Members Absent: None 1. Call to order and Pledge of Allegiance. Mayor Belsaas called the meeting to order at 7 p.m. and declared a quorum present. The Pledge of Allegiance was said. 2. Approve minutes of June 24, 2002 Regular Council Meeting, BRIAN STUMPF MOVED TO APPROVE THE MINUTES OF THE JUNE 24, 2002 REGULAR COUNCIL MEETING. CLINT HERBST SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 3. Consideration of adding items to the agenda. Clint Herbst stated he had received a call from a resident asking about placing signs stating it is the law that motorists have to stop for pedestrians in a marked crosswalk. Public Works Director, John Simola responded that he had also talked to that resident and explained to him the existing sign regulations but indicated that he would check into the particular sign the resident was talking about and report back. 4. Citizens comments/petitions, requests, and complaints. None. 5. Consent Agenda. A. Consideration of ratifying new hires for the Community Center, streets and parks department. Recommendation: Ratify the new hires as identified. B. Consideration of a conditional use permit allowing accessory space in excess of 1200 sq. ft. in the R-1 District. Applicant: Lynn & Christine Anderson. Recommendation: Move to approve a conditional use permit allowing construction of the accessory structure in excess of 10% of the rear yard and allowing the combined detached and attached accessory structure area to be greater than that of the principle use and in excess of 1200 sq. ft with the following conditions based on the finding that the accessory structure will improve the �A Council Minutes - 7/8/02 appearance of the neighborhood and will not have an adverse affect on the surrounding properties. l . Accessory building space is to be utilized solely for the storage of residential personal property of the occupant of the principal dwelling and no accessory building space is to be utilized for commercial purposes. 2. The parcel on which the accessory building is to be located is of sufficient size such that the building will not crowd the open space on the lot. 3. The accessory building will not be so large as to have an adverse effect on the architectural character or reasonable residential use of the surrounding property. 4. The accessory buildings shall be constructed to be similar to the principal building in architectural style and building materials. 5. The proposed accessory structure shall be used for storage of seasonal vehicles only. There shall be no vehicles parked in front of the accessory structure or along the rear yard which would give the appearance of an everyday garage and driveway. 6. Confirmation that the applicant can do what is shown on the site plan via a survey or staking the plan and getting the approval of the zoning official. C. Consideration of approval of request for charitable gambling license - St. Henry's Fall Festival. Recommendation: Adopt a resolution authorizing the State Gambling Control Board to issue the exempt charitable gambling license to St. Henry's Church for September 14"' and 15"'. Res. No. 2002-40. D. Consideration of development stage planned unit development allowing a mixed residential and institutional use in the R-2 District including use of church building for church purposes and conversion of former parish center into combination church offices and rental housing. Applicant: Hope Evangelical Free Church and the Church of St. Henry. Recommendation: Move to approve the development stage PUD allowing a mixed residential and institutional use in the R-2 district. Request include the church building to be allowed for church uses and the parish center converted into a combination of office and residential use. Development stage PUD subject to the requirement that interior lot lines be eliminated and subject to requirement that existing landscaping be trimmed and weeded, dead brush and branches removed and replaced. E. Consideration of approving revisions to current Drug and Alcohol Testing Policy for Heartland Express. Recommendation: Moved to adopt the resolution approving the changes made to the Monticello/Heartland Express Drug and Alcohol Policy reflecting the revisions made by the Federal Transit Administration. Res. No. 2002-41 2 A Council Minutes - 7/8/02 F. Consideration of proposal from Xcel Energy for replacing the 1960 Cobrahead lighting on Broadway and installation of the new acorn lighting on the medians on the reconstruction of County Road 75. Recommendation: Move to accept proposal #I from Xcel Energy to replace the cobrahead lighting with the new group V lighting for a cost of $109,700, to include accepting Xcel Energy's second proposal for the ornamental lighting in the medians with the construction of County Road 75 at a cost of $82,500 making a total cost of $192,200. Acceptance of these proposals is contingent upon the City moving forward with the County Road 75 project. G. Consideration of approval of temporary on -sale liquor license for St. Henry's Fall Festival. Recommendation: Approve the issuance of a temporary on -sale liquor license to the Church of St. Henry's for their Fall Festival on September 14"' and 15"'. H. Consideration of a request to grant preliminary plat approval and a request for rezoning from A -O to B-3. Applicant: Prairie Ponds, LLC. Recommendation: Move to approve the preliminary plat with staff recommendations as follows and to include provisions for connecting road to Groveland pending approval from City Engineer and Parks Commission. 1. A detailed landscaping plan must be provided showing a buffer yard between area adjacent to all residential districts. 2. The grading, utilities, and drainage plan are subject to the review of the City Engineer. I Access off of Wolters Way must frilly align with the access to School Boulevard to the south. 4. A lighting plan must be provided that meet City Code guidelines. 5. Easement issues are subject to the review of City Staff. 6. Further recommendations by City Staff. Move to approve rezoning from A -O to B-3 based on the finding that the proposed use is consistent with the comprehensive plan. Ord. Amd. 4380 Brian Stumpf questioned who requested the change in orientation of the road. Jeff O'Neill replied that it was a requirement of the Planning Commission because the road didn't align fully with School Boulevard. BRIAN STUMPF MOVED TO APPROVE THE CONSENT AGENDA WITH A CONTINGENCY ON #5H THAT APPROVAL WAS SUBJECT TO REVIEW AND APPROVAL BY CITY ENGINEER AND CITY STAFF. BRUCE THIELEN SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. dA Council Minutes - 7/8/02 6. Consideration of items removed from the consent agenda for discussion. None. 7. Consideration of accepting the 2001 audit report. Rick Borden from Gruys Borden Carlson was present to review with the Council the audit report for the year ending December 31, 2001. The general fund revenue budget was $4.1 million and actual revenue collected was $4.8 million. The general fund budget for expenditures was $4.1 million and $4.5 million was expended. He pointed out that the dollar reserves in the special funds can only be used for the purposes that the special fund was established for. Most of the City's fund balances are designated for a specific use. He noted a deficit in the park fund and explained that the expenditures were budgeted in the capital outlay fiend but coded to the park fund. He also noted that in Public Works Engineering fund there is preliminary project costs which will go to the construction fund once that project is set up. Rick Borden briefly covered the debt service funds and the proprietary funds and indicated that they were in good shape. He did recommend that the liquor store financial statements be done in a more timely fashion. Mr. Borden also explained the items that were covered in the legal compliance letter which included compliance with regulations relating to contracts, bidding, investments and public indebtedness. Overall the City is in good financial shape according to the audit findings. The auditor will be sending a copy of the audit report to the state. ROGER CARLSON MOVED TO ACCEPT THE AUDIT REPORT FOR 2001. BRUCE THIELEN SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 8. Consideration of setting a date for assessment hearing on Gillard Avenue Pathway and consideration of acceptance of bids for pathwav work. Clint Herbst asked if the assessment hearing date could be changed since he would not be present at the next meeting. After discussion it was determined to hold the assessment hearing at the July 22nd meeting. City Engineer, Bret Weiss, stated that $5,200 would be the estimated assessment per parcel if the City assessed 100% of the cost. Although it was discussed when the public hearing on the project was conducted, no decision had been made on the amount of City participation in the project costs. It was noted that this trail segment is not on the City's grid system. John Simola stated the City's grid system deals with sidewalks not pathway. For sidewalks in the grid system the City would pay 75%. Clint Herbst asked if the City had any other similar situations where a pathway was installed after the development took place. Staff indicated that most of the pathways were constructed as part of development. The Council discussed a 50%-50% policy with 50% being assessed and 50% picked up the City. City Administrator, Rick Wolfsteller asked how the Council intended to fund the City's share of the cost. The Council indicated that it would come from the park/pathway dedication fiends. ►I A Council Minutes - 7/8/02 The maintenance of the pathway was discussed. Brian Stumpf stated that is should be made clear to property owner that the City would not be clearing snow off the pathway. Jeff O'Neill felt that the pathway should be cleared because it serves as a sidewalk and that the property owners should be responsible for doing that. BRIAN STUMPF MOVED TO ASSESS 25% OF THE PROJECT COST FOR THE GILLARD AVENUE PATHWAY TO THE ABUTTING PROPERTY OWNERS WITH THE CLEARING OF THE PATHWAY TO BE THE RESPONSIBILITY OF THE PROPERTY OWNERS AND TO SET AN ASSESSMENT HEARING FOR JULY 22, 2002. In further discussion, Bret Weiss stated that one comment the Council will hear at the assessment hearing relates to concern about the amount of traffic generated by the proposed Bruggeman development and the capability of Gillard Avenue to handle the increase in traffic. Clint Herbst felt that as development pressure in that area continues the City would be wise to look at another outlet besides Gillard Avenue. Bret Weiss stated that since half of the roadway is in the township it makes any decision affecting Gillard Avenue a little more complicated. ROGER CARLSON SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. Res. No. 2002-39. 8A. Consideration of resolution acceptinLy quotes and awardinLy contract for construction of the Locust, Walnut and Cedar Street Parking Lot Improvements, Proiect No. 2002-07C. The City had received two quotes for construction of parking stalls at three locations: 1) Cedar Street - The location of the former Senior Citizens Center; 2) Locust Street - In the area of the China Buffet and Walnut Street in the area of Sunny Fresh. The price range quoted was from $38,534 to $62,232.26 with Buffalo Bituminous submitting the low quote. A revised plan was developed which would allow the construction of three additional stalls on Cedar Street. If the Council authorized the additional stalls, it would add approximately $3,600 to the bid price. Clint Herbst asked about funding for this work. Some of the cost will be assessed. Meeting was adjourned at 8 p.m. Recording Secretary MINUTES SPECIAL MEETING - MONTICELLO CITY COUNCIL Monday, July 8, 2002 - 5:30 p.m. Members Present: Roger Belsaas, Roger Carlson, Clint Herbst, Brian Stumpf and Bruce Thielen. Members Absent: None. 1. Call the meeting to order. Mayor Belsaas called the meeting to order at 5:35 p.m. 2. Ice Arena/Community Recreation Complex Proposal. Jeff O'Neill provided some background on the proposal to construct an ice arena at the 7"' Street location. In a previous meeting, the Council was asked to consider the donation and/or lease of the land and would upon submittal of financial information give consideration to the waiving or reduction of development fees. At that time the proposal by the group was that the facility would be owned and operated by a non-profit corporation. Since that meeting there have been changes to the proposal and representatives from the various groups involved were present to explain the new proposal. Al Gagnon from the Pointe Group stated that initially just a single ice sheet was proposed and it has since developed into much more. The group had just begun the fund raising to get the project started and had contacted Silver Creek Development. Silver Creek Development expressed an interest in the facility and became involved in the proposal as did the Monticello Youth Hockey Association and the Monticello Youth Soccer Association. The proposal now includes two ice sheets, a domed soccer field, related facilities such as locker rooms, concessions, restrooms, parking and also a retail development. Chuck Freiberg presented some preliminary sketches showing the proposed layout. Silver Creek would be involved in the construction of the recreational facility and would develop the retail portion of the proposal. Brian Stumpf asked if the parcel was fully utilized whether there would be sufficient parking area. Chuck Freiberg stated that parking spaces were laid out based on the retail use and not the recreational use. He indicated that there would be cross easements between the recreational and commercial use for parking. They did not expect that parking would be fully utilized except possibly when tournaments were held. It was estimated that construction costs could run between $100-$110 per square foot. Amenities could add to the square foot cost. Estimated schedule for the project would be 6-10 months. Todd Banek and Gregg Engle, representing Monticello Youth Hockey, spoke to the Council for the need for the facility. They noted they are 60 hours short of the ice time needed this year and there is no time available at any area facilities. The Hockey Association stated they are committed to fund- raising a considerable amount for this project. They felt not only the ice facility was needed but also Z ►3 Special Council Meeting Minutes - 7/8/02 that the commercial development would bring notoriety to the City bringing in people who would be spending time and money in the city. Todd Banek emphasized the need for the City's help in getting this project done. With the five entities involved they felt there was a good base for making this development happen. Gregg Engle added that the Hockey Association is in their 26" year of existence and emphasized repeatedly the need for more ice time for the hockey participants. He felt this proposal was a good venture between private and public entities. Kent Johnson from Monticello Youth Soccer spoke about providing a facility for the 700 youth involved in the soccer program. There is an indoor and outdoor soccer season. Most of the domed facilities, however are in the metropolitan area. For the Soccer Association there were two key concerns: 1) Competitive fee for use of the facility - the fee must be low enough for the existing clubs to handle. 2) It must be a full sized facility. The Monticello Youth Soccer Association was looking at a 20 year lease. He emphasized that the City's participation would help keep the fee competitive so that the Association could afford to lease the number of hours needed. They did not want a pared down facility and felt that what was proposed would be attractive to other communities. It would also make the City of Monticello more visible and bring in more people. He thought maybe they could work with the Community Center for multiple use of the facility such as indoor walking area. Tentatively it is proposed that the Monticello Youth Hockey Association would be operating the ice facility. Silver Creek would do the construction operating as a bank as far as financing the construction of the facility. The City would not have liability for the operation of the facility. Al Gagnon indicated that Silver Creek Development would own the building and lease it to the group. Pat Cruikshank of Silver Creek Development stated that they have a number of development in the City of Monticello such as the 6t" Street Annex, Towne Centre and a 35 unit apartment complex currently under construction. He noted there is no other project out there like the one being proposed and he looked forward to their partnership with the various groups involved. In discussing development costs, the group indicated that they had talked to Fred Patch and they came up with an estimated $115,000 in development costs. The group was asking that these fees be waived or reduced. In addition they would like a ten year tax abatement on the property. They are also looking at acquiring the entire parcel (approximately 17 acres). The extension of 7`" Street in this area was discussed. Roger Belsaas noted that with the ever increasing traffic on Broadway the need becomes greater to get 7`" Street extended on the west to County Road 39 and on the east to County Road 18. The question was how the City could fund the street extension. The Council pointed out that the City had a considerable amount of money invested in this parcel and there was some reluctance on their part to give the land away, especially for private development. Although the Council had earlier considered donation/lease of the land it was only for the amount of land that would be needed for the ice arena and they were not looking at development of the entire parcel. Recreational complexes like this had been done in other communities such as Plymouth, Champlin, Stillwater and Prior Lake/Savage. Bruce Thielen indicated that while he liked the concept he would be interested in getting information from the other communities on how they put the package 2 23 Special Council Meeting Minutes - 7/8/02 together. He added that the Council has a fiduciary responsibility to the taxpayers and as a result there is a concern with giving property away for commercial development and waiving of fees. Bruce Thielen stated that if the ice arena is put in and at some point no longer used as a recreational facility the City should be compensated. He talked about having a "sunset clause" wherein if the recreational facility operated as such for a given period of time such as 15 years the City would feel that they had been compensated for the land donation. In discussing the commercial area, Pat Cruikshank indicated that they were looking at a restaurant, something like Applebees in their initial concept. Bruce Thielen stated the Council was comfortable with the donation of the land for the recreational use but not with donating land for commercial development. Pat Cruikshank stated the project would not be viable for them without the City giving them the land. The land would solidify the deal for them. He added that they would not be asking for a tax abatement on the commercial portion of the property. The Council discussed whether land should be given away for commercial development. Bruce Thielen stated the Council is trying to arrive at a rationale for what is being done and needs to analyze what benefits would be received for what the City is being asked to give. Brian Stumpf suggested offering the land to the hockey association but that the Council not consider waiving of the development fees or a tax abatement on the parcel. Bruce Thielen felt that should be a time limit that the facility would need to operate as recreational complex and suggested 15 years. In addition, he felt that by donating the land to the hockey association it would give them greater flexibility. It was noted that without the tax abatement, it could mean higher user fees for the hockey association and soccer association. The consensus of the Council was that they were comfortable with the donation of the land to the association but would not consider waiving of fees or a tax abatement. The Council felt this proposal would not unfairly burden the taxpayers. Bruce Thielen said he would like to see some guarantee that local groups would get preference in use of the facility. Rick Wolfsteller stated that the $115,000 in development fees was most likely based on the area for the recreational complex only and that if the full parcel was being donated the fees should be calculated on the full parcel. He suggested that the development fees be rechecked and then the group would have a better idea of the fees involved. It was noted that if the property was utilized for commercial development it would require rezoning. There was a also a question of the amount of stormwater ponding area that would be needed by the City. The proposal that was submitted to the group by the Council was: 1) Donation of the land to the hockey association; 2) No waiving of the development fees; and 3) No tax abatement. REFERENCE AND BACKGROUND: The 2002 primary election will be held on Tuesday, September 10th, and the general election will be on Tuesday, November 5th. The individuals appointed as election judges would be serving for both the primary and general elections. The attached is a list of names of people who have previously served as election judges in the past or who indicated a willingness to serve as a judge at the caucuses in Wright County. The names on the attached list area pool of individuals that the City can tap for election judges. It should be noted that these individuals can serve only upon completion of election judge training. Training sessions will be scheduled by Wright County over the next month and all appointed judges must complete a training session. B. ALTERNATIVE ACTIONS: The only alternative available is to appoint election judges as required by law with the contingency that they complete election judge training. C. STAFF RECOMMENDATION: None. D. REFERENCE AND BACKGROUND: Section 3-15-19 of the City's ordinance governing pawn shops allows for off site storage of pawned items provided: 1) A written request is submitted; 2) The storage facility be locked and secured; 3) All provision of the ordinance regarding record keeping and reporting apply to the off site facility; 4) Licensee shall permit inspection of the storage facility in accordance with the provisions of the ordinance; 5) The licensee must own the building in which the business is conducted and own any off site storage facility or have a lease that extends for six months; and 6) Property shall be stored in compliance with all provisions of the City code. Randel Thompson who has purchased Walt's Pawn & Gun has submitted a written request to the City requesting off site storage for pawned items. He has indicated in his letter that he has discussed this request with Wright County Officer Paul Johnson. Mr. Johnson indicated that as long as the Sheriff's Department had access to the items, they didn't have a problem with off site storage. Mr. Thompson is requesting that the off site storage be located at his home in Cedar, Minnesota which would impact his ability to meet condition #6 noted above. The provisions of the City of Monticello's ordinance relating to outside storage in residential areas would not apply to property in a different community. There is nothing in our ordinance that states that any off site storage must be located in the same community as the licensed pawn business. If the Council considers approving the request for off site storage it should be contingent upon compliance with the code requirements of the community in which the off site storage facility is located. B. ALTERNATIVE ACTIONS: 1. Approve the request for off site storage of pawned items for Walt's Pawn & Gun with the contingency that the proposed storage facility meet the code requirements of the community it is located in. 2. Do not approve the request for off site storage of pawned items for Walt's Pawn & Gun. C. STAFF RECOMMENDATION: Most of the provisions of this ordinance are enforced by the Wright County Sheriff's Department and if they are acceptable to the off site storage, the City may see no reason to deny the request. Consideration of establishing a hearing date for an ordinance allowing Sundav liquor license holders to sell liquor for on site consumption prior to noon on Sundays. (RW) A. REFERENCE AND BACKGROUND: The City currently allows on sale liquor license holders to also serve liquor on Sundays between the hours of noon and one a.m. Monday morning with the addition of a separate Sunday liquor license. The twelve noon starting time is the City's ordinance, but state statutes do allow cities to have an earlier starting time of 10 a.m. on Sundays provided the City holds a public hearing on the ordinance change and that the earlier starting time is in conjunction with the sale of food at the licensed establishment. This issue was discussed by the Council a few years ago at the request of one of the local restaurants, but the Council chose to leave the time at twelve noon. The purpose of this agenda item is to see if the Council would be interested in amending the ordinance to allow Sunday liquor license holders possibly up to two times a year the opportunity to serve liquor earlier than noon for a special event at their establishment. If the Council was interested in modifying the Sunday liquor license rules in this fashion, we would need to schedule a public hearing at the next council meeting before actually adopting any ordinance amendment. A request was recently received by the American Legion Club to be able to serve liquor earlier than noon for a special event that was upcoming in Monticello. Although the ordinance could not be changed in time for this particular situation, the Council may want to consider some flexibility to allow an earlier serving time for special events being held or promoted by a liquor license holder and the Council could limit the number of events to a specific number each year. It would be suggested that the ordinance require Council approval of each special event and it is suggested that two per year should be sufficient for most cases. B. ALTERNATI'VE ACTIONS: 1. Council could set a public hearing date to consider an ordinance amendment allowing for (J amendments to the Sunday liquor license hours of operation. 2. Council could decide not to amend the ordinance. C. STAFF RECOMMENDATION: Staff feels an ordinance amendment can be easily established that would allow for earlier starting times on occasion for special events. If the Council is willing to consider this type of an amendment, it is recommended that a public hearing be held at the next Council meeting to consider the ordinance amendment. Consideration of concept and development stage planned unit development and preliminary plat for Autumn Ridge. Applicant: Shawn Weinand - Ocello, LLC. (JO) This item is on the consent agenda but staff would be happy to provide a presentation on this project if requested. REFERENCE AND BACKGROUND, At the Planning Commission meeting on 7/2/02 the Planning Commission reviewed the project and voted to recommend approval, subject to completion of refinements to the road system and subject to comments from the Parks Commission. The requested changes have been made and thus the project is ready for City Council review. Ocello LLC has submitted an application for PUD site plan review. The property is located west of Oakwood Drive and south of School Boulevard and is zoned PZM, Performance Zone -Mixed. The site consists of 21.59 acres. The applicant is proposing to construct 167 unit townhomes with a density of 7.7 units per acre. Land Use. The area that surrounds the proposed development consists of a mobile home park to the south, commercial to the west, industrial to the north and single-family to the east. The mid -density residential land use would be compatible with the surrounding pattern. Zoning. The purpose of the PZ -Mixed Zoning District is to provide a land use transition between high density residential land uses and low intensity business land uses, as well as the intermixing of each land use. The density requirements for this zoning district are 5,000 square feet per unit. Setback requirements for this district call for flexibility, however, City Code suggests 20 feet in the side yard and 30 feet in rear yards. Staffs concerns regarding the setbacks of this development have been resolved with the latest revision. All buildings, decks, and porches must meet the minimum 30 -foot setbacks. The setback areas of particular concern are those along both street frontages around the perimeter of the site. Access/Circulation. 1. Following are staff comments on the original layout shown to the Planning Commission. The revised layout in your packet is acceptable from the City Planner's standpoint as it addressed the main concerns through creation of a "roundabout" in the middle of the development. The current access and traffic circulation plan should be modified to reflect more intuitive circulation throughout the project. Staff recommends a more continuous looped roadway with spur streets to perimeter access points along with spacing the intersections to avoid conflicts with City Council Agenda - 07/22/02 driveways. Staff recommends a minimum of three access points, as shown on the site plan, as the minimum required for this project. Staff has additional concerns regarding several oddly angled intersections, combined with several driveways backing out into the middle of the intersections. Trails. The current plan shows a series of internal trails that connect School Boulevard near the driveway access to Edmondson near the northern driveway access and to the south along the utility easement. Staff recommends that a trail system be incorporated into this plan that will link to existing trails on the northeast and southeast corners of the project. The plan should be designed so that individual units would be within 200 feet of a trail or sidewalk leading to a trail on school Blvd. or Edmundson (Co Rd 117). Staff would recommend that a public trail along Edmondson be completed with the project. Staff does not recommend sidewalks along internal streets due to the impact on landscaping. The changes requested above were made to the revised plan. Off -Street Parking. The applicant is proposing 42 guest parking stalls. Because no off- street parking will be allowed on private drives, staff is recommending a ratio of one parking space per three dwelling units or a total of 55 parking stalls needed. Therefore, an additional 13 parking stalls must be incorporated into the development. The additional 13 stalls should be incorporated in the northwest corner, southwest corner, middle, and northeast corner of the project. The changes requested above were made to the revised plan. Landscaping Plan. Staff recommends berm placement along Edmondson as well as to construct a pathway along the planting area. The applicant should intensively landscape areas with high exposure to offset the impact of high-density, low open space design. These include areas around the play area, areas around guest parking, and areas behind proposed townhomes. The applicant should provide additional landscaping around the southerly portion of the project. The area between the mobile home park and power lines to the south should be heavily landscaped and buffer the project from the adjacent properties. This change needs to be verified with revised landscaping plan. Outdoor Recreation. The current plan shows two private small tot -lots and additional "Hot -Shot" basketball court along the southerly utility easements. All play areas should be located away from easement areas. It is suggested that Klein Farms Park is close enough to provide an adequate local public park resource. #2. The Parks Commission reviewed the plan and indicated acceptance of the park and trail layout with the exception that the basketball court should be removed as it is not a feature that young families would use and it could attract kids from outside the development area. The Parks Commission supported granting some credit for park improvements made against the $142,000 in park dedication expense but the amount is yet to be determined. 0 City Council Agenda - 07/22/02 Lighting. A detailed private street lighting plan must be submitted to public works prior to development. Grading, Utilities and Drainage Plans. All grading plans are subject to review of the City Engineer. Design Guidelines. According to City Code, the PUD allows for higher standards of site and building design standards. As such, staff feel that this proposed development should provide the community a high standard of building design. These include brick elements on the front of buildings, texture -look roofing materials, and steeper roof pitches (6/12 to 8/12 or more). This needs to be confirmed. Phasing. According to City Code, no such stage, when averaged with all previously completed stages, may have a residential density that exceeds 25% of the proposed residential density of the entire PUD. Moreover, staff recommends that no more than 50 units should be built before a second access is provided within the project. Easements. Staff recommends that the applicant provide documentation from the gas company regarding the gas line easements and the construction of this project. Development Agreement. The development agreement must include information for the maintenance of all open spaces facilities. ALTERNATIVE ACTIONS I . Motion to grant approval of the development stage PUD with staff recommendations. 2. Motion to deny development based on inconsistent street patterns and problems with traffic circulation as well as the higher density that is inconsistent with the City's Comprehensive Plan. 3. Motion to table based on a lack of information. STAFF RECOMMENDATION The Planning Commission was comfortable'with forwarding this to the City Council with modifications. The modifications have been made, therefore staff recommends approval, subject to the following conditions: 1. A detailed landscaping plan must be submitted that includes buffer areas, berms, and City Council Agenda - 07/22/02 more intensive landscaping in the rear areas to mitigate site lines as well as the area between the proposed development and the mobile homes to the south. 2. A detailed lighting plan must be submitted to public works and is subject to Cit staff approval. J y �. The applicant must resolve easement issues and receive permission from the gas company for the second access to Edmondson with the County. Presently all the scheduling is being done through Public works. Earl Smith and Rick Traver will be the Parks Commission representatives on the ballfield subcommittee. Because of a previous commitment. John Simola provided an update on the ATV subcommittee. There are many obstacles to getting a route established for ATV's that would allow them to get out of the City limits. The only place you can ride is in the ditch. If an ATV is on the road, it must be a licensed motorized vehicle. Even the DNR is working to find places for ATV use that would not damage the environment. John Simola indicated the city could designate a portion of the street as an ATV trail and mark it then the ATV "s could go on city streets. John Simola didn't feel striping would be feasible. He noted that he was informed that ATV's can cross the freeway at bridges which was new information from previously. John Simola felt the ordinance should stand as it is. John Simola also added as an update to the entrance the signs that there were discussions on providing electric service to the sign at the west entrance to the city. Xcel Energy will submit a cost estimate to the city. 6. Shawn Weinand - Townhome Development Review (Autumn Riche). The Parks Commission reviewed a preliminary sketch of Autumn.. No representative from the developer and no City staff was present to information on the preliminary sketch. The Parks Commission noted that the drawing submitted to them was an undated preliminary landscape plan. The Parks Commission noted the following objections to the plan as submitted: 1) There is no parking near the play area; 2) The play area is too small in size; 3) Proximity of the play area to the Amoco easement; 4) Concerns about drainage and 5) No street access to the play area. The Comprehensive Parks and Pathway Plan requires access from two streets. The Parks Commission felt that cash in lieu of land was desirable for this development. The Parks Commission noted that since this development is self-contained. including private streets, they questioned why the City would want to place a public park there and especially one that did not meet the requirements of the comprehensive plan. Adam Hawkinson felt the trails should be constructed to an 8' width in case the City ends up having to maintain them. 7. Discussion of Rolling Woods Area Park Plans. The Parks Commission discussed having an informational meeting for the residents in the area. Adam Hawkinson indicated that he would like the Parks Commission to meet every other week during the summer and that way hopefully within the next couple of weeks they could schedule a meeting with the Rolling Woods residents. The Parks Commission discussed development plans including the playstructure for the area which would run approximately $8.000. Adam Hawkinson will be getting a spec sheet for the structure. He also noted that the manufacturer's inspector was out to check the playstructure at West Bridge Park but he has not heard back with what the inspector found. He reported on an incident that occurred on the structure and whether the child was of an appropriate age to be on it. Adam Hawkinson stated that if there was an age restriction for use of the structure the manufacturer should be providing signage so noting that. There was also discussion on looking at Council Agenda - 7/22/02 5G. Consideration of approving cooperative agreement with Wright Countv for reconstruction of CSAH 75 from Washington Street to Otter Creek, Proiect No. 2000-16C, State Project SAP 86-675-14. (JS) A. REFERENCE AND BACKGROUND: The planning of the improvements to CSAH 75 appears to be coming to a close. The plans and specifications have been completed for both the County and City portion and the project is now out for bids. The bid opening for the project is August 6, 2002. The County is expecting to award the project on the same day if the bids are within the budget for the project. The City of Monticello should be ready to do the same so that the work can be started immediately upon signing of the contracts and receipt of insurance and bonds. The agreement which is enclosed for your review is on the County Board agenda for approval on July 30". The agreement itself lays out cost sharing parameters for various portions of the project. For example, the City will be responsible for paying 30% of the final wear course on the paved shoulders or parking lanes only. In addition, we will be responsible for any Class V wasted due to installation of water, sanitary sewer and services. We, of course, are responsible for 100% of all the utility costs. In addition the County pays for 75% of the raised concrete medians and any concrete surfacing done within the median. The signal at County Road 39 and CSAH 75 is split 50-50 as are the improvements to the intersection of State Highway 25 and CSAH 75. Some curbing work and minor storm sewer work will be done in this area. Mobilization and traffic control are split based upon the percentage of costs and engineering services are split. The City pays for 100% of all the engineering done by WSB for our utilities and we pay the County 10% of our share of the cost of the work being done by the County, such as our 25% of the concrete medians, all of the sidewalk and the curbing replacement. B. ALTERNATIVE ACTIONS: 1. The first alternative would be to approve the agreement with Wright County for the improvements to CSAH 75 as drafted and enclosed.. Additionally, this alternative would authorize the City Engineer, City Administrator and Public Works Director to attend the bid opening and to proceed with the project should the bids come in within 5%-10% of the cost previously estimated by the City Engineer. 2. The second alternative would be to approve the agreement for improvements to CSAH 75 but to schedule a joint meeting of either the Council as a whole with the County or a subcommittee of the Council with the County Board to make approval of the bids and authorize proceeding with the project on August 6 should bids come in within 5%-10% of the previous estimates. The project includes, but is not limited to, pavement removal and replacement, turn lane construction, curb replacement, storm drainage construction, sidewalk construction, utility improvements, traffic control signal improvements, raised median "street scape" improvements, and other miscellaneous improvements within the corporate limits of Monticello, and WHEREAS, a Cooperative Agreement between the County and the City outlines the responsibilities and financial commitments for the proposed project. NOW THEREFORE, IT IS MUTUALLY AGREED AND UNDERSTOOD THAT: Article 1 The County shall construct or cause to be constructed a project meeting state aid standards of pavement rehabilitation including roadway, utility, drainage, traffic control signal installation at Elm Street (CSAR 39) and other miscellaneous improvements upon or along CSAH 75 within the City limits in accordance with the approved plans and specifications as prepared by the County Highway Department, and on file at the office of the County Engineer, and: Article 2 It is agreed that upon completion of and acceptance of the work as to quantity and quality by the County, the County Engineer shall determine the actual amount that the City will reimburse the County in accordance with the following funding participation schedule: 1. Maintenance of the center landscaped median, upon completion of the project, will be the responsibility of the City. D. The County and City will share in the construction & engineering costs for the traffic control signal at CSAH 75 & CSAH 39 (Elin St.) on a 50/50 basis. This is consistent with the present Wright County Traffic Signal Funding Policy. The County and City will share in the construction cost & engineering costs for the signal modifications at CSAH 75 and TH 25 on a 50/50 basis for the costs not covered by the State. The County will not be responsible for certain maintenance provisions upon completion of a traffic control signal system. Painting, relamping, cleaning of the signal system, street light maintenance, and power costs to operate the signal and street light systems will be the responsibility of the City (refer to Article 6 of this agreement). E. The County will provide engineering services for design, construction, and administration of the project. The County will not participate in any engineering costs incurred by the City that are necessary for the City to assess their portion of the project costs (Feasibility Studies, hearings, legal expenses, etc.). The City will reimburse the County for engineering services for the City's portion of the project that was designed by the County, based upon the following table. The final reimbursement will be computed using the appropriate % below times the City's portion only of the contract construction cost (not including City utility work that plans were completed by the City's consultant engineer). The County will pay for the initial striping of crosswalks and pavement markings as outlined on the plan. Maintenance of the crosswalk pavement markings, upon completion of the project, will be the responsibility of the City. H. Permanent right-of-way acquisition costs are the responsibility of the City. Temporary right-of- way acquisition costs for any roadway work are the responsibility of the County. Temporary right- of-way acquisition costs for sidewalk/pathway or utility work are the responsibility of the City. The County shall prepare a preliminary estimate of construction cost for the County prepared plans for the project. The City shall prepare a preliminary estimate of construction cost for the City consultant prepared plans for the project. The preliminary cost estimates shall identify both the City's share and County's share of cost for the project based upon this funding agreement. This preliminary construction cost estimate shall be attached to this funding agreement. It is intended that the work outlined above in Article Two is to be done by a contractor on a unit price basis through a contract duly let by the County. At such time as the County awards a contract, the City will prepare a new estimate of the County's share of the construction cost based on the unit prices bid by the County's contractor. A copy of such revised cost estimate will be forwarded to the County Highway Engineer. F1 Article 3 The County will be responsible for all field inspection of materials, quantities, and contractor performance for the work identified in the plan sheets prepared by the County (except sidewalk/pathway work, which is 100% City work). The City shall be responsible for construction staking, inspection of materials, quantities and contractor performance for all utility work & sidewalk/pathway work (water main & sanitary sewer) for which plans were prepared by the City's consultant engineer. The County will monitor the wage rates to insure that the contractors working on the County prepared plans have complied with the wage rates as specified in the contract. The City will monitor and report to the County the wage rates for the sub -contractors performing the utility work on the contract. Article 4 Upon award of the contract, the City's portion of the contract shall be computed based upon the contract unit bid prices. Upon written request from the County the City shall forward to the County, within 30 days of contract award, 50% of their portion of the cost. Upon notice by the County that the contract is 50% complete, the City shall forward an additional 25 % of their portion of the cost. Upon notice by the County that the contract is 75 % complete, the City shall forward an additional 20 % of their portion of the cost, and the remaining 5 % upon completion of the work. Upon final completion of the work the County Engineer will submit a certificate of performance which indicates that the work complies with the plans and specifications. The County Engineer will notify the City of the final amount of the City's share based on the actual quantities used and the funding participation amounts shown in Article Two. The City will be responsible for reimbursing final payment to the County within 30 days of receipt of the final payment request by the County. The County Engineer will provide to the City an as -built plan (ledger sized, 11 " x 17") of the project within six (6) months of the final completion of the project. Article 5 The City shall be responsible for all snow and ice removal on sidewalks and other boulevard/sidewalk/bikepath related maintenance outside the curb or street area. The County shall be responsible for routine snow & ice maintenance within the curb to curb area of the highway. Article 6 The City shall be responsible for providing the necessary electrical energy for the operation of the traffic control signals, and any electrical energy for street lights. In addition, the City shall be responsible for at its cost and expense to (1) relamp the traffic control signals; and (2) clean and paint the traffic control signals and cabinets; (3) provide, at its costs and expense, the maintenance on luminaries; and (4) reimbursiniz the County for maintaininiz the EVP System. (Emitter units may be installed and used only on vehicles responding to an emergency as defined in Minnesota Statutes Chapter 169.01, Subdivision 5 and 169.03.) In the event said EVP System or components are, in the opinion of the County, being misused or the conditions set forth herein are violated, and such misuse or violation continues after receipt by the City of written notice thereof from the County, the County shall remove the EVP System, at the City's expense. Upon completion of the project; it shall be County's responsibility at its cost and expense to (1) maintain the signal controller, (2) determine the appropriate signal timing sequence, (3) provide phone service to the controller for remote servicing, (4) provide for replacement of poles, cabinet etc. if they should be damaged through vehicle collision etc. (major maintenance). (5) Provide maintenance for the EVP system, which costs would be reimbursed by the City of Monticello. Article 7 The City shall indemnify, save and hold harmless the County and all of its agents and employees of any form against any and all claims, demands, actions or causes of action of whatever nature or character arising out of or by reason of the execution or performance of the work provided for herein to be performed by the City. The County shall indemnify, save and hold harmless the City and all of its agents and employees of any form against any and all claims, demands, actions or causes of action of whatever nature or character arising out of or by reason of the execution of performance of the work provided for herein to be performed by the County. 5 Article 8 It is further agreed that any and all full-time employees of the County and all other employees of the County engaged in the performance by any work or services required or provided for herein to be performed by the County shall be considered employees of the County only and not of the City and that any and all claims that may or might arise under Workmen's Compensation Act of the State of Minnesota on behalf of said employees while so engaged and any and all claims made by any third parties as a consequence of any act or omission on the part of said County employees while so engaged on any of the work or services provided to be rendered herein shall be the sole obligation and responsibility of the County. It is further agreed that any and all full-time employees of the City and all other employees of the City engaged in the performance by any work or services required or provided for herein to be performed by the City shall be considered employees of the City only and not of the County and that any and all claims that may or might arise under Workmen's Compensation Act of the State of Minnesota on behalf of said employees while so engaged and any and all claims made by any third parties as a consequence of any act or omission on the part of said City employees which so engaged on any of the work or services provided to be rendered herein shall be the sole obligation and responsibility of the City. Article 9 Before this agreement shall become binding and effective it shall be approved by the City Council of Monticello and it shall also be approved by the County Board and such other officers as law may provide. Assessment hearing for Dillard Avenue Pathwav and consideration of award of contract for Gillard Avenue Improvement Proiect No. 2001-10C. (RW) A. REFERENCE AND BACKGROUND: At the last meeting, the Council reviewed the bids that were received for the Gillard Avenue Pathway Project that ranged from $60,178 to over $100,000. It was decided by the Council to delay awarding the contract to the low bidder, Sunram Construction, Inc. in the amount of $60,178, until an assessment hearing was held. As you know, the pathway project was requested by some of the residents on Gillard Avenue. Typically pathway improvements are constructed and paid for by the development in which they are located, but since the lots that exist along Gillard Avenue were platted a number of years ago, it would typically be the responsibility of the benefitting property owners to pay or all or a portion of the cost for the pathway. With the project cost being spread over a total of 15 properties this would amount to an assessment for each home of approximately $5,135 at 100% assessment rate. The Council directed staff to notify property owners that the City would consider an assessment of 25% of the project costs or $1,283 each with the understanding that it would be the property owner's responsibility for snow removal maintenance because of the reduced assessment amount. The assessment notice was modified to reflect the 25% assessment rate and each property owner was notified of the Council's intent. After the public hearing is held and comments are received from the affected property owners, the Council can decide whether to proceed with the project as proposed or not award the contract at this time. By holding the public hearing in advance of awarding the contract, the Council will know whether the property owners are acceptable to the assessments being proposed. If the Council receives a lot of opposition to the assessments or the project, the Council can stop the project by not awarding the contract. B. ALTERNATIVE ACTIONS: 1. Adopt the resolution establishing the assessments for the pathway project at 25% of the construction cost or $1,283 per parcel and awarding of the contract to Sunram Construction, Inc. in the amount of $60,178. 2. Adopt the resolution establishing the assessment at a different percentage rate than 25% and awarding the contract to Sunram Construction, Inc. 3. Do not award the contract for the project at this time. C. STAFF RECOMMENDATION: If the Council is comfortable with the comments received at the assessment hearing and/or objections Council Agenda - 7//22/02 that may have been noted, it is recommended that the assessment roll be adopted for certification to the County Auditor and that the project contract be awarded to the low bidder, Sunram Construction. As I noted above, if the Council receives a lot of opposition to paying for any of the project costs by the property owners, Council can choose to simply cancel the project if the property owners no longer want the improvement. That was the purpose for holding the special assessment hearing prior to commencing the project. D. SUPPORTING DATA: Resolution Adopting Assessment Letter to affected properties RESOLUTION 2002-43 RESOLUTION ADOPTING ASSESSMENT GILLARD AVENUE PATHWAY IMPROVEMENT PROJECT NO. 2001 -IOC WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment for the improvement of Gillard Avenue by the construction of 8' pathway and other appurtenant work. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or before the first Monday in January, 2003 and shall bear interest at the rate of six (6.5) percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2003. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Included in the notice was an estimated cost for the improvement which was listed at $5,200 per parcel. The $5,200 figure was the cost if the City assessed 100% of the project costs back to the abutting property owners. The Council at their July 8, 2002 meeting discussed the pathway project and determined that the City would pick up 75% of the cost and only 25% of the cost would be assessed to the property owners. With only 25% of the cost being assessed the cost per parcel comes to $1,284.00. This would be the amount assessed against your property if the Council adopts the assessment roll on July 22, 2002. In their discussion on the pathway project, the Council noted that since this segment of pathway was not on the City's grid system, the city staff would not be clearing snow off the pathway in the winter. REFERENCE AND BACKGROUND: The City Council is again asked to adopt an assessment roll for utility billing accounts which are delinquent more than 60 days and to certify the assessment roll to the County Auditor for collection on next year's real estate taxes. The delinquent utility accounts that are included with the agenda are accounts that are at least 60 days past due and include all new delinquents from the last time we certified them. In addition to the delinquent amount, the Council also previously approved the establishment of an administrative fee of $50 per account that is added to each delinquent assessment. The amounts shown on the enclosed delinquent utilities list include the additional $50 administration fee for the preparation of the assessment roll. It is recommended that the delinquent accounts be put on an assessment roll for certification at an interest rate of 6% as allowed by state statute. As in the past, if any accounts are paid within 30 days after the adoption of the assessment roll, they can be paid without the additional interest. After 30 days, payments will be charged interest. CITY OF MONTICELLO RESOLUTION NO. 2002-42 RESOLUTION ADOPTING ASSESSMENT ROLL FOR DELINQUENT UTILITY ACCOUNTS WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment for delinquent utility account charges, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA.- Such INNESOTA: Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessments against the parcels named herein, and each tract of land therein included is hereby found to be benefitted by the assessment levied against it. 2. Such assessment shall be payable in one (1) annual installment payable on or before the first Monday in January 2003 and shall bear interest at the rate of 6 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2003. 3. The owner of the property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution. 4. The City Administrator shall forthwith transmit a certified duplicate of this assessment roll to the county auditor to be extended on the proper tax list of the county, and such assessment shall be collected and paid over in the same manner as other municipal taxes. REFERENCE AND BACKGROUND: On Friday, July 19"' bids were opened on the proposed reconstruction of street and utilities for Front Street between Walnut Street and Locust Street. A total of 3 bids were received with the apparent low bidder being Schluender Construction with a bid of $197,987.80. The engineer's cost estimate was $180,000. The bids will be checked and a final bid tabulation will be provided at the meeting. CONTRACTOR Schluender Construction Buffalo Bituminous IDave Perkins Contracting, Inc. TOTAL BASE BID $197,987.80 $252,782.15 1 $264,884.25 The feasibility report for the project was completed in April, 2001 prior to the completion of the proposed development plan. Since April of 2001 there have been various alterations and additions that have increased the construction cost significantly. A discussion of those items is as follows: • 42" Apron Repair - $6,950 - This is an existing storm sewer that needs to be repaired just north of Walnut Street. • Bike Path - $4,920 - In anticipation of the future bike path along the north curb line, this item was bid as an alternate. • Alley Storm Sewer - $11,250 - This item should be charged to the developer. This is storm sewer to serve the alley and the rear yard area south of the project. • Bike Path Grading - $11,250 - This is the clearing of trees and grading to allow for the proposed bike path. • Street Subgrade Correction - $17,500 - This item was not in the feasibility report because soil borings had not been taken at the time. This item is estimated and may not be this amount depending on what is discovered during construction. In addition to the above items, there is approximately $32,000 of increased costs or added item with the bid as compared with the feasibility report. Some of this is related to the fact that the bids were received 15 months after the feasibility report and some of it is related to the size and complexity of the project. The grading for the Hans Hagen Front Street Townhome project is nearing completion. This project is necessary to provide sanitary sewer and water main service to the property. It is my understanding that the City is obligated to provide service to the site in the near future. Considering the time of year and the bidding climate, it is unlikely that better bids would be received if these bids were rejected. If the project could wait, the price could possibly be reduced by combining this project with another. B. ALTERNATIVE ACTIONS: 1. Adopt a resolution awarding the bid to Schluender Construction in the amount of $197,987.80 for the improvements to Front Street, Project No. 2001-06C. 2. Do not accept the bids. 3 . Other C. STAFF RECOMMENDATION: Since there is a time constraint with the developer on this project, the City may have no recourse other than to award the bid. Consideration of Development Stage Planned Unit Development Approval and Consideration of Approval of the Preliminary and Final Plat of the Maiestic Heights. residential subdivision. (JO) REFERENCE AND BACKGROUND, City Council is asked to consider granting approval to the Development Stage PUD, Preliminary Plat and Final Plat of the Majestic Heights. The Planning Commission will be providing a recommendation on this project after completion of a special meeting immediately prior to the City Council meeting. At the previous meeting of the Planning Commission there was general consensus that the redevelopment project will result in a net benefit to the area and to the City. However, final plans for the homes were not quite complete and therefore a final recommendation could not be made to the City Council. The main question pertains to the basic style of the homes. The concept PUD was approved based on a rambler home style. Subsequent to the original PUD approval following Rambler design, the developer (CMHP) presented an option for construction of a split level style home and removal of irrigation and landscaping. The Planning Commission considered the concepts at the meeting but tabled the matter and directed the developer to work with staff in developing a home style that would work within the confines of the site and result in a project that meets or exceeds the project contemplated under the original concept PUD approval. After further discussion with the developer at staff level and after an examination of the project budget, it has been determined that the rambler style home is best suited for this site and the cost could be kept within budget. With regard to the name of the development, Shari Harris at CMHP has indicated that the name may be changed at the City's discretion. Does anyone have a better name than Majestic Heights? Please see the attached agenda item from the previous Planning Commission meeting for more information on the project. ALTERNATIVE ACTIONS 1. Motion to grant development stage PUD approval allowing 11 single family detached townhomes, along with approval of the preliminary and final plat. Motion based on the finding that the redevelopment project development under the PUD requirements is consistent with the character of the neighborhood, consistent with the comprehensive plan and will not result in a depreciation of adjoining land values. Motion to approve subject to the following conditions. A. Establishment of home owners association or other format for assuring City Council Agenda - 07/22/02 long term maintenance of the PUD. The association or agreement/covenants must include the following items. • Snow removal. • Mowing of common areas and maintenance of landscaping. • Parking stalls, drive maintenance. • Regulations governing fences, storage buildings. • Maintenance of exterior of building. B. Required use of pre -finished siding. C. Completion of all site improvements and home improvements as identified in the approved plans. D. Landscaped plantings and/or screening fence to be provided along the western boundary of the site along with installation of landscaped plantings as shown in the attached supporting documentation. E. Landscaping plan should include installation of an irrigation system. F. Side yard lot lines to follow a building wall thus giving all side yard space to the homeowner opposite of the building wall (included in latest plat update). G. Approval of grading and drainage plans by the City Engineer. H. Curb and gutter included with the alley. I. Removal of existing driveways. J. No accessory buildings. 2. Motion to deny development stage PUD approval along with denial of the preliminary and final plat. Consideration of establishing procedure for evaluating request for proposals for legal services. (RW) A. REFERENCE AND BACKGROUND: At the May 13, 2002 meeting, the City Council authorized the city staff to seek requests for proposals from a limited number of firms to provide legal services for the City of Monticello. Staff prepared a request for proposal which was submitted to five firms. Three of the five firms have responded and the staff is looking to establish a procedure for evaluating the UP's that have been received. Because there are a limited number of firms being considered, it is proposed that all firms be interviewed. The interview process can be conducted in a number of ways: 1) The Personnel Committee and city staff can interview the firms and make a recommendation to the full Council; 2) A committee made up of staff and council representatives can conduct the interviews or 3) the interviews can be conducted by the full Council at a special meeting. Having the Personnel Committee or a committee established by the Council conducting the interviews would eliminate the need for setting a special meeting. However, if the full Council wants to be involved in the process, staff would recommend that the interviews of the three firms be done at a special meeting. B. ALTERNATIVE ACTIONS: 1. Authorize the Personnel Committee and city staff to interview the three firms that submitted a proposal for legal services and make a recommendation to the full Council. 2. Authorize establishing a committee of city staff and designated council representatives to conduct the interviews. 3. Have the full City Council conduct the interviews and set a date for the interviews. C. In Crosswalk" Sign Currently several cities have either installed or propose to install sighs advising motorists to "Stop for Peds. in Crosswalk. Attached is a copy of the above referenced sign. The signs are anchored to the pavement with bolts. The installation of these devises has been brought to the attention of the Minnesota Manual on Uniform Traffic Control Devises (MMUTCD) Committee. The MMUTCD Committee's purpose is to review any material that is proposed to be included MMUTCD. The committee is made up of members representing the Minnesota Department of Transportation (Mn/DOT), the Federal Highway Administration (FHWA), Rural Counties, Urban Counties, Cities, and Consulting Engineers. This broad base of membership is required to ensure that the MMUTCD reflects current Minnesota Statutes and/or policies as they pertain to all streets or highways within the State. The Committee hes reviewed, discussed, and evaluated a number of issues relating to these signs. The Committee's recommendation is based on State Statute Chapter 169.06 Subd 3. Placement and maintenance by local authority, which states, "All such traffic -control devices hereafter erected shall conform to the state manual and specifications." The " Stop for Peds. _in Crosswalk" sign is not in the MMUTCD or Mn/DOT's Standard Signs Manual, and therefore is not recognized as an official traffic control device in Minnesota. The Committee also recommends that if a city or county wishes to employ this sign, the sign must be evaluated in accordance with process contained in the MMUTCD.
