-.nda Item 1. Public HearinR - Sewer and Water Extensions - W. County Road N39.
l At the last regular city council meeting, a resolution was a-
dopted calling for a public hearing and the preparation of an updated
feasibility report on the extension of sewer and water on West
County Road #39.
Since the improvement project will not likely be ready for con-
struction until 1978, the council could approve plans and specs for the
project now but wait until spring of 1978 to determine if this
could be combined with other projects.
POwIBLE ACTION: Consideration of resolution approving plans and
specifications for the improvement.

Agenda Item 2. Public Hearinp,- Consideration of Variance from Monticello City
Ordinance Relative to 2*- Acre Lot Size Minimum for Lot Without Citv
Sewer and Water.
Mgr. David Hoskin ie requesting a variance to build on a 100' x
320' (32,000 square feet) lot without city sewer and water.
Monticello Ordinance Section 10-3-4-(C) requires a 2-J acre minimum
lot size without city sewer and water.
The variance request is for a portion of Lot 1 of Block 2 of Oak-
wood Industrial Park. At our last regular city council meeting, a
building permit request was approved. In reviewing the area with
our city engineer, it was felt that it would not be practical at
this time to serve the area with city.scwcr and water until the
southern portion of Oakwood Industrial Park was developed. As a
result, Keith Nelson felt it would be better for this particular
parcel to have a private septic tank and well system. As with
other variance requests of this nature, applicable city and state
regulations relative to septic tank and wells would have to be
adhered to.
At the lost planning commission meeting, a recommendation woo made
to grant the variance.
POSSIBLE ACTION: Consideration of variance request.

Agenda Item 3. Consideration of Vnrianco. (Public Hearing). Conditional Use Permit
and BuildinR Permit - Dairy Queen.
Mr. Mel Wolters of Monticello is proposing to build a Dairy Queen
on lots 6,7 and 8 of Block 5 of Upper Monticello (sea enclosed map).
Following aro issues relevant to the proposal:
Public Hearing - Varinnen - ParkinR.
Ordinance Section 10-3-5-(0-13 requires one parking space
for every 15 ocivaro foot of groes floor area for a convenience
food eatabliahment. A convenience food establighment is
defined in our ordinances as a food establishment which
serves food on or in disposable containers.

I As a result of the above ordinance provision, the proposed
Dairy Queen would be required to have 92 parking spaces
based upon a 1377 square foot building.
Presently the Dairy Queen proposes to provide 33 spaces.
At their last meeting, the planning commission voted to
approve the variance based upon the following:
1. Felt ordinance provision was too stringent as applied to
convenience food operations. For example, a restaurant
such as Perkins, was required to have one space for every
40 square feet of dining area and one space for every 80
feet of kitchen area. Dairy Queen's proposal of 33 spaces
would provide one parking space for every 40 square feet
of floor area. Planning commission also requested to have
Howard Dahlgren & Assoc. prepare a more realistic parking
ordinance as applied to these establishments. Richard
Dwinell concurred with the feeling of the planning commission
in that the current ordinance was too stringent.
2. A drive-in window will allow customers to drive up to
a window and order without parking their cars, thus allow-
ing more spaces to be available to other customers.
1. In reviewing the records, Kentucky Fried Chicken was
allowed a similar variance in that the requirement was 132
spaces and 50 spaces were provided. The ratio here was
one space was provided for each 40 square feet of floor
area. However, there was also consideration given to an
agreement the Kentucky Fried Chicken had with the shopping
center to utilize their lot if required. The planning
commission felt the ratio of 1 space to 40 that Kentucky
Fried Chicken provided was more than adequate since the
present lot is never filled close to capacity.
A. Dairy Queen representative, Nhr. Bruce Bloom, indicated
their experience indicates that an establishment of this
nature requires 25 parking spaces at the peak of business
during the entire year. The 33 spaces provided should be
mars than sufficient to meat the peak demand according to
Mr. Bloom.
As required by Manticollo ordinances, hearings are hold for
any variances of this nature before the city council.
Oonriitional Use Permit.
Area proposed for the Dairy Queen is a B-3 (Highway Business)
zone and as such a convenience food operation requires a
conditional. uen permit end hearing before the city pinning
commission.
No objections were presented at the hearing held at
planning commission mooting and the commission voted to
recommend approval of the conditional use permit.

(( Building Permit.
1- As mentioned above, Dairy Queen's proposal is for a
1377 square foot building (51' x 27'). There is a
proposed seating area to accomodate 18 people in addition
to the service counter and kitchen area.
All Monticello ordinances have been explained in summary
form to Dairy Queen and all other applicable ordinances
will be adhered to except a request for a variance to allow
2 wall signs and 1 pylon sign (ordinance allows only 2
wall signs or 1 of each) was received too late to schedule
a hearing for this meeting. This hearing will be scheduled
for our next meeting.
POSSIBLE ACTION: Consideration of Variance, Conditional
Use Permit and Building Permit.

Agenda Item 4. Consideration of Water Extension to Dino's Other World.
At our last regular meeting, a feasibility report was presented
to the city council on the extension of water to Dints Other World.
This feasibility report was initiated by the city council as a
result of a petition received by Mr. Floyd Kruse.
As the report indicates, the cost of extending water along Hart
Blvd. would be an estimated $14,000. Dino' a Other World has a
previous deferred assessment of $2,069.72 for the extension of
water to the northwest of the facility that was constructed in
1976. However, because of the terrain and woods, it would be quite
costly for Myr. Kruse to hook up to the exiot.. ng water main.
Additionally, Mr. Kruse has requested the water extension to lower
his insurance rates.
Although it was initially felt that Mr. Kruse should be assessed
100% of the cost, consideration should be given to a portion of
the costs being picked up on ad valorem taxes. Listed below
aro the advantages of this extension to Mr. Kruse and the city of
Monticello:
Advantagas - Floyd Kruse:
1. Greater fire protection.
2. Reduced insurance rates.
3. Would roduco hookup fee costs aineo service stubs from
Hart Blvd. would be more accessible to Dino's other World.
Advantages- City of Monticello:
i. This extension would have to be completed some day to
provide water looping and future firs protection to the
area.
2. Should Dino' o Other World decide to obtain service from
the existing water line, the future extension of the proposed
improvement would probably be placed on ad valorem taxes
although a portion could be assessed to other property
owners. However, it is unlikely the city would aosesa thie

�•- cost to Mr. Kruse, since he would already be assessed on
one side of his property.
It is suggested that consideration be given to assessing 50% of
this cost or $14,000. If this were done, the cost to Mr. Kruse
would be as follows:
Assessment on existing line $2070

Approximate hookup charge on basis

As a result, Dino's Other World would be assessed on more than one
side of his property which differs from the city's policy. How-
ever, I believe it is justified in this one case since it is
Dino's Other World which is requesting the additional water extension.
Mr. Kruse has been informed of the cost and it has been indicated
to him that it is possible the entire $14,000 could be assessed
against him. He has been told of the item being on the agenda
Tuesday night and can relay his feelings relative to the cost of
the project at that time. For example, he may want to still have
the water extension put in regardless of his assessment or he may
only request the extension if it costs him X amount of dollars.
POSSIBLE ACTION: Consideration of water main extension and proposed
assessment. Because of the nature of the project, I believe it
would be best to indicate the assessment method now since it may
affect Mr. Kruse's decision.

Agenda Item 5. Consideration of Calling for Feasibility Report on Extension of
Sewer and Water to Dr. Erickson's Pet Hospital.
At a previous meeting, Dr. Joel Erickson was granted a building
permit along with a variance to build a pet hospital with a private
septic tank and well on a lot less than the 27J acro minimum ro-
quired by city ordinancos.

Dr. Erickoon would now like to consider the possibility of obtaining
city sewer and water and has petitioned for a hearing to consider
the matter.

Agenda Item 6. Consideration of Ordinance Amendment Relative to Erratic Driving.
Enclosed, please find a proposed ordinance amendment relative to
erratic driving.
Thio ordinance amendment is essentially the same as an ordinance
Monticello previously had prior to an adoption of a new set of
ordinances in 1975• Jim Powers of the Wright County Sheriff's
office recommended the ordinance be reinstated. Purpose of the
ordinance is to regulate the squealing of tires, grinding gears,
unusual acceleration and other types of erratic driving.
Although Jim Powers will be unable to attend Tuesday's meeting,
officer Don Hozempa will be here representing the sheriff's office
should any questions arise on this topic.
POSSIBLE ACTION: Consideration of ordinance amendment.

Agenda Item 7. Consideration of Building Permit - Ken Holker.
Mr. Ken Holker has applied for a building permit to remodel and add
on to the existing drive in just west of the Phillip 66 Station
on Broadway (see Pnclosed map).
Purpose of remodeling would be for professional office space. This
area is zoned as B-4 (Regional Business) and as such, professional
offices would be a permitted use.
At their last meeting, the Planning Commission reviewed the plans
and recommended approval of the permit. W. Holker indicated that
the parking areas would be hard surfaced with a bituminous overlay.
In terms of landscaping requirements, since the building is an
e.3dsting one and the permit is for remodeling and an addition, it
is recommended the 1'6 landscaping requirement be applied only to
the building permit valuation and to waivo the $1, 500 minimum
requirement.
POSSIBLE ACTION: Consideration of building permit and landscaping
requirements.

RESOLUTION ORDERING IMPROVEMENT
BE IT RESOLVED, by the City Council of Monticello,
Minnesota, as follows:
1. It is hereby found and determined that notice of a i
hearing on the 1978 Sewer and'Water•Imorovement Prostram
in the City of Monticello was duly mailed on October 13, 1977 ,
and published in the Monticello Times, the official newspaper
of the City, on October 11. 1977 , and October 20. 1977
as required by Minnesota Statutes, Chapter 4299 and as ordered
by resolution of this council adopted October 10. 1977
2. A public hearing was held on October 25, 1977 ,
and opportunity given at such hearing to all persona to make
known their views on said improvement, and the council being
fully advised of the pertinent fact., does hereby order the
construction of said improvement, in accordance with the
description thereof contained in said notice of hearing.
3. Mr. John Badalich of the consulting engineering firm
of Orr-Schelen-Mayeron and Associates of Minneapolis, Minnesota,
is hereby authorized and directed to prepare final plans and
specifications for said improvement and to submit them to
the council.

REGULAR CITY COUNCIL MEETING
October 25, 1977 - 7:30 P.M.

Citizen's Cormnents:
Mr. Dave Heskins read a letter to the council criticizing the City Building
Inspector.
Mr. Heskins felt there is a conflict of interest present in the Building
Inspector's Department due to the fact the Luspector is also a building Io
contractor. In addition, he would like to see the city establish perma--tert ciJ
office hours for the Building Inspector so that he would be available on
a daily basis.
The council discussed the increasing work load of the Building Inspector in
recent years and requested that this item be placed on the council agenda
in 30 days to review the possibility of a full-time building inspector's
position.
1. Rublic Hearing - Sewer and Water Extensions - W. County Road N39.
As the result of a petition requesting sewer and water extensions along
W. County #39, an updated feasibility report wee prepared by the Consulting
Engineer, O.S.M.
The project was estimated to cost $163,700.00 and would serve 37 parcels.
A lift station would have to be constructed for this extension bringing
the proposed per parcel assessments cost to $3,693.00 each.
On a motion by G. Walters, second by P. White, it was unanimously carried
to adopt a Resolution ordering preparation of Plans and Specifications for
the 1979 sewer and water improvements along W. County Road #39.
(See Resolution #1977 - 25).
2. Consideration of Vnriance from Monticello City Ordinance Relative to tar
Acro Lot Size Minimum for Lot Without City Sewer and Water.
Mr. David Heskins requested a variance to build on a 100' x 320' (32,000
square feet) lot without city sewer and water. Wnticollo Ordinance Section
10 -9 -L. -(C) requires a 2} acre minimum lot size without city cower and water.
The variance request was for a portion of Lot 1 of Block 2 of Oakwood
Lnduotrial Park.
After reviewing the area with the City flngincer, it was felt that it would
not be practical at this time to serve the area with City Sewer and Water
until Au•ther development occurs in the couthem portion of tho Industrial
Pnrk.
r` A motion was made by P. White, second by A. Crimamo and unaiimoualy carried
to grant Mr. Haskins a variance for a private septic tank and wall system
for a portion of Lot 1, Block 2, Oakwood Industrial Park.

3. Consideration of Water Extension to Dino's Other World.
At the last council meeting, a feasibility report was presented to the council
on the extension of water to Dino's Other World as a result of a Petition
received from the owner, Mr. Floyd Kruse. Dino's Restaurant has a deferred
assessment for a water service extension at the Northwest corner of his
property, but because of the rough terrain and woods, Mr. Kruse felt it would
be too costly to hook up to this water service. Additionally, the requested
water extension to the front of his property would provide the facility with
a 6" water service for additional fire protection.
Mr. Kruse was informed of the estimated $149000.00 cost of the project
and that all or a portion of the costs would probably be assessed to him
since this extension would not benefit any other parcel of land.
Because Mr. Kruse was not present at the meeting and did not indicate his
feelings toward the project, a motion was made by G. Walters, second by
A. Grimsmo to not consider extending water to Dino's Restaurant at this time.

4. Consideration of Calling, for Fensibilitv Report on Extension of Sewer and
Water to Dr. 1;:•ickson's Pet Ilosnital.
A_ a previous meeting, Dr. Joel Erickson was granted a building permit along
with a variance to build a pet hospital with a private septic tank and well
on o lot less than the 2_4 acro minimum required by city ordinances.
Dr. Erickson would now like to consider the possibility of obtaining city
sewer and water and has petitioned for n hearing to consider the matter.
Keith Nelson, Consulting Engineer, indicated that this property could possi-
bly be oerveJ with sewer and water a number of ways. The property located
just west of Mr. Erickson's parcel is now boing proposed for subdivision
and will Likely be requesting city services in the near future.
The councll consensus was that more than (1) property owner or parcel should
request city services rathor than initiating feasibility study's on a
piecemeal basis.
Ao o result, a motion was made by P. White, second by D. Blonigen and
unanimously carried to decline Mr. E•ickoorn's request for a sewer and
rater feasibility study to servo his property.
j. Consideration of Ordinance Amendment Relative to Frratic Driving.
1.1r. Jim Powers of the Wright County Sheriff's Department recommended that
an ordinance reloting to erratic driving, squealing tires, unusual
acceleration, etc. bo adopted by the city council similar to on ordinance
previously on record.

When the current city ordinances were adopted in 1975, the old ordinance
ff relating to erratic driving was eliminated.
A notion was made by D. Blonigen, second by P. White and unanimously
carried to adopt an Ordinance Amendment adding Section 9-1-7(A) and (B)
relating to unreasonable acceleration and erratic driving to the traffic
ordinances currently in effect.
(See Ordinance Amendment 8-15-75 N42).
6. Consideration of Building Permit - Ken Holker.
pr . Ken Holker applied for a building permit to remodel and add on to the

the council consensus was to treat this application the sane as a new com-
mercial building permit and therefore, require that all city ordinances be
adhered to, including landscaping and parking requirements.

are subndtted for, review.

The council discussed the landacaping and blacktopping comploted so for at
the City's Maintcnwco Building with the Public Works Director. Council
conseneuo was to got cost estimates for inotalling a permanent curb harrier
around the parking lot, rather than using individual concreto curb barriers.
A quarterly fire department report was presented to the Council by Firo
C'hiof, Paul Klein, and a 9-mmth liquor store financial statement woo
reviewed with the maiager, Mark lrmiter.

8. Discussion on Sten II Facilities Plan ADolication Forms.
Keith Nelson of O.S.M. & Assoc. presented to the council for review a num-
ber of application forms required for Step II State and Federal Grant FLnd-
l• ing for improvements to the wastewater treatment plant.
I -lotion was made by P. White, second by D. Blonigen and unanimously carried
to table action on the application forms pending further review.
9. ADDroval of Bills.
Motion was made by P. White, second by D. Blonigen and unanimously carried
to approve the bills for the month of October 1977 as presented.

10. Approval of Minutes.
P. White asked that the tapes be reviewed to determine if the motion made
t_nder item #9 in the 10-10-77 minutes is the same as recorded in the
minutes.
D. Blonigen also questioned the completeness of the minutes for the special
meeting held 10-6-77.

Jive Hoskins, General Contractor for the 4th Street Park Warndn g House,
.,vbstituted 2 x 4 rafters for the 2 x 6 rafters specified in the original
plans.
Previous Plans called for the used funnaco from the Dridgo Park Warming
!louse to be used in the 40 Street Park Warming House but now will rema n
of the Bridge Ptu-k site.
As a result, a motion woo made by P. White, second by D. Bloni.gen and
unanimously carried to approve a change order on the warming house contract

-13. Demolition of Old Senior Citizens Building.
A motion was made by P. White, second by D. Blonigen to advertise locally
for bids on the demolition and removal of the old Senior Citizens 9uilding.

14. %Yscellaneous.
Councilman D. Blonigen requested that the City Council consider asking for
a state audit of the city's books from 1960 to 1977. It was mentioned that
e."i scumal audit of the books has been done each year,.by a C.P.A. firm of
which a copy is already sent to the state auditor for review, and that an
audit for this period of time could cost as much as 825.000.
D. Blonigen then entered a motion requesting the state auditor's office
a.dit the city' a records for the past 6 years.

A special council meeting wat, scheduled for 11-7-77 at 8:00 P.M. to review
L. Flake's building plans and request for a conditional use permit for
a new car dealership south of I-94.

The Monticello Planning Commission has a meeting on Monday
night at 7:00 P. M. and their recommendations will be pre-
sented at the council mecti.ng on all the issues.

all .issues before action is taken on any one issue. It
