" day of November, 2016, by the City Council of the City of Monticello, Minnesota.
