3. Consideration of adding items to the agenda.
a. City View Park Name Change Proposal: Tom Pawelk said that it was brought
to his attention that the name "City View" did not seem appropriate for the
park on "Monti Hill" but would be better named "Montiview Park ".

4. Citizens requests and comments.
a. Thank you from Joe Rosh: Tom Pawelk passed around a card from Joe Rosh
thanking the City and the Parks Department for all their efforts in making the
off -leash dog park a reality in Monticello.
b. Pawelk said that he has received a lot of positive comments about the Par
West Park playground improvements from residents in the area.
5. Review parks budget items.
Tom Pawelk reviewed the 2017 proposed budget line items with the commission,
highlighting the following items:
• Rolling Woods Sidewalk Connection: $40,000
• Rolling Woods Playground Improvements: $65,000
• Gazebos: $10,000
• Montiview Park Single Track Trail: $10,000
• Ellison Park Open Air Shelter: $50,000
• Pathway Maintenance Program: $45,000
• Cardinal Hills Tot Lot Improvements: $15,000
• Electrical Improvements: $8,000 (Ellison); $8,000 (Hillside Cemetery)
• Bike Racks: $2,000
• Capital Equipment: Mower Replacement, Additional Mower, Truck
Replacement
6. Motion to approve updating Rolling Woods Park amenities and discussion of
signed petition from Carlisle Village Development.
Tom Pawelk said that the Rolling Woods Park has been in need of a sidewalk
connection from the Carlisle Village Development for quite some time now. This
park is serving the residents of the Carlisle Village Development and those
residents have sent in a petition for park improvements for age appropriate play
structures including a picnic shelter. Pawelk said it would be similar to River Mill
and Hunters Crossing so it has more play value. Pawelk reviewed the aerial map,
indicating where the sidewalk connection is needed and the parkland that has area
available to develop. Pawelk said the play structure currently at the park is not in
need of replacement but it doesn't have much play value for the demographics of
the area. The new equipment would offer play areas for ages 2 to 5 and 5 to 12.
Pawelk said that staff would salvage and reuse some of the existing equipment in
other parks where needed. The proposed cost of the new playground is $65,000
and the sidewalk connection is another $40,000

7. Motion to approve replacing Cardinal Hills Tot Lot play equipment.
Tom Pawelk said that he has budgeted funds to cover the replacement of the old
play equipment at the Cardin Hills tot lot. Pawelk said the plan is to do the same
type of upgrades that were just completed in Par West Park with a large play area
extending into the swing area. The new equipment will be roughly just under
$11,000 with play areas for ages 2 to 5 and 5 to 12.

PLAY EQUIPMENT AT THE CARDINAL HILLS TOT LOT WITH NEW
EQUIPMENT. MOTION SECONDED BY TIM STALPES. MOTION

8. Discussion of Wag `n Walk event at Meadow Oak Park, Monti Paws Park.
City Council approved the special event permit for the 2nd Annual Walk & Walk
Festival on Sunday, September 25, 2016 from 1 -4pm. The event will have the
same walking courses as last year's event with short course and long course
options along the Meadow Oak pathway system. The volunteer group, Paws for
Parks, is currently seeking sponsors for the event. Pawelk said that it would be a
nice gesture to invite Authority Fence to the festival.
9. Recommendation to approve developing single track mountain bike course at
Montiview Park with volunteer group, Dirt Werks.
Tom Pawelk said he has been working with the volunteer group, DirtWirx, to put
together a plan for trail building at Montiview Park for the mountain bike
challenge course. This is a volunteer group based out of Elk River and they are
very excited to help construct the trails here in Monticello. Pawelk said that he
will put together an MOU similar to the agreement with MORC at Bertram. Once
the design is put together it will be brought back to the Parks Commission for
review and approval.

BIKE CHALLENGE COURSE DEVELOPMENT AT CITY VIEW PARK
UTILIZING THE VOLUNTEER GROUP KNOWN AS DIRTWIRX. MOTION
SECONDED BY NANCY MCCAFFREY. MOTION CARRIED
UNANIMOUSLY, 3 -0.
10. BCOL update of athletic field interim proiect.
Tom Pawelk noted that the interim improvements to meet the grant requirements
are almost complete at the future Bertram Athletic Complex. The improvements

consist of a gravel drive and parking area to the north, signage, a trail along
Briarwood Avenue going south to connect into the regional park, and a multi -use
greenspace (20 -acre) field which will be ready for play in 2017. Pawelk said that
he had a farmer come out and till the fields and parks staff is seeding the
greenspace today.
Once the overall Athletic Complex Master Plan is complete and approved, the
development will be phased from north to south with the entire north play area as
Phase 1 as the City owns that property and is still working to acquire the middle
40.89 acres. The goal is to try for a 2018 build with field play ready by 2020.
The Wright County Board passed the land alteration permit for the interim
improvements. Staff will do as much as they can to help offset costs. There is
$2,000,000 in the budget for 2018, and each year thereafter there is $700,000 to
be set aside.
The MOAA Board approved the division of the 27 acres from the City's 157 -acre
biosolid farm on the condition that the land must be used for recreational
development only in order to preserve the potential for future decommissioning of
the Xcel Ballfields. Angela Schumann said that on September 12th, the item for
consideration to the City Council will be to execute the amendment to the outdoor
recreation contract, once they do that, the obligation for the outdoor recreation
funds that were used to build the fields at Xcel are transferred to that 27 acres and
that is a binding obligation of the City so that 27 acres will be required to be used
only for recreation. The required deed restriction will be recorded and the MOAA
Board only approved that split provided it was for recreation. That doesn't
necessarily mean the area has to be used for ballfields but just that it has to be
used for public recreation. Once the conversion is wrapped up, then the Master
Planning Process can be completed.
11. Introduction of new Community Center Director Ann Mosack.
Tom Pawelk introduced Ann Mosack who was hired as the new Community
Center Director after Kitty Baltos resigned. Mosack brings a lot of experience
with parks and recreation and worked for the City of Bloomington for nearly nine
years. She worked in parks and recreation, and on projects and facilities
management.
12. General Park Updates.
Tom Pawelk provided updates on the following parks and projects with no formal
action taken at this time:
A. Par West Park: New playground completed and positive feedback from
residents.
B. Montiview Park: DirtWirx crew trail building process: Pawelk walked
property with crew and said the brainstorming starts now. The primary group

consist of about six core members and there are assigned trail bosses with
duties being feathered out to additional workers.
C. Hunters Crossing: The Girl Scout project is complete with the wildflowers in
and growing and the kiosk signs are in.
D. Meadow Oak Park Playground: The final pieces for the playground were
installed last week and the project is complete.
E. Park Maintenance: Staff has been busy fertilizing and maintaining park turf,
prepping for park rentals which are up this year, and keeping up with the
docks on the river due to the higher water levels.
F. East Bridge: STS Crew was in this week spreading mulch and doing some
landscaping and they did a very good job. Nancy McCaffrey said that one of
the volunteer gardeners submitted a recognition award request for the porta
surround at East Bridge built by Special Projects Coordinator Wipper. Those
requests were sent to Kare 11 and also to Midwest Magazine.
13. Next regular meeting scheduled for September 22, 2016.
The next regular Parks Commission Meeting is scheduled for September 22,
2016, at 9:15 a.m. in the Public Works Office.

Volunteers of DirtWirx
Montiview Park, Mountain Bike Park
INTRODUCTION AND PURPOSE
The City of Monticello and the Volunteers of DirtWirx are interested in promoting
mountain biking as an outdoor recreation, fitness and skill building activity and in helping
to develop trails, technical mountain bike trail features, and a regular volunteer crew at
Montiview Park.
This memorandum shows that DirtWirx is offering to provide initial support and guidance
to the City of Monticello for specific projects, including the design and construction of
technical mountain bike trails and features, and the development of a regular volunteer
base, which DirtWirx volunteers have agreed to provide as a temporary service to The
City of Monticello. This memorandum also establishes the responsibilities and
conditions under which that volunteer service will be provided, and delineates the
responsibilities of The City of Monticello.
SCOPE OF THE AGREEMENT
Ownership of Improvements
All improvements, constructed on City of Monticello lands, shall be, and remain the
property of The City of Monticello. All materials, including records, data, and other
information acquired, developed or documented under this MOU shall be the property of
the originating party, unless otherwise mutually agreed upon by both parties.
Term of Agreement
The term of this MOU shall start September 1, 2016 and extend through August 31,
2017. The City of Monticello and DirtWirx can subsequently agree to extend this
agreement on an annual calendar year basis with the approval of both parties.
Termination of Agreement
This MOU may be terminated by either party upon delivery of written notice to the
other party. When a new volunteer crew is prepared to assume the volunteer duties,
DirtWirx will transfer responsibility to the new crew. At that time, this agreement would
be terminated and a new agreement would be executed.
Amendment of Agreement
This MOU shall not be altered, changed or amended except by written mutual
agreement of the parties
DirtWirx Volunteers
Volunteers assigned to work under this agreement at Montiview are volunteers of
DirtWirx. Volunteers are not employees of or individual volunteers of The City of
Monticello, however they may receive training enabling them to represent the
relationship between DirtWirx and The City of Monticello.
DirtWirx Responsibilities
1. Provide technical support to The City of Monticello in determining the
location and design of technical features for the Mountain Bike Trail,
consistent with the planned ability level of the trail segment.
2. Provide guidance to the City of Monticello to find volunteers.
3. Provide direction to the City of Monticello as they develop a qualified and regular
crew to carry out the ongoing construction and maintenance needs of the park.
4. Supervise volunteers in the construction of approved technical features and
alignment changes.
• Utilize tools owned by DirtWirx volunteers and The City of Monticello that may
be made available by the designated City of Monticello Trail Steward.
• Train and supervise volunteers in appropriate construction techniques.
• Identify potential crew leader(s) and submit the name(s) to the designated City
of Monticello Trail Steward.
• Coordinate work schedule and on -site public notification, when needed, with
the designated City of Monticello Trail Steward.
• DirtWirx volunteers may use bikes in the on -site planning and testing of
technical features prior to official trail opening as coordinated with the City of
Monticello Trail Steward.
5. Supervise volunteers in the inspection and hand -work maintenance of the trail.
• DirtWirx volunteers will assist in monitoring and inspecting trail features and
inform the City of Monticello Trail Steward if action is required.
• Ensure that all volunteers have received training in trail maintenance
responsibilities.
• DirtWirx volunteers are authorized to sculpt and /or remove downed trees
found on the trail tread.
• Perform routine maintenance activities.
• In the event that DirtWirx is unable to safely and promptly address an
identified issue that may create an unsafe situation, the DirtWirx volunteers
should notify the City of Monticello Trail Steward.
6. Use of Chainsaws and Tree Removal by DirtWirx Volunteers.
• Only individuals who DirtWirx has designated as "chainsaw operators" will be
allowed to operate chainsaws on the City of Monticello properties. Such
designation will only be granted to individuals who have been trained by
DirtWirx in the safe and proper use of chainsaws.
• No live standing trees of native species over 4 inches (except Oak trees,
which shall be at 2 inches or greater) in diameter will be cut without first
receiving approval from the designated City of Monticello Trail Steward.
• For brush and small trees that are cut, it is preferred to remove the debris
completely from the Park, or to a designated debris area within the Park. If
that is not practical, they should be scattered at least 15 feet away from the
trail and lopped up so that no portion extends more than 3 feet above the
ground.
• Large trees that fall across the trail may be cut to clear passage for the bike
trail but the remaining portions of the trees could be left in place provided it's
safe to do so.
• DirtWirx will notify the designated City of Monticello Trail Steward when there
are fallen trees that DirtWirx requires assistance with.
7. If applicable, supervise volunteers for the purpose of winter trail grooming,
maintenance, and inspection.
• Routine trail inspection and maintenance shall be conducted during the
winter season under the same guidelines specified by the MOU for summer
season.
• Develop, implement and evaluate winter trail grooming techniques and
equipment.
• Train and supervise volunteers in appropriate trail grooming techniques in
accordance with DirtWirx guidelines for winter trail use.
• Recommend a crew leader(s) for winter grooming who will maintain timely
communication with the designated City of Monticello Trail Steward.
8. All trail feature designs and changes will be discussed with the City of Monticello
Trail Steward.
9. Recommend to the City of Monticello the types, location and language for trail
directional, cautionary and informational signs and install (if requested by the City
of Monticello).
10. A designated DirtWirx representative(s) may make recommendations to the
City of Monticello Trail Steward as to when to close and re -open trails due to poor
conditions or other unforeseen circumstances.
11. Hold Harmless Agreement
Each party agrees that it will be responsible for its own acts and the results
thereof and shall not be responsible for the acts of the other party and the
results thereof. Each party, therefore, agrees that it will assume all risk and
liability to itself, its agents or employees, for the injury to persons or property
resulting in any manner from the conduct of its own operations, and the
operation of its agents or employees under this agreement, for any loss, cost,
damage, or expense resulting at any time from any and all causes due to any
acts or acts of negligence, or the failure to exercise proper precautions, of or
by itself or its own agents or its own employees, while occupying or visiting
the premises under and pursuant to the agreement.
12. DirtWirx must abide by City of Monticello Park Ordinances.
City of MONTICELLO RESPONSIBILITIES
1. The City of Monticello Trail Steward will review and approve design and
implementation plans for all agreed to volunteer activities.
2. To purchase materials as agreed upon and, if needed, to be used in the
construction of approved technical features.
3. To provide tools for construction and maintenance activities.
4. To provide Park maintenance staff support for approved work on a schedule
agreed to by Park Maintenance Supervisor.
5. To recognize DirtWirx's contributions for trail design, technical feature design and
construction and volunteer maintenance support in appropriate signage at an
appropriate location in a manner approved by the City of Monticello.
6. To display a message about the DirtWirx organization and event opportunities in
a manner approved by the City of Monticello.
7. To notify DirtWirx of trail closures or events which affect the use of the trail.

MONTICELLO RIVERSIDE CEMETERY
RULES AND REGULATIONS
EFFECTIVE NOVEMBER 1, 2001
AMENDED MARCH 9, 2015
1. PURCHASE OF GRAVES:
1.1 All fees or charges shall be set by the City and are payable to the City at the Public
Works Office located at 909 Golf Course Road, Monticello, MN 55362.
1.2 No grave shall be reserved with the intent to purchase for any reason.
1.3 Upon full payment of the purchase price of a grave, the City of Monticello will issue
a cemetery deed conveying the grave, executed by the City, and the deed shall be recorded in
the records of the City. Description of the grave will be in accordance with the cemetery
plats, which are kept on file at the City Public Works Office.
2. CONDITIONS OF GRAVE PURCHASE:
2.1 All graves will be sold subject to these rules and regulations, or those hereafter
adopted. The purchaser shall expressly agree, in the deed conveying the lot their rights are
subject to such reasonable rules and regulations as the City Council may adopt. The deed,
and these rules and regulations, and any amendments, constitute the sale agreement between
the cemetery and the lot owner.
2.2 No grave shall be used for any purpose other than the burial of human remains and
the placing of appropriate memorials, as per the rules and regulations of the cemetery.
2.3 No easement or right of interment is granted to any grave owner in any road, drive,
alley, or walkway within the Riverside Cemetery, but such road, drive, alley, or walkway
may be used as a means of access to the owner's cemetery grave or graves.
2.4 The City reserves, and shall have, the right to correct any errors that may be made by
it either in making interments, disinterment, or removals, or in the description, transfer, or
conveyance of any interment property, either by canceling such conveyance and substituting
and conveying in lieu thereof other interment property of equal value and similar location, as
far as possible, or as may be selected by the City, or in sole discretion of the City, by
refunding the amount of money paid on account of said purchase. In the event that such error
shall involve the interment of remains of any person in such property, the City reserves, and
will have, the right to remove or transfer such remains so interred to other property of equal
value and similar location as may be substituted and conveyed in lieu thereof.

3. TRANSFER OF GRAVES:
3.1 The owner of a cemetery grave may transfer the grave:
3.1.1 To the City of Monticello at the original sale price,
3.1.2 Any of his /her relatives, who may survive him/her by will for the use and
benefit of the person designated in the will, or
3.1.3 To other persons not related to him/her.
In all cases, the owner must complete and have signed by witnesses and a Notary Public, a
Transfer of Ownership document provided by the City of Monticello. The transfer of
ownership document must be approved by the City prior to the transfer of graves by the
owner. When a transfer has been made in conformance with these rules, the City will issue a
deed to the new owner. In all cases, a transfer fee payable to the City of Monticello will
apply based upon the City's current fee schedule.
3.2 No grave will be permitted to be re -sold, disposed of, or otherwise used until the
purchase price, and all unpaid charges, have been paid in full.
3.3 No cemetery grave may be re -sold or otherwise disposed of, without approval of the
City of Monticello.
3.4 Grave owners may not allow interments to be made on their grave unless the transfer
of grave process has been completed.
4. DESCENT OF GRAVES:
4.1 On the death of a grave owner, such grave shall be granted and conveyed by the City
to the descendant's surviving spouse. If there is no surviving spouse, then to the
descendant's eldest surviving child; if there is no surviving child, then to the descendant's
youngest surviving sibling; if there is no surviving spouse, child or sibling of the descendent
and the grave is not sold during the administration of the descendant's estate or otherwise
provided for by will, the City may convey the lot to any of the descendant's parents, siblings
or descendants as it deems fit.
5. BURIAL PERMITS:
5.1 A burial permit shall be issued and delivered to the City of Monticello for all burials
in the cemetery. In the case of a cremation burial and certificate of cremation shall be
delivered to the City of Monticello.

6. INTERMENTS:
6.1 Grave owners are granted only the right of interment in their graves. The City of
Monticello reserves the right to refuse to permit the interment of anyone who is not at the
time the owner of the lot, or a relative of the owner, by blood or marriage. Permission, in
writing, and with the seal of a Notary Public, of the grave owner must accompany all
requests for permits to bury persons not members of the immediate family of the grave
owner.
6.2 At least forty -eight (48) hours notice shall be given prior to the time set for the
funeral service to assure a timely grave opening.
6.3 City Holidays are as follows: New Year's Day, Martin Luther King Jr Day,
President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's
Day, Thanksgiving Day and the day after Thanksgiving, '/2 day — Christmas Eve and
Christmas Day. If a family chooses a burial the day following a holiday — the family will be
charged the Public Works Labor fee as stated in the most current fee schedule for time spent
preparing for burial.
6.4 No casket shall be interred in the cemetery unless it is enclosed in a concrete vault or
box. Ashes must be placed in a container prior to burial.
6.5 Should the grave owner or funeral director fail or neglect to designate the location,
the City of Monticello reserves the right to make the interment in a location designated by the
City. The City will not be responsible for any order given by telephone, or for any mistake
occurring from the want of precise, proper instructions as to the particular location within a
plot where interment is desired.
6.6 Interments are for the purpose of the human dead only. No pets, jewelry, artifacts, or
other material items will be allowed to be buried.
6.7 The City will not be liable for the interment permit, nor the identity of the person
sought to be interred.
6.8 No interment of more than one body shall be made in one grave, except in the
following cases:
6.8.1 One adult and one child or infant.
6.8.2 Two infants or children.
6.8.3 Two urns of ashes.
6.8.4 One adult and one urn of ashes.
6.9 The cost of interments, including burial of ashes, shall be set by the City.
6.10 Payment in FULL of all fees, must be made prior to burial.

7. DELAY OF INTERMENT:
7.1 The City of Monticello will be in no way liable for any delay in the interment of a
body when a protest to the interment has been made, or where rules or regulations have not
been complied with.
8. DISINTERMENTS:
8.1 Written permission of the grave owner, and the next of kin, shall be filed with the
City, and a permit from the County Health Officer shall be secured and presented, and the
required fees paid before any grave may be opened for any purpose. At least thirty (30) days
written notice must be given prior to any disinterment. This provision does not apply when
disinterment is ordered by a duly authorized public authority.
8.2 The cost of disinterment will be the same as the current cost of interments unless
otherwise stated in the fee schedule.
9. MONUMENTS, MARKERS AND FOUNDATIONS:
9.1 Every marker must be placed in the space reserved therefore, as shown upon the plat
of such grave, or as directed by the City.
9.2 Monuments will be allowed in the old section of the cemetery only and are limited in
size to a maximum of 36" for a single grave and a maximum of 72" for a double grave,
including the 4" concrete border. New proposed: Monuments in the old section of the
cemetery only and are limited in size to a maximum of 44" for a single grave including the 4"
precast border or poured concrete border.
9.3 Monuments will not be allowed in the new section of the cemetery. Only flat markers
of sizes specified by the City will be allowed in the new section of the cemetery. Marker size
shall not exceed 2' x 3' for a single grave, 2' x 4' for a double grave, and 12" x 18" for a
single baby grave, including the 4" precast concrete border. All markers shall be uniform in
thickness and a minimum of 4" thick with the exception of the brass veteran markers.
Markers embracing more than two graves will not be permitted, unless otherwise approved
by the City. New Proposed: Marker size shall not exceed 2' x 44" for a single grave, 2' x
48" for a double grave including the 4" precast concrete border or poured concrete border,
and a maximum 12" x 24" for a single baby grave in infant section, including the 2" precast
concrete border or poured concrete border.
9.4 No monument or marker, nor any part thereof, may be constructed of limestone,
sandstone, or any artificial material.
9.5 A foundation of concrete is required for monuments /markers. There shall be a
minimum of 4" concrete border set at grade level. Setting of all monuments /markers shall be
performed by the City or its approved contractor, or an accepted monument company.

The City requires that all above ground monuments /markers must be attached to the
foundation by setting it into the wet cement, pinning it into the cement, or adhering it to the
foundation using exterior adhesive for stones such as PL400.

9.6 Prior to any monument /marker placement or removal for repair the City or its
approved contractor shall be contacted in order to stake the area and supervise the placement.
9.7 For all graves there will be a staking fee payable to the City of Monticello as listed in
the City's current fee schedule. This fee must be paid IN ADVANCE of the staking
performed by the City.
9.8 The City requires that all flush markers in the new section of the cemetery shall be set
at the head end and face east. Furthermore, all monuments /markers in the old section shall
be set at the head end and face east unless existing conditions warrant placing elsewhere.
Such variances will be approved in writing by the City prior to monument/marker placement.
9.9 Only one marker will be permitted on any one grave in the new part of the cemetery
with the exception of a veteran marker which may be placed at the foot end, unless otherwise
approved by the City.
9.10 A maximum of one upright monument or memorial bench monument and one flat
marker will be permitted on any one grave in the old part of the cemetery.
9.11 Corner markers of like material may be placed on graves and/or lots in the old part of
the cemetery only. Corner markers shall be no larger than 4" x 4" square and shall be placed
flush with the ground.
10. PERMANENT CARE:
10.1 The general care of the cemetery is assumed by the City and includes the following:
10.1.1 Cutting of the grass at reasonable intervals;
10.1.2 Raking and cleaning of the grounds;
10.1.3 Pruning of the shrubs and trees that may be placed by the City; and
Maintaining the general preservation of the graves and grounds, walks,
roadways, boundaries, and structures, to the end that said grounds shall remain
and be reasonably cared for as cemetery grounds.
10.1.4 The general care of the cemetery may be awarded by contract to private firms
by the City as they see fit.
10.2 General care of the cemetery assumed by the City shall in no case mean the
maintenance, repair, or replacement of any monument marker erected upon graves, nor the
doing of any special or unusual work in the cemetery.
11. LANDSCAPING IMPROVEMENTS:
11.1 Plants and flowers may be placed above ground, in pots on stands. Any pot placed on
the ground will not be the responsibility of the City of Monticello, or its employees, should it
be destroyed. Flowers and other items placed directly on the grave may be removed by the
City prior to routine cutting of the grass.

11.2 No trees, shrubs, or vines may be planted, nor may fences be erected. The City
reserves the right to remove any tree, shrub, vine, plant, or flowers which may become
unsightly, dangerous, or not in keeping with the landscape design of the cemetery.
11.3 Pots, urns or stands that are left unused on a grave for a period of one (1) year will be
removed by the City.
11.4 All landscaping, grading, and seeding shall be done by the City of Monticello or its
approved contractor. All graves will be seeded and kept flush with the adjacent ground.
When weather conditions allow, seeding will be done following the burial.
11.5 The City will make water available to grave owners for care of flowers and plants in
pots, set in stands, from spring to fall of each year, depending on weather. Grave owners
may water the grass covering their graves.
11.6 The City cannot be held responsible for any damages, loss, or theft, of any personal
property such as flowers, plants, decorations, vases, crocks, markers, monuments, etc.
11.7 The last week in April will be designated as Spring Cleanup in the cemetery. Easter
arrangements will be allowed one week before and one week after Easter.
11.8 The last week in October will be designated as Fall Cleanup in the cemetery. All
items left on the ground will be disposed of and the City will not accept liability for such
items. The City recommends that above ground pots and stands should be removed before
the first freeze and can be replaced at the appropriate grave site after the completion of
Spring Cleanup. If pots and stands are left year- round, the City will not accept responsibility
for such items if they are destroyed due to weather, snow plowing, vandalism, etc.
12. PERPETUAL CARE:
12.1 There shall be established a Perpetual Care Fund and all monies collected for
perpetual care of graves shall be deposited in said fund, and shall be kept separate from all
other funds of the City.
12.2 The fee for perpetual care shall be fixed by the Council of the City by resolution.
13. HOURS OF OPERATION:
13.1 The cemetery will be open to visitors from sunrise to one half hour past sunset.
Permission to enter at all other times shall be secured from the City. The City reserves the
right to refuse admission to the cemetery and to refuse the use of any of the cemetery's
facilities, at any time, to any person or persons whom the City may deem objectionable to the
best interest of the cemetery.

14. GENERAL REGULATIONS:
14.1 Persons within the cemetery shall use only the paths and walkways, and no one is
permitted to walk upon or across lots or graves unless it is necessary to do so to gain access
to one's own lot. The cemetery expressly disclaims any liability for any injuries sustained by
anyone violating this rule.
14.2 Persons visiting the cemetery or attending funerals are strictly prohibited from writing
upon, defacing, or injuring any monument or marker, breaking or injuring any tree, shrub,
plant, or other structure within the cemetery grounds.
14.3 The following acts are expressly prohibited, as well as any other violations of City
Ordinances and regulations that may apply:
14.3.1 The driving of motor vehicles into the cemetery, unless attending a funeral,
visiting a relative or a friend's grave site, or carrying on maintenance work
authorized by the City.
14.3.2 The driving or parking of any motor vehicle across or upon any grave or lot.
14.3.3 Loud or boisterous talking or music.
14.3.4 Bringing of lunches or refreshments, including alcoholic beverages, into the
cemetery or consuming them on the grounds.
14.3.5 Peddling or soliciting the sale of any commodity within the cemetery.
14.3.6 Placing of signs, notices or advertisements of any kind within the cemetery.
14.3.7 The throwing of rubbish on any part of the grounds.
14.3.8 The walking of pets (including dogs, cats, or any other household pet) on
any part of the grounds.
14.3.9 The driving or parking of any snowmobiles, ATV's or motorized off -road
bikes on any part of the grounds.
14.3.10 The placing of glass containers or bottles on any part of the grounds.
14.4 Special cases may arise in which the literal enforcement or interpretation of a rule
may impose unnecessary hardship. The City reserves the right to make exceptions,
suspensions, or modifications of any of these rules and regulations, when in the judgment of
the City such action appears necessary, and such a temporary exception, suspension, or
modification shall in no way be construed as affecting the general application of such rules
and regulations.

14.5 The City of Monticello reserves the right to amend these rules and regulations
whenever it is determined that it is in the best interest of the cemetery to do so. Any and all
amendments to these regulations will be approved by the City Council of Monticello.
14.6 The City of Monticello reserves the right to remove all monuments, markers, flowers,
plants, trees, decorations, or other similar objects whenever any of these objects become
unsafe, unsightly, dangerous, or not in keeping with the landscape design of the cemetery.
14.7 Specific costs for graves, interments, disinterment, burial of ashes, and setting
monuments /markers are not included in these rules because of the necessity to revise these
rates. A current schedule of fees can be obtained from the City.
14.8 Individuals with questions or concerns about cemetery operations shall report their
concerns to the Office of Public Works and shall not delay, interfere with or harass City
employees, authorized contractors, or agents of the City as they go about their duties in the
cemetery.
15. PENALTIES:
15.1 Violation of the City Ordinance is considered a misdemeanor and the penalty is
described by law. These cemetery rules and regulations are part of the City Ordinance and
shall be enforced and penalties imposed for violation of such rules and regulations.
16. CEMETERY MANAGEMENT:
16.1 The responsibility for the management of Monticello Riverside Cemetery and all
matters related thereto shall be vested in the City.
16.2 The Monticello Parks Commission shall be the overseeing board for any maintenance
or other issues with regard to Monticello Riverside Cemetery.
