TO PARK COMMISSION MEMBERS:
You received an agenda in the mail indicating that the Parks Commission meeting is scheduled for
August 21, 2003, The fourth Thursday of the mont would be August 28", Unfortunately, when
the Parks Commission switched their meeting to the r. urth Thursday, I forgot to make that change for
the month of August. Attached is a revised agenda w th the correct date.

On the East Bridge Park item, Adam Hawkinson stated that he needed a decision by August 25",
Unless you Want to meet on the 21st and make a decision at that time, you may want to leave Adam a
message indicating your decision and make the formal ecision at the August 28th meeting.

Chair Nolan called the meeting to order at 4:30 p.m. and declared a quorum present.

Adam Hawkinson had a correction to Item #7 of the minutes relating to the construction of the
berm. The statement should have read tha the debris from the berm was on the pathway and in the
neighhor's baek yard as well as on the stre t.

Glen Posusta - Berm on Park Pro cr
Parks Commission Minutes - 7/24/03
Glen Posusta was present regarding the erm he had constructed on park property and other
related issucs. He stated that since the s'te is under construction it looks bad but thc site will look
better oncc the construction is completed Glen Posusta talkcd to Deb Colefield 1I-om Xcel Energy
regarding the berm being in the easement area. Xcel Energy indicated they didn't have a problem
with the location of the berm. The overh ad lines, however are GRE's and he has talked to
Michelle Lumley from their ollice regard ng the berm. Glen Posusta stated he is under the northerly
string of the overhead wires. Tfthe berm s allowed by the Parks Commission it should be
contingent upon GRE/UP A approval.
Glen Posusta brought up mowing of the p rk area ffild presented pictures of the area in its unmowed
state. He stated that similar areas along C unty Road 117 and School Boulevard are Inowed and
his berm is not any steeper than those are, s. He challenged the statement about liability concerns
as he didn't feel the liability would be any greater here than at any other park location. Glen
Posusta presented pictures of the berm sta ing that the berm was meant to be a little further to the
north and if need be he would relocate it tl ere. He questioned the validity of the concerns raised by
the Parks Commission. He felt the bigges issue would be the location of his driveway. The
ordinance requires it to be 3' hom the property line. Glen Posusta proposed that if the Parks
Commission would allow the berm to rem in, he would seed or sod the berm and would move his
driveway to the north side of the power po e thus reducing the hazard. Glen Posusta questioned
whether the bike path was in the proper 10 'ation and pointed out safety concerns with how the bike
traffic enters onto the street. He offered to pay for the relocation of the bi ke path. If he relocates
his driveway to the north of the power pole he would like to erect some type of berm to protect his
driveway from runoff Jlow. Public Works Director, John S;mola had a drawing of the Posusta
property that showed the driveway 25' 1I-on the property line. Mr. Posusta stated that the
driveway location shown on the drawing w s placed there by the surveyor. He ended up changing
the driveway location in order to preserve s me trees. John Simola stated that he was disappointed
that Mr. Posuta built the berm prior to the Parks Commission having an opportunity to consider it
and that he continucd to work on it even th ugh the Parks Commission did not approve it.
Glen Posusta stated that he is considering pl-ntings of some sort for the berm to make the area Inore
attractive to people using the pathway. This would eliminate the need to mow and creatc a nice
visual attraction. John Simola stated that _lacing the perm on park property was like a taking of
the property. Thcre was discussion on the 1 cation and width of the berm with Glen Posusta stating
that at its highest point thc berm would be 7' There was discussion whether the berm would divert
runoff flows or conccntratc the now to the b I'm causing the berm to washout. In addition, the area
around the bcrm should have silt fencing. J hn Sinlola stated there is nothing that allows Mr.
Posusta to do plantings or anything elsc on pirk land. Glen Posusta questioned the cfTectivencss of
silt fencing. John Simola stated the silt fencing is required by ordinance and should be placed around
any area that is disturbed. The silt fencing is to remain in place until vegctation is established.

Parks Commission Minutes ~ 7/24/03
Fran Fair statcd the question was why the b I'm was placed on park property in thc first place. She
felt it was too late to comc before the Parks COlllmission now. Glen Posusta stated he purchased
the lot before the pathway was in and he w': s not aware that the City owned Outlot A. Adam
Hawkinson asked ifhe knew where his pro erty line was located and why Mr. Posusta thought it
would be okay to build something on pro pc ty that was not his own. The Parks Department has
required other property owners to remove fI nces, structures and plantings from park land. Adam
Hawkinson felt that since the Parks does no allow those encroachments they should not allow the
berm to encroach on park property. He al 0 pointed out that the power company indicated they
did have restrictions on what could be place in the casement area. Larry Nolan stated the minutes
did not reflect the concern of the Parks Con mission about setting a precedent by allowing this berm
to remain.
Glen Posuta stated the biggest concern was he location of his driveway and related safety issues.
He reiterated his proposal to relocate his dri eway if the berm could remain. John Simola asked if
the Building Department had approved a pi, n showing the driveway in its present location. The
drawing that John Simola obtained from the Building Department did not show the driveway where
it is presently situated. Nancy McCaffrey a 'ked if the berm couldn't bc built on his property. Fran
Fair expressed her concern about the preced nt set by allowing this. Hen Hitter concurred and
raised the issue of future maintenance of the area if there are new property owners. Mr. Posusta
indicated that there is no maintenance done lOW. Adam Hawkinson responded that the ordinance
requires maintenance when it is within 100' l' an occupied structure. Chair Nolan asked if anyone
wanted to change the motion m.ade at the las Parks Commission meeting to have the herm
removed. The Parks Commission did not ish to change the motion directing that the berm be
removed.
10.
Youth Football.
Adam Hawkinson reported that they met wit Gene Emanuel and Mr. Emanuel was told that youth
football would not have the use of the Xeel f e1ds. Gene Emanuel indicated that youth fCJotbal1
needed five fields. Adam Ilawkinson came lp with alternative fields but was then told by Mr.
Emanuel that these were not suitable. Adam Hawkinson and John Simola will work with Mr.
Emanuel on a proposal to have 1 game on ea h of the three fields on Tuesday and Thursday j()r this
year. The possible acquisition of the site cur ently occupied by Our Back Yard could make
available some land for use as fields. John S'mola will talk to Duane Gates about the fields at
Pinewood and the condition they are in as M . Emanuel stated those fields are in poor shape. John
Simola indicated that youth football would n t play when the fields are wet. John Simola noted with
the watering ordinance in effect it does not mike for easy scheduling to get the watering done and
the gamcs in. The Parks Commission was aL 0 inf(xmed that Mark Banyai may be forming a fall
softballlcague which would impact the youth football play. Fran Fair suggested some concession to
the youth football this year but to get the issu s resolved for next season. Staff expressed some
frustration in working with youth football. T lere was some discussion of "sweat equity" or fees
heing charged for use of the fields hy the yout j()otball.

The specifications for the East Bridge (E.B.) steps are on the first page. A map
of the steps for location purposes is the s cond page. This page also shows the
platfonns that are 5'x8' in dimension so t ey see where to place the pads. This area
is an approximation but shows we want t e future terraces as equally spaced as
possible. The expense of the handrail is n t figured in to the price. Parks
Department would purchase and install t rail. Most of the cost would be internal
labor. The estimates for a concrete path om the steps to Hwy 25 should be
included. Those numbers will be added t the infonnation packet while I am on
vacation.
Please note that the cost of the steps, b tween $11,000 and $16,000, is more than
that of paving both East and West Bridge athways. The pathways are bid as a 10ft
wide pathway. The paving of each path w uld start at the bridge and go in opposite
directions. East Bridge path would end in the parking lot, as shown on the terrace
drawing provided. West Bridge (W.B.) p th would end at the Front 81. pathway as
a connection of that path.
The excavation ofE. B. would be done by the Parks Department and any walls
needed constructed by them as well. The all material would cost approximately
$1200 to $1500 for a retaining wall on the down hill side and up near the oak tree
would cost approximately $700 to $800 in materials. The total cost of both B.B. and
W.B. pathways and retaining walls would e about $10,000 to $ 11,000 in
materials.
In either instance, there will be trees an shrubs that will need to be moved.
There will also be a cost associated with st p removal. An estimate of$300 to $500
for the dumping of the old timbers. We ha e boulders to build the terrace retaining
walls.
Hope these numbers and notes help wit a decision so we can move on this
project. Time is running out and the $25,0.0 may not be carried over to next year
with the budget restraints we are currently xperiencing. Please have a decision for
me when I get back on the 25th of August.

RE: RESURFACE ASPHALT BASED BASKETBALL COURT
Dear Adam,
We hereby submit the following specifications to install a California Products Corporation
Plexipave@ (fortified), acrylic color coating system to one (1) asphalt based basketball court.
QUALITY CONTROL:
The owner should designate one representative to oversee the project. This person will be
responsible to conduct the following checks through out the job.
A. Pre-Installation walk through. All aspects of the job will be discussed at this time. Any
questions will be answered by the lead technician.
B. Confinn that correct amount of product has been received on site. This will ensure that
the specifications will be met.
C. After installation, a walk through will be conducted. A sign off sheet will be completed .
and signed. The signature indicates that the installation meets all specifications and the
complete satisfaction of the owner.
1. PRE.RENOV ATION PROCEDURES --TO BE DONE BY OWNERS:
A. The courts must be cleared of all objects.
COLOR COATING PROCEDURES:
2. POWER CLEANING
A. Blow off all dirt and debris that exists on the surface, using high pressure forced air.
3. CRACK SEALING
A. Clean out existing cracks.
B. Pre-sand the cracks with silica sand where needed.
C. Fill all cracks with a 100% acrylic crack sealant.
D. Apply acrylic patch binder over the large thermo cracks.
NOTE: All cracks will be filled with silica sand. The silica sand will fall into the small cracks and
fill in all voids and act as a caulking backer. Cracks are not guaranteed to not reappear.

A. The low areas will be primed with an rytic patch binder patching primer.
B. Apply an acrylic patch binder mix to al areas needed.
C. All patch ~ will be sanded as need prior to color coating.

is no guarantee expressed or implied that all low 18 can be totally eliminated

A-I Track and Tennis a division 0 Sports Surfaces, Inc. warrants its
labor and materials for a period 0 two (2) years from the date of
completion of work on any track 0 tennis court All work performed
by A-I Track and Tennis is w against peeling, chipping and
flaking under nonnal use. A-I fur er warrants that any paint applied
during the striping or resurfacing 0 any track or tennis court will not
flake or peel for a period of two ears from the date application is
completed.
Customer acknowledges that it is a are that A-I Track and Tennis is
not responsible for defects, cracks, tches or Wleven surfaces in the
substrate which is being resurface by A-I Track and Tennis. A-I
Track and Tennis does not warrant.that existing cracks or patches in
existing substrate surfaces will not open or continue to increase in
size. A-I Track and Tennis shall not warrant nor be in anyway
responsible for peeling of paint or amage to any surface caused by
fmIme of customer to keep the free of debris, vegetation or
dirt and shall further not be res nsible for damage to painted
surfaces or any other actions by the customer. A-I Track &
Tennis also does not warrant se ation of the coatings from the
concrete base where the base lacks vapor barrier. Lack of a vapor
barrier can cause moisture to be tained under the coating, which
will eventually result in lack of adh ion to the surface.
In the event of any claims arisi under this Warranty, damages
incUlTed by the customer shall limited to such repaiIs to be
performed by A-I Track and Tenni as are necessary to remedy any
defects. A-I Track and Tennis h by agrees to perform any such
repairs (weather permitting) prom tIy, after written notification of
such claim from customer. A-I Tea k and Tennis shall not be liable
for any breach of any express or implied warranty except where
expressly prohibited by applicable 1 w.

Hunter's Crossing Park

As you know, the Parks Commission requested a 5 acre park at the SW corner of the portion of the development that is
adjacent to 85th.. Unfortunately, it was very difficult to see that the original home on the site would be smack dab in the
middle of the park if it was located a requested. The questi n is, what would be the second choice with regards to park
location... to the east which places it closer to Fallon Avenu and thus closer to Klein Farms park... or more internal to the
development ... I think the better choice is to put the park in the middle of the development and require that the park be
bounded on at least two sides by a public street Could you look at the site and let me know what you think ... also--
perhaps one of you should call Larry Nolan to see what he t inks.
Any feedback you can provide ASAP would be greatly appr ciated as the developer would like to make adjustments to the
plan by Wed August 20 so staff can review it at the site revi w meeting at 1 :00

The city is continuing to work with ^ VR Ready llix in an effort to relocate the company to the
Our Back Yard Site. It has not been determined I' zoning approvals \vill be granted so execution
of the purchase agreement remains in doubt. Th City has until 9/15 to make a (kcision or pay an
additional $100,000 to have the purchase agreem 'nt extended. The ('ity may \\:ish to purclwse
the site regardkss in the event the relocation con -cpt docs not proceed for the purpose of
acquiring the land l(lr park purposes. In the inter 111 stall is looking at a number of otl1cr nearby
sites for cost cOl11parisions (Dawn Report).. In th ' next lCw weeks stall would like t(l meet \\ith
other property O\vners in to determine if better 0 tions exist. Perhaps there is a site that has good
access, flat and less expensive per acre.
IllInter's Crossing
With regards to the Bison Development -- It is 111' understanding that the Parks Commission
wantl'd at least 5 acres for a ncighhorhood park \ ith the balance of the park dedication coming to
the city in the form of cash. This cash would the 1 contributed to thL' fund used to purchasc future
balllields. The location identified at the last mec ing is circled on the attachl'd map. This loc<ltion
\\as selected due to distance from Pioneer Park a ld due to the street exposure on X51". This
location could still work hut the shape of the par \vould he alleCll'd by a pre-cxisting hOllle.
^nother location that could be considered would he on the north east side of the property
adjacent to the po\\'(:rline corridor. This \vould r quire purchase of the Klein property and brings
the park closer to Pioneer Park. Thank you 1()I' r viewing the situation and considcration of
providing a recolllmcndation to the developer an I Planning Commission.

ballfields/park with the following results:

mlllld be interested in selling but would prefer to sel the entire 79 acrcs. I Ie also noted that his
mother. who is 79. currcntly has a life estate in the ploperty so if the City was lonking to den:lop the
land immediately, the life estate would need to be cOlsidered.

(25 acres). lhe land is vacant and flat. lie has o\\'led the land ror 7 years and at one til11e had

currcnt plans to dcvclop the land. I Ie would consid'r selling the property.
Cullins, Thomas _ 76:\-295-5() 17. Owns parcel 19.02 on the attached map (40 acres). lie indicated
an interest in selling the 40 acre parcel and added he owned some additional acreage in the area that
the City might want to look at.

the attached map. Overall he owns approximately 4)0 acres in the area. I Ie would like to sell his
