REGULAR MEETING - MONTICELLO PLANNING COMMISSION
Tuesday, November 10, 1987 - 7:30 p.m.
Members Present: Richard Carlson, Cindy Lemm, Richard Martie, Joyce Dowling,
and Jim Ridgeway

1. The meeting was called to order by Chairperson Richard Carlson at
7:31 p.m.
2. Motion was made by Joyce Bowling, seconded by Cindy Le:rm, to appro:o the
minutes of the meeting held October 14, 1987. Motion carried
unanimously.
3. Public Hearing - A request for general concept stage review of a planned
unit development to fi@ known as Highland Heights One. Applicant, !fivers
Financial aim Development Company.
Mr. Dennis Taylor, who was representing Mr. George Rivera, was present to
show the layout for the concept stage of a planned unit development to be
known as Highland Heights One. Mr. Taylor indicated that Mr. Rivera had
met all of the minimum requirements of the concept stage check list on
the planned unit development plat.
With no input from the public, Chairperson Richard Carlson then opened
the meeting for input from Planning Commission members.
With no input from Planning Commission members, Richard Carlson asked if
there was anymore input from the City staff. There being none from
Zoning Administrator Anderson, motion was made by Jim Ridgeway, seconded
by Richard Martie, to approve the request for general concept stage
review of a planned unit development to be known as Highland Heights
one. Motion carried unanimously.
4. Public HearinL- A request for a preliminarryy plat review of a proposed
new suodivieion plat. XpPitcant, Charles hitze.
Zoning Administrator Anderson indicated to Planning Commission members
that Mr. Ritze had not completed all the minimum requirements for his
preliminary plat, and he asked that the Planning Coamiasion table hio
request until the next regularly scheduled Planning Commission meeting
tentatively set for December 0, 1987, 7:30 p.m.
Motion by Richard Martie, seconded by Joyce Dowling, to table the request
for a preliminary plat review of a proposed new subdivision plat. Motion
carried unanimously.

5. Public Hearing - A request for a preliminary plat review of a proposed
new subdivision plat. Applicant, City of Monticello.
Zoning Administrator, Gary Anderson, indicated to Planning Commission
members that the City of Monticello had engaged the services of Dennis
Taylor, Taylor Land Surveyors, to do the platting layout for the proposed
new subdivision plat.
Mr. Taylor was present to propose the layout of the plat with the amount
of acreage for each of the six lots and with the proposed layout of the
street with a cul-de-sac.
Chairperson Richard Carlson then opened the meeting for input from the
public. There was no input from the public on the preliminary plat.
Therefore, Mr. Carlson opened the meeting for any discussion by Planning
Commission members. Mr. Jim Ridgeway questioned the actual width of the
street serving this property and the width of the cul-de-sac. Dennis
Taylor indicated the platted area would be a 66 -foot platted street with
a 46 -foot back -of -the -curb to back -of -the -curb street surface. The
cul-de-sac is also designed similarly to accommodate substantial turning
around by a semi -truck tractor. Chairperson Richard Carlson questioned
the area of land up on Lot 3 with it being divided by the gas line
easement. Zoning Administrator Anderson explained to Commission members
the area east of the easement through this lot would acro maodate
approximately 100' x 100' building and still be within the setback
requirements. if a parking lot was to be constructed, it could be
constructed within the building setback requirements on the east one-half
of this drainage easements or it could be placed over the drainage
easement with a hard surfaced parking lot.
with no further input from the public on this request, motion was made by
Joyce Dowling, seconded by Cindy Learn, to approve the preliminary plat
review of the proposed new subdivision plat. Motion carried unanimously.
6. A sketch plan review of a proposed new subdivision plat. Applicant, Tom
Brennan.
Mr. Tom Brennan was present to propose a lot and block platting layout of
two unplatted parcels of land which he currently owns. The proposed
layout of the plat with the road system would provide a link from
Minnesota Street to Elm Street up near the freeway as a collector type
road. with no one present from the public for any public input,
Chairperson Richard Carlson opened the meeting for input from the
Planning Commission mom. re. The general consensus of the Planning
Commission membere is that they look favorable at the type of layout that
he had, even recognising the fact that Mr. Brennan had a substantial
amount of fill that would have to be moved from different areas within .
this proposed replatting of unplatted land to acco=K)date this proposed
development plat.

Additional Information rtems
1. A simple subdivision request to subdivide an existing unplatted lot into
two unplatted lots. Applicant, Debbie Kramer. Council action: Approved
as per Planning Commission recommendation.
2. A variance request to allow placement of a detached garage within the
sideyard setback requirement. Applicant, Bruce Parson. Applicant's
request withdrawn before Planning Commission's meeting. No further
action.
3. A request for general concept stage review of a planned unit development
to be known as Highland Heights One. Applicant, Rivera Financial and
Development Company. Planning Cmmission's action to table to the next
regularly scheduled Planning Commission meeting. Applicant did not
proceed on to City Council.
4. Notion by Joyce Dowling, seconded by Richard Martie, to set the next
tentative date for the Monticello Planning Commission for Tuesday, '
December 8, 1987, 7:30 p.m.

meeting. The meeting adjourned at 8:13 p.m.

3. Public Hearin 99 - A conditional use request to allow auction sales in a
B-3 (highway business) zone. Applicant, Martie•s Farm Service. (G.A.)
A. REFERENCE AND BACKGROUND:
Martie's Farm Service is proposing to conduct auction sales at their
current facility for the purpose of selling baled quantities of hay and
straw.
Auction sales are an allowable use in a B-3 (highway business) zone only
as a conditional use. The conditions as indicated under the conditional
use section for auction sales deals primarily with activities of an
auction sale around the entire site of the proposed auction sale. Most
of the conditions deal with conditions that would have to be addressed if
this property abutted a residential zone. With this not the case, the
majority of these conditions do not apply to this particular conditional
use request.
Mr. Martie has found a need for this type of service at his current
facility to service a need of his existing customers. Mr. Martie is
proposing to conduct the auction sales which may last from one to two
hours at the most depending on the quantities of hay and straw he has.
These would be conducted in weekly or bi-weekly auction sales depending
on the need.
B. ALTERNATIVE ACTIONS:
1. Approve the conditional use request to allow auction sales in a B-3
(highway business) zone.
2. Deny the conditional use request to allow auction sales in a B-3
(highway business) zone.
C. STAFF RECOM ENDATION:
City staff recommends approval of the conditional use request to allow
auction sales in a B-3 (highway business) zone. Staff recognizes many of
the conditions under the auction sales section in our ordinance are not
applicable in this caaos or should development occur to the west of this
site, the applicant is aware that some of these conditiona may kick in at
that time.

4. Public Hearing - A variance request to allow construction of a building
addition within the front yard setback requirement. Applicant, American
Legion Post #260. (G.A.)
A. REFERENCE AMID BACKGROUND:
The American Legion is proposing to construct a 6 -foot addition on the
westerly portion of their building which faces Elm Street. The
construction of this addition would be within the sideyard setback
requirement.
The notice as was published indicated an encroachment into the front yard
setback. In further review of the applicant's request, the shorter side
is always considered the front, and the shorter side would be along west
Third Street. Therefore, the encroachment would be in the sideyard
setback requirement, that being 20 feet. The encroachment which the
American Legion is looking for is to be within 11 feet of the sideyard
setback requirement.
You will note that construction has already begun with the footings and
the foundation wall of this proposed addition. Mr. Floyd Markling,
representing the American Legion, went to each of the City Council
members and supposedly did receive permission from the City Council
members to proceed with the construction of the building addition
footings and foundation wall.
B. ALTERNATIVE ACTIONS:
1. Approve the variance request to allow construction of a building
addition within the front yard setback requirement.
2. Deny the variance request to allow construction of a building
addition within the front yard setback requirement.
C. STAFF RECOMMENDATION:
Staff recommends denial of the variance request to allow construction of
the building addition within the sideyard setback requirement. Staff
fails to see the hardship created by this variance request. If you will
note on the enclosed site plan, the existing entries onto the existing
Legion Club building are within the 20 foot eideyard setback requirement
already.

subdivision plat. Applicant, City of Monticello. (G.A.)
A. REFERENCE AND BACKGROUND:
Mr. Dennis Taylor, Taylor Land Surveyors, is in the final stages of
developing the final plat for the Oakwood Industrial Park Second
Addition. However, the final plat copies will not be distributed in your
agenda supplement but will be ready in time for the Tuesday night
Planning Commission meeting. The final plat will be in its review form
only and will not be put onto the hard shells until final approval is
granted by Planning Commission and City Council.
B. ALTERNATIVE ACTIONS:
1. Approve the request for final plat stage of a proposed subdivision
addition.
2. Deny the request for final plat stage of a proposed subdivision
addition.
C. STAFF REC KKENDATION:
City staff recommends approval of the final plat stage of this proposed
Q subdivision addition. We are recommending your approval even though hard
shells have not been prepared at this time and will not be prepared until
final approval is granted by the Planning Commission and City Council.
