MINUTES MONTICELLO POLICE ADVISORY COMMISSION Wednesday, January 21, 2009 - 7 p.m. Members Present: Brad Fyle, Jim Roberts, Dick Slais and Tom Perrault Members Absent: Dave Gerads, Glen Posusta Ex -Officio Representatives: Lt. Dan Anselment and Sgt. Dave Anderson - Wright County Sheriff's Others Present: 1. Call to Order 2. 3. Department Bruce Westby - City Engineer Tom Moores — Street Superintendent Commissioner Fyle called the meeting to order at 7:02 p.m. It was noted that a quorum was present. Commissioner Roberts arrived at 7:05 pm (following approval of minutes). Approval of minutes of October 21. 2008 Police Advisory Commission meeting., COMMISSIONER SLAIS MOTIONED TO APPROVE THE MINUTES OF THE OCTOBER 21, 2008 POLICE ADVISORY COMMISSION MEETING AS WRITTEN. COMMISSIONER FYLE SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY (3-0). Consideration of adding items to the agenda. Commissioner Perrault requested information on typical response times for local calls. 4. Wright County Sheriffs Department updates / O&A session. Lieutenant Anselment updated the Commission on several items including: • Wright County's 2008 year-end crime statistics are not yet available. Completion of the 2008 statistics is being slowed by the use of new software, as well as due to the on-going relocation to the new Wright County jail/law enforcement center on Braddock Avenue NE. • In general, crime was down county -wide in 2008 from 2007. • Financial related thefts are on the rise, likely due to the economy. Such thefts include theft from parked vehicles and armed robbery. GPS units are a highly targeted item. • Late night traffic volumes are down. Volumes are similar to mid -1990's volumes. • Traffic violations have been minimal recently. • Thefts, assaults, and criminal damage to property are on the rise in our schools, despite the presence of school resource officers. The Wright County Sheriff s Office strives for continuity with resource officers so kids get to know them so they are more approachable. • Officers bid for their shifts every year and most deputies request to work in Monticello due to the busy and challenging work environment here. Police Advisory Commission Meeting Minutes January 21, 2009 Page 2 • The Wright County Sheriff's Office serves 13 communities throughout the County and they try to fit into each community as best they can. They typically access and review ordinances for each community they work in over the internet. • Wa1Mart accounts for a lot of their time due to an aggressive Loss Prevention program. • Overall, things have been relatively quiet lately. • Mr. Moores asked for additional enforcement in regards to trailers being unhooked and left in the commuter parking lot south of School Boulevard. Lieutenant Anselment said he would assign extra patrols to this lot. • Mr. Moores noted that traffic enforcement calls are often taken by Public Works staff. Lieutenant Anselment said all traffic enforcement calls should be routed to the Sheriff's Office. • Mr. Moores asked if the Sheriff's Office has noticed any issues with visibility or operations since being relocated from City Hall to the Fire Department. Sergeant Anderson noted that they appreciate the support they've received from Fire Department staff while housing them temporarily, but that it would help to have two permanent offices in Monticello, especially for the purpose of having enough room to interrogate witnesses. Sergeant Anderson asked if it might help to add a note to City mailings about the office relocation. • Wright County will offer tours of the new Wright County jail/law enforcement center within the next month or so. • Commissioner Perrault asked if an Emergency Preparedness office will be located at the new jail. Lieutenant Anselment said their offices will remain at the courthouse in Buffalo for the time being. • Commissioner Fyle asked whether the Police Advisory Commission could hold their next meeting at the new jail and take a tour of it. Lieutenant Anselment said he would check but that it should be okay. NO FORMAL ACTION REQUIRED/TAKEN. 5. Consideration of approving revisions to Citv Ordinance 2-7. At the January 12, 2009 City Council meeting two Council members, Tom Perrault and Glen Posusta, were appointed to the Police Advisory Commission. Prior to this only one Council member was appointed to the Commission so Council directed staff to research what needed to be done to appoint a second Council member to the Commission. Staff determined that City Ordinance 2-7 would require revisions. In addition, it was noted this would result in the Commission having an equal number (6) of voting members so staff recommended that one of the Council members be an ex -officio (non-voting) member. Staff also recommended defining a set meeting schedule to avoid confusion with meeting dates, and to make it easier to schedule rooms for the meetings. The meeting dates being recommended were the second Wednesday of the months of January, April, July and October. Commissioner Roberts stated that his only concern with appointing a second City Council member to the Commission is if both are voting members this might result in motions being made favoring budget reductions over safety improvements. This is because Council members Police Advisory Commission Meeting Minutes January 21, 2009 Page 3 tend to focus on budget impacts and may therefore vote against something that would improve safety simply because of the costs associated with it. Commissioner Fyle noted that he feels the Commission functions well with five voting members and he reminded everyone that their meetings are open to the public so any Council member can attend their meetings if they want to without being appointed to the Commission. Commissioner Fyle then stated he would be open to allowing one vote for any Council member in attendance, provided that the appointed member is not in attendance. Commissioner Perrault noted that he can't meet the second Wednesday of the month since he is appointed to the EDA and they currently meet on those dates. Mr. Westby will research potential alternate dates for regular meetings and present his findings at the next meeting. NO FORMAL MOTION WAS MADE BUT COMMISSIONER FYLE DIRECTED MR. WESTBY TO SUMMARIZE THE COMMISSIONS DISCUSSION TO THE CITY COUNCIL SO THEY UNDERSTAND THE COMMISSIONS CONCERNS WITH TWO COUNCIL MEMBERS HAVING VOTING PRIVILEGES. 6. Consideration of electing Police Advisory Commission officers. City Ordinance 2-7 specifies that "The Commission shall elect from among its members a chairman, vice chairman, and a secretary, however to date this had not been done. The Commission determined that Commissioner Fyle had been acting in the capacity of Chairman so he was nominated unanimously to fill this position. The Commission then determined that a vice chairman was not needed so nobody was elected to this position. The Commission then unanimously elected Mr. Westby to fill the position of secretary. COMMISSIONER FYLE MOTIONED TO APPROVE THE ELECTIONS AS NOTED. COMMISSIONER ROBERTS SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY (4-0). 7. Update on adoption of Outstanding Citizen Recognition Award. The Commission reviewed the proposed award certificate and directed Mr. Westby to revise the award certificate as follows: • Replace the award medallion in the upper left-hand corner with the Wright County Sheriff's Office logo (Sergeant Anderson will provide via e-mail). • Add a signature line for the Police Advisory Commission chairman. This will be in addition to the signature lines for the Mayor and the Wright County Sheriff. The Commission authorized the use of an on-line nomination form similar to the one presented to them at the meeting so Mr. Westby will complete and format the form and post it on-line following City Council approval of the award. Mr. Westby will contact all the Commission members after the award certificate and on-line nomination forms are revised to determine who is available to present the award to the Council for approval at an upcoming Council meeting. Police Advisory Commission Meeting Minutes January 21, 2009 Page 4 NO FORMAL MOTION WAS MADE. 8. Update on relocation of Sheriffs Office from City Hall to Fire Station. Lieutenant Anselment and Sergeant Anderson said the Wright County Sheriff's Office considers this to be a short-term solution at best. They said the space they are working out of is quite cramped, but they have been pleased with the reception they received from everyone at the Fire Station. However, one of their main concerns is that they are not sure they are compliant with the Data Privacy Act. This is because the area they are working out of is not secure, and while they are doing their best to make sure private data is not left laying around for others to see they can't be sure this is the case all of the time. The Commission discussed some of the other locations currently being considered by staff and the City Council. Of the locations discussed, Sergeant Anderson noted that they would not want to be located in the DMV building. This is because there is a large public presence and the public tends to stop Sheriff's Deputies to ask them questions related to licensing, which would only tend to slow them down. NO FORMAL ACTION REQUIRED/TAKEN. 9. Update on River Street access closures to TH 25. Mr. Westby updated the Commission on the status of the River Street closure pilot project. He noted that staff is gathering field data including current traffic volumes and speeds since the latest access modifications were made, and that this information would then be presented to the City Council on February 9ffi for their review and consideration before directing further short- term access modifications or making the current configuration permanent. NO FORMAL ACTION REQUIRED/TAKEN. 10. Review of draft Transportation Plan. Commission members were provided with a copy of the draft Transportation Plan with their agenda packets. Mr. Westby briefly updated the Commission on the purpose of the Plan. He then briefly reviewed the major elements of the Plan and its potential regional impacts. The Commission was then updated on who the various reviewing bodies are and what the approval process consists of. Mr. Westby finished his introduction by informing the Commission that they are being asked to provide input on the plan since their charge is advising the City Council on police and public safety matters. Commissioner Fyle began the discussion by noting the high crash rate at the intersection of TH 25 and 7t' Street. He feels this intersection should be one of the first areas where improvements are made. The other Commissioners agreed with Commissioner Fyle's recommendation and unanimously agreed that the entire TH 25 corridor through the City is the biggest safety concern and as such should be addressed prior to any other items in the Plan. Mr. Westby advised the Commission that their findings were consistent with all the other comments taken to date and that their comments would be passed along to the City Council. Local response times: Commissioner Perrault said that a resident near River Mill Park had contacted him recently to complain about police response times. The resident said they recently called the police to investigate a vehicle that drove into the park and that it took about 30 minutes for the police to respond. Sergeant Anderson said their average response time in Monticello is less than 5 minutes, but that it all depends on the nature of the call. He noted that calls related to non -emergency situations receive a lower priority and response times may be longer if there are higher priority (emergency) calls to respond to first. Commissioner Perrault said he would carry this message back to the resident who contacted him. A TV Licensing: Lieutenant Anselment noted that he was made aware recently that the City had issued a vehicle license for an ATV but that they then reversed their decision and pulled the license. He wanted to make the Commission aware that ATV's may be licensed for use on public streets so long as the driver either has a valid driver's license or has written permission from the City to operate the vehicle on City streets. Lieutenant Anselment noted that typically he would recommend that City's not license ATV's for use on public streets unless the operator has taken appropriate training classes and is able to operate the ATV in a safe, controlled manner. 12. REFERENCE AND BACKGROUND: Representatives from the Wright County Sheriff's Department will update the Police Advisory Commission on recent issues affecting the City of Monticello, and will respond to questions and concerns from Commission members and any citizens in attendance. B. SUPPORTING DATA: None. Police Advisory Commission Agenda: 4/15/09 5. Update on Council adoption of Outstanding Citizen Recognition Award. (BW) A. REFERENCE AND BACKGROUND: The Police Advisory Commission previously voted to recommend to the City Council that they adopt an Outstanding Citizen Recognition Award for the City of Monticello. This award will consist of a framed award certificate that will be signed by the Mayor, the Wright County Sheriff and the Police Advisory Commission chairman. The Outstanding Citizen Recognition Award will be funded with an annual budget of $300, which has already been approved by the City Council for 2009. Upon completing the preparation of the award following direction from the previous Police Advisory Commission, the award is now ready to be presented to the City Council for consideration of adoption (see attached). Mr. Westby is therefore requesting that several Commissioners volunteer to attend the next City Council meeting on April 27, 2009 to present the award to Council and recommend its adoption. B.
