I am addressing myself to the question - whether the Village Council can accept
a bid which is other than the one for the lowest sum of money, assuming that
all bids meet specification.
The Village Council is required to accept the lowest responsible bid. In a
situation, like the one at hand, where services are involved, the Village must
consider the responsible part of the bid as well as the lowest part of the
bid.
Where the bid is substantially lower, as in this case where the three year
period would result in a savings of approximately $1,500.00, the Village Council
should be very careful to consider the quality of the services of each bidder.
If it would appear that the low bidder could provide services equal to those
of the next higher bidder than the Village Council should seriously consider
going with the lower bidder.
