Regular meeting of Village Council -- Tuesday, October 12, 1971

Councilmen present: Ron Schleif, Richard "'artie, "William Sandberg,
James Illaus, 74alter Markling. Absent: None. Also in attendance:
Bill Elliott, engineer; Dick Brooks and ?"'alt Mack, maintenance;
and, Phil Chenoweth, 7hlers -?,:Assoc.
Meeting called to order by Ron Schleif, MaTror.
Discussion brought un that village harking lot should be seal coated.
Voted that weather too unsettled now. Rrooks directed to fill and
seal cracks now and nrenare for coating in spring.
Councilman Sandber:� reTistered nrntest that meeting* called for Oct.
2 was an illegal meeting because of lack of written notice. Yeeting
not recorded as a valid meeting.
Councilman Sandberg registered protest teat meeting held October
5th was an illegal meeting as he did not receive his notice. Clerk
responded that notices were mailed to all councilmen in adequate
time. James Maus rolled and noted that all other councilmen had
received notice of meeting.
Gregg Smith, of Attorney firm Smith and Pringle, was present and
rendered the opinion that letters mailed are presumed received.
14'alter Mark"Ling made motion that council recognize October 5th
meeting as a legal meeting based on opinion rendered by Greg Smith,
Attorney. Seconded by Richard Martie. Voting in favor: I°lartie,
Markling, Y�aus, Schleif. Voting against notion:. Sandberg.
Sandberg made motion that notices of all special meetings be made by
reffistered mail. Councilmen not recuiring or desiring registered
mail should so indicate in writing to the clerk. Special meetings
designated at a regular meeting need not be noticed by registered
mail. Seconded by James TTaus. Carried. In favor: Sandberg, Schleif,
Maus, Martie, Markling.
Motion by James Maus to annrove building Hermit for ParaPe for Tom
Chock based on opinion of attorney that multiple garage could be
Placed on lot behind anartment rouse. T%`illiam_ Sandberg seconded.
Carried all in favor.

a7e be approved. Seconded b7r Richard Martie. Carried -- all in favor.

Clerk directed to supply record of improvements to assessor's
office.
Phil Chenoweth presented a recap of improvements and proposed
bonding level. Recommended that village qet a rating from Moody's
Investors at a cost of $600.00. 'Walter Markling made motion that
village apply for a rating from Moody's, James Maus seconded.
Carried -- all in favor.
Motion by Richard Martie to go ahead with storm sewer drainage ex-
tension as proposed for Locust and Broadway to Third to Walnut.
Seconded by Walter 1arkling. Carried. In favor: Maus, Markling,
11artie, Schleif. Against: Sandberg. Contract to be amended as
follows:

It is understood and agreed that the additional units of work
will be on the same unit nri ce basis as the aforesaid orieinal con..
tract and that the adAitional work will not exceed 25% of the original
contract. It is further agreed that we will. increase our bond, now
on file with the village clerk, to cover the additional work.

for November 9th at 8:00 P.M. for sale of $135,000Water Revenue Bonds
and $110,000 General Obligation Bonds. Seconded b,,.r Richard; Martie.
Carried. Voting in favor: Schleif, Maus, Martie, Markling. Sandberg
voted against because of inclusion of $12,400.00 provision for funds
for storm sewer extensions.
Bill Elliott advised that water service along Front Street had to be
extended one block as inadequate service had been provided for proper
tie in of new lines.
Set up special budget meeting for October 21st at 7:30 P.M.
Motion by o1alter Markling, seconded bsr R. Martie to void October 2nd
meeting. Carried.
Motion by 'Walter Markling to anprove minutes of September 28j and October
5 as mailed. James Maus seconded motion. Carried. In favor: Maus,
Markling, Martie, Schleif. Sandberg voted nay to approve minutes of
October 5th meeting.
James Maus made motion to anprove payment of bills as presented. Walter
/,1arkling seconded motion. Carried -- all in favor. Liquor Fund $54,319.61; Administrative - $4,181.81; Police - $781 �1,6; Park - $89.44;
Water - $883.34; Fire - $523.54; Sewer - $2,998.21; Street - $2,839.85;
Service - $25025.04.
William Sandberg made motion to adjourn, seconded by James Maus. So
ordered, at 11:30 P,M.
