City Council Resolution 2016-45ACITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2016-045A Date: June 27, 2016 Resolution No. 2016 -045A Motion By: Charlotte Gabler Seconded By: Lloyd Hilgart A RESOLUTION OF THE MONTICELLO CITY COUNCIL APPROVING CONDITIONAL USE PERMITS FOR CROSS PARKING AND ACCESS, BULK FUEL STORAGE, AND BUILDING HEIGHT: LOTS 1 - 3, BLOCK 1, CLEAR CREEK ADDITION WHEREAS, the Rocky Mountain Exchange Group has submitted an application for approval of Conditional Use Permits to construct a building addition on the subject property; and WHEREAS, the property in question is guided for industrial uses under the "Places to Work" category in the Monticello Comprehensive Plan; and WHEREAS, the proposed plat will accommodate a development project consistent with the requirements of the Monticello Comprehensive Plan; and WHEREAS, the proposed project will meet the goals and policies of the Monticello Comprehensive Plan, as well as the Zoning Ordinance encouraging the expansion of industrial and warehousing uses in the district; and WHEREAS, the Planning Commission held a public hearing on June 7, 2016 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the City Council has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the City Council of the City of Monticello hereby makes the following Findings of Fact in relation to the recommendation of approval: 1. The proposed project complies with the intent of the use, and furthers the objectives, for the area within the City Comprehensive Plan. 2. With conditions, the proposed Conditional Use Pen-nits meet all applicable requirements of the City's Zoning Ordinance. 3. The addition of building area to the existing use is consistent with the City's community and economic development objectives. 4. The project contributes to a reasonable expectation and density of land use on the property. 5. The Conditional Use Permits within the PUD better accommodate the use of shared spaces and facilities. 6. The project will not overburden the City's public service capacity in the area. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota: The Monticello City Council hereby approves the Clear Creek Addition Preliminary and Final Plat as recommended by the Planning Commission, subject to compliance with related codes and regulations for such use, and the following conditions: 1. Deferred Parking. The applicants provide a narrative on the number of parking spaces that are needed for their business. The applicants have shown on the site plan that the 52 spaces can easily be added if needed. 2. Cross parking and access agreement is applied and recorded against all parcels. 3. An encroachment agreement is executed should it be necessary to accommodate storm water ponding design. 4. A development agreement is executed addressing all improvements to the site, including requirements for registering the property, accepting temporary occupancy until title issues are resolved, and replatting according to the terms of the agreement. 5. Curb Cut Width. The curb cut width shall be reviewed by the City Engineer. 6. The Landscaping Plan is modified to add or move plant materials that will enhance the screening of the view of the loading docks from Dalton Way. 7. The requirements of the City Engineer are addressed per the Engineer's letter dated June 1, 2016, and the applicants continue to work with the City regarding stormwater management requirements. 8. Bulk fuel dispensing on the site shall only be for the fueling of company delivery vehicles, and shall meet all other requirements of the applicable zoning ordinance, along with required building and fire codes. 9. Any proposed signage changes shall be subject to the applicable sign ordinances and a separate permitting process. 10. The requirements of other City staff are complied with.
