Motion to accept Lions splash pad partnership for Pioneer Park. Mike Benedetto and Wes Olson from the Monticello Lions presented the splash park plan and partnership program to the Commission. This is a unique opportunity with the Lions approaching the City to partner for a splash pad at Pioneer Park. Lions have been working Page 1 of 4 PARKS & RECREATION COMMISSION MINUTES I SEPT 28, 2017 with Aquatix and have received a proposal for the splash pad and want to move forward with a splash pad at Pioneer Park. Benedetto shared a draft rendering of the proposed plan just to give a concept of what it could look like and explained that the Monticello Lions are asking the Parks & Recreation Commission to make a decision on the location and secondly, to make a recommendation to enter into a partnership program for this project. The total commitment from the Lions would be $150,000 towards the project in three equal installments of $50,000. The total project cost is estimated at the high end at $300,000. The splash pad would function as a recirculation system which is the most environmentally friendly by recirculating the water. There will be a maintenance expense with the project, and the staff will have to become certified pool operators to check the water two times daily. Other issues discussed included parking. Tom Pawelk said in addition to the existing parking lot there is on -street grass parking along Fallon Avenue but there definitely would need to be additional parking added. Pawelk said there is a possibility for expansion to the parking lot to the south. BRIAN STOLL MOVED TO RECOMMEND PIONEER PARK AS THE LOCATION FOR A FUTURE SPLASH PAD. MOTION SECONDED BY KAREN VETSCH. MOTION CARRIED UNANIMOUSLY, 4-0. NANCY MCCAFFREY MOVED TO RECOMMEND ENTERING INTO A PARTERSHIP WITH THE MONTICELLO LIONS TO DEVELOP A SPLASH PAD AT PIONEER PARK IN 2018, WITH A FUNDING COMMITMENT OVER A THREE-YEAR PERIOD FROM THE MONTICELLO LIONS. MOTION SECONDED BY BRIAN STOLL. MOTION CARRIED UNANIMOUSLY, 4-0. 6. Motion to approve Featherstone Park improvement for 2018. Tom Pawelk presented the plan for developing the Featherstone Park. The park (in planning) was previously graded and seeded in native grass. Pawelk noted that this is the final neighborhood park in the Parks & Pathway Plan to be developed. The proposed park development includes a new playground, open air shelter and pathway to the road. The equipment is on sale in 2017, so the city can save nearly $40,000 if purchased now and it will be billed in 2018, which includes $80,000 in the budget for park development. The low quote based upon state contract pricing is from Miracle Recreation for $61,000 plus the addition of wood chip mulch for $2,500. Pawelk said the goal is to provide minimum play for 20 years and for ages 2 to 12. The city has been using Miracle Recreation for the current play structures and staff has been very happy with the quality of the play structures. Sunset Ponds: The grading is done for the basketball court and Parks is waiting for the Street Department to run the paver for the asphalt later this fall. b. Rolling Woods Park: All of the new equipment is in and the chips are being installed in the play area. Next summer staff will build the shelter and add the trail. c. Budget: There are three capital improvement items in the 2018 Budget, including developing Featherstone Park, a new replacement tractor, and equipment at Bertram. 12. Discussion of added items. A. Replat/Preliminary Plat, Carlisle Village 4th: The Commission is asked to acknowledge that the developer is providing a new preliminary plat for Carlisle Village 4th. In this case for the park dedication, the developer has already pre -paid all of their fees as cash in lieu of park dedication. b. Dol? Park Update: The third year of the Wag & Walk Festival went well. It was a nice day and the participants had fun. The committee did not ask for any funding this year as the event was promoted as a "Thank You" to the community and for everyone's help in getting the dog park initiated. McCaffrey noted that there is a lack of interest amongst some Paws for Parks Committee members to volunteer as many feel the mission has been accomplished with fundraising to get the park installed. With that being said, the original Facebook fundraising page for Paws for Parks is still up and there have been some issues with whether or not they are the voice to "police the park" with various issues at the park. The general consensus of the Commission is to keep the subcommittee in place for future fundraising needs or attendance at events to hand out educational materials, etc. However, the Facebook page should be transferred over to City staff for administering as the official park page. (AS) REFERENCE AND BACKGROUND The Parks Commission is asked to consider a formal recommendation related to park dedication requirements for a proposed nine -unit residential plat, Erickell Townhomes. Scott Builders, Inc, on behalf of the property owners, is seeking approval of a preliminary and final plat for development and planned unit development of a vacant property located on the south side of Hart Boulevard, located just north of Hawk's Bar & Grill and east of Kwik Trip. At present, the property is two parcels, zoned B-2 and B-3. The project requires a Comprehensive Plan amendment and rezoning to change the parcel from commercial to residential land use and zoning. Scott Development proposes to develop three 3 -unit buildings in a townhome style development, utilizing a private street to access the units. The parcel being platted is approximately 1.0 acres. The site is currently undeveloped and is adjacent to existing duplex residential homes to the north, restaurant/bar to the south and a commercial office/retail use to the east. The developer is seeking to re -guide the site's Comprehensive Plan use to "Places to Live" and rezone the site to R-3. The R-3 Medium Density Residence District is intended to provide for medium density housing in multiple -family structures such as that proposed. Under State Statute 462,358, with every new development, such as this plat, the City has the option of either requiring a land dedication for park, or the City can collect park dedication fees for purchase of park land at another location — referred to as "cash in lieu". The Parks Commission's consideration is related to a recommendation for this allocation. In 2009, the City completed an analysis of existing and needed parkland in relationship to dedication requirements. This analysis indicated that the City's park requirement to serve the existing city and its growth area (Monticello Orderly Annexation Area) would result in an 11 % park land dedication. Therefore, if a developer is proposing a subdivision, the City can require a dedication of 11 % of the land as the proportionate requirement for the development. In some cases, development will not occur in a location which meets the City's park plans and objectives. As such, the statute allows the City to require a cash fee in lieu of land dedication to use for purchase of land that is located according to the City's plan, such as Bertram Chain of Lakes. Under Minnesota statutes, the City may set this fee to be equal to the value of raw land no later than at the time of final plat — this is the value of raw land that is immediately developable, but is not yet actually developed. The Parks & Recreation Commission is asked to consider a recommendation on whether to require a land dedication or cash -lieu of land based on the above for the proposed project. In this case, the Erickell Townhomes parkland dedication would require approximately 4,790 square feet of dedication on the plat. This small amount of land, and the inability to combine this land with any surrounding property for park purposes, would point toward a cash in lieu scenario as a more realistic park planning option for the Commission. The cash in lieu required for this parcel would total $9,130, based on 2015 Wright County Market Value. The fee calculation is based on 11% of the value of the land ($83,000) at the time of final plat. In addition, the project is currently served by an existing neighborhood park within'/2 mile, River Mill Park at approximately 1600 feet. The site has direct access by sidewalk and pathway to River Mill Park. ALTERNATIVE ACTIONS 1. Motion to recommend park dedication equal to 11% of the value of raw land at the time of final plat as cash in lieu of land dedication for the proposed Erickell Townhomes. 2. Motion of other. STAFF RECOMMENDATION Staff recommends alternative 1 above. Staff's recommendation is based on the proximity of other neighborhood parks to the plat, as well as existing trail and sidewalk connections. Further supporting the recommendation is the limited amount of land dedication which would result on the plat and the inability to combine the possible dedication with other land for park or pathway purposes. The location of said land shall be at the discretion of the City Council. The amount of said land shall be reasonably commensurate with demand that the platting or replatting places on the City park system, as described in the Comprehensive Plan. For purposes of this section, an amount of land equal to eleven percent (11%) of the total gross land area of the plat shall be presumptively defined as "reasonably commensurate." In the event that the subdivider objects to the eleven percent (11%) standard, the City shall, at the developer's request and expense, conduct a specific dedication study of the park system and the demand placed on the system by the proposed plat. Prior to conducting the study, the City shall obtain a waiver of statutory time lines for plat approval during the conduct of the study. No approval of final plats, nor construction of any improvements, shall occur until the park dedication study is completed. In lieu of land dedication, the City Council may require a cash contribution in accordance with Minnesota Statutes, or a combination of both. The City Council's decision on land and/or cash shall be made following recommendations from the City's Park Commission and staff, in accordance with the Comprehensive Plan. (#412 8/23/04; #5016/22/09) (B) In accordance with Minnesota Statutes, where the City Council determines that the park dedication requirements shall be paid in a cash contribution, the amount of said contribution shall be based on the market value of the raw land not later than at the time of final plat. The City may require that the subdivider provide an appraisal to determine the market value. In the alternative, the city may, by Ordinance, establish a fee per residential unit that will meet the cash dedication requirement. The determination of the appropriate fee calculation shall be made by the City Council. (#412 8/23/04; #5016/22/09) MONTICELLO SUBDIVISION ORDINANCE Title XI/Chapter 6/Page I (C) The City Council shall not accept for credit against a subdivider's park dedication requirement any of the following: 1. Delineated wetlands. 2. Land within a designated flood plain. 3. Land encumbered by a utility easement such as a petroleum or electric power transmission line (except where such easement is a standard platting requirement of the City of Monticello pursuant to Section 11-5-4 of this Chapter, and where the City determines that the land within the easement will be usable for park, trail or open space purposes). 4. Land within a drainage easement or other land required for stormwater treatment. The City may, at its discretion, accept lands in the above categories for park dedication purposes if it deems the dedication to be of public benefit. No credit shall be given against the subdivider's park dedication requirement, however, unless the City determines that the land will be used for a specific public park, trail or open space purpose. (#412, 8/23/04) (D) Land dedicated for park purposes shall be transferred to the City of Monticello by warranty deed. The transfer of said land shall occur at the time of recording of the final plat. For multiple -phased developments, all of the park dedication land shown on the approved Preliminary Plat shall be transferred to the City upon recording of the first final plat, in the form of Outlot(s) and shall not be shown as "Park" on the plat. The Development Agreement may permit the phasing of said land transfer. In addition, the Development Agreement shall grant the subdivider a license to enter the park dedication land for the purposes of required grading, seeding or other work approved by the City Council. (#412, 8/23/04) (E) In addition to the park dedication requirements listed above, each newly subdivided lot shall pay a surcharge for park and trail development purposes. The surcharge will be at a prevailing rate as determined by the City Council. (#412, 8/23/04) 11-6-2: CASH CONTRIBUTION: All monies collected from cash contributions shall be placed in a special fund from which only those public uses as listed in (1) above may be constructed or improved or land for those same uses may be acquired. 11-6-3: DELAYED DEDICATION PAYMENT: Upon petition by the developer, the Council may approve a delay in the actual dedication of the cash required in lieu MONTICELLO SUBDIVISION ORDINANCE Title XI/Chapter 6/Page 2 of land until such time as development occurs on the property being platted provided that a proper legal agreement is executed guaranteeing such dedication. Delayed dedication payment shall include eight percent (8%) interest per year. 11-6-4: PURCHASE OR CONDEMNATION OF LANDS: Where a proposed park, playground or other recreational area, proposed school site, or other public ground that has been indicated in the official map and/or master plan is located in whole or in part within a proposed subdivision, such proposed public site shall be designated as such and should be dedicated to the City, School District, or other proper governmental unit. If the subdivider chooses not to dedicate an area in excess of the land required under this section hereof for such proposed public site, the Council shall be required to act to approve or disapprove the plat of the subdivision for a period of ninety (90) days after the subdivider meets all the provisions of the subdivision title in order to permit the Council, School Board, or other appropriate governmental unit to consider the proposed plat and to take the necessary steps to acquire, through purchase or condemnation, all or part of the public site proposed under the official map or master plan. 11-6-5: LOCATION AND CONFIGURATION OF DEDICATION: In such cases where the developer is required to dedicate land area, the City Council of the City of Monticello shall have the right to determine the geographic location and configuration of said dedication.
